DECISION: WRIT OF EXECUTION FROM BPI





Got permission from one of the defaulter na nagemail sa akin ng decided case ng BPI sa kanya, oh siya basahin niyo nalang lol. 


As we always said in this blog, SA COURT MAS LEGAL, FORMAL AND FAIR. Bakit ayaw ng mga CA doon? NOT ALL BANK FILED A CASE AND ITS THEIR END. Once my decision na ang court, hindi na sila pwede makipag negotiate sayo at kaw na magdidirect na sa bank makipagusap kung willing ka isettle or PAY WHEN ABLE. Kapag wala edi wala. 
Marami na po ang my decided case, nakulong ba? HINDI. Anyare? BACK READ KA.

Bakit may mga defaulter pa din takot pa din sa CA at sa demand letter? KASI THEY CANNOT ACCEPT THE FACT THAT THEY CAN NO LONGER TO PAY kahit alam nilang lubog na sila. AND hindi sila marunong magbackread lol.

    -Eastwest Bank- my friend paid her 200k default for just 5,000pesos after 5years of being default.

    KURIPOT magbigay ng AMNESTY
    -Metrobank at Security Bank

    Minsan ang pagdedemanda nila ay depende sa amount default kaya sinasabi namin dito na swertehan lang. May mga nabasa ako post dito since 2015.
    -May nademanda si BPI sa 50k default amount.
    -Hindi nagdemanda si CITI sa 250k default amount

    3. Hello po, defaulter po ako ni RCBC for five months po, and si BPI ganun din Kasi po I have four comorbidities kay napupunta sa gamot ko po ang pambayad ko Dapat sa cards. Ang tanong ko po, Ilang months po ba na defaulter Bago ka Ma file ng civil case po?

    1. I got the same notice 15 years ago kaya BPI na lang ang di ko nababayaran na utang ko.

      Ayoko tumawag sa BPI to make an arrangement kasi if di kami magkasundo, they already have a writ on their side.

      May nakakausap ako na walang expiry ang writ, while meron nagsasabi na amy expiry sya ng 10 years.

      Anyway, I would have probably avoided that if I answered the calls and discovered this group earlier.

    3. Rule 39 Section 6. Execution by motion or by independent action. — A final and executory judgment or order may be executed on motion within five (5) years from the date of its entry. After the lapse of such time, and before it is barred by the statute of limitations, a judgment may be enforced by action. The revived judgment may also be enforced by motion within five (5) years from the date of its entry and thereafter by action before it is barred by the statute of limitations. (6a)

      Yeah, I am awar of that. In my case, the writ was executed and I was garnished. That applies to writs that were never enforced. Since mine was enforced, it remains active.

      I changed my number when I defaulted, so di ako ma-contact over the phone.

      Nalaman ko na lang may civil case na ko. If I talked to BPI, I may hav avoided that.

    8. True. Rule 39, Section 14 of the Rules of Court provides:

      Sec. 14. Return of writ of execution. – The officer shall make a report to the court every (30) days on the proceedings taken thereon until the judgment is satisfied in full, or its effectivity expires.

      However, for practical and other known reasons, once served and reported with " No assets can be found" , the sheriff (and the bank) no longer follows it up monthly. (imagine even just 100,000 accounts for a sheriff to follow it up monthly from beginning to end would be too burdensome)

    12. @briansurewood, nakareceive ka po ba ng summons from court na may case kna from BPI? Diba they cannot file if not received by the defaulter? Or nag push through parin ang case kahit not received by you? I defaulted my BPI dn kc since 2015 almost 800k dn. I changed my number and returned back to province na. Apartment q na nka address before was at makati. Currently working but di Pa kaya magbayad talaga.

    1. Ang sabi, ipatupad Ang decision na mag bayad ng utang. Kung walang Pera o kayamanan, mag report si sheriff kada buwan Hanggang ma bayaran( kahit forever pa 😁

      meron na po ba kayo nakausap na naka experience na may nagpuntang Sheriff sa bahay po at nag check ng mga gamit po o nakipagusap sa sheriff para itanong kung ano makukuha? May ganun po ba?

Hello question lng po.. may civil case din po aq sa bpi since 2018 and now wala p nmn po q narereceive n ganyang letter.. except lang po sa isang CA.. now ang inaalala q po kc nag apply po aq work then natanggap kaso ang payroll po nila is bpi.. paano po kya un malalaman po ba ng company na papasukan q na may civil case aq sa bpi? d kaya po ireject nila q pag nalaman nila na may utang aq kay bpi or hindi aq mabigyan ng payroll account dahil a civil case q... sana po may mkasagot sa question q.. salamat po 😔😔

    1. Kung aalamin ng kumpanya malalaman nila. Pag nagka writ ka na garnished malamang sweldo mo pero Im not sure.

      May mga companies na hindi tumatanggap ng mga applicants na may utang. Usually, ang mga companies na ganyan may backrgound check. Posible di sila nagcheck.

      Now, kung malaman, wala naman effect yan palagay ko, unless you are working for a financial institution.

      Btw, withdraw your money and transfer it to a different bank under a different name. If BPI filed a case against you, makakakuha ka na din ng ganyan soon.

  8. @brianSureWood.. in your experience po, ilan beses po may nakuha sa bank account mo po, kelan po last na nakuhaan ka po? Kinontak ka po ba ng sheriff, pumunta po ba yun sheriff sa bahay ninyo po para mag check at kumuha ng gamit? Nakapag invest ka po ba under your name ng mga properties po? Pasensya na po madami tanong, sana po masagot. Salamat po.

      Ang ibig ko po sabihin eh yung mga writ na hindi nakahanap ng kukunin sa defaulter. Wala po nahanap so the writ was not enforced.

      Di po nila.pwede kunin yun dahil wala pa naman po yung titulo dahil hinuhulugan nyo pa yung bahay.

      And the bank can only take what you owe. If you owe 5p0k and your house worth 1.5 million, di naman nila.pwede kunin yan.

      How much po ba ang utang nyo? Wala pa naman po ako nababasa o naririnig na pati property nagarnish.

      Kung ang utang nyo po ay mas malaki sa amount, maari po siguro kunin KUNG makikita.

      Hindi po basta basta makikita yan kasi madami po defaulter.

      Hahanapin pa po ng Sheriff yan which could take time.

  13. @brian paano po kung lagyan ng writ of attachment sa registry of deeds yung real estate property and once paid atsaka nila ienforce yung writ of execution to take the property or sell it to get a portion of the amount to get the proceeds in the order of the court?

  16. I would like to point out a couple of things from my experience about the writ of execution and garnishment as I think some need to be discussed.

    I mean no disrespect to Mr.Kabado2 as we all want the same thing, and that is for the threats to defaulters to stop, but some of my statements will contradict some of the things he posted on this thread. Again, I mean no disrespect. This is another side I want to show.

    I've been here for more about 14 years alrrady, and I totally agree bringing it to court is the one of the best things to do, as it will be surely above board.

    However, a bank bringing it to court is also one of the worst things that can happen to you.

    I say it's one of the worst because once a writ of execution is handed down, that basically means the full force of the law is now with the bank.

    Contrary to what Mr.Kabado2 says, the bank and the collection agency has the upper hand in negotiating your case, as they have a court decision they can show you.

    And you still have to negotiate with the collections agency, especially if they were the ones the bank assigned to file the case against you. Yes, they either assign their internal collections or a 3rd party to file civil cases. Di ko na papangalanan yung law firm/collections agency that BPI assigned, but I definitely hate those guys.

    My case was handled by a 3rd Party Collections Agency, which BPI kept pointing me to when I was trying to negotiate with on how to settle the amount. And the collections agency refused the amounts I proposed. When they did agree, gusto nila one time payment.

    I have settled all my defaulted cards and loans, except BPI, because I do not know how to approach them to get amount I want to pay, or just walk away if we cannot make the deal.

    With my other cards that didn't file a case, it was easier. I can tell them I cannot afford that amount and they just say "Di ka naman pinipilit magbayad" because they know the time to file a case already lapsed. Becauee of that, I can negotiate an amount I want and can afford to pay.

    Excluding debts I settled from 2011-2014, I only paid around 160k of a debt over 1 million pesos from defaulted cards And loans last 2022. I was able to do that because the banks knew they can't do anything anymore.

    I think I can't do that with BPI. Or if I can, it won't be that easy.

    I am afraid that if we do not come to an agreement, they would order a search of my assets and properties.

    The good news is, the garnishment was a one-time thing, probably because sa dami ng nagdefault, a sheriff cannot keep on searching for your properties.

    That is it for now. I have a few more stories to post that might be of help.

      there are multiple, and at times differing "diskartes" in handling our unique situations. we have to make the call what we think is best given our circumstances. I am more of mix and match. 😊

      Here are my answers

      - It was not really a strategy since I have been meaning to payn since 2011. Ang una ko binayaran was my Citibank, then AIG (EastWest) a few months after.

      I had every intention to pay, the problem was I was afraid that by paying one bank, it might trigger some banks to locate me and call me again. Kahit nga yung Metrobank ko, binayaran ko lang sya when my office changed banks for payroll. That was the only time I contacted them.

      Nobody called me afer that because I think it had been too long and some banks cannot locate me anymore. I also moved in 2012 and lived on my own.

      I just wanted to settle because I knew it would be easier to get loans again. And kakabasa ko dito sa blog na 7 years or 10 years ang period to file cases, I knew I had the advantage since the bank cannot file cases anymore.

      - how many years would be required to arrive that point?
      - As far as I know it is just seven years and banks cannot file cases anymore.

      - is it the notorious SP Madrid that handles you BPI account?

      - I cannot reveal the name because they might be here and I am very superstitious that I am afraid to mention their name.

      SP Madrid is notorious for harrassing people, but those firms who file cases do not even get mentioned here in this group. I could be wrong but I have never seen the name of the firm who filed the case against me in this group.

      - were there other assets that were garnished?
      - Just my 35k. Wala na.

      - were you ever garnished (bank accounts)?
      - My BDO bank account was garnished. 35k. All the money I had that time.

      This is why I never change my SIM or mobile # kasi I have all the intention naman din to settle.
      Alam ko super naka anxiety at nakaka praning ang mga calls at na share ko an experience ko dito how at paano ako kinulit to the point na nag call talaga sa HR ( good thing marunong sumagot ang HR namin at barado agad collection agency wala pakels office namin sa personal matters). pero isip ko yun ang declared numbers ko so doon ako ma contact if and when may pa amnesty ang mga banks or kung ready na ako makipag negotiate.
      True enough mga beshy nun ready na ako to settle saktohan nag text si Eastwest bank at napaka generous aarte pa ba ako? bukod sa text nag email din. kaya grab ko na kasi may extra naman para to settle.
      Tama si @BrianSureWood yun feeling baka pag naka pag settle ka sa isa eh isa isa na silang mag contact sa atin(lol) pero thankful ako sa blog na eto kasi dito ko nalaman ang diskarte na need unahin yun mga banks na nag demanda. kaya RCBC next ko settle.
      At the moment tuwing nakipag negotiate ako kay Security bank at ayaw talaga sa alok ko amount ginagamit ko yun money to pay other CC ko. I still have a few to go. kaya ang diskarte ko is to withdraw agad sa bank ko lipat sa digital banks at cooperative bank.

    10. hi @BrianSureWood, ano ibig mo po sabihin na one time garnishment lang? as in 1 month salary lang? mine kc sa landbank until now naka hold pa rin dahil sa payroll garnishment na nag start nun May 30, 2023.. after ng 1 time garnishment sa iyo, ok na ulit ang payroll mo?

  18. I just received my update credit report from Transunion and the results, while still not satisfactory in my eyes, looks optimistic.

    The first time I applied, i was tagged as Very High Risk. Now, I am tagged as Medium Risk.

Hello po Is there someone here na nademanda ng security bank? defaulter po since last year umabot na po sa 300k dahil sa interest. and i’m afraid na magfile sila ng case sakin nasa abroad na po ako and ung family ko po kasi hindi alam ang situation ko. dati nakikipagnegotiate pa ko na baka pwede na tanggalin na naila kasi mga nasa 100k lang talaga ang amount na utang ko pero ayaw nila kaya hindi ko na sila ulit inemail and hindi ko nadin binubuksan ung email nila sakin paiba iba na nga sila ng mga CA na nageemail sakin. ask ko lang if meron po

      Yes po Security Bank sues. And with what you owe it is almost certain they will file a case.

      If I were you, I will open the email and talk to them.
      This is a classic example of what I've been saying here, regardless of whether you intend to pay or not, it is better to know what their next move is

      Ang maganda, sabihin mo na family mo so they don't have to receive the summons. Kung nagdemanda na at nareceive na, you designate someone to talk on your behalf or represent you in a small claims hearing.

      Kung wala ka naman balak magbayad, pwede mo na din ignore hayaan mo na.

      I cannot say for sure since di po ako lawyer. Pero there needs to be an acknowledgement that you have received it whether thru the sheriiff or someone who will give it to you.

  22. Hello! Napadalhan na ko ng Sum of Money keme (aka the makapal na papel) ng isang bank after 3 years ng 1M utang sa kanila.

    Baka may makapagshare naman ng next steps. Kahit ba wag ko nang siputin? Hearing is in 2 weeks. If di naman ako pumunta, may judgment rin naman diba?

    May ilan pala akong assets (real property): house and lot sa Metro Manila na inherited ko 15 years ago, 2 condo (isa dun naka bank amort pa). Di ko alam alin dun yung family home na matatawag (di raw seizable yun). Magriresearch rin ako online kung may similar cases. May bank accounts akong minimaintain for payroll and mostly digital banks. Walang laman lahat haha. Transfer transfer kasi agad.

    1. Inunahan ko na habang wala pang kaso. I already transferred my property docs to my sons name and vehicles registrations to my brothers name. Maski paulit ulit na sinasabi na banks go for the money mas kampante na ako na wala sila makukuha maski anong gawin nila. Kinakape ako dun sa writ of preliminary attachment. Pag nakabawi ako in the future then I would settle with them.

      for your peace of mind, I would agree.
      However, IF the bank would really run after your assets, that would be fraud (Art. 1387) kaya may preliminary attachments if ever.
      HOWEVER, we go only for deposits due to many practical reason.
      kaya, still nothing to worry. lol!

    1. Hello yung bank na we find ways hehe, pero skeptical pala ako kasi downloadable lang pala yung MTC forms sa web. Possible na fake rin pala yun, but who knows? Ang malabo pa dun was may amnesty email from a popular CA na magaling mangharrass a few days ago pa kong natanggap. The so-called summon was dated a month before the amnesty e-mail. Ang daming details rin coming from another bank I have beef with (maling company name spelling, and sure ako na dun lang sa bank na yun yung may ganung info). Parang di na rin tuloy ako convinced na legit case yun. If ever man, I was advised na wag na lang puntahan... bahala na si Batman.

      Kung may nakalagay na court branch and yung details ng kaso mo ay naka-attach, you can call the court and confirm that.

      Di ko na matandaan. I previously mentioned I changed numbers to avoid them, which was a total mistake on my part. I had no idea of when and what their moves were since they can't contact me.

      They would have filed a case regardless dahil wala naman ako ibabayad talaga pero I could have probably negotiated a better deal if I knew.

Today nag email nnman sila nagbabanta na magfile sila legal action against me. Ask ko lang po if ever gusto ko iclear ito sa bank po ba ako dapat magpatulong? 150k credit limit ko pero dahil 6yrs na ito na hndi nabayaran 800k na daw po. Please po help me for any suggestions.

    citibank-150k

    Nag migrate na po ako. No plans of going back to the philippines pero yung family ko nasa pinas pa. I already told them my situation and sila yung nakaka receive ng letters and visits pero sinasabi lang nila na hindi na ako dun nakatira at yung mga letters kinukuha nila pero tinatapon nalang din. Paano po pag nag file ang bank ng small claims? Wala po kasi ako work dito sa abroad since ako nag aalaga sa mga anak ko might take another year bago ako maka work kapag nag aaral na yung bunso ko. Is it better to respond to them via email? kasi i receive their email pero di ko sila pinapansin kasi wala naman ako ibabayad.
    Sabi ng parents ko medyo nabawasan na mga mga letters at nag vivisit pero lately napapansin ko napapadalas email nila sa akin.

Pag di daw po nag bayad ay papunta na sa execution sale yung property. Nagkaroon ng notice of levy on execution sa last page ng tct ng family home namin.

    1. Hi Ms Nobody, Ganyan din nangyari sa BDO ko, around 170K to 190k (dahil minimum lang lagi bayad ko) nagpabalance convert ako, naging 300k+. Over the phone rin during pandemic to. 2 cards almost same amount. So naging 500k+. 3 years defaulted, hindi ko pa nababayaran.
      To answer your question, Yes.
      Pero sa Sum of Money pa rin naman if ever magfile ng case.

      Kung wala ka naman ibabayad, wala ka magagawa. If they call you, tell them the truth.

      Now, if they sue, then they sue. That is now beyond your control. If you want to know what their next moves are so you can plan yours, just answer them or reply.

      The good news is until your case is decided, you are still in a position to negotiate. The bank would rather deal with you than proceed with a case.

      Now, if it happens and talagang wala, life goes on. People have survived. Plan again.

      It took me a total of basically 16 years from the day I defaulted to pay off almost all of my debt. So there is life after it.

    2. Ilang years na? If you have good credit score u will be approved. Just try, pero bka dhil sa kka-apply mo ma trace and mag file pa ng case sau.

    3. Hi Guys, anyone with experience makipag settle sa BDO pero 3rd party collection na? Nag ask kasi ako ung 90k at least 4 installment. Kaso discounted na raw yan. Hindi ko naman kaya one time. Ipapasala lang kasi ako if sa BDO tatawag. Thank you

      Depende po kung yang mga card nyo na defaulted ay laumalabs sa credit report. Most if cards you mentioned appear in both the CIBI and Transunion credit report so malabo.

  68. At long last nabayaran ko rin ung isang EW CC ko. Pumayag na sa 5k from 120K na sinisingil sa akin ni CA.

    I had been in default for almost 10 years na sa EW. Months na silang nangungulit lately. I stood by sa offer ko. One time payment lng at yan lang ang available ko right now. May nasagot na akong CA na if ayaw nila sa offer ko, ok lang na kunin na nila ung mga lumang electric fan at washing machine ko sa bahay. Napagod na cguro kasi same line lang binibigay ko lagi. Kesa nga naman na walang makolekta.

    Ngayon antay ko ung certificate. Wag naman sana akong pahirapan at pag-intayin ng matagal.

  69. I am defaultee of BPI 7years na pero nung July 3 lang lumabas yung Writ of Execution and now all my accounts in Union Bank ay naka freeze! Sabi ng branch manager ay may court order daw so I think ito na yung for garnishment? What to do next? Safe ba maglagay ng funds sa Digital Banks like CIMB, Gcash or Maya?

      Open an account using someone else's name. Mother, Cather, Spouse, Sibling, Children then dun mo lagay pera mo.
