There's an excerpt on the RCBC blog post that reads, "If you’re worried they’ll seize your house and evict your family, the Family Code and Commonwealth Act No. 141 prevents this from happening. The bank can’t claim your family home, no matter your outstanding debt."

Even RCBC knows and acknowledges the limitations of debt collection on their blogs.

  3. Hello po, magandang araw po sa lahat. Magtatanong lang po sana kung gaano kaya katagal o kabilis ang pag garnish sa bank account. Today po kasi nakareceived ako ng registered mail galing sa MTC may desicion napo ang court. Nademanda po kasi ako ng Robinsons bank. Default amount is 97k ung desicion po is 150k. Dapat e173k. Kasi mayactive card pa po ako at binayaran ko po iyon ng 400k kasi umaasa po ako na maloan ko po ulet kaso nawala napo ang madness. Inuna ko bayaran kasi po ang min amount due ko na po sa 375k is nasa 13 to 14k na halos nawawala sakin monthly. Kaya inisip ko po para ung min amount na dati e papasok na sa principal once maloan ko po. May pwese pa nman po ako mlaoan kaso un po yung credit limit nalang ang pinag aalala ko lang po e baka pagpumasok ung loan credit to cash magarnish lang po. Patulong naman po kung ano po maganda gawin ko po.. ano po kaya sa palagay nyo po ang best thing na gawin? Napakabilis ni Robinson magdemanda ang liit lang naman po ng credit limit.😔 Salamat po sa nyo..kung di dahil sa diskarte malamang nasiraan napo ko ng bait nung kasagsagan ng pandemic sa narereceived ko na demand letter. Sobrang laki po ng tulong nyo para marelax ako at makatulog sa gabi.

    1. the pace of garnishment is dependent sa lawyer ng bank. typically, within two years mostly. pero huwag mo na antayin yun. as early as this time, huwag na magtambay ng pera sa banks, if ever meron man. pag salary, withdraw agad.

      tama ka - interesting si Robinsons. Kahit maliit, pinapatulan. i have two accounts sa kanila. defaulted for more than 3 years, at mas malaki pa sa amounts mo. waiting for case filing ako, if ever. hehehe.

      but then again, pag wala kang pera, eh di wala rin silang makukuha sayo.

      In my case, my mother and brother opened an account under their name and yun ang ginamit ko for 7 years.

      And yes, nasa 2 or 3 years ang pace ng garnishment proceedings.

    3. Napakabilis nga po nga desisyon Sir, Nov nagpunta dito messenger nagdala ng makapal na papel tapos nakalagay duon Nov 9. ung hearing, according po sa nagdemanda pangalawang hearing nadaw po. Hindi ako nag attend po nuong hearing ng Nov 9. Pero kinontak ko po sila ang sabi nila hindi daw po nagbibigay ng malaking discount si Robinsons ,since wala pa po ako pambayad kasi may sinesettle po ako na mga bayarin sa tao na nakuha namin nung pandemic pa ayaw ko po masira pangalan ko sa nagkaluwag samin. Usapan namin po ni hubby bayaran namin paisa isa ung mga cc once bayad na sa mga tao kaso napakabilis kumilos ng robinsons bank. Ito papo pinakamaliit na credit limit ko. Di ko inaakala na sila pa magdemanda. Salamat po sa advice Sir.

    4. Nag open po ng account ung dalawang anak ko isang 13 yrs old and 10 yrs old may atm sila so need ng signature ko po. Ito po kaya ay safe sa garnishment? One time garnishment lang po kaya? Natatakot ako na sa bilis ng kaso e bka mahold na mga bank account ko po. Magagamit ko pa din po kaya ito o nakahold na?

  6. Good day po sa inyong lahat , matagal napo ako defaulter ng 4 cards po at silent reader po ako dito. Ara po nickname ko Puro cash loan po ang nakuha ko sa apat na card ko ang pinakamalaki po is ung metrobank. Pwede ko po ba malaman cp # kung sino po pwede ko makausap please po until now bigla na naman ako inatake ng anxiety at stress ko po. May mga question lng po ako pls... Hi po may itatanung lang po may sinend sakin si bdo last few days regarding sa walang payment sa bdo for 3 years since pandemic at nagchange ako ng cp number and wala ako sa residence na niregister ko kc nasa province pa ako since pandemic pero by next year babalik na po ako sa residence na nakaregister sa bank tingin nyo po once na nakabalik ako sa residence ko pupunta kaya sila kc may sulat sila na email sakin sa bdo legal affairs mismo natatakot ako baka pumunta talaga sila sa bahay

Paadvice nmn po defaulted ako sa ibat iBang banks ung iba mag 2 years na latest lang cna pnb bdo at bpi may times na sa 1 araw10-15 missed calls ako may times nmn ndi nagpaparamdam Ang mga CA once in a while sumasagot nmn ako sa mga calls nla knina sumagot ako CA ng pnb bungad plang alam Kong ihaharass nako kc mataray ung boses some CA kc is mababait nmn kpg cnbi mo na Wla kpa ibabayad sasabhan ka lang cge mam tawagan nlng Kita ulit pero ung nakausap ko knina pinipilit ako pumasok sa installment program ndi ko daw pwedi ireason out na wala pako ibbyad kc nga ginamit ko daw Yung card nung cnbi ko na magfile nlng cla sa court sobrang nagalit ipapatwag daw Nia ako sa brgy wala tlga ako sa mood knina Kya nasagot sagot ko ung ca..tanong ko lang po kung may nkaexperinced na dto na knharap c CA sa brgy niu?

  14. Share ko lang po para sa mga kapwa ko debters yung wins ko 2022-2023 when it comes to credit card debts. Meron po akong 100k kay eastwest including all charges na and na nasettle ko last dec 2022. Meron po ako kay metrobank na 300k plus and nasettle ko ng 108k na lang this dec 2023 both po nag offer ng amnesty kay naigrab ko na, ang nangyari po kasi yung SP Madrid po na collections naging firm po ako na sa email lang makikipag usap sa kanila para kako documented at the same time sinasabi ko po talaga na nag eemail ako mismo sa bangko para magtanong kuing meron silang amnesty offer at pag kaya ko magbabayd ako. totoo po yun pero lagi pong walang offer si metrobank at laging sinasabi na affiliated sila sa SP Madrid. Hanggang sa wala pong mapala sa akin ang SP Madrid dahil lagi kong sinasabi na sa bangko ako makikipag usap pag makakabayad na ako. That time sinisingil pa nila ako ng 275k. Hindi ko gnrab. Hanggang this October, nakakuha sila ng way para kontakin ung kaibigan ko, hindi ko alam paano nila nakuha ang contact number kaya ingat kayo dahil pwedeng sa fb nila nakkuha ang impormasyon kung naka tag kayo or what, magaling sila humalungkat. Tapos ang ginawa ko nag complaint ako thru email at naka send sa sp madrid, sa metrobank, sa nbi cybercrime at bsp. Sabi ko don, I have documents expressing my desire to pay. Pero wala pa ako pambayad sa hinihingi nila sa ngayon pero I am firm that I will pay when able. Hindi nila kako pwdeng gawin na kumontak sila ng kahit na sino na walang kinalaman sa utang ko. Ang nangyari after that, si Metrobank na po ang kumontak sa akin from there, nag offer sila ng amnesty from 300k to 108k na lang. Isa po ako sa mga nag susulat dito lagi asking kung paano pag ganto paano pag ganyan, umabot pa po na kinontak ang brgy captain namin at pinuntahan pa ako sa bahay. Isa po ako sa mga halos suicidal na dito. Pero dahil sa blog na to may nakapitan ako ng lakas ng loob. Napakarami nyo pong natulungan gaya ko , kaya sana itong story ko may matulungan din kahit paano. Cheers to debt free 2024!! Mabuhay po kayo!

    1. Hi, thank you for sharing. Same tayo na settle ko na si Eastwest. Pero si Metrobank hindi pa, 2 cards ko sa kanila. Ung 300k mo ba principal or kasama mga finance charges?

      Nakipag negotiate ako sana na ung one time payment na gusto nila kung pwede yun ung installment, kaso wala pa na contact ulit sa akin.

      Saan email ka nila nagsend sa MB? Thank you in advance.

    5. Hi Kinakape, around 2 years po bago masettle. Pandemic ako nadefault, 2022 ako nakapag pay. Monthly may promo silang na email. Share ko lang din nung tumawag ang CA at nagsabi ng amount and deadline, tumawag ako sa main office nagpa extend ako na gawing 1 month para maipon ko ung amount. Pumayag naman, tapos may isang taga bank officer akong naka cc sa email ng CA, from bank din ako nag email sa contact person para sa Cert of Full Payment.

  17. Hello po, baka po may makapag share na nakapag settle na ng Security Bank kahit installment. Na default ako mag 4 years na. Kaso hindi ko kaya one time payment tapos kapag installment naman mas malaki pa amount kasi magbased sa default amount plus interest and charges. Thank you.

      Ilan years po bago sila nag case sayo? Ung last SOA ko po nasa 290k kasama finance charges na halos 8k per month. Kaya yan po sinasabi nilang principal. Ung CA na assign sa account ko ang sabi 400k payable ng 2 years. Pero may downpayment tapos subject for approval. Mas okay po kaya na sa bank tumawag? Baka kasi ibalik din ako sa CA. Kapag hintayin ko na lang ung sa small claims, mas okay po ba or andun pa rin ung malaking charges?

Hi po ilang years po kayo defaulted sa SB bago sila nag file? almost 3 years na po ako defaulted sa kanila and kinukulit ako ni SP na pumayag sa 36 months kaso ayoko mag commit medyo di ko kasi kaya yung monthly na gusto nila mas prio ko ang needs ng parents ko and my ongoing installment pa ako sa hsbc hoping na matapos kahit pa isa isa lang muna. And how much po defaulted niyo sa kanila?

      Nagfile ng case sakin ang Security Bank less than 2 years after I defaulted.

      Nasa 140k ang balance ko and we settled at 125 if tama pagka-alala ko. 24 months starting March 2019 pero lumagpas ng umabot ng 2022.

      Pwede nyo naman antayin magfile ng case kaya lang baka mas mataas na ang amount na pag-uusapan nyo.

      Kahit naman sa bank kayo pumunta, ibabalik nila kayo sa Collections Agency. Kung wala pa talaga pambayad, wala naman kayo magagawa and wala din naman sila magagawa.

  18. Defaulter po ako s unionbank ung payroll namin under the same bank, pumasok po ung sahod at 13thmonth pay ko d ko agad na withdraw kc hanggang 20k lang hinayaan ko muna sa acct. Naka received ako ng email na kukunin nila ung balance sa acct ko ngayon ko lang nabasa pag check ko wala na yung pera 😭 pag nakipag usap po na ako ano possible n mangyayari? Pls advise po... Mag papasko walang wala kami 😭😭😭

    1. Kukunin at kukunin yan ng bank until mabayaran ng buo.

      Kausapin mo ang office mo. Ask them to issue you a check instead of depositing cash on your payroll.

    2. Offsetting is in your terms of agreement. You can call the bank but I highly doubt that they'll credit the money back. Lesson learned na lang talaga.

    3. garnishment of salaries is not sanctioned by law in fact, there is a prohibition to that effect on the ground of public policy; (3) that even if salary is subject to garnishment, it becomes effective only if it is in excess for the needs of petitioner and family.

      Sadly, most defaulters tend to "withdraw" their petitions for certiorari once banks "apologizes" hence, pa-balik balik ang problems due to lack of subsequent jurisprudence

    4. nakausap ko na po ang HR namin, unfortunately hawak ng 3rd party vendor payroll namin kaya wala silang control lalo na personal loan daw... Tumawag na po ako sa UB sabi nila d n daw mababalik ung pera at ma o off set n talaga lahat ng pera.papasok s acct. Natatakot po ako mag commit solo parent po ako baka lalo lang ako malubog. 😥

    5. Meron akong past due loan din with union bank before ginagawa ko withdraw ko agad pgpasok ng sweldo naka abang ako pwede mo ma increase ang withdrawable amount mo or mas maganda online transfer mo na agad.

  19. A CA email this after I answered them that I cant commit for the installment na binigay nila. Di ko masi talaga kaya ang 6k per month.
    parang naiiyak ako sa email niya. since defaulted ako sa kanila nag aask na ako ng mahabang installment kaso di lagi pwede sagot nila.

    Hanggang kailan ka hihintayin ng bangko? Bakit parang banko pa ang nakikiusap na magsettle ka ng account mo. Gusto lang ng bank na maibalik mo ang nahiram mo sa kanila.

Hello po Sir Brian nung nag attempt po ba kayo mkpg negotiate kay BPI pwede ko po malaman ang amount na pinapa settle nila? and if nag email po ba kayo o tumawag? parang anghirap kase mkpg negotiate sa kanila kase yung nasa writ ko 3.5% per month and judgement parang ayaw na tlaga nila ako pgbayarin sa sobrang pgco cumpute ko if parang bago ako mkpg ipon baka hndi narin sufficient.. stress na naman ako

  20. I'm on the brink of defaulting 4 of my cards. 2 of which is Unionbank, may Citi din ako pero gusto ko sana keep. Kaso under one bank na lang sila, damay na din yung Citi once madefault yung UB no? Gusto ko din sana malaman pano kapag may civil claims na and judgment at di pa din talaga makakabayad? Ano ang mangyayari sakin? Thank you.

  21. @anon wala po mangyayari sau. Meron dn ako ub 23k citi 40k. Pina2ngan nila ng charges madami. Pay ko sana one time payment pero sa kaya ko e pay pero ayaw nila kasi malaki gus2 makuha ni collection. Antayin ko ma aprove. Pinalaki pa nila kasi maliit palang.

Hi jitters yup deducted yun agad sa savings account na naka indicate sa terms based from my experienced ma modify mo lang siya if mas early pumasok sa schedule of payment mo for example every 5th of the month ang due mo if may ppasok before that date pwede mo pa ma withdraw meron ding case na example every 11AM sila ngauto deduct then ngka system error yun ma uunahan mo pa sila mg transfer then if past due amount namn sample lapse kana sa payment contract mkkipg unahan kana sa kanila ako before na full paid inuunahan ko sila sa pg transfer pero within my loan terms pgka pasok na pgka pasok ng payroll ko auto deduct agad sa past due, system error and early credit of money lang applicable na mauunahan mo sila hope this helps

Hello po Sir @BrianSureWood nung nag attempt po ba kayo mkpg negotiate kay BPI pwede ko po malaman ang amount na pinapa settle nila? and if nag email po ba kayo o tumawag? parang anghirap kase mkpg negotiate sa kanila kase yung nasa writ ko 3.5% per month and judgement parang ayaw na tlaga nila ako pgbayarin sa sobrang pgco cumpute ko if parang bago ako mkpg ipon baka hndi narin sufficient.. stress na naman ako

    5. Hi, I also have a quick cash loan from union bank. Pag ibig loyalty card din po siya naka link, but I have a Unib payroll within the same online banking. over 2 mos na po ako delay sa payment. I plan on paying for sana nxt month pa. feb 15 madededuct kaya siya sa payroll account ko?

  27. Hi po! Magtatanong lang po ako I am a RCBC defaulter since 2020, nagstart po ako ma default because of hospitalization bills.. from the start goodpayer naman po ako. Year 2021 nag open po ako ng savings acct. sa rcbc and made me as hexagon club member. Recently I received a call from CA GCSS& Assoc. intimidating po si CA and telling me na bat wala pa daw ako pambayad eh may trabaho naman daw po ako. Sabi ko naman sakto lang ung sinasahod ko sa pangangailangan ng pamilya ko as a breadwinner. And she’s telling me na demandable na daw ung case ko kaya maghintay nalang daw ako ng demand letter. As of writing today may na received na letter from law firm ung ka work ko kasi dun po pala pinadala and they received the letter with my consent. Now po, i dont know what’s inside the letter.
    If madedemanda po ako, makukuha po ba nila ung mga property na merun po ako? For example po merun po ako sasakyan and this coming march is fully paid na po ito. Do they have the rights to seized it po? Hope matulungan nyo po ako. Maraming Salamat po.

  31. But your default is still manageable. Try to negotiate directly with RCBC and see if you could come up with a payment plan that you could easily comply with. Pero kung di talaga kaya mag monthly payments, wag na muna.

Aside kasi sa cc which 2mos over na po ako delay meron din ako kay revi credit under cimb. ayan po ang nareciv ko thru email today. much better po ba na tawagan ko sila today? pero kasi hindi ko po kayang bayaran ang full amount. if ever naman po makkapag start pa ko ng payment ng feb 15 partially. ano po ang best kong gawin?
