Yes, and most banks do. But in many instances it is better that way. The courts are always formal, legal and fair. The banks will assess if it is worth filing the case. Kung may makuha pa sila sayo, then definitely they will file. kung wala, there is no point.

Nag aantay nalang talaga ako dun sa letter ng garnish.. kasi yun po yung nababasa ko dito dati na After decision garnish na yung kasunod. Actually ang laki talaga ng tulong nitong blog sakin na maging buhay normal kahit defaulter. Kaso ngayon po bumalik nanaman yung kaba ko. Kasi yung mother ko hindi nya tinanggap yung letter galing korte po ata yun. Bali pangalawang letter na ang dumating sa bahay po nila, parehong di nya tinanggap at sinabi nya di na ako dun nakatira... Dun po kasi naka address yung bpi ko. My decision na po ako ng korte nung march 2021 pa po.. hindi din po ako umatend ng mga hearing.. bali yung inaantay ko nalang yung letter sana na mag gagarnish na sila. Kaya ang kinababahala ko po yung hindi pagtanggap ng letter na dumating dun s bahay ng parents ko. Twice na daw kasi yun hindi nya tinanggap. Yung huling letter tinanong daw nya sa delivery man kung ano ba daw yun. Ang sabi daw subponea. Possible po kaya yun na magkaso na sila agad ng ganun. Diba po hindi na civil case yun kung my subpoena na. Kaya kinakabahan po ako. Baka iniisip nila tinakbuhan ko na yung utang ko after decision ng korte. ReplyDeleteWala po akong ibang.cc. Bpi lang po ang meron ako at mga 13yrs kung gamit bago ako na default. Nagsara kasi yung business namin tapos sunod sunod ang problema kaya nalubog kami sa utang. Pag my decison na po ba hindi na sila magkakaso pa ng iba. Maniningil nalang po talaga? Na stress po kasi ako dun pag naiisip ko yung sinabi ng nagdala ng sulat na subpoena daw yung letter, yung kaba ko po sobra.
Delete@Yuichi when they file a case and eventually win they will hunt for assets. Based on posted experiences here they look for money in banks. But theres always that possibility they could go after other properties. Talk to BPI baka kaya pa magawan ng paraan. Goodluck.

Btw, I am a defaulter of 3 CCs (my 1st CC was not yet settled di ko pa sila kinakausap, 2nd CC- on going na; my 3rd - paid, well binawas sa account ko) Anyways, para dun sa nabasa ko na nagtatanong if pwede mag apply ng another CC with different bank, based on my experience po ito nag apply ako even I have defaulted CC na and approved naman.
ReplyDeleteMy experience, nakakareceived din po ako ng demand letters but I chose to ignore based sa mga payo dito, yun ibang letters nga napunit ko na ng hindi binubuksan, May nagpunta daw sa bahay dati hinahanap ako I dont know if CA to but kapitbahay ang nakausap, di ko na inalam kung anong na disclose, di rin naman kinuwento ng kapitbahay, still as of today close pa din naman kami with our kapitbahay. And even I am a CC defaulter, I was approved with the car loan - in house financing under my name, need ni Parents but hindi na approved under ng name nila. Also, Nakakalabas pa naman ako ng ibang bansa as a tourist.

Pa help naman po. Kahapon ko lang nabasa yung email. Tumawag po ako Kay atty cayetano and he said na Meron nga pong civil case at yung babayaran ay nasa 400k daw po. He also read po yung papers as to why my civil case ako (change of address without informing the bank daw po - nag dodorm po kasi ako Kaya papalit palit po) Pero Ang alam ko po nasa 200k po yung nasa statement of accnt. Yung nadagda daw po kasi is bayad Nya as atty. if mag settle daw po ako hnd na daw po Nya papabayaran pamasko na lang daw po Nya sakin. I ask po if anong pwede na solution para hnd na mag punta pa sa province (where the writ of execution will be held) dahil nasa Manila po ako at yung parents ko lng yung nasa province. Ang sabi po Nya bayaran ko daw po yung 200k sa secbank then sya na daw po bahala mag counter ng case. Sinabi dn po Nya sakin na if wala ako sa province mag tuloy Ang case and worst hnd na ako makaka kuha ng NBI clearance and mag ka hold departure if balak ko po mag abroad.

Year 2021 nag open po ako ng savings acct. sa rcbc and made me as hexagon club member. Recently I received a call from CA GCSS& Assoc. intimidating po si CA and telling me na bat wala pa daw ako pambayad eh may trabaho naman daw po ako. Sabi ko naman sakto lang ung sinasahod ko sa pangangailangan ng pamilya ko as a breadwinner. And she’s telling me na demandable na daw ung case ko kaya maghintay nalang daw ako ng demand letter. As of writing today may na received na letter from law firm ung ka work ko kasi dun po pala pinadala and they received the letter with my consent. Now po, i dont know what’s inside the letter.

DeleteMeron po akong default credit card sa Eastwest bank pero hindi ko po mabayaran kasi nagka cancer po ako. Hindi ko narin po nasasagot yun tawag ng CAs kasi wala naman po ako pambayad. Nagpadala na po sila ng mga messages na magpapadala sila ng officials ng barangay. Sinagot ko po yun isang text na may due process po before mag occular ng property. Tama naman po sinagot ko? Kasi kahit meron na po akong mga medical certificates ng sakit ko, grabe parin sila mang harass.

Sa ngayon po wala pa po talaga ako pambayad. Should I ignore the calls, texts and emails? or better na sumagot ako and tell them na wala pa akong pambayad.

Sobrang kulet ni telan law office CA ni rcbc everyday walang palya ang tawag sa office to the point na iirita na ang receptionist namin sobrang aggresive din maningil ng kausap ko. right now talaga struggling pa ako financially and short pa talaga sa funds. I’m expecting I can get back on track mga march pa talaga, ang worried ko lng by that time sobrang laki na ng interest and penalty fees not to mention ang sobrang kulet na CA’s. Please help naman po whats the best way to deal with them, naka try na po kayo magpa waive ng interest? Gusto ko po talaga makabayad at masalba ang ibang cards.

DeleteHello po, ask ko lang po kasi may nareceived na call ung barangay samin Police daw po named Roberto Medina at nagpapaassist po for property garnishment under sa name ko para bukas pero hindi naman sinabi anong company and ung number na binigay sa barangay unattended naman lagi at wala naman po ako narereceive na letter or demand letter prior this.
ReplyDeletenadali na naman barangay nyo. next time pag mag inform ang barangay, sabihan mo na naglipala ang scammers ngayon. pag walang documents, automatic scam yan. kahit sino pwedeng gawin yan at ipadampot si kapitan nyo. 😂 old scare tactic ng hunghang na kolektor yan. it is your right to educate your barangay officials of the right way. back read ka na rin. maraming na share na on this dito.

ReplyDeletequestion lang po.. since 2011 pa po ako defaulter ng MBC and wala nman po nrinig from them since then tpos ngaun SP is calling me.. not sure pano nila nakuha number. Can i just let it go.. wala na po plan na bayaran? but i've learned the lesson nman po.
