PRISM BLUE WON IN THAT ILLEGAL GARNISHMENT NI BOBONG LANDBANK MANAGER DATED MARCH 3, 2022
-Si PRISM BLUE ay lumapit sa group na ito and asking some advice.
-Siya ay isang Public School Teacher at sa Land Bank Pumapasok ang kanyang salary.
-May default credit card siya sa BPI 100K(2014) but nung nademanda siya ay worth 500k na. Notorious si BPI sa pagdedemanda ng mga defaulter.
-Expected denemanda siya at si SP MADRID ang Collection Agency.
Court Decision: SALARY GARNISHMENT. Hinold ng LandBank ang sahod niya.
-In Normal cases, PAY WHEN ABLE. Magpapadala si Sheriff ng letter sa lahat ng banko para tignan kung may tinatago kang pera, ihold nila yun at igarnish. ONE TIME LANG YUN. Kung wala edi wala sabi nga namin dito JUST PAPER VICTORY. Kung meron igarnish nila kahit 10pesos laman niyan kukunin nila.
-Pero sa cased ni PrismBlue, hindi ganun. the decision is correct per Rule 39 of Rules of Court ; the IMPLEMENTATION/INTERPRETATION of Land Bank is WRONG.
-Lumapit siya sa PAO, ang sabi wala na daw magagawa kasi my court order na. Lumapit ulit siya sa ibang PAO nalift ng 4months ang garnishment pero after 4months ay hinold ulit ng landbank.
SO PAANO NIYA NAPANALO?
-Seek a private lawyer.
-Nagsulat siya PCC.. PRESIDENTIAL COMPLAINTS CENTER.
-Your lawyer can file for a "Certiorari" (a judicial review order by the Court of Appeals/Supreme Court)
....and after a long battle, HE WON. GARNISHMENT PROCESS NI LANDBANK AY ILLEGAL.
Is the Landbank Manager working in SP MADRID? Sabi niya sumunod lang siya lol
Pwede ba kasuhan ni PrismBlue si LandBank Manager? YES.
Pwede ba mangyari sa akin ito? DEPENDE KUNG BOBO yung manager. Marami na po nademanda dito ng mga banko pero one time lang ang garnishment sa kanila, yung iba nga wala pa. YANG case ni PrismBlue ay rare case. Sa tagal ko member dito, inabangan ko talaga yan kasi paano kung mangyari sa akin or sa iba, alam natin gagawin.
Lahat ba ng bank nagdedemanda? HINDI PO. IBA nga milyon utang sa MB at EWB walang nangyari, nakapag ibang bansa ang iba at iba nakaahon ulit.

How abount unionbank? Meron na po ba dito may experience na nademanda ni unionbank?

ReplyDeleteAko mag 3 years na sa October 2025 na default sa bdo, metrobank and eastwest. Pero napansin ko yung collection agency ng eastwest ang malupit. Tumawag sa office namin ng may warrant of arrest sa akin at padlock daw bahay namin sa barangay naman. Sa lists na nagkakaso pasok bdo ko. Pero siya pinakatahimik sa lahat ng mga collection agency. I don't know why. Maybe naghahanda para kasuhan ako he he, sana wag naman.

My Brother account in BPI got hold and had -50k.. Yes negative 50k ung payroll account nya because of the Garnishment received by BPI.. nalaman na lang nya un nung nareceive nya letter sa BPi abiut the Garnishment n nareceive nila..

DeleteHello po, ask ko na lang din if the same advice applies to OLAs? Si home credit kasi talagang frequent ang home visit and hindi ko alam kung hayaan na lang and sabihan sila na magdemanda nanlang sa small claims court at tigilan na kakapunta sa bahay.
ReplyDeleteMe sinasabi pa na irereport ako sa barangay. Do the barangay have jurisdiction or sila pa ang pwede ko ireklamo? Nakakaumay na din kasi yung home visits.
Given na po yung home visit huwag lang po iskandaluhin po kayo. Wala pong jurisdiction ang barangay sa mga kautangan po natin sa mga corporation.

ReplyDeleteSome collectors do. But like what banker and others advice here, ask them to sue you in court. Also you can make it harder by asking for their ID's, if they will give it. Take a picture of it if possible, then ask for statement of account (kase you need proof that they can legally collect from you, malay mo ba kung sino sila). Then ask them to sue you in court, mostly they will not. If they do and wala ka namang pera to garnish its false victory for them. We here made a mistake of falling into the debt trap but it doesn't warrant harassment from these banks. And debts prescribe after 10 years. Know your rights.

ReplyDeleteIt has been almost 2 years since I became delinquent. They are still pursuing to collect from me. I can attest na sobrang mabait si EWB dahil malaki ang discount offer. Kaya lang di ko pa rin sya kaya. Same with MB, 50%-60% ang discount. I also have RCBC, HSBC, Citibank/Unionbank. I read that RCBC and HSBC are notorious in filing case. Medyo napaisip na naman ako. Baka magfile na sila. Hindi naman millions ang debt ko sa kanila. I fully paid BDO just last week since nagbigay sila amnesty for 30k plus. 30k lang limit ko. I followed up for certificate of full payment pero wala pa daw. Haays!
Unti unti ko binababayaran lahat ng debts. I start from small. One down, many more to go. Kakayanin hanggat kaya. Nakasurvive sa depression. Nakahelp ang pagbabasa ng posts dito sa blogspot community. Minsan stressed pa rin talaga lalo pag nakakareceive ng emails or texts from collection agencies saying they will start to file a case. Iniisip ko na lang lagi na kahit magfile sila, wala naman akong pangfull payment, wala rin naman sila makokolekta. I focus on my day to day living. Life is short to worry too long on problems that you can’t control. However, I am not sure, if I have millions of debt, will the bank file a criminal case like what the collection agencies mentioned in their emails? or just a civil case and ano ang gagawin nila since wala akong property to garnish? Updated naman ang address ko and contact info. I’ll start reading again here baka may sagot. I would appreciate though kung may sumagot na sa mga tanong ko. 🙂

Anyone familiar sa Fastdeal Collection Management Inc, sila may hawak ng Metro account ko ngaun., Maganda sana yung discount nila from 200Kplus to 26K, di ko pa kaya bayaran, huminingi pa ko ng discount kahit sana gawing 15K kaso ayaw nila. although hindi naman lahat yung 200K na yun eh nagamit ko sa pagkkaalam ko eh nasa 50K lang yun dati., puro penalties and interest lang yung nadagdag. Notorious po ba si Fastdeal?
