Presenting to you the ever passionate collection agencies. 

These guys are super passionate about their job, which is to get people to pay up their debts.
But oftentimes, they get a bit too intense. 
Some of these agencies can be pretty scary, using tactics that feel almost illegal to make sure defaulters like us pay what we owe. Always in haste and panic. At the expense of our common sense.
It's like they'll do anything to get that payment. They can move mountains of lies to make us pay.
We've got to be careful with them. Understand their moves and strategies. Let us learn their diskartes and manage them.
It's super important to know our rights and how to handle these situations.
Let us stay alert and protect ourselves from these collection agencies.
We need to know the right diskartes too.

    Tama si Sonixx Haven, there is a way to deal with this.

    It is impotant to understand that Collection Agencies can only threaten you. And yung threats are more on the embarrassment side of things, like sa Barangay, o may pupunta sa bahay for ocular inspection.

    Lahat po ay nagkaka-utang. Whether it's by your own making or bad luck, lahat po ay dumadaan dyan.

    By knowing that, you can deal with Collectors more easily.

    Now, dun sa mga nagdedemanda na banks, here is what you do.

    If you have no capacity to pay, and wala kayo balak tanggapin ang mga sulat...

    - Transfer your money to a bank account not under your name na walang utang. Your parents or siblings.

    - Tell the people in your home not to accept any letters from anyone or sign anything kasi baka summons na yan. Mas mahirap gawin yan sa opisina since sa opisina pupunta yan kapag di ka maabutan sa bahay.

    In my case, and as I have advised, accept the letters so you have an idea what is happening so you can prepare. That works for me, but it might not work for you.

    In the end, they can't do anything if you can't pay. If they sue, make sure you are ready to transfer your cash to another account. Kung ang payroll mo ay bank na may utang ka, that might be a problem. Nangyari sakin yan and it was never a problem. Sa iba it was.

      Ako po eh inatanggap ko at tinatawagan ko din ang collection agency dahil from experience baka meron offer na maganda at pag ikaw ang tumawag o email sa kanila, di kanila kelangan puntahan sa bahay o puntahan sa office o tawagan ka sa opisina.

    1. Wala pang nag share that theri digital banks and / or mobile wallets have been garnished. Pag meron na, kindly share for all of us to learn.

      Technically all six digital banks (Overseas Filipino Bank {OF Bank} of the Land Bank of the Philippines, Tonik Bank, UNO Digital Bank, Union Digital of Union Bank, Gotyme, Maya Bank) are all BSP licensed. Mobile wallet services like Gcash, Maya, Coins.ph, Grabpay, etc are also approved by BSP.

    2. Garnishment of deposits emanates from a judgment. The only hitch is "if debtors can easily find it!"
      With digital banks and digital banking of traditional banks, the deposits are too "mobile" and it will take a resolute determination to find and hold them from a banking point of view.
      p.s.
      the downside for users however is :
      most of these digital fintech channel are NOT covered by deposit insurance of PDIC.
      p.s.s.
      GCash is NOT a bank ( it's more of a pseudo bank. lol!)

    3. I agree with Banker here. Kelangan masipag ang maghahanap ng bank account mo para sa garnishment.

      Kung tama ang pagkakatanda ko, para maexecute ang garnishment, ang kelangan puntahan ng Sheriff eh yung branch of your account to put your account on hold.

      With Digital Banks,
      since walang physical branch and main office lang kadalasan, they might ignore that. Ang pupuntahan ng Sheriff ay yung mga banks na malapit kung san ka nakatira o nagtrabaho.

      And again, like Banker said, mabilis ang transfer.

      It is bound by the same rules but for now, mas safe sya.

      Kaso, hindi totoo yan. Hindi magpapadala sayo ng warning na may i-serve sayo na summons. Makukuha mo na lang yan kapag dumating ang Sheriff, walang warning, sa bahay o office mo.

      Wag ka mag-alala, hindi totoo yan. I usually encourage people to call collection agencies and settle, pero in cases like this, I am against it since the collection agency is not dealing in good faith.

    4. Kinukulit na lang kayo nyan kasi alam nila ang address mo, pero hanggang dyan na lang pwede nila gawin. They cannot sue you anymore so pwede mo na di bayaran yan.

      However, since nabili na ng Collectius yang utang mo for a very low amount, pwede mo sila tawagan and ask how much you owe.

      I have a strong feeling they will be more than open to a settlement considering wala naman sila pwede gawin and mura nila nakuha yang utang mo.

      Pero, tumawag ka lang pag ready ka na. Pag hindi pa, let them be.

    6. Salamat po sir@briansurewood pag nag eemail po yan nasa 105k po ang balance ko pero pagnag eemail cla sa amnesty ko is nasa 36k po ung bnbgay nilang amount. Minsan paiba iba may nasa 45k then yang 36k na po ang pinaka mababa na executive amnesty. Sobrang thank u po.

  9. Hi! I am a silent reader here and I am also a defaulter. Maraming salamat po sa mga articles dito dahil very informative at helpful sa pag-manage ng stress ko sa mga nare-receive na messages from CAs .

    Gusto ko lang din pong malaman kung affected din po ba ng garnishment ang mga investments like Pag-Ibig MP2.

    Nais ko rin pong i-clarify yung 10 years from the time na na-default yung cc account, hindi na puwedeng mag-sue ang bank? Does that mean na safe na after that 10 years, puwede at safe na po uli akong mag-iwan ng savings sa bank account under my name?

      The New Civil Code of the Philippines states that:
      “Art. 1144. The following actions must be brought within 10 years from the time the right of action accrues:

      Interestingly, may mga nag share na CA crooks continue to collect even after the prescriptive period. Hehehe

New defaulter po ako. 2 months palang non-payment. ang laki na po kase ng interest patong patong na mas lalo na hindi ko kayang bayaran.. thanks po sa sasagot

    1. Security Bank, or any other bank that files claims, usually files cases around the second or third year of default.

      Walang warning yan unlike yung pananakot ng agencies. May darating na lang na Sheriff sa bahay or office mo to serve you summons.

      Once that happens, hearing the case might take a year or two or even three, depende kung gano kasipag ang judge.

      After that, mabilis na ang process ng garnishment.

    2. It will be a long way for you. Almost 4 years na akong defaulter, at wala pa akong case. Depende talaga sa banks nun. Swertehan lang din. After decision, writ of execution and garnishment can also take time, depende na rin sa sipag ng bank lawyers. Meanwhile, secure mo na ang natitirang pera mo sa banks.

    3. I just received an email about final attempt to settle the dispute. They've offered me half nung total balance of my cc as approved one time payment para masettle lahat. Sabi ko hindi ko kaya yung amount na offer nila. Is there a chance na mapapayag sila sa amount na kaya mong isettle sa due date na binigay nila?

  11. Hi po! Magtatanong lang po ako I am a RCBC defaulter since 2020, nagstart po ako ma default because of hospitalization bills.. from the start goodpayer naman po ako. Year 2021 nag open po ako ng savings acct. sa rcbc and made me as hexagon club member. Recently I received a call from CA GCSS& Assoc. intimidating po si CA and telling me na bat wala pa daw ako pambayad eh may trabaho naman daw po ako. Sabi ko naman sakto lang ung sinasahod ko sa pangangailangan ng pamilya ko as a breadwinner. And she’s telling me na demandable na daw ung case ko kaya maghintay nalang daw ako ng demand letter. As of writing today may na received na letter from law firm ung ka work ko kasi dun po pala pinadala and they received the letter with my consent. Now po, i dont know what’s inside the letter.
    If madedemanda po ako, makukuha po ba nila ung mga property na merun po ako? For example po merun po ako sasakyan and this coming march is fully paid na po ito. Do they have the rights to seized it po? Hope matulungan nyo po ako. Maraming Salamat po.

    1. usual na hanapin nila ang pera mo sa banko. legally speaking, yes, other properties can be garnished. pragmatically speaking, banks rarely go that route. we are still waiting for defaulters to share experiences about property garnishment (house and lot, vehicles) due to credit card default.

      Ang sagot po pag sinabi na due and demandable na ang account ay

      Say 500k utang mo, kukunin ba nila ang bahay mo for that.

  12. Salamat po sa pagsagot Sir Sonnixx haven and Sir BrianSureWood. Nabasa ko na po yung letter and nakalagay po is if i will not cooperate and will not pay within the 5days grace period.. iaakyat na daw po nila ito sa small claims court.

    Possible po ba un? 2 po kasi ung acct ko sa RCBC na default po, one is 60k and 150k po..

      Wala ka din naman ibabayad so wala sila pwede kunin sayo.

  15. Hello Everyone,
    Just wanted to ask for some advise especially sa mga nadefault last pandemic 2020 sa Security Bank.
    Currently I want to settle na, ang problem ko ang one time payment is 250k. If installment nasa 400k then ang laki ng downpayment. Si CA na pala kausap ko, since based sa experience ko, kahit tumawag ako sa bank, ipapasa ako sa kanila.
    Background lang po, I paid minimum lang for a year kaya umabot sa 200k ang oustanding then nahinto payment ko kaya umabot sa 290k bago madefault. Ung principal less than 70k. Talagang nadali sa finance charge at overlimit fee :(

    Ngayon gusto ko na magsettle kahit sa installment, yun lang ang laki ng 400k with DP pa.

    Please advise naman po ano pa pwedeng gawin? Ayaw ko na po sana mag file sila ng case kasi hindi rin ako makakapunta at willing to settle naman ako. Possible rin na mas malaki pa i-ask nila pag sa court na.

  16. I'll give you a few advantages of answering calls and emails from collectors:

    - If you answer their call or respond to their emails and you sound confident enough to say the things na natutunan nyo dito, there is a very high chance di na kayo guguluhin, lalo na yung mga nananakot. Kasi alam na nila di nila kayo matatakot.

    - Baka may offer yan na kaya nyo na bayaran.

    Another thing, do not negotiate on the phone. It should always be on email if kaya.

Kung ibaba lang sana na mas malapit pa sa principal amount ko, kakayanin na e, kaso ung discounted nila, close sa outstanding balance na ilang buwan may finance charges. :( May way pa po ba para gawing principal na lang bayaran pero installment kung na experience nyo na po.   17. Hello, Do you have experience coordinating directly sa Security Bank kahit may active communication sa CA? Pang ilang CA na sila na nakausap ko, kaso hindi raw approved ung inask kong discounted amount. 150k principal ko, pero nung nadefault nasa 250k. Ung discounted na installment sabi 220k. Mag 4 years default na po. Thank you.

    1. yes, pwede mo gawin yan. and if the bank will refer you back to CA, then balik ka sa kanila. with CA crooks, negotiate with them the least amount na kayanin mo. if di mo pa kaya, so be it. let them file a case against you. court is always formal, legal and fair. pag meron na decision, execution at garnishment, at wala ka pang pera, eh di wala pa rin. make sure though to equip yourself with right strategies to manage all the scare tactics of the CA crooks.

    2. Ibabalik ka ng Security Bank sa CAs nila.

      Typically, ang first level ng SB is Cendana Neri. After nyan, yung mga hardcore CAs na ng MBA at RGS ang tatawag sayo.

      Tama si Sonixx Haven, if wala oambayad, wala ka naman magagawa. Wala din naman sjlila magagawa.

      Pang ilang CA na naghandle ng account ko talagang hindi bumababa ng 280k pag installment na discounted na. Kahit alam kong lower 100k naman talaga principal or mas less pa kasi puro finance charges na lang. nakaka stress lang na gusto ko na magbayad, may konting budget, kaso walang magawa kasi hindi kaya ung offer nila.

  18. Sa bdo naman po ako nagkaron ng debt, and na-cancel na rin po yung cc ko sknila. Worth 20k umakyat 38k as in di ako makatulog dahil naka receive na po ako ng demand letter. I don't what to do po 😭 thank u po sa pagsagot.

    1. kung wala ka pang pambayad, eh di wala pa. there is nothing to do. i don't think, with this amount, kakasuhan ka ng bank. be prepared lang sa mga CA crooks. they will move mountains to force you to pay.

    3. Dati po nagkaron ako ng balance sa bdo, during pandemic. 35k yun balance tapos nagulat ako nag offer sila ng amnesty, 21k nalang pinabayaran sakin. Eh yun total ata ng na-swipe ko dun nasa 30k.

  19. Mga sir, my wife is a defaulter for 3yrs now. she is sick with mental disability due to pandemic. Can this collection agency still sue my wife? cause if this happens this might cause a big impact on her mental health. so far sinusunod ko lang po lahat ng nabasa ko dito pag tumatawag sila lagi ko sinasabi wala pambayad if dadalin sa court dun nalang kami makikiusap. ang original amount na debt nya is 400k nagulat kami kinukuha ng agency 1M+ na.

  22. Hello. I'm a first time defaulter. Due to financial issue for the past few months, hindi na po ako nakabayad ng monthly with BPI. Nagsend po ng email na ifull amount ko po yung one time offer na 24,400 which is half nung total outstanding balance ko however wala po akong ganong amount to settle it by tomorrow. I tried to negotiate sa mas mababang amount na kaya ko pero no response from them. This is from Constantino nand Associates Law Office. Any suggestions? Natatakot po ako na baka makasuhan ako.

    2. Sayang kung di masettle. Masisipag pa naman mga abogado ng BPI baka patulan pa yang default mo dalhin sa small claims. Pero kung wala talaga wala naman sila magagawa.

    3. I was able to settle the amount that the agency offered to me. I went to BPI branch to confirm the legitimacy of this agency para na rin mawala doubt ko. I said to them na I'm planning to settle the full payment pero hulugan, pero sabi nung nakausap ko, wala na rin silbi kung mag aattempt kang hulugan hanggang sa makumpleto kasi nakablock na yung card. Ones nakablock, hindi na talaga magagamit even if nasettle full amount. Then sabi pa, ones nag issue sila ng Certificate of Full payment, that's the time na confirmed yung deactivated account.
      And yes, kapag nahand over na yung issue mo sa agency, labas na BPI or other banks. Replenish ng account/name mo para makapag apply ka ulit for credit cards etc might take 6mons to 1yr as per BPI. Possible na makita ng ibang banks yung naging issue pero wala pa rin naman masama magtry sa pag apply ulit. Atleast nakabayad na ko and masasabi kong sobrang relief talaga. Hindi man same sa iba naging ssue ko, ayoko lang talaga lumala pa at lumaki debt ko sa bank. At the end of the day, you still need to pay them kasi in the 1st place, napakinabangan mo rin sila.

    Nag apply ako IDRP and RCBC, my lead bank initiated the process. Pero nung binabasa ko na yung terms and conditions napaisip ako na parang hindi sya feasible for me right now with the huge amount that I need to settle monthly, the commitment and with the financial challenges I'm going through. My cc debt ballooned up 2m for my 11 cards. Nabasa ko po lahat ng sinasbai dito and I plan to improve my situation in the next 2-3 years. I know that I have to deal with collection calls and letters and the usual pang gigipit. Is that something that I could do to just ignore everything for now and accept that collection agencies will hound me, work on my self and my income and reconsider idrp or pay my debts one by one later on when I'm able?

    I'm not seeking for scrutiny, but I'd appreciate insights frm those who've been through something similar. Should I be worried about someone coming to our house? I prefer not to disclose my situation to my family. I'm confident that I can do this alone. I just need time to bounce back.

    1. most of us think that IDRP is not a better option, as this is just a huge trap. debt consolidation nga, so all banks will run after you once you won't be able to sustain the amortization. interestingly though, it would be hard for you to get approved given the financial capacity requirements. after all, nag default ka nga, which meant di mo kinaya ang pag sustain sa card payments.

      I have been a defaulter for almost four years now. Nothing worst has happened to me so far. From all the diskartes dito, I have managed so far the CA crooks. You will survive the crooks as long as you don't lose your common sense. The most difficult hurdle is to tame yourself and learn the right diskartes. Believe me, you will survive this. Read, backread, learn.

    2. As someone who was on default for almost 15 years, here are a couple of things I can tell you:

      - If you are not going to change numbers, they are going to hound you.
      - Even if they bother you, do not change numbers. I am advising this so they do not have to go to your place and work. This way you can receive any good offer to pay your debt.
      - In the same vein, tell everyone in your household to not just accept letters, especially those that require them to sign off after they ask if you still live in that place.
      - Consider paying these cards as a marathon, not a race. It will take time.
      - Unahin mo yung mga banks na mahilig magfile ng case pag ready ka na. While they cannot do anything if wala ka naman pambayad, it's good to avoid an actual court decision that empowers them to garnish your savings until you are completely paid.

      I defaulted in 2007 or 2008, then settled 2 cards in 2011, settled 1 card in 2014, then settled the rest except one in 2022.

      Even with debt, I was able to apply for a car loan at East West, the same card I defaulted and paid in 2011.

      I went from having a high risk to medium risk rating in 2023. Hopefully low risk by 2024.

      My tip is to be patient and do not be frustrated. It will take time.

    3. Approved sir ako but I said no nung nasa negotiation stage na since ayun nga super taas din pala which I cannot afford right now. Yes, I try to be on top of my mind as much as I could. I answer all the calls and recieve all the letters. But I always say the same thing to them na wala pa ko pambayad at this point of my life. Yes - thanks for the encouragement, I'll backread some more and apply all the diskarte!

  30. hello, im a silent reader. defaulter din po ako. kaso may existing car loan ako and loans pero ung mga quickloan ko is fully settled na and ung car loan ko naman is walang palya sa payment and balak ko sana mag apply for personal loan sa bank, ma ga-grant po kaya application ko i really need money lang kasi and i know na mali ang umutang but this is the only way i see. may mga na approved na po ba dito sa sa personal loan kahit defaulter? salamat sasagot

    3. matagal pa yun, depende sa legal counsel ng banks. ang na share dito between 1-2 years after sa writ execution. but don't wait for it. you can maintain bank accounts using names ng iba. Maya ang Gcash are safer, I believe.

  36. New defaulter po ako, na scam nagamit ng iba ung mga CC ko. Halos lahat ng bank tumatawag, CAs. Medyo malaki ung amount na default. Makakasuhan ba ako agad ng mga banks? Ano pwde kong gawin, stress, anxiety, deppresion ramdam ko na halos lahat. Si bpi matic minsan nawala pera sa deposit acct. Ung ibang abot na Million dahil sa interest.

Ngayon po kasi nag require na talaga mag register sa DTI and Bir. Sa tingin niyo po ba pag ginamit ko name ko sa registration, may kaso mailalaban sakin un mga CA’s? Or ipangalan ko na lang sa kapamilya ko un business?

Good Day po, call me Faith nalang po, hope ma post po, I am currently suffering deep depression,at nagkakasakit na rin po, anxiety attacks at na temp rin po to commit suicide due to my ccard problem, thank God I found this blog kakasearch, desperate makahanap nang ways how to deal w/ my situation w/o panghuhusga at makapag share narin po, I have 5 ccards, - rcbc w/cash loan-100k+ due to balcon(minimum pay nalang), maybank 15k+ (nababayaran po-restructured), PNB 100k+(minimum pay nalang) metro 200k+ (due to balcon) defaulted, that was about june 2023 same sa ewb 200k+, back in that time i was so deperate to settle begging them to accept my payment offer but it failed, nagtry pa ko IDRP, request nila co-maker due to insufficient income(ndi ko na po tinuloy). May mga tao rin pong nahingan ng advice regarding sa prob ko, iba-iba rin ang sinabi, pero may mga naka add up din po sa anxiety ko, like a kakilala po na dati nagwork sa banks credit dept telling me na baka makasuhan daw ako ng forgery asking bakit daw nakakuha ako mga ccards w/big credit limits 6 digits and 200k+ highest, dito po sa part na to:sometime in 2019 a ccard agent offer us sa work to apply for ccard asked to send two ID at Signature via fb msngr, bigla nalang po nagdatingan, maintain ko po nun ay Mybnk 20k at Metro(lumaki limit to 150k) for 10yrs na, sa recall ko po wala naman po akong send na forged docs, ID is authentic so as my signature and address(ndi ko naman po mareceived card if mali ung info). Ndi na sila nanghingi ng ITR, COE, payslips or proof of income wich is maprprovide ko namn po..they just call lang po for some infos. Maliit lang po ang sahod ko walang pong 20k+ and may mga side hustles po for add income. ask ko lang po paano pong forged? diba po may CI naman sila bago ma aapprove?..what if pinorged or falsify po nang ccard agent ung ibang docs para maapprove, liable po ba ko nun even though my only knowledge is nag apply lang ng ccard, if ever ginawa po nila? And dahil din po sa desipiration I took a free consultation of a lawyer in fb, addressing my sitaution, sabi nya though civil in nature ang debts pero sa laki nang default pedi daw po trabahuhin sa criminal case?. Sa kakilala naman po namin police possible daw po may kulong kasi parang rule out na scam daw po?, at dahil may cash din daw po ako na-obtain? this statement puts me in this state of deppresion and still battling it.

    Back then maayos naman po nang lahat, until pandemic strike, almost 2 years walang work at income, nawala rin po mga side hustles ko lahat po kami sa family nagka CoVID, nawalan ng means to support my family, nag resort from using ccards to sustain our needs, ung mga nakiride sa akin ndi na nakabayad some gone and some didn't complete their payments, na fall sa never ending na pangungutang at pagbabayad nang utang sa tao, sa lending,sa ccard nagpatong patong na.

    Sa ngaun po as per sa ibang nakausap ko, change ko po muna num ko due to unsolicited calls at msgs pananakot ng nang court cases at barangay mediations, tinago ko po old sim para kung may pangsettle na po or ready na to deal with them ay ibabalik ko po, even though i know it will take years pa makabangon :( ..sa work nakisuyo nalang po sa guard not to accept anything na iiwan or ipapa recieve na letter same sa home.. may email are still active but due to anxiety and deppresion ndi ko pa po kayang buksan..same home address parin.

    1. I felt the same way before ako nag default and during the first year in 2020. most of us, ganito talaga ang experience. what helped me was educating myself with the right knowledge and diskartes.

      mga maling payo nakuha mo sa mga taong nakausap mo. (1) walang fraud sa pagkuha mo sa credit card. ang agents ang nag process sayo using the information you provided. (2) kahit 100M pa utang mo sa credit cards, civil case pa rin yun at di criminal case. kung tutuusin, maliit pa nga ang total ng buong default mo. (3) using your issued credit cards to obtain cash is never a basis na nag scam ka. Maling mga tao ang tinanong mo.

      kung hirap pa talaga, hayaan mo muna. ibat ibang diskarte ang pag manage sa CA crooks. lahat ng pangungulit, scare tactics, at ano ano pa, gagawin yan nila. huwag ka magpa apekto muna. kung kaya mo na, you can take their calls and respond to their emails, and tell them na you will connect with them once you have the means to settle. and if all fails, use banker's ultimate bluff, "sue me in court, as it is always formal, legal and fair." kahit matalo ka pa, at wala ka pa ring pambayad, no worries.

      di naman natin ginusto na ma default tayo. there were many circumstances that led us to this. and much as have wanted to settle now, we also do not have the means to do it.

      as I always say, relax lang, chill and pray na rin. accept your situation now para mas madali sayo. focus on your priority needs and to recover. utang lang to. this is not the end of the world. we are way better than our debts.

    4. Kaya sila dumidirekta sa employer dahil tinatakot ka nila pero di na nila magawang sabihin sa employer mo na may utang ka kasi bawal yun sa privacy laws baka malasin sila sa mga alagad ng batas kapag nagreklamo ka.

  48. Hi, regarding sa garnishment if may money / payroll ka under your name kaya bang habulin ng bank un kahit hindi same bank ng defaulted account. How about yung sa husband mo po?

    1. maraming info na about this. mangyari yun pag may writ of garnishment na. your husband's accounts will only be at risk if masama siya sa kaso. as to the question if likely masama ba ang husband / partner sa kaso, sinagot na to dati ni banker na hindi. pero may na share na cases na ang iba nasama rin.

  49. One year na akong defaulter at malaki naitulong ng blog na ito na bukod sa panalangin na mawala kaba ko sa araw araw dahil sa malaking utang ko sa cc. Four credit cards ang pinag kakautangan ko metrobank, bdo, at eastwest. Nagpapadala sila ng letter sa bahay at office, tumatawag din sa cell ko at pag minsan pag hindi nasasagot pati sa office . Ngayon lang may nakausap ako na credit collector at minamadali pa ako maki pag settle . Parang pinalalabas nya na kakasuhan na ako at Kailagan maki pag deal ako sa kanila. Alam ko na na tactics nila yan para mataranta mga defaulter. Sabi ko kung papayag ang bangko ang kaya ko lang bayaran sa isang buwan ay 3k, which is iniisip ko kasi na hindi papayag ang metrobank dahil nag offer sila ng one time payment na 750,000. Malaki na utang ko umabot na ng 1.2M dahil s penalties. Pinaghintay ako sandali tapos ok daw bayaran ko 3k for one year tapos taasan daw sa susunod na taon. Pero sa kwenta pa rin ng 1.2M. sabi ko hindi ako papayag dahil alam ko na sa kanila lang mapupunta yung 3k a month. Hindi ko talaga kaya magbayad ng malaki. Kailangan maki pag deal ako dahil hanggang 4pm lang daw at mare report na ako. Sabi ko sige gawin mo na report , hindi hanggang 3k a month lang ako at hanggang sa matapos at kailangan on paper. Sorry ang haba na.

    1. general rule - pag hindi kaya isustain ang payment arrangements, never enter into it. itong offer na patingi ting is a huge scam, sayang lang konting pera mo. tell them na magbayad ka if maka recover na.

  50. may experience po ba rito na naka tanggap ng summon sa small claims? pa share naman po, may natanggap po kasi akong summon sa lending coop ng sangla atm ko ( deped payroll ) yes isa po akong nalugmok sa utang na guro kaya nasangla atm january 25 2024 po yong schedule sa akin, nasa kanila ung atm ko na lock ko lng po sa mobile apps kaya hindi sila maka withdarw. makuha ko kaya ung atm ko f ever may agreement na kami gusto ko kasi tru gcash n lng ang payment, sana may makapg share ng experience,, update ko po kayo kung ano mangyari sa jan 25 2024

    3. Kung aattend ka hanapan mo ng authorization and updated statement of account dapat indicated doon kung paano sila naglagay ng penalties. Ask them kung amenable ba sila sa compromise terms KUNG may pambayad ka and amenable naman go for it. Kung wala talagang pambayad pwede ka din naman nang di umattend.

  51. Hi po sa lahat! 1 year anniversary na po akong nag-default at unti unting nakakasanayan ko na po maging madiskarteng defaulter dahil po sa page na ito. Maraming salamat po sa mga admin, dahil sa mga nabasa ko dito sa page na ito alam ko ang tamang diskarte at di ako nascam ng mga kolektor. Alam kong malayo layo pang lakbayin pero salamat po mga ka-diskarte tuloy po ang buhay. God bless po sa ating lahat.

    1. Kung ang ibig sabihin nyo po ng nagpa-ride eh pinagamit mo ang card mo sa iba, hindi bawal yun.

      Ang problema dahil sayo naka-pangalan ang card, ikaw ang may utang, hindi yung nakigamit.

  55. 2013 to 2014 nasimulan ako nadefault then now after 10 years nabago na naman CA dati si Molaer eh... Ask ko lang aabot b tlg ng 10 yrs bago sila magfile ng case sa court? RCBC card ko nun ata alam ko 20k lng na max ko noon.. Nagstart na naman sila mag email pati sa email ng offce

  56. My experience is that the more you talk to them, the more they will contact you. If you don't entertain their calls, the less they will contact you. But if you are in the mood to argue with them, tell them you will only entertain them if they can provide you 2 conditions: 1) power of attorney for them to enter into negotiations (must have your specific name on the power of atty); 2) provide you all the signed vouchers (charge slips) you have signed and it must reconcile with the amount they claim you owe them. However, by asking them those documents, implicitly, you admit that you are a deliquent cardholder of the said bank. Another way to do it is to just deny that you had such a credit card and let them prove to you that it was your are the credit card holder. There is a dictum in law: "he who claims must prove."

    1. if it is the same bank na may default ka, YES. nasa fine print ng terms and conditions yan. when we concurred to it, we gave the bank the right to do automatic offset. nadala ako nyan at early stage of being a defaulter. four banks, though maliliit lang.

    2. I pity the late comer-defaulters. These "problems" were addressed several times already and are very simple to solve.
      For sensitive issues and concerns, I even tried to talk to them personally but after mentioning the yumburgers, they simply disappear! maybe just one of my failures. lol!

  58. I’m really stressed from overthinking po. May case na po ba na real properties yung na gagarnish ng sheriff? My parents just passed away and yung bahay namin sa akin na naka pangalan. Too scared na mawala ito because ito nalang yung naiwan nila sa akin.

    1. Wala pa ko nababasa dito an ang property na-garnish.

      Pero sa palagay ko, magiging issue lang yan kung ang utang mo ay equal na ng property mo. Di ka naman nila susuklian kung mas malaki ang value ng property mo sa utang mo.

    3. to begin with, wala pang nag share ng property garnishment. hassle on the side ng bank yun, especially pag may bayaran pa sila sayo. priority ng bank is to look for your bank accounts.

      by law, exempted ang house for garnishment especially for non-secured loans.

      pag complicated and hassle sa banks to garnish home properties under your name na, moreso ang not yet fully paid na home loan sa pag-ibig and other banks. naka emcumbrance pa ang mga yon.

      in my case, binenta ko na ang bahay namin nung 2021 pa. wala kaming properties under our name, pati ang sasakyan na gamit namin, di sa amin.

    4. one more thing - being defaulters, our worst enemy is ourselves. we tend to entertain unreal possibilities. it is feeding into our fears and killing our common sense.

      we should never allow to lose our common sense. it is our ultimate defense, diskarte to counter the hunghang CA crooks. defaulter na nga tayo, di tayo magpakatanga. 😊

      overthinking destroys us. maintaining our common sense keeps us live our normal lives.
