Paranoia Synopsis - Answers To Most Queries - from @reTIRED Banker

SECTION A - FEARS :

1. I will go to jail

Utang is a civil liability. Imprisonment is for criminal offenses.
Therefore walang pakialam ang :

a. Police - they handle peace & order
b. NBI - NBI Clearances cover criminal cases
It contains the entire criminal history record
(Criminal Incident History) from the different
judicial courts and law-enforcement agencies
c. Immigration - Hold Departure Orders are for criminal cases
d. DFA/Embassy - Passport/Visa issuance is not dependent on CCs
e. Barangay - They cannot entertain complaints from a corporation
f. Courts - They mediate not collect
g. Other Countries - Their laws are not applicable to us. Remember Contemplacion?

2. They will visit our house and get my properties/Cause a scandal

Trespass To Dwelling is a crime against security - kulong sila.
Is there a court order? file muna sila ng case!
Get your properties? does your name appears in your electric fan?

Sec.13 of Rule 39 of the Rules of Court outlines some properties
they cannot get from you :
- family home
- salary/pension
- furniture ( beds/dining tables etc.)

Check mo Crimes Against Honor - Art. 353(Libel);Oral Defamation etc.

3. They will charge me with RA 8484 because:
-I transferred residence/office/went abroad
without informing them;
-I am defrauding creditors by not paying.

Did you used a fake card and supplied faked information?
(reasons why you do not want to pay)
Did you left your place “surreptitiously”? (look for its meaning)

If your answer is “YES”. Then, maybe you are guilty indeed.

4. They will file a case.
The Worst They Can Do, or What You Have Been Afraid Of

They wont ; They cant. Impractical, expensive, waste of
time and pointless. What makes you more important than the
other 999,999 accounts?
You've been complaining about high interest before? Now is the time.
Our compassionate Judge usually reduces it to 12% Interest PER
ANNUM na lang, ayaw mo pa noon?

And, even if they file a thousand cases against you, if you do not
have the money or identifiable properties, That’s IT!

5. They will come and talk to our Manager/HR ; cause a scandal

See no. 2 above and some suggested diskartes below

6. I issued PDCs.

BP 22 has been decriminalized. Just attend when invited. That is the
only requirement.

7. My account will balloon because of continued interest and charges.
I surrendered already my card but the charges wont stop.

Your card is automatically suspended even without you asking for it.
Your account will continue to incur interest and other charges
"until fully paid" - That is what your Card Agreement says.
So, it will never stop, but collection efforts can.

8. I will be BLACKLISTED

You cannot erase an experience, even if you pay it now. but you can
justify it - nawalan ka ng trabaho e. A good credit officer( not them
CC officers)looks beyond that experience. Why not try to find it out?
A good number of people do get to be issued new credit cards despite
the experience. Try before you quit. Pakiusap lang,
LEARN FROM YOUR EXPERIENCE.

SECTION B - Sources of Harassments:

a. Collection Letters

You already know what's inside. Throw it right away without even
opening it. No good news there. It will just spoil your day.

b. Text - SMS & Calls

delete. avoid sending replies. sayang ang load
divert those calls.

c. Visits

Ask for their ID, authority as representative and/or Court Order.
You have the right to refuse them entry if they cannot show one.
Then call for police assistance (This is their ACTUAL function)

Ito ngayon ang may imprisonment:
c.1 Trespass To Dwelling ( Crime Against Security)
c.2 Fraud - Pretending to be somebody
c.3 Extortion
c.4 Robbery
c.5 Oral defamation

d.Calls - office and home landlines
We always assume they are from the bank
how can you be sure? ask them that.

d.1 Don't take the calls. You have other better things to do.
d.2 If you can't avoid it, just make your replies simple, even if you
do not mean it, to avoid prolonging your agony
d.3 No need to explain why you cannot pay, plead that you be given
time, nor engage in an argument - all pointless.
d.4 Can't take the call anymore? Bang the telephone! That is your right.

e. Call/Text Messages

e.1 A case has been file already. To stop, call this number
- You cannot stop a case if already filed. It has to be formally
withdrawn
- Did you actually received a Summons? Ano ito, shortcut?
e.2 You have a package for pick-up
- You should know better

SECTION C - Venues for Sama ng Loob

Bangko Sentral ng Pilipinas is our friend.
So is the Bank President.
IBP/Supreme Court can remind lawyers
This Blog reduces tensions
Your friends are willing to lend an ear
Our support group - Diskarte, Pilipinas ! is on your side.

SECTION D - The Golden Rules on Credit Card Paranoia

Rule No. 1 – If you cannot pay, don’t
Rule No. 2 – Prioritize your need ; not their greed
Rule No. 3 - Don’t let them control your life. It’s your life anyway
Rule No. 4 - Disregard….delete…..dedma
Rule No. 5 - Dare To Fight Back ; Dare Their Bluff

  1. Thank you. Very thankful ako sa blog na2 for 2 years panay ako search. Nakahanap din ng kakampi. 😊

With regards dun sa no. 3, mag aabrado po kasi ako.. paramag work and eventually makabayad sa mga cc debt, if my intention is to work at hindi takbuhan ang mgavutang? How can I prove it?

    1. @Sonnixx Haven Regarding sa number 3, which is ung mag abroad, how can i show the banks na hindi ako tumatakbo sa utang at mag aabroad para magtrabaho.. actually, i asked an atty na regarding this pero iba ang payo nya. Ang payo nya is huwag na lang ipaalam na umalis ako.. so at first panatag ang loob ko kasi abogado na kausap ko.. but now medyo kinakabahan nanaman ako.. the atty also said na mas okay na nasa ibang bansa ako kasi hnd ma serve ang summon, but apparently, may substituted service of summon so kung mareceive ng kamag anak ko.. mag start parin kaso.. and if nag start ang kaso ng wala ako, and lumabas yung decision, and the bank asked for the full amt ng money like 400k, wala na akong magagawa but to pay? Paano kung wala pa pambayad?

    3. Hi @AnonymousWednesday, May 31, 2023 at 4:28:00 PM GMT+8

Ang hack ko diyan is alamin sa accounting office when OR if na send na ba yun electronic file ng payroll ninyo sa bank. Need natin kasi withdraw agad ang payroll as soon as ma credit. If too much naman yun ganoon style. well old school na lagi post dito ay check mo kada oras kung credited na payroll ninyo sabay lipat sa gcash or maya or any digital banks mo

      Delete

      Delete
    6. busy si sheriff, so that is right. usually one time lang ang garnishment as experienced by many. though may mga unusual case na nahold ang salary account mismo for a long time. diskarte lang. pwede naman makuha ang salary sa ibang paraan.

      Delete
    7. Hinde kaya BPI card and BPI ang payroll nya so parang set off ang nangyayari?

      Delete
Ang problem lang is baka automatic din ang pag debit ng BPI sa payroll mo, so once pumasok ang salary is debited agad. I also have a debt with BPI credit card and personal loan. Worry ko din yan magarnish nila ang payroll ko since BPI din ang payroll ko sa work. Praying na this won't happen in my case. :(

  6. There is nothing wrong with that. Magandang diskarte.

  7. How is the 12% interest per annum is computed? For example I have a total of 100000 debt, less interest ba or kasama? Then x sa 12% and divide sa terms? Sorry but I have to be prepared just in case.. 😊

    ReplyDelete

    1. Parang ready ka na mag settle ah? Hehehe. ang 12% per annum is the usual court order. Pay when able yan. kahit 100 years mo pa bayaran. iba yung negotiated settlement with CA crooks and banks. Sila mag determine sa terms nun.

    2. Thank you po.. Not yet ready.. Just in case lang..

Then she called me and asked me if papunta na daw akong brgy sabi ko bat ako pupunta? Then kakatanong kakatanong ko sa kanya nag sawa ata binabaan ako hahahaha. 9. Hello po . Need lang po ng more advice. Last may 25 nakareceive ako ng tawag from aiqon regarding sa credit card from EWB.
Which is ndi n ko nakabalik mula nung nag file ako ng MatLeave..
Now ang pinapabayaran ni aiqon is 35k n lng within dis month..which is ndi ko pa din kaya. Ayaw pumayag na installment ung 35k.
Totoo po Bang ndi no I entertain ng EWB kung dun ako mag request ng settlement?
    Salamat po..Sana may makapansin.

Call ng bank yun. practical ang bank kasi ang goal nila is to collect from us. kung gusto nila magkaso, dapat ginawa na nila matagal na, and should be within 1-5 years. pag sa tingin nila may makuha sila sa atin, magkaso talaga yan to collect. pag wala naman, what is the point. dagdag gastos lang yun on their part. so better arrangement sa kanila to get CA crooks para sagarin tayo magbayad.

again and again, as banker would argue, we dare their bluff. sue me in court. technically, better sa atin yun kasi easy na mag manage sa CA crooks. sabihan lang natin, nasa korte na yan.

      So chill lang.

Legally speaking, the supplementary is also liable. HOWEVER, financial evaluation is primarily based on the Principal. one can appoint a supplementary CH even without financial capacity.even husbands are not liable if x x x x.
Lastly, you can check the dispositive portion of any court decision where only the Principal CH is liable.

that is why matagal silang magkaso at ang strategy nila to collect is through CA crooks using scare tactics, threats, public shame and all. yes, marami sa ginagawa nila ay bawal. pero alam na nila diskarte paano lusotan ang mga BSP circulars and other government regulations on anti-debt collection practices.

chill ka lang. accept your present reality as defaulter, and learn the lessons. diskarte ka lang.

FINAL DEMAND is hereby made upon you to SETTLE RCBC CREDIT CARD unpaid account. Litigation is quite expensive, time consuming, stressful and ultimately embarrassing for you . Worse, a court case also affects NBI Clearances, passport applications and other government applications and requirements. Having a criminal case is much worse, because even freedom to travel may be restricted while the case is pending. It is easy to avoid all the above problems if you just settle immediately.

in your case, with the writ of garnishment sa salaries nyo, there is no other way but to file a motion. very clear naman ang batas on salary garnishment - that only the excess amounts (after covering your household needs) ang pwede ma garnish. except that may mga sheriffs or banks that interpret the writ of garnishment wrongly.

By the way, yun ma na receive mo na text- is that for another credit card? kasi kung may court case ka na with BPI ( SP Madrid collecting agency) bakit pa sila nag text ng ganyan? Well best way is to implement lang ang mga diskarte na nandito sa blog. ako pag text unknown number delete lang sabay block. Mas better kasi sa email sumagot kasi may thread.

gaya ng sabi nga dito accept lang the fact na defaulter tayo, learn the lessons, AND IMPLEMENT the diskarte.

We can not manage collection agencies at mga collectors nila, but we can manage how we react to their tactics.

    1. @Prismblue experience - motion to lift salary garnishment filed in court on Feb 11,2022. Hearing was set on Feb 18,2022. Usual procedure, hearing should be scheduled within 15 days upon receipt. Court decision declaring salary garnishment illegal and thus to be lifted on March 3, 2022.

All these info naggaling sa open posts.

Now, may alternative ba to lift the salary garnishment. WALA.

    1. Kalma ka lang. It happened to me and to many others here. Sabihan mo ang employer mo na malaking scam yan at kunin all details possible para you can file appropriate complaint. Advice your employer to call PPI to confirm na scam yan.

Thank you so much po! 🥺 Nagulat din ako na ganun na ang pag harass na gagawin nila, nakakahiya man sa dati ko employer pero wala nman ako magawa, saka last time my napunta sa bahay, kapitan at mga tanod hinahanap ako kasi may nagpunta nga daw sa barangay. I dont know kung kakampi ko ba sila kasi tinanong ng ate ko bkit ako hinahanap, wala nman sila masabi.

    3. CA crooks would do all illegal scare tactics to shake, rattle, and roll us all along. They would find ways to shame us publicly to force us to pay. Sa mga situation like this beyond our control, fast and easy way out is to tag them as scam.

Sabi ko agad, what, scam yan. After all, di ko sila kilala, at kung may legal issue man ako, they could have done it the right way. The following day, after calling PPI, tumawag ang former employer sa akin, at ayun, nag apologize sa abala. Dapat di raw sila maniwala agad.

We don't owe people (former employers, current employees, colleagues, friends, relatives, etc) an explanation of our situation. Di naman sila tutulong sa atin ah. Ako I only share and explain to my immediate family and children, and few select trusted friends who listen and extend help. Again and again, this is a psychological and emotional game with CA crooks.

I just received the summons today (makapal na mga papers) and I was advised that I have 10-days to respond and na-set na din hearing next month (August). Ano po ang dapat kong gawin? Should I ignore that and do nothing or mag-comply po sa pag-send ng response within 10-days at umattend ng court hearing?

come to think of it. banks will definitely survive even if maraming defaulters in millions. the system is in place for them to recover and survive. for us defaulters, we only have our selves to rely on once we are in financial mess, mostly not of our willful decision to be in. so diskarte lang talaga.

walang firing squad sa Pinas pag may decided case on credit card default. technically, blessing in disguise nga yun in managing the CA crooks pag mangulit sila. easy na lang sabihin na, tigilan mo ako, I deal with the court. See!

    1. mag back read pa ng maigi. Ilang beses na meron nag share na huwag pumasok sa Debt Aid International kasi dagdag gastos lang. kung gusto mo talagang mag settle, ang general rule sa payment arrangements ay never enter into one if you are not sure. all payments will just to go to waste. only negotiate when you are ready if have the means. better yet, negotiate for lowest, one-time payment settlement para tapos agad.

  84. I want to share my experience. I had 3 defaulted credit cards - BDO 40k+, EW 20k+, BPI 300k+.

Officially debt free as of today. Siyempre si BPI yung last diyan.

I failed to pay my cards back in 2018. Lahat napunta sa CA. Si BPI nagfile ng Sum of Money case back in 2019.

Kahit naman pumunta ko malamang talo talaga ko at wala din naman akong pambayad that time.

Fast forward to last year 2022, ginapang ang trabaho at nagkapera. So ayun, nag reply ako sa mga email nila asking if I can still avail the offer. I settled EW for 1k pesos, si BDO naman 19k.

Fast forward to June 2023, after a long time nag email ang CA ng BPI regarding Writ of Execution (ipapa sheriff na nila ko) pero they are also offering an amnesty for 100k+. I offered 40k at na dismaya sila. Yes, ang baba ng offer ko pero yan ang kaya kong ibayad agad within the slim timeframe na binigay nila.

We went back and forth trying to get more discount which I can settle with a one-time payment. We agreed with 90k+. Mataas parin, but it's a far out swing compared sa running amount + interests. Luckily, we came up with the required amount at yun nga nabayaran ko siya.

Earlier today, nag email na ng electronic certificate of full payment si BPI and officially debt free na ko!!!

Next step is to update the CA para ipa-dismiss yung case na na-file nila. This was part of the agreement that we had.

    ----------------------
I know the feeling nung hinahabol ka ng collectors. Yung feeling na may case against your name. Pero tama nga sabi nila, if you cant pay wala naman talaga silang magagawa. But, when you get the chance to pay and clear your debt, try to settle it. Do it at your own pace. Talk to your creditors when you think you have the ability to pay and dont hesitate to ask for discounts or amnesty. At the end of the day, gusto rin nilang matapos lang na.

I hope my story can inspire you. Keep fighting and don't lose hope.

  85. Good day po.
