DISKARTE BOOKLET! MUST READ!

Chapter I   Meet Mr. Collector

He is usually a high school graduate who earns his living
on a no-collect ; no-commission basis, employing mainly:
1. Pretense (  lawyer/police/NBI,whatever)
2. Harassment
3. Blackmail
4. Extortion
5. Swindling
which are all CRIMINAL OFFENSES just in case you don't know yet

Chapter II   Ways of Contacting You

1. Demand letters
1.a. Receive them. No big deal. You can even sign it front and back or left to right.
1.b  Do not open. There are no good news there anyway, only lies. tapon

2.Text Messages
Para iwas stress, simply press 'delete'

3.Calls
3.a)  Take the call. It can't kill you anyway.
3.b)  Do not argue, plead or explain, so that the call will not take long.
3.c)  "According to my lawyer, sa court na lang daw natin pag-usapan ito"
3.d)  Stick to that line. simplify your answers to "yes" or "no"
3.e)  Remember this sound - "click"
3.f)   Huwag ma-pikon. " Tama ka" is standard reply para SIYA ang ma-pikon.

Chapter III  The Lies Collectors Tell

The first lie is his name.
That is not the collector's real name.
So, why would you believe anything he says afterwards?

1.Court Case
    They won't ; they don't ; they can't
Why would they'd be called "collectors" in the first place!

2.Imprisonment
Failure to pay means you promised, but did not fulfill it.
Its found under "Obligations and Contracts" of the Civil Code,
not in the Revised Penal Code, hence, not a criminal act.
This also applies to debts abroad like UEA.

3.Amnesty and Promos
Show me first the documents that he is legally allowed by the bank to do so
   before I believe him.

4.Travel Ban
You are not a criminal, what gives?

5.Getting Your Properties/Assets/Money/Salary
   May court decision na ba?
   Meron ka bang condo/Ferrari/Time deposits?
   Plain robbery

6.Publishing Your Face
Have you ever seen one in a newspaper?

7.Warrants of Arrest/ BP 22/ RA 8484/ PNP/NBI/CIDG/INTERPOL
These words imply "imprisonment" ; now go back and read again if you missed anything.

Chapter IV  Threats and Blackmails - Visits

1. Office
2. Home
3. Barangay

What for, Eskadalo?
Tip :
A list of criminal offenses you can file against collectors is found here:
http://failuretopaycreditcard.blogspot.com/2010/11/matapang-na-collector.html

Chapter V  How To Pay

1. Go to the bank personally
2. Ask for an updated Statement of Account
3. Review and request for waiver or reduction of charges
4. If there is an agreement, document it ; the start paying
If there is no agreement ( referred only to collectors),
wait  for the court, if ever it will come.
5.The process will simply repeat again from steps 1 - 4

Chapter VI  Worst Case Scenario

If the bank is serious in collecting from you,
matagal ka na dapat pina-tawag sa court.

Even if the bank files a thousand cases,
if you have no condo, ferrari or time deposit,
THE END

Chapter VII  The Five Golden Rules

1. If you cannot pay, don't
2. Prioritize you need, not their greed
3. Disregard, delete, dedma.
4. Don't let them control your life, it's your life anyway
5.  Dare their bluffs ; just for laughs?
(I forgot the last one. honest. ha..ha..ha..)

Chapter VIII  Lessons Learned

1. Debt is a humbling, not a humiliating experience.
2. Forget the debt, not the lessons.
Then reflect on  this :
Parable Of The Ten Lepers

Postface
Someone asked me:
"You told me they won't sue me but they did!"
I answered back:
" I cannot guarantee everything 100% ;  Remember,  I am not God!"

    3. Sonixx is this true? I have a 10yr old unpaid loan.

"Unpaid credit card balances in the Philippines will not be erased, as is the case in other countries. You owe the credit card companies no matter how long it has been since you made the purchases. A common misconception is that debts are erased from a bank's database after they have been collected for seven years."

  2. This is amazing. I found this blog exactly when I needed it. I was terrorized by these collectors for some time. And even when I talked to them politely, ang gaspang sumagot. I literally don't know if their job turned them that way eventually, or requirement talaga na kapag debt collector ka na medyo dapat wala kang kaluluwa.

Sabagay, when you think about it, hindi naman yung mga nakakaluwag sa buhay ang nalulubog sa utang.

Anyway, things will get better. Things always get better. If you're reading this and you're scared, makakaahon ka rin.

  3. Malayo-layo na rin pala,
    Mula noong ika'y nag-umpisa.

    Paulit-ulit mong kinakaya.

    1. WPS garnishment? It is possible, but highly improbable. It will be more expensive for the bank to bring you to court than to have a settlement. My position is: it is difficult for the credit card companies (banks) to prove that you owe them money. For them to prove you owe them money they have to produce the ff: 1) A contract that is notarized (did you sign anything that is notarized?); 2) All the charge slips you have signed, and it has to be original (do you think the banks have kept all those charge slips); 3) how they arrived at the amount that they claim you owe them. Now if you don't ask them to prove it, and you enter into negotiations immediately, then all proofs will be considered waived. And it will take the bank too much of their time, money, and effort. Remember they have to pay filing fee if they plan to bring a case against you. And the filing fee is dependent on how much they claim you owe them. Too much trouble. And there is a whole list of procedures before they can garnish your assets. It's simply not worth it for the bank.

      Delete
    2. Thank you for sharing sir.

If ever man madala sa court ung case ko, will ask for computation and breakdown.

      Delete
Better maintain minimal amounts na you can let go. If you need talaga, you may maintain time deposits under sa ibang name.

    3. @Anonymous Apri 1, 11:13PM = It will not be erased, but if ever you pay you can get a certificate of full payment and then go to the office of CMAP somewhere in Makati and show it to them. Btw, if you are eager to pay lump sum (I don't know why you should pay them in the first place), ask if you can get a clearance from the bank of full payment, "kaliwaan". Meaning, tell the CA, to accompany you to the bank and then pay the amount to the teller, only if they have a signed clearance ready to give you the moment you pay in the bank and that the moment you get the clearance, both of you go tot the nearest Notary Public to notarize the clearance. Only if those conditions are met, are you willing to pay them. Now, I doubt if they will agree to those conditions.

  16. better to negotiate directly with the bank. if ibalik ka nila sa CA, then you have to deal with the CA. either way, you need to ensure all agreements are documented. I had my negotiations through email exchanges.

but only do this if you are sure, you have enough resources to sustain your settlement. if di ka sure, huwag na. worst, never go for installment settlement kasi if di mo ma sustain, sayang lang ang bayad.

I always prefer one-time negotiated settlement, with fast issuance of certificate of full payment.

Dala ng pandemic, maraming ccs akong maxed out and di na nabayaran.

Nagsisimula akong muli. Kakahire lang sa akin despite my many utangs.

Out of sight, out of mind muna. Masyadong painful ang first year ko with them and stressful kaya babawi muna ako para makapag provide sa pamilya ko.

Wag uutang para magbayad ng utang, I learned that the hard way.

Yun lang and God bless sa lahat ng mods and admins ng blog na to. Utang ko sa inyo ang second chance ko in life. Maraming salamat po.

Since I don't answer the phone, they the calls have become less and less. If they call and I answer, I just deny I have a credit card with them. If they insist and get argumentative, I simply ask, "Do still want to argue with me or do you want to go to your next caller? The reason I am not hanging up is because I am being polite. But if you keep arguing with me, I will hang up." As for "lying" that you didn't have a credit card, just remember you are not under oath. So legally you are not lying. The more you entertain their calls, the more they will call you.

    2. Keep in mind the legal dictum: "Whoever claims must prove." They are claiming that you owe them money. They have to prove that. Do they have proof? Wala. Why? For them to prove that you owe them money, they have to produce the ORIGINAL charge slips (the one you have signed) for them to show that you owe them money. Now if you go to court and admit that you owe them money and not dispute the amount, then your right to accounting and "proof" is considered waived. Best thing to do, if in court is to ask the ff documents from them. 1)The terms of agreement (did you sign it?) and has it been notarized; 2) The charge slips they claim upon my purchased that you have signed. Has to be original (Citibank vs Teodoro-its in the internet); 3) How they arrived at the figure they claim you owe them. In other words, it will be very difficult for the bank to produce those documents. That's why they gave it to the collection agency.

The bank has endorsed your Maybank Credit Card 5328XXXXXXXX7533 to Constantino And Associates Law Offices as you have failed to comply with the payment requirement set despite the numerous efforts made by the bank.

Final demand notice is given to collect the Total Outstanding Balance of Php 43,535.68 to avoid possible endorsement of account for legal proceedings.

Settle immediately at any branch of Maybank, BDO, RCBC, SM bills payment counter, Bancnet online or ATM, and via M2U Online or BPI online.

Any advice po how to deal with this?

    1. if you want to reply, simple lang naman sagot , "wala pa akong pambayad sa ngayon. i will reach out directly to you once I recover and have the means."

magiging astig ang mga CA crooks kung hinahayaan lang natin sila. last time may taga SP Madrid pumunta sa bahay, messenger plus isang babae. ako mismo tumatanggap sa letters pag nasa bahay ako. ang babae gusto nang mag umpisang magsalita. ang nasabi nya lang na paalma, "Sir, anong plano mo?" sagot ko, sino ka nga at anong role mo bakit ka pumunta sa bahay? tagahatid lang kayo ng sulat, di ba? kapag may gusto pa kayong sabihin, sa formal na sulat o kaya sa korte na ha. bahay ko to. at for your information, nakaharap mo camera at recorded ka. ayun, umalis. bluff ko lang yung may camera. hahaha. pero I am considering palagay ng camera (shoppee lang) as a precaution.

kalma lang tayo. again and again, we should NOT let the CA crooks control our lives. diskarte lang.

    3. @Anonymous,

I will assume that your defaulted account with BPI is/are

      A. A Loan
      B. Amount is less than 100k
      C. Both

I am assuming this since BPI has not sued you yet after 4 years, and SP Madrid pa din ang humahabol sayo.

Anyway, wala naman sila magagawa kung ayaw mo magbayad, but just a heads-up that BPI files cases against defaulters. You may want to watch out and inform anyone from your house about accepting or not accepting anything that may come from BPI and its agencies.

    ReplyDelete
  48. It means, even with all the diskartes here, at the end of the day, it is the call of the banks to file a case against us.

But why worry? yes, clear win ng banks ang sum of money cases. pero pag wala pa rin tayong pambayad, eh di wala pa rin. and banks know that fact. yan kung bakit, they do their homework before mag file ng case to ensure maka collect sila. Come to think of it, dagdag expenses sa banks to file cases, and if they know they can't collect, hassle lang yun sa kanila.

  66. Here is a practical tip for Collections Agencies to stop calling your office or going to your house.

Answer their calls or emails! I am using an explanation point for emphasis. Hindi ako galit.

If you are answer their call or email, and tell them wala ka ibabayad sa kanila, the chances are they will stop calling you after. And if they don't stop, they would only have to keep on calling or emailing you since they can contact you. As long as they can contact you, you minimize the chances of them going to your house, office or calling your place of work.

Also, I am opinion you cannot complain about the Data Privacy act when they call your office or people you know because most probably ikaw ang nagbigay ng number na yan.

You can't have your cake and eat it too. You can't default on your cards or loans and expect peace of mind from collection agencies. Magalit man tayo sa collector because of their tactics, they are hired by banks to get their money back. The best you can do is arm yourelf with knowledge and face them a few times every couple of months.

    ReplyDelete
    Replies
    1. great point for emphasis. walang mawawala sa atin pag sinagot natin sila, except oras natin sa pagsagot at peace of mind natin pag di tayo marunong makipag deal sa kanila.

maghanap at maghanap ng creative ways ang CA paano tayo makontak. p though oftentimes, kahit makontak man nila tayo, they continue to call our offices, connect with our social media contacts, and worst even leave info in their walls (nangyari sa akin). All these just to shame us publicly and force us to settle.

      so diskarte lang talaga.

personal strategy ko for three years na. I continue to send formal email financial updates to all banks copying CA crooks. Pag sinagot ko tawag nila, automatic response, binasa mo na ba email ko? hehehe. paulit ulit lang naman email ko sa kanila, telling them wala pa akong pang settle at magkontak ako sa kanila pag maka ahon na ako. hehehe. napansin ko, di sila masyadong kulit for few weeks after my formal email financial updates.

bottomline - since defaulters tayo, diskarte lang talaga paano natin i-manage ang CA crooks.

banker's ultimate bluff - "sue me" works.

and if indeed kasuhan tayo, talo tayo - execution, garnishment, etc. diskarte pa rin. tuloy ang buhay.

    1. @Anonymous,

Yang "Office of Attorney Norman Lorenzo" eh Collections Agency.

Sinasabi nila na law firm nila to get your attention so you have to call them.

Titimplahin nya ang reaction mo by your tone and your questions. When "Attorney Lorenzo" feels natatakot ka, sasabihin nya sayo yung utang mo at kelangan mo magbayad ng half bukas. Pag hindi mo nabayaran, kakasuhan ka nila.

Kung di mo nakita tong blog na to, malamang super takot mo na at hahanap ka ng way makapagbayad and you will feel desperate.

Yan ag scenario dyan. While I advise that you should take their call. I also advise do not engage with agencies who pretend to be the other agencies or individuals.

In short, kalokohan yan and do not worry.

We were told that prior to us, your said account has been previously referred to at least three (3) accredited agencies for appropriate collection but all proved unsuccessful for reason/s that you have been avoiding our calls/hiding/stubbornly/unjustifiably refused to pay, or you left your given address without informing our client of your present whereabouts. Our client has instructed us to pursue all efforts to collect your above obligation even if it will mean filing civil and/or criminal cases as maybe warranted by attending circumstances.

Please be informed that REPUBLIC ACT NO. 8484, otherwise known as the Access Device Regulation Act provides for the following:

“ Section 9. Prohibited Acts. — The following acts shall constitute access device fraud and are hereby declared to be unlawful: xxx

“Section 14. Presumption and prima facie evidence of intent to defraud. — The mere possession, control or custody of:

    xxx

A cardholder who abandons or surreptitiously leaves the place of employment, business of residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least ninety (90) days and is more than Ten thousand pesos (P10,000.00), shall be prima facie presumed to have used his credit card with intent to defraud.”

Your abovementioned acts and your failure and refusal to pay your LONG OVERDUE obligation to our client, despite demands clearly shows that you purposely do not want to honor your said obligation and therefore intends to defraud our said client to its great damage and prejudice and which is clearly a criminal act punishable by law.

In addition, your prosecution under the above-mentioned law shall not free you of other liability under other laws, thus, Section 17 of R.A. 8484 states:

Your failure to heed this FINAL DEMAND shall constrain us to revert back the compromised amount to its original figure of 197,283.45 plus stipulated interests, finance charges, late fees, other charges and 25 % of the amount due for and as attorney’s fees. We shall thereafter initiate/file in court SUM OF MONEY COMPLAINT W/ PRAYER FOR PRELIMINARY ATTACHMENT and/ or a CRIMINAL CASE/S FOR VIOLATION OF R.A.8484 otherwise known as the ACCESS DEVICES REGULATION ACT OF 1998, violation of any provision of the Revised Penal Code or any other law as may be warranted against you without prior notice to protect our client’s interests.

So most of the time napapasok sila sa bayad terms na di masustain and at the end ayun ending is failed payment na lang. So as we always advice, ignore or kung may tapang, pwede naman sagutin pero sabihin lang lagi rekta na "Sorry wala pa budget to pay at the moment". Kung mangulit at manakot na mag file ng case ang sabihin lang lagi "Go ahead file a case. Hope to see you in court!." :)
