  1. Hi. I received a summon from Makati RTC re: my BPI credit card nsa 460k including charges and interest. Nakalagay sa prayer 3.5% interest per month plus 700 per month plus atty's fee. I have these list of questions po sana matulungan nyo ko:

    1. Pwede ba ko sumagot dun sa summon kahit hindi kumuha nang lawyer? I'll just say na willing to pay nman kaso will need to recompute without the interest and charges pati ung 700 per month.
    2. Pag hindi ba ako sumagot automatic matutupad ung prayer nila o iaadjust na un nang court for me na 1% lang?
    3. May hinuhulugan pa kong Adventure (ginagamit nang asawa ko sa Grab) pwede ba nila un kunin kahit di pa fully paid?
    4. All my bank accounts were closed na, pero may mga e-wallets ako like Paypal and Gcash, will they get the money from there too?

    1. @Sebastian, hi as per my experience my sum of money case went to the rtc and need a lawyer but even if i hire the best lawyer in town same decision to pay back bpi (possible mapababa ang defaulted amount...)
      banker assured defaulters that banks will only ran after cash and bank deposits
      yes non-appearance sa hearing automatic na panalo si bank ( but what is new, mag-attend or hindi... ganun din naman ang mangyayari) so i might as well save my hard earned money
      again, no big deal

    3. @ Sebastian, sa decision court will order defendant to pay the bank at .5%/month or 6%/year (before in my time 1%/month or 12%/year from the date na-default ang account) but again pag walang pambayad like cash and bank accounts...eh di wala
      and this was further confirmed by the liaison officer of the c/a ( who happened to be our corporate lawyer) the least na nagawa nila was to look around for the defaulter's bank account and na-execute nila ang savings account ni defaulter
      -without you attending the hearing, bank's legal counsel will request court for summary judgment
      so court will render resolution in favor of bank with the filed amt., cost of lawsuit minimal ( as case considered not full blown)
      -i had the decided case with bpi in 2014, writ of execution in 2016 (early part of 2017 bank's legal counsel asking if am amenable with a discounted amt. for one time payment
      -para que...case been filed and decided upon and years ago i was asking them repayments na kaya ng budget and now halos interest/surcharges ang gusto nilang bayaran ko
      and paying them will not simply erase the sum of money case they've filed
      -and hey years ago, i made full payments like 200-300k...siguro time naman po for me to prioritize my retirement money
      pls. don't worry bout car you're amortizing for grab

  2. Hi i am jet po. Just want to ask papaano po kung loans recovery po ng Ewb tumawag at pag di raw nabayaran sa court na daw dadalhin. Ok lang po ba na ok lang at small claims pa din ang isagot sa kanila

    1. @jet, hi fyi no postings yet bout ewb filing for a case be it sa mtc or sa rtc
      and for sure si kotong-collector lang ang tumawag sa iyo and this kotong collector will also be the pulis-patola, attorney-no-case and name it and carry nila mag-impersonate
      -so chillax lang po

    2. hello, I have a defaulted account with EWB and puro collectors lang din ang nakikipag communicate. it has been 5 years already and if the bank really wants to sue you then sa umpisa pa lang eh nakatanggap ka na ng official notice from the courts and they would never announce it kung dedemanda ka or not. hope this helps.

    1. @don, hi as per my personal experience if bank is serious to file a case it will surely happen within the first 2 years of being in default ( ako nga within the first year lang...)
      -in absence of the final-never-ending demand letter; malamang natabunan lang yung account mo ng mas dumaraming defaulters
      -lalo na when you have defaulted like 3-4 years ago
      haven't encountered gccs ( just learn how to deal with them, and c/a's were trained to harass defaulters... so it's really asar-talo lang with them
      and sa totoo lang, no forever with the comedians and they will definitely not dwell on not so promising accounts...

  4. Hi ms cherrylou...bakit nawala n po un iba dati pang q and a. Mam cherry lou san ko po kau pwede pa email. Kung let say wala po ako work wala na din ari arian pano po mangyayati dun sa mga cr card def ko umabot n po kc sa million 1.2 halos n po me eatery po ako kya lang po napakahina..naghahanap pa po ako iba mapagkakakitaan kung swertehin naman po ako sa iba p negosyo or source of income willing naman po ako to pay kya lang po s sobrang stress ki n po yun mga diskarte ko po n gusto ko gawin e minsan po pinapangunahan n ako ng depression dahil sa mga calls nila na nakakapanghina...

    2. hi the worst thing that a creditor can do is to file for a sum of money case and that is the most legal way for the bank to filter who among the debtors can pay
      -kasi po some of defaulters opt lang not to pay like they keep their money in several bank accounts
      -pag me case filed, keribels na ni defaulted bank na hanapin lahat ng tagong yaman ni defaulter
      -what to do... wala po but to accept the fact na di na natin kayang mag-bayad ng kautangan
      -otherwise kung ibabayad huling money sa wallet, baka ma-sacrifice na po ang family... and that's what we have been doing for soooo many years bayaran si bank ng min. due ( and the interests just caught up on us...) others took out office loans (and guilty po ako for that) others ginawang revolver ang cc like taking call-for-cash para ibayad sa ibang cc
      -wag po kayong ma-stress/depress... pramis this is not the end of the world for us
      -who know's manalo tayo sa lotto ( or sa cod-city of dreams joke) and ma-settle ang cc... one-at-a-time

  5. Hello Ms. Cherry, until now po wala pa akong na rereceive calls or email from receivers and liquidators or sa ibang collectors. Ano po kayang moves na naman nila? 2016 BPI defaulter po of 56k. Thanks po

      and if bpi wanted to file a case it should have happened looong ago... and with 56k
      malamang si kotong-collector lang ang mag-bibigay kulay sa araw mo
      filing of case... malamang hindi
      sayang filing fee and effort
      and kung bully si defaulted bank and nag-file ng case...no big deal
      -just don't keep bank accounts

  8. Hello po, sumisilip lang po. Akala ko nung nakaraan wala na yung blog, nawala kasi lahat ng post. Kumusta po si Banker mam Cherry?

    Anyway, I'm on my 10th month MCC defaulter. Wala na tumatawag at nagtetext saakin. Pero kaba kaba padin nung minsan. Yung huli kasi nagtetext ng very informal like bayaran ko daw at nagamit ko naman daw at idedemanda ako. Pumunta pa sa office, pero messenger lang ata, may pinapareceive na letter, sakto work from home ako kaya nireceive nalang ng receptionist namin.

    1. @samantha, hi banker is doing well, nagpapa-hinga lang ng konte and he promised na he will be in touch once in a while and never na iiwanan tayo... debah banker
      -alam naman nya na he is the sole soul keeping our sanity intact...
      yeah for now just ignore the comedians... just like what banker had said "walang forever sa c/a and they won't dwell on not so promising accounts
      -sayang ang time nila and baka sila pa mauna sa mental asylum...he he he

    Meron po akong defaulted loan sa ctbc, 6mos na ako di nakakapaghulog and parang tatlong CA na ung humawak. Same reason pa din ako na medical expenses and wala pa ding budget pero willing to pay this year. May nagemail sakin bagong CA, Anchor ung company. Eto po ung email nila.

    In view of your refusal to settle your account with standing repeated demands, we will proceed immediately with the filling of the court case against you for violation of Batas Pambansa (BP22) Anti-bouncing check law. We are just waiting for the signed for your reference, once signed it will be filed in the court of Taguig City please take note that Civil Case and Criminal Case will definitely embarrass and jeopardize you aside from tarnish your name on the record of the National Bureau of Investigation (NBI).

      before ang alam ko, pdc ng chinatrust like they gave you a checkbook and pina-sign and iniwan sa bank na you need to fund every due date
      sa totoo lang check from cbtc is not pdc per se but payment stubs
      and if this will make you feel no postings yet bout defaulted bank filing for a case
      and just ignore the crooks, sanay po silang mang-stress ng defaulters
      if you want you can send that email to consumeraffairs@bsp.gov.ph
      -copied in si kotong-collector and the defaulted bank

    2. Good pm Ma'am! I started defaulting payment on ewb almost 5 months na po dahil kahit deligent po pagbayad ko and even paid 30k in one payment, napansin ko po na hindi naman bumaba ang bill nila sa akin. Sa hirap ng panahon, nahirapan na po akong magbayad.

      Now po, iba't ibang number po ang tumabatawag sa akin re my payment and I replied that I can pay but only 1000 per month but sad to say wala po silang reply and di po pumayag.

      Ano po kaya ang possible na mangyayari? I have a car loan po from security bank, possible po kaya na ihold nila release ng kotse ko once I fully paid the car loan?

    3. hi no need to reply on the sms of the kotong-collectors
      kung ayaw nila ng 1k eh di wag (choosy sila huh)
      -pag newly defaulted pls. expect the c/a to be sobrang kulit and most of them are bully (these crooks were trained to harass defaulters) mindset po nila pag newbie madali pang mapa-ikot... that's my experience
      and pls. don't ever make patol sa dialogue nila na to show willingness to the kotong-collector este to the bank eh magbayad ng kahit anong amount ( wala pong mapupuntahan ang payment nyo... better na ibili na lang ng food for the family)
      no worry with your carloan sa security bank as wala naman yata kayong defaulted cc/loan with them

    4. Likewise here na nawala lang parang bula mga partials ko, if pay ka lang ng partial sa kanila mababalewala lang siya much better ask for a discounted total balances na fix if possible at doon maless directly mga payments mo.

    1. @rich, hi yes psbank and mcc are sister-company and there's a possibility na ma-detect unpaid cc/loan with mcc
      -by not releasing the chattel mortgage, the only setback is that you won't be able to completely transfer ownership to your name and di poss ma-dispose without paying back mcc

      mcc got the mortgage and you got to keep the car

  11. hi just to share on the garnishment of bank deposits
    -as per banker, payroll is exempted from garnishment
    a ka-diskarte had an unfortunate experience, her partner's payroll account was garnished.. what was weird then is the legal person at the said bank told the defaulter that "he is aware on the exemption of payroll and pension account... but nevertheless they hold on to the said account kasi daw yun ang order ni court...but sa notice of garnishment stated dun na savings/time deposit etc is subject to execution but NAKALAGAY din dun other accounts exempted otherwise ( and dun po papasok ang payroll and pension account, pls. see sec. 13 rule 39 rules of court) and it was stupid of him saying na they need to hold on to the account baka daw sila mabalikan ni court??? what ??? can they not put na payroll ang nasa kanila and di possible ma-execute
    OMG , what's going on with these lawyers ??? kaya nga siguro most of the law firms in town have also ventured out into the work of collecting agency... maganda nga naman kitahan... konteng bola lang... paranoid na si defaulter ( and yung iba, to the extent of committing suicide naiisip nila.... haist life !!!
    "mahirap talaga ang maging mahirap... in the first place who wanted to be a defaulter... who wanted to be in the shoes of the defaulter na laging ginugulo ng pesteng collector...

      RULE 39

      Execution, Satisfaction and Effect of Judgments
      Section 13. Property exempt from execution. — Except as otherwise expressly provided by law, the following property, and no other, shall be exempt from execution:

      (a) The judgment obligor's family home as provided by law, or the homestead in which he resides, and land necessarily used in connection therewith;

      (b) Ordinary tools and implements personally used by him in his trade, employment, or livelihood;

      (c) Three horses, or three cows, or three carabaos, or other beasts of burden, such as the judgment obligor may select necessarily used by him in his ordinary occupation;

      (d) His necessary clothing and articles for ordinary personal use, excluding jewelry;

      (e) Household furniture and utensils necessary for housekeeping, and used for that purpose by the judgment obligor and his family, such as the judgment obligor may select, of a value not exceeding one hundred thousand pesos;

      (f) Provisions for individual or family use sufficient for four months;

      (g) The professional libraries and equipment of judges, lawyers, physicians, pharmacists, dentists, engineers, surveyors, clergymen, teachers, and other professionals, not exceeding three hundred thousand pesos in value;

      (h) One fishing boat and accessories not exceeding the total value of one hundred thousand pesos owned by a fisherman and by the lawful use of which he earns his livelihood;

      (i) So much of the salaries, wages, or earnings of the judgment obligor for his personal services within the four months preceding the levy as are necessary for the support of his family;

      (j) Lettered gravestones;

      (k) Monies, benefits, privileges, or annuities accruing or in any manner growing out of any life insurance;

      (l) The right to receive legal support, or money or property obtained as such support, or any pension or gratuity from the Government;

      (m) Properties specially exempted by law.
      -now if your salary is being deposited in banks and na-execute...i guess you have all the right na i-question si bank handling your payroll and as per banker dapat everything must be in black and white
      -as there are newbies na lawyer na though aware sa exemption ng payroll and pension... ipilit pa rin ang pag-hold ng payroll account ( kasi utos daw ng court !!! )
      -just thinking... what is the court asked him to jump from the penthouse of the building... gagawin din kaya nya (kasi order ni court...lol
      -sana lang po common sense is COMMON TO ALL... haist, wishful thinking indeed)

Gud am po, �� meron akong 2 cc sa rcbc, dhl sa financial prblem, d ko na kayang bayaran.. as of now tru cp calls ang bank at d ko sinasagot.. kc ung isang cc nahulugan ko pero d umabot ng minimum.. ung isa naman nakapaghulog ako min due... my restructuring ba ang rcbc? ask po advice what to do... thank you...

    1. @Anne, hi yes lahat ng banks me repayment schemes pag nasa inhouse collection pa ang account natin and mas ok sya
      -kasi wala pang patong si kotong-collector/3rd party collector po yun)
      sa repayment, parang both accounts will be cancelled- kahit ok pa yung isa
      -but tagged daw as "paying"

      yes kung struggle na po ang pagbabayad ok lang po to completely stop ( kesa ma-sacrifice ang budget for the family) pls. don't worry walang kaso sa friendly c/a
      -the only setback is malamang sa hindi minimal lang ang mababawas sa defaulted amt. nyo with mcc ... kasi papasok na po lahat ng nakaka-lurkey na interest and surcharges
      -after magsawa ni friendly collector sa pag follow-up ng payment... for sure malilipat lang po sa ibang c/a ang account nyo ( like what had happened to other defaulters...)
      yun lang po

      rcbc yes pag medyo malaki ang huge amt like more than 100k and filing of case (as per my experience) is within the first 2 years of being in-default
      again no big deal... just don't keep bank deposits

  18. cc defaulter po ako almost 2 years na, naloko po kasi ako, indi po swipe ng mga material things. ang nakuha ko po is ung mga offer nila na cash na maliit lang ang interest, ginamit ko po as investment, nong una maganda pa, kaso nong lumaki na yung naibigay kong investment tinakbuhan na ako, kesyo daw wala na nagbabayad na mga nagloan sa knya, til now nagtatago na xa, hindi na namin mahagilap, kaya ngayon ako ang pumapasan lahat, ako lang po ang bread winner sa'min, walang work ang asawa ko, i have children 10 and 9 years old, dati nasa private school sila, since neon na kahit pang upa namin sa bahay ay wala na ako maprovide nilipat ko na sila sa public school, kasama pa jan ung support ko sa mother ko na bed ridden na almost 10 years na. Nakaka stressed po kasi ung mga CA na minumura na ako kahit anong paliwanag ko sa knila ng sitwasyon ko, minsan nga CA ng Eastwest (lalakeng agent) sinabi nia na kung kailangan ibenta ko ang katawan ko gawin ko, tama po ba un? ilang months na labas masok ako sa hospital dahil sa sobrang stress,, me time din na halos magdamag akong gising kasi nag aalala ako na baka idemanda na lng nila ako bigla. Citibank, Metrobank, Eastwest at HSBC ung mga card ko, pero indi naman po malaki ung utang ko,, sa HSBC ko po is aroung 50k, sa citi is 60k sa metro is 50k and sa eastwest is 50k. lumaki lang ng todo dahil sa mga interest nila. ung mga cc ko po is nagstart ng 2009 until 2016 maganda ung record ko, nagbabayad ako ng full, un nga lng po nong natakbuhan na ako indi ko na po alam san ako kukuha ng perang ipambabayad ko, ano po ang dapat kong gawin sa mga CA na nanakot na idedemanda ako,, pupuntahan ako sa bahay at ipapabaranggay,magbabayad naman po ako, wala pa lng po talaga ako kakayahan magbayad sa ngayon,

      TO: ALL REGIONAL TRIAL COURTS, METROPOLITAN TRIAL COURTS, MUNICIPAL TRIAL COURTS AND MUNICIPAL CIRCUIT TRIAL COURTS

      SUBJECT: GUIDELINES ON THE KATARUNGANG PAMBARANGAY CONCILIATION PROCEDURE TO PREVENT CIRCUMVENTION OF THE REVISED KATARUNGANG PAMBARANGAY LAW (SECTIONS 399-422, CHAPTER VII, TITLE I, BOOK III, R.A. 7160. OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991).

      The Revised Katarungang Pambarangay Law under R.A. 7160, otherwise known as the local Government Code of 1991, effective on January 1, 1992, and which repealed P.D. 1508, introduced substantial changes not only in the authority granted to the Lupong Tagapamayapa but also in the procedure to be observed in the settlement of disputes within the authority of the Lupon.

      In order that the laudable purpose of the law may not be subverted and its effectiveness undermined by indiscriminate, improper and/or premature issuance of certifications to file actions in court by the Lupon or Pangkat Secretaries, attested by the Lupon/Pangkat Chairmen, respectively, the following guidelines are hereby issued for the information of trial court judges in cases brought before them coming from the Barangays:

      I. All disputes are subject to Barangay conciliation pursuant to the Revised Katarungang Pambarangay Law (formerly P.D. 1508, repealed and now replaced by Secs. 399-422, Chapter VII, Title I, Book III, and Sec. 515, Title I, Book IV, R.A. 7160, otherwise known as the Local Government Code of 1991), and prior recourse thereto is a pre-condition before filing a complaint in court or any government offices, except in the following disputes:

      1. Where one party is the government, or any subdivision or instrumentality thereof;

      2. Where one party is a public officer or employee, and the dispute relates to the performance of his official functions;

      3. Where the dispute involves real properties located in different cities and municipalities, unless the parties thereto agree to submit their difference to amicable settlement by an appropriate Lupon;

      -for me your defaulted amount won't merit the bank to file a case...sayang filing fee and effort and bank will just leave pesteng collectors na masingil ng kautangan
      NOW PLS. DON'T EVER LET ME KOTONG-COLLECTORS na murahin ka (you simply don't owe them money, collector lang po sila, like no collection-no commission) and pramis walang forever with the crooks and c/a won't concentrate on not promising accounts
      -next time, nag-maldita si c/a ipa-blotter lang po or isumbong sa bsp (consumeraffairs@bsp.gov.ph)
      and just hang around para po aware kayo sa galawan ng mga comedians/cosplayers

  19. Hi, just this morning may nagdala ng letter dito sa bahay from rcbc, tapos may pinakausap sa akin from alexis molaer law firm daw. Pinapabayaran sa akin is 33k from the 52k na utang ko daw sa bank.. Sa tanda ko nasa 25k lang ung utang ko talaga, so interest charges yung iba.. Sabi nya, magbayad ako sa hindi mas pabor daw sa kanila kasi pede daw sila magfile ng case para makuha nila ung full amount na 52k pag dinala nila sa court yung case ko.. How true is this po?

    1. @Erona Shawn, hi first of all pls. don't talk to strangers that "lawyer" from ewb is not a lawyer, just a kotong-collector... just ignore them for the meantime lalo na pag pag mahilig silang mag-impersonate
      with rcbc, defaulted ba sya like one year ago and you're paying the account paying your account thru the c/a kasi it won't really matter kung nag-expire ang cc mo last march... now kung di ka pa defaulted you can always call the customer service of the bank
      -now kung defaulted ka na, by all means get the c/a to give you the right figure to pay or give you a rundown of all your payments... baka walang napupuntahan ang mga payments mo sa kanila ( and i hope you had a written agreement when you decided to pay monthly)

      lending companies aka 5/6 banks
      -for the above banks, guess defaulted amt. quite huge like 100k and above
      fyi starting aug. 1, 2018 defaulted amt. of 300k will go to the small claims court
      understand from another defaulter na maybank also filing for a case kahit below 50k.... toink!!!
      and as per my experience, when a bank is serious to file a case it will surely happen within the first 2 years of being in-default

    Ma'am want to express my gratitude because of your help and guidance naka survived ako.

    Been a defaulter for 3 years with 2 cards MCC nand EWB. With existing restructuring program sa CITI and 1 year nan no payment with 2 cards HSBC.

    Been a card holder for a decade and been in good handling but same with other defaulter naka experience nan family health problem and financial setback kaya no choice talaga di na makabayad.

    Im a former bank officer. Now I decided to resigned because of health issue maybe dahil sa stress na naexperienced ko sa mga collector and sa hiya na rin kasi sa office tawag sila nan tawag.

    First 2 years of being in default sobra hirap, takot at stress an experienced ko sknila. Naging quite sila for the few months pero now bigla na nmn silang nabuhay.

    Ma'am question ko po;

    1. What do you know about Collectius? They sent an email regarding my MCC, as expected times 10 un balance compare dun sa last SOA ko with payment arrangement na imposible kong bayaran for now. They also said that they wil endorse my accouny to third party collector if di ako makipag settle sa knila. Diba sila na un third party? They will also endorsed daw for filing a sum of money or small claims? Possible po ba un?

    2. With CITI po, currently 2 months past due under restructuring program ako with signed PNDS (but I did not affixed my real signature) trying my best na bayaran sila kaso hirap tlg wala na po akong source. What do you think mam? Your recommendation po?

    3. Un account ko with HSBC po I know na knila pa account ko since nag file ako nan complaint sa BSP since I requested for payment arrangement. 2 weeks ago they sent an arrangement but too late no work na kaya di ko na inopen. What do you think will happen po?

      and yes for months, it's been collectius who's been making follow-ups on my account and yes the friendly collector txted me yesterday "that it would be bitter daw ( sa totoo lang nahulog ako dun kasi bitter daw... omg napaisip tuloy ako why ako magiging bitter... tsk tsk tsk )for me to pay otherwise, they will file a sum of money case... and hey i defaulted in 2014, if mcc wanted to file a case it should have happened looong ago... 4 years later ( what if am 6 ft under the ground...so morbid 'no, just trying to point out na di pinag-tatagal ang filing of case)
      with citibank kung struggle na po ang pagbabayad, ok na po to default and if ever me filed case si citibank just don't keep bank deposits
      same din po with hsbc, and from what i know hsbc not filing for case (though someone posted na he got a case from hsbc... sorry cannot verify if true...
      anyway pag walang pambayad... eh di wala
      -just an empty victory for the bank
      and kalma lang po kayo and everything will be ok and these crooks will simply come and go
      so di po dapat seryosohin

  27. Hi ms.cherrylou.. Ask lang po, may dumating na writ of execution from MTC. What should i expect? Meron ako 2 bank accounts na maintaning balance lang parehas (for online transactions ko lang) nilipat ko ba lahat sa accoubt ng wife ko. Kung i garnish nila yun which is 2k and 3k lang.(widraw ko na ba or hayaan ko nalang sa kanila). Anu mangyayari next? Hahabol pa ba sila sa personal propeties ko (kung example 100k na umabot yung sa CC ko), motor lang naman nakapangalan sa aken,well sabi ni banker before they only go after the money. Sure kaya yun hanggang dun nalang sila? Eh pano pa kung ubusin ko na laman ng account ko?

    May nabasa kasi ako online na kapag wala sila nakita bank accounts mo, lilipat naman sa registered properties like cars, land and stocks if none daw he will go to your house for personal properties.

    Isa pa po, kung sakali may pumunta sheriff, may mali kasi sa address ko, like LABO ang street name talaga, pero ang address na nakalagay dun sa letter from MTC is LAPOS, paano yun? Salamat po!

      banks will only ran after cash/bank deposits
      with creditors running after properties not exempted from execution... siguro depende yun sa creditor
      like if someone owes money sa isang private individual maybe he will push sheriff to try all means na mabayaran sya
      -yes pls. close all bank accounts (sayang din po yung 2/3k) and pls. double check kung di liable si partner sa execution
      -there are instances na pati si partner na di principal debtor is also subject to execution
      i don't think sheriff will bother to show us at our doorstep

Naka indicate ba name nya dapat? Kasi sa mga letters from mtc eh name ko lang ang nakalagay (pati sa writ of execution name ko lang)? May instances na ba na hindi nakaindicate name ni partner pero nadamay sa garnishment? Dami ko tanong :)

    3. @toto pacheco, hi sa summons kasama na ang name ng partner and sa decision nakalagay ang name ng partners, kung ikaw lang... malamang ikaw lang ang subject for execution
      kasi sa nakita ko na sample nung notice of garnishment na napadala sa bank, naka-lagay dun name ng hubby and wifey and yung na-hold is payroll account pa... lol
      and legal officer soooo bopol kahit aware na payroll na-hold pa rin, baka daw kasi balikan ng court ( malamang di nya alam what is meant by OTHERWISE EXEMPTED ACCOUNTS hay naku... and as per banker, pwede habulin yun, need lang mag-provide ng proper documents etc)
      -pag wala ang name ng partner di sya damay sa execution... wala pong basis

      no way para malaman mo ang amount na need to pay or if i may suggest pls. go to the recovery department of bankard, ang alam ko malapit sila sa me poveda
      -automatic ang sagot sa iyo pag customer service like nasa collection or 3rd party kotong-collector na ang account mo
      so in that case, pls. call your current c/a and demand the soa... dun mo lang makikita ang bayarin mo (wala na po sa bank ang account mo)

    1. hi there are times na kahit defaulter, possible pa rin na maka-kuha ng cc ... lalo na when you are keeping bank accounts like with bpi and bdo
      and yes there were also times na tamad mag-report ng defaulter ang isang bank sa cmap... so ayun di pa sya blacklisted ( this was shared by a defaulter who requested a friend working in a bank to check his/defaulter's status
      visa... ok naman ( i had a sum of money case and was able to get visa for japan and korea... nagkaron po ng extra budget...)

  32. Hi Ms. Cherrylou. Babista Law office is trying to communicate with me. Grabe! They email may higher office. So, nag take action ang Head office namin, pinadaan thrunchannel hangang malocate akomtawag2 sa ofc so napilitan na ako kausapin kasi sanction na aabutin ko. Eto scenario
    1. Mr Erick Reyes daw siya, then kakausapin daw ako ni Atty. Babista, i 2. I talked to a certain atty. (Di q sure kung atty.)they given the card details etc. Then from 119K payag na daw ang bank to 48K.principal na lang daw.
    3. I told them that i cant remember the accnt. Since 2008 pa daw defaukt and pang 4 na CA na sila. I asked for the SOA and Endorsement from the bank. Sabi ni atty, may bayad na daw ang SOA 100 per page.
    4.sabi ko just email me the details. Pag-aralam ko kung ano gagawin. Sayang kako 48K,di ki na kaya yan. Pamg dialysis na kako yan. So they asked for email. At eto ako waiting .

    Ms. Cherrylou, is it possible to still corrdinate with metrobank. Or wala na talaga ito. Kasi 4 ma CA na. Si ala tsamba na lang sila. Baka kasi mamaya, kung mag installment, hindi na din papasok sa bank. Sayang. Lahat namn tayo gusto magbayadml. Kaso dumarating ang time na nagkaka financial problem tayo.     1. @Mr. Valdez, sorry to hear what had happened in the office; first of all di po concern ni company, management, hr, barangay, ncrpo and past due natin with credit cards and if ok with you, pwede po mag-file ng complaint with the bsp (consumeraffairs@bsp.gov.ph) copied in sa email si pesteng collector and the defaulted bank
      - atty babista won't bother to speak with you, he got hordes of stupid collectors para mag-follow-up ng payment
      -creditors are given prescriptive period of 10 years to collect and mabi-break lang when the bank files for a case
      -account is no longer with mcc,
      -now if i were you , i will request for the least amount to pay (not the 48k) pag ayaw ...then wag and pls. use na lang the money for the dialysis
      -health is more important than feeding the greed of the comedians
      -yes nobody wanted to be in this position; being pestered by collectors

    Madedefault napo ako sa Metrobank Credit Card ko amounting to 150k. Unfortunately due to medical reasons of one of my family member eh hindi ko nakakayain mag bayad sa kanila.

    May existing po akong binabayaran na bahay at lupa. Meron din po akong existing insurance na binabayaran sa Sun life.

    1. Pwede po ba nila kunin yung binabayaran ko lupat bahay na nakapangalan sa akin.

    2. Worst Case pwede din po ba nila kunin yung savings ko kay Sunlife.

    Member po ako dati ng website nyo, dito po ako kumuha ng lakas ng loob para harapin ung mga c/a 5 yrs ago. Pero hindi ko na po naharap magjoin sa forum dahil naging ofw na po ako. Akala ko nadelete na record ng defaulted card ko pero last month may dumating na letter sa nanay ko sa probinsya from Molaer. I wonder pano nila nalaman provincial address ko. But anyway, natatakot ako na umabot sila sa point na magulang ko ihaharrass nila. Napag-isip isip ko na isettle na lang kasi wala ako sa Pinas para humarap sa kanila. Ang tanong ko ngayon e, ano po ba ang tamang paraan ng settlement?(HSBC pla defaulted card ko, nsa more or less 30k principal and nsa 100k na ngyon). Ano po mga steps na dapat iconsider. Sa HSBC parin ba magbabayad?Mag-iissue na ba agad sila ng certificate of full payment kung one-time payment ang gagawin? Salamat po.

    3. Molaer din may hawak ng RCBC account ko since 2013. Naranasan ko na halos lahat ng harassment sa kanila: never ending final demand letters, calls and texts, office visits, at mga bastos na pananalita. This “legal officer” kuno also threatened to sue me and my husband, andiyang iko-complain daw ako sa barangay.

      Sabi ko, go ahead feel free to sue me or call our barangay. Nag lie low sila pagkatapos nun, isang demand letter na lang na receive ko, humirit pa talaga. Ilang buwan na rin silang di nagpaparamdam. Wala na siguro silang maipanakot sa akin na dema-demanda.

      At yan ay dahil natuto ako sa tulong ni Sir Rene and Ms. Cherrylou nang matagpuan ko itong Diskarte blog nung August last year. Nasagot ko Molaer nang may lakas ng loob. Willing naman ako magbayad basta properly documented, at yung kaya kong i-maintain na hulog ha. Sa tagal na naming nagnenegotitate ayaw nila nang may kasulatan. Pag walang decent SOA at written agreement na notarized ng bank, no way for me to resume payment. Sa bank na lang ako magbabayad pag kaya na talaga ng finances.

      Kaya forever akong thankful kina Sir Rene/Banker at Ms. Cherrylou, at sa iba pang kadiskarte na nagpalakas ng loob ko. Kaya kayo din mga kapatid, tambay lang kayo sa blogsite na ito at makakahanap din kayo ng peace of mind tulad ko.

Hi po...ask ko lang i have citibank cc last 2010..may credit was 24k then last billing umabot ng 50 to 60k due late posting ng electronic transactions daw.kinontest ko po nagrefuse tlaga akong magsettle...im receiving letter from collecting agents but refuse to pay not more than 20k,, i receive a letter last 2017 from citibank that i can contact them and now nasa lawfirm na ung account...pero by 2018 may tumatawag ulet citibank daw directly ... gusto ko pong malaman kung magbabayad po ako gusto ko sana makatarungan ang halaga...sabi nila 48k daw cash to close the account.hindi ko po kaya ang ganun sabi nila if hindi i file nlang daw sa court. Hi!If you want to pay go directly to the bank concern.if they refuse, and refer you their CA,bargain if you have the money to pay.then if they will tell you they will file a case,Dare them to file.if you really don't have the money to pay, the judge will know.     Because I was so scared, I paid 10k straight from my savings account. I've only been default since April or March but they keep contacting me, it's like this with new defaulters right? Haist. I called BPI to request for restructuring a few weeks ago pero sabi nila I have to contact Collections dept. na daw. Can I still go to the bank and request for restructuring or will they refer me to collections dept. again? Pls advise me what to do, salamat kaayo.

    1. If the bank told you that you contact the CA,it means na wala na sa kanila ang account.if you want to pay, settle for the best option.if you cannot,tell them.if they will keep on harassIng you, tell them lets talk in court na lang.

    1. hi sir, same po tayo sa MCC at halos di na nagkakalayo amount. Dumaan na po ako sa SP Madrid. Actually sakanila ako kinabahan kasi madami na ako nabasa tungkol sakanila. Nakatanggap nadin ako ganyan email at calls at text. Never ko sinagot mga calls. Hanggang sa nalipat nalang din ng ibang CA. 1 month lang sakanila account ko. Nailipat din sa iba after. 2 months pinakamatagal ko sa isang CA.

Good day po mam cherrylou..may 2 cc ako sa rcbc at 2 din sa bdo..actually di po ako default sa payment ko sa ngayon..nagbabayad ako kahit minimum due lang monthly..may cash loan ako sa rcbc 2 ang isa is 149k na plus interest at surcharges...at yung isa is around 11k naman..may other cash loan akong 300k sa rcbc pro separate ito sa 2 cc ko with them, at iba naman ang card# pro wala itong credit card na inissue (monthly is 10,702 for 36 mos at nakabayad na ako ng mga 7 mos dito at fixed amount ito)..ang binayaran ko sa rcbc is 3 statements monthly at sa bdo is 2 statements naman..ang sa bdo ko naman ang isa is around 27k at 11k naman..nagcash loan ako sa rcbc pra mabayaran ko ang ibang cc ko..wala na po akong work ngayon at halos lahat ng pera ko napunta lang lahat sa kababayad ko sa mga cc na ito..this july hindi ko na po kayang magbayad pa kahit isa sa cc ko...gusto ko din naman magbayad talaga pro ngayon wala na talaga akong kapera pera na...sa sobrang stressed ko dito kung minsan nagiisip na ako ng di maganda..affected na din ang pagaaral ng anak (single mom po ako) ko kasi kahit baon wala na akong maibigay pa...ano po ba ang pwede kong gawin mam cherrylou? di ko na kasi alam ang gagawin ko kasi kahit nagbabayad ako ay halos napupunta lang sa interest..hindi na ako nakakatulog lately dahil dito at lagi sumasakit ulo ko..kung hindi na ako makabayad at dahil din sa laki ng utang ko esp sa rcbc, mapupunta ba sa small claims ang magiging kaso ko if ever? ilang months before nila iconsider na defaulter na ako? I hope mabigyan mo ako ng konting payo about sa gagawin ko..thanks po ng marami.

    1. hi kung struggle na po ang pag-babayad just stop paying and pls. prioritize your child (lalo na't single mom ka) mayaman ang banks and di sila magsa-suffer sa unpaid cc/loans natin...but iba tayo
      after 3 months of non payment, accounts will be endorsed to the 3rd party c/a and after 6 months of non-payment, our account will be considered loss and written off by the bank ( sabi nga nung iba... how come nagiging bloated ang account natin when after 6 months written off na ito ??? well i guess that is their diskarte para pahirapan pa tayo more
      -now pls. don't worry bout sum of money case... no big deal (just don't keep bank accounts)

      -i had a decided case for sum of money and am GOOD

    Its my 2nd month na hindi nakapagbayad po sa MCC, they keep on calling gamit po ang mga ibat - ibang number. Im just worried lang po baka kasi tumawag sila sa office or pumunta sa pinag tratrabahoan ko since nasa mall lang ko.
    tanong kulang po, kung anong mas maigi gawin? ako lang po ang nag tratrabaho sa aming pamilya, baka po kasi ako matanggal sa trabaho. Baka po kasi ipahiya nila ako sa trabaho or tawagan yung office namin.
    Im so worried na po, kinulang lang po talaga ako ng pambayad since ang anak ko palaging nagkakasakit. Salamat po.

    1. Hi Hanna here. I'm also a defaulter. Tell them confidently na sa korte na lang natin pag-usapan. It's usually enough to shut them down. In that case they know you are already well informed about your rights. Good luck kaya mo yan girl.

      -now for ocular visit- c/a will just send over their messenger to deliver the demand letter na ok to sign anywhere you wish and bawal na po ang mang-harass ng defaulters and you will not allow anyone na i-bully ka right ??? not even the collector

Ayaw nla pumayag na 5k lng a month, so I tried to look for a job pdn un nga lng mas mababa sa kinikita ko kya pang gamot at allowance lng tlga, ininform ko po cla about dun sa bago kong work na hndi na gaya ng kinikita ko, as usual d padn po pumayag, calls txt emails mga nttnggap ko from the agency. Now, nag apply po ako sa Manila ng work, and fortunately mas mataas salary kesa sa nung nsa Tarlac po ako nagwo work. I tried to pay pdin po like 6k for the past 2 months sa takot ko po na makasuhan. Kso dumating dn sa point na tntwagan ako at nagdedemand ng 30k ora orada sabi ko po dko kya un, so I decided to stop paying them na kc ayaw ndn mkipag usap ng maayos nung agency. Ma'am natatakot po ako na baka makasuhan ako, andto po ako sa Manila at ung address sa Card ko is sa Tarlac iniisip ko po kc ung RA 8484 ba yun? tska ano po kya mgnda kong gawin, kc nhhrapan po ako, hndi makatulog at kaen. 3months na po ako hndi nagbbayad sa knila.     3.d) Stick to that line. simplify your answers to "yes" or "no"
    3.e) Remember this sound - "click"
    3.f) Huwag ma-pikon. " Tama ka" is standard reply para SIYA ang ma-pikon.

    Chapter III The Lies Collectors Tell

    The first lie is his name.
    That is not the collector's real name.
    So, why would you believe anything he says afterwards?


    1.Court Case
    They won't ; they don't ; they can't
    Why would they'd be called "collectors" in the first place!

    2.Imprisonment
    Failure to pay means you promised, but did not fulfill it.
    Its found under "Obligations and Contracts" of the Civil Code,
    not in the Revised Penal Code, hence, not a criminal act.
    This also applies to debts abroad like UEA.

    Show me first the documents that he is legally allowed by the bank to do so

    Plain robbery

    6.Publishing Your Face

    7.Warrants of Arrest/ BP 22/ RA 8484/ PNP/NBI/CIDG/INTERPOL
    These words imply "imprisonment" ; now go back and read again if you
    missed anything.

    Chapter IV Threats and Blackmails - Visits

    Na share ko na dito yung experience ko with a CA na sobra din kung makasingil,sinigawan ako and all. I immediately filed a complain sa bsp consumer affairs, cc si bank and the Collection Agency. After a week bank was reprimanded by bsp, then they called me and apologize and my account was transferred back to them. Please do file a complain sa bsp be specific lang sa complain mo, if you can still remember the name of that agent (usually aliases din gamit nila) much better. Abuso kasi sila madala kasi walang nag cocomplain sa kanila.

      Ayaw po ata pag gmail to your yahoomail. Bale eto po ung concern ko:

      CC defaulter po ako with the following:

      Security bank = di ko na po alam kung ilang years na maybe mga 2-3 yrs then di na din po ako updated sa amount last time they message me lagpas 200k napo (75k original limit)

      Eastwest bank = siguro mga 1-2 yrs na po (75k original limit) umabot nadin ng 100-200k

      Last Oct 2016 nawalan ako ng work dahil sa mga absences ko sa office sunod sunod kasi pag absent ko dahil naaksidente bunso kong kapatid then magkasunod na ngkasakit mga anak ko (I'm a mom with 2 kids and currently 6mos pregnant sa 3rd).

      Nakapagstart lang ako magwork last March 2016 and ung sinusweldo ko is nauubos lang sa pagbayad sa ibang debts ko (not credit cards).

      Di ko naman po masyado inaalala ung sa SCB at EW dahil nabasa ko sa blog nga na no history for them of filing a case.

      Ang inaalala ko po is ung bank loans ko with the following:

      PSBank flexiloan - 35k po naloan ko and dahil di ko na po nabayaran it ballooned to 97k+. Last July 3 may ngemail sakin a certain Aris Morta from Atty. Roberto B. Ultado Jr and associates and eto po nilalaman:

      FINAL DEMAND LETTER
      SUBJECT: PS BANK FLEXI REVOLVING
      ACCOUNT NO: 020-120-02983671-9
      AMOUNT: Php 97,048.00

      Dear Maam/ Sir,


      All of our efforts to settle you're above PS BANK amicably have been unsuccessful.
      We have made numerous calls and, to date,have not had the courtesy of a call back.

      so I replied saying na wala pa kong capacity to pay them and I'm pregnant kaso I did not receive any response after.

      Then ang pinaka worry ko po is ung Insular Bank loan ko amounting to 50k and dun po may comaker ako (kaso he's dead na ) and nag issue ako ng check. They visited me last time sa dati naming tinitirhan but pinaalis na kasi kami ng landlady namin dun dahil di kami nakakabayad ng upa so we moved to a different place and they no longer got in touch with me even via email, text, calls or FB wala po.

      So i'm worrying kasi baka sampahan na lang ako ng case anytime due to BP22 at Estafa.

      Any advice po on what should I do?

    3. Just sharing mine. I have issued checks for my personal loan sa 1 bank. I took up the loan year 2007. And they keep on calling me but I didnt reply. Sabi nga ni Ms Cherrylou if they are interested to file a case they will do it within 2 years. So I guess panghaharass na lang ginagawa ng collector sa kin. Until now sabi nya 640k na daw utang ko. And I did asked him if they filed the case di makasagot so I just ignore hehe

      -sabi nga ng matatanda... baka mag-habol sila sa tambol-mayor (sorry di ko rin alam what is meant by that...as i will be having my dual citizenship in 2019 pa...lol)
      prescriptive period to collect is 10 years, so technically ini-ignore po yan ng bank or simpleng nagpapaka-waley lang sila

  64. Ms. Cherrylou, hello po sa inyo. Pasensya na po sa marami kong tanong. Sobrang depressed na ko di ko na alam ang gagawin. Call me Mrs. Bothered. Ask ko lang po kasi sobrang natatakot ako. Lumabas na decision sa sum of money case na filed ng BPI against me. I have 15 days to reappeal my case pero sa nabasa ko dito, ganun din naman, pag nagappeal ako, dun din ang bagsak. Pagbabayarin ako. Wala akong pambayad. Kung hindi ako mag-appeal, writ of execution na ang sunod sa pagkaintindi ko sa mga nabasa ko dito. How long bago lumabas ang writ of execution ng case mo with BPI? Kung lumabas na po yun, Ihaharass po ba ako ng sheriff dito sa bahay namin, natatakot at nahihiya po ako na baka eskandaluhin ako dito. Ako po ang defaulter pero pati hubby ko nasa case filed dahil married kami. Kung ang i-keep nya lang na bank account ay BDO at Eastwest, at wag na gamitin ang sa BPI nya, magagarnish pa rin po ba yun? Wala silang makukuha sakin dahil wala na ko bank account. Hubby na lang ang earning ngayon at may account. Kung magga-garnish sila, uubusin po ba nila yun? pano kung yun na lang ang pambuhay sa pamilya diba? At hanggang kelan sila mangga-garnish ng account, hanggang gusto lang nila? Ang decision ng MTC ay 125k plus interest and legal fees. Please help me. Sobrang iyak na ako ng iyak dahil dito. Is it wise to not reappeal at hayaan ng magtuloy-tuloy sa writ of execution?

      in my personal experience i had the sum of money case in 2014 and writ of execution in 2016 ( early part of 2017, bpi's legal counsel trying to offer for a discounted amt. for one time payment and never bothered to comply... para que, case been filed and decided upon and if i pay, mawawala ba yung sum of money case ko ?
      -sorry lang ng bank wala akong money, no bank accounts ( payroll lang po and exempted from execution, a defaulter had a problem with robinson's bank, pati payroll account na-hold and what's weird is alam ng legal officer ng robinson's bank bout bank accounts na exempted sa execution, but still the waley na lawyer officer walang ginawa and stupid reasoning sa defaulter na baka daw balikan sila ng court...lol )
      since kasama si hubby sa decision am afraid na he too cannot keep bank accounts ( except payroll/pension account)
      validity of execution is 5 years from date na na-render ang decision and poss mag-request ang bank thru legal counsel ng 5 more years
      -as per sec. 13 rule 39 rules of court, sheriff is required by court to make a report at month end kung me na-execute sa defaulter
      -so yun po, when faced with a decided case for sum of money... don't keep muna bank accounts
      and so far no sight of sheriff in my doorstep and what will he do naman with my old stuff
      -i-auction sa ukay-ukay ???

You mentioned po na sheriff is required by court to report kung may nakuha kay defaulter, sa experience mo po, pano po ang naging diskarte ng sheriff para makasingil sayo? Pinuntahan po ba kayo sa house o tinawagan? Is my legal aged daughter na single exempted from execution ng case naming mag-asawa sa decided case ko? Pasensya na po sa mga questions ko.       -as of this moment, no contacts ni sheriff
      and from what i understand, sheriff will send notice of garnishment to all banks and see kung saan me bank account si defaulter (like kung sino sumagot, dun me account si defaulter) and as confirmed by one poster, defaulter kept a payroll account with robinson's bank and supposedly this is exempted from execution same with pension account
      -but the bank's legal officer just the same na-hold si payroll and he was honest enough na sabihin na aware daw sya sa exemption ni payroll BUT natakot si officer na baka balikan ng court...lol what an excuse and am so sorry for the defaulter ( and sana di na dumami yung tribe ni legal officer; otherwise walang gagawin ang defaulter kung di mag-appeal to quash the decision na i-execute si payroll )
      validity po for execution is 5 years from first date of entry ng decided case
      yes your child is exempted... so if you got extra money paki deposit na lang po sa account nya...

      Sa case nyo gaano katagal bago dumating ang decision ng court? Meron din kasi ako sum of money case pero wala pang decision, pinadala sakin ang summons Dec 2016 then hindi din ako nag attend sa mga hearings. Dati sobrang takot na takot din ako at hindi makatulog dahil syempre summons yun e buti nakita ko ang blog na ito at salamat kay Ms. Cherrylou napanatag ang dibdib ko. Kanina lang may tumawag ulit na taga BPI tinatanong kung ano daw plan ko sa utang ko sabi ko wala pa ako pambayad at baka hintayin ko na lang ang decision ng court. Kahit pala nasa court na ang kaso mo tumatawag pa din sila at umaasa na makakabayad ka. Ang pinagpipray ko lang talaga ay huwag na pumunta ang sheriff sa bahay. Married din ako at kasama sa summons ang asawa ko, ang medyo worry lang ako ay govt employee sya hindi kaya mas maging interesado sila kapag govt emp? Tingin nyo po Ms. Cherrylou?

      kasi in my experience, i had the case in 2014 and the whole legal process took less than a year, writ of execution in 2016 (early part of 2017 nag-follow-up ang bank's legal counsel... yes sometimes the former kotong-collector will make contacts... nag-babaka-sakali baka maka-singil pa pwede daw installment, but when one fails to pay again...tuloy ang sum of money case/ or minsan execution pa rin ang ending... tsk tsk tsk

      when i had the case, automatic na di na kami nag keep ng bank accounts
      -payroll lang po
      guess walang naman po effect kung gov't employee man kayo

I would like to seek advice po sana kase nakatanggap po ako ng document saying I was being sued at the Makati City Court for non-payment of my cc debt. I have 10 days to file a reply. Gusto ko po sanang magpa-consult muna sa attorney bago ko gawin yung reply para po ma-explain sa akin ang mga naka-attach na documents pati na rin kung ano ang best option. Wala po akong work kaya kahit gusto ko pong i-settle na ang amount, wala po akong mapagkukunan. Please help me.Maraming salamat po.

    1. hi when defaulted amount is 200k and below, case will go to the small claims court
      no need for a lawyer and maybe you can request judge to lower the amount as alam naman po natin na wagas ang naging interest/surcharges
      -now mag-attend or hindi ng hearing same decision bayaran si bank
      -pay when able now kung walang cash and bank deposits
      just an empty victory for the bank

I will send the reply po as required by the court indicating the request to lower the amount and to be allowed to pay when able.

  67. Hi Miss Cherrylou, is it legal to charge a late fee debit adjustment amounting to Php13, 000 which is more higher than the billed finance charge of Php6, 000? Aside from that another Overlimit fee which is fair at Php500. I am referring to Eastwest Bank. Nung pa po delinquent ang account ko Php500 lang ang late charges then afterwards became around that amount na kaya no wonder lumaki ng lumaki po balances ko? Ganun po ba talaga ang dapat nilang icharge? Please help po para ma enlighten po ako at alam ko po ang isasagot ko doon sa collector. Thank you po ng marami. - April

  68. @ April, hi yes there are instances na bank charged a late payment fee of that much 13k ( lalo na when defaulted amt is huge) and that is also the reason why cardholders chose not to pay than go deeper with debt
    if account is active meron ngang 500 psos na over-limit fee si ewb
    and of course it's illegal mag-impose ng penalty ng ganyang kalaki that is why banker is advising us to take the bluff of these crazy collectors to just file a case kung kaya nila

Hirap na nga po makabayad doon sa original balances instead they will reach out to help you is lalo kapa nila ibabaon sa utang :( Kapag po may overlimit fee means active pa po ba siya? Ano pong the best na dapat kong gawin. Less than a year palang po akong di nakakabayad and they are offering a 10% discount with .50% interest a month.       -now ang alam kong mas madalas mag-file ng bp22 case are lending companies aka 5/6 banks
      -since now ka lang di naka-pag-fund ng check , siguro mas better to call na lang the inhouse-collection and tell them na you will simply pay for penalties like late payment, fee for returned check (before nasa 1k ang returned fee for checks ) etc

  70. Hi Ms Cherrylou. I am a Unionbank credit card defaulter since 2013 because nawalan ako ng trabaho. Nahirapan na din ako maghanap ng work kasi nasa 50s na ako. As far as I can remember defaulted amount is 120k pero ang sinisingil ni CA is 691,706 na. Been receiving demand letters from different CAs. Like all the defaulters, I had sleepless nights too. Thanks to you and banker, I find the courage to face my financial distress. Last week, I received another demand letter from Molaer Law Offices re Advise Not to Dispose, Sell and/orTransfer Properties. May mention pa na 'advise not to dispose properties and not to withdraw your bank deposits and/or salaries and wages, if any .. which have been conditionally listed down by our officers... Your deafening silence and/or non-response to our said demands indicate your unjustified refusal to pay a just and demandable obligation to our said client". My question po is may possibility pa rin ba magfile ng case si Unionbank? Ipost ko sana whole letter pero mahirap po magtype sa cellphone. Thank you. - Sis El

      -lumang scam na po yan and they will just edit the name of the defaulter and the defaulted amt.
      and yan din po ang one million dollar question ng isang defaulter...how come nag-incur pa ng interest and defaulted amt. when after 6 months of non-payment, written-off na po ang defaulted amt. and ina-alis na po sa record ng creditor... so why oh why ???

      defaulted amount of 200k and below will go to small claims court, no need for lawyer and parang one-day hearing lang
      -effective aug. 1, magiging 300k and below na po
      defaulted amt. of 200k and above will go to rtc, need ang lawyer and when defaulter fails to attend hearing
      bank's legal counsel will request summary of judgment (meaning case is not full blown) and syempre court will favor the bank and payment will be pay-when-able but penalty is .5%/month and gusto ni bank 3.5%

  73. Hi Ms. Cherry, good afternoon po.

    Hingi lang po ako ng advice, meron po kasi akong cc under Unionbank since 2014. And unfortuately po nawalan po ako ng work that time din, so I didn’t get the chance to pay yung utang ko. I think mga nasa 50-60K na bcoz of the interest chu chu. Eh nasa 20K lang ang credit limit ko.

    Na receive na fin lahat ng mga kadaraman ng mga c/a na yan, texts, emails, calls, letters and I ingore them all. Kaya nga lang ngayon tumawag sila sa bahay and si Mama ang naka sagot, may case daw na file against me estafa daw and they would only give me until tom 3pm daw. Natatakot si Mama for me kasi pulis ang tumawag.

    Pero since may relative kami na pulis tinawagan ang “pulis” na tumawag sa bahay, and parang galit pa sila na hnd ako yung kumakausap. Hnd rin sila maka sagotsagotsa tanong ng Tita ko kung saan na police station.

    I know its my responsibility po na bayaran ang utang ko sa cc but as of now po kasi I am waiting po for my visa to be processed. I’m going to work abroad po kasi to help my family financially. Ako po kasi ang panganay and I wanted to support my other siblings sa education nila.

    Totoo po ba na may file na na case ang UNIONBANK against me? Maapektuhan po ba ang visa application ko?

    1. @Maezee, hi no postings yet bout ubp filing for a case and if bank was serious to file a case... matagal na pong nangyari yun and NOT for estafa ( pls. tell that to the peteng collector) and pramis si c/a lang ang tumawag at hindi si pulis-patola (they have better things to do kesa pumatol sa kautangan sa banks)
      -good luck on your work overseas and yes pag ok na ang finances... just call the BANK and pay

      -what you can do is to request the judge to re-compute the amount you owe the bank
      am afraid na court will not care if we have been unemployed for years.. and what they would like to prove/establish na indeed we owe the bank
      -now pag walang pambayad... eh di wala
      no imprisonment and sabi nga ni banker "we cannot be put in the firing squad...lol

Hi Miss Cherrylou, ask ko lng po way back 2014 nasa Saudi ako, may loan ako sa isang bank doon unfortunately nagbawas ng tao ang company namin at isa ako don sa natanggal, lahat ng nakuha ko sa company automatic kinuha ng bank. Akala ko ok na lahat din after 2 years start ng naka received call and txt ang mother ko asking for payment mga law firms sa pinas. naka received din ng final demand letter. may travel ban daw ako etc. ang tumawag sa mother ko ay credit collector parang ALLTEL ata yun.

    ask ko lng po kasi uuwi po ako sa pinas, natakot ako baka pag dating ko sa immigration mahold ako. possible ba na may case na ako sa pinas? pwde ba nila ako mahabol dito sa UAE? salamat po.

      -not possible na habulin ka sa uae

    situation: BPI defaulter last dec 2016 and initial unpaid amount is around 450k (ballooned now to almost double after 2 years).

    1. Can I apply to other jobs if I have a defaulted card? What happens sa CMAP background check and how would that affect my application?

    2. Anyone here who has a defaulted card but was approved for a US VISA? I have a Korean and Japanese Visa but these got approved prior to me defaulting and now I'm wanting to know kung meron dito na first hand me defaulted card but got approved for a US VISA. I'm scared kasi na pwede ako madeny because of that.

    3. if my prospective new company's payroll is BPI, should I pursue my application to them even if I have a defaulted card under BPI?

      did bpi file for a case?
      1. sure you can apply for other jobs
      -preferably not in banking/financial (?) industry
      lalo na if supervisory level, prospective employer might check with cmap
      2. haven't tried u.s. visa ( and yes even with a decided case for sum of money i was able to get visas with korea and japan)
      -if defaulter lang, no reason why you can't get a visa
      -just give it a try ( anyway visa officer will just depend on the way how you will conduct the interview
      3. well with payroll account, understand it's case-to-case kung ma-o-auto debit ang payroll account mo ( sa ibang defaulter...di naman daw- malamang di na flagged ang payroll account nila )

      1. Managerial na po kasi yung position ko and inisip ko if pag nagapply ako sa iba at nag negative record ako sa CMAP (most likely) and how it will affect my application

      2. Yung US Visa po specifically yung gusto ko ding malaman, kasi though alam ko na more of criminal cases yung hinaharang nila im not sure if meron na ditong nadeny/approve ng US visa kahit defaulter sila. Ang mahal po kasi ng visa fee kaya nakakahinayang magtry ng magtry hehe.

Btw, sinabihan ako na kapag di ako nakabayad, bukas ng 3pm may mag site visit daw to see my properties (as if mweon ako. Hehe). Sabi ko po sa sobrang pananakot nila, sa korte na lang kami magkita at nagreply po sila na 'if thats what u want. Be sure may pambayad ka.'

    Ano po kaya next move nila? Manggugulo po kaya sila sa office o bahay? Huhu

    1. @ cheche dumlao, hi when faced with a bp22 case as per banker's adv. just attend when subpoenaed and bring all the cleared checks (aware naman si judge na pdcs were issued to pay off loans and not to defraud) now if you don't have the cleared checks pwede i-request sa bank or a simple bank statement will do

      pag walang pambayad eh di wala... malamang same penalty to apply .5%/month

    Meron po ako 5cc na dina nabayadan way 2016 po kc due na nawalan po trabaho c mister ngyon po panay demand letter po dumadating so dedma po ako kc dati humingi nadin po ako advice kela banker and buntis po ako that tym and sabi nga po mas priorities ko muna ung health ko at ni baby ko..

    So ngyon po ung isa may hawak kay Metrobank ngpatawag ng paghaharap sa barangay last july 24,2018 di po ako pumunta kc umalis po ako para mg pick up ng order ko kc ng oonline seller lang po ako ngyon
    So bumalik po barangay same day sv bakit di daw ako pumunta.. so dedma lang po
    Kahapon po may pinadala uli paanyaya para sa july 27,2018 sa makatuwid bukas po iyon paano po kaya un kung ayoko makipag usap sa knina sa baranggay dahil wala naman cla magagawa tungkol
    Sa utang ko sa cc..
    ok lang po ba na di na talaga ako pumunta ng baranggay?

  84. Unfortunately, nalulong ako sa bad habits. Bili ng bili ng gadgets tapos nawalan ng job kaya di na nakabayad kahit yung minimum lang. Nagpatong patong na finance charge and late payment fees ko. Hanggang sa umabot na ng 50k. Meron ba way para di na madagdagan yung utang ko? Gusto ko bayaran pa rin utang ko pero paunti unti lang muna. Naiisip ko rin na di na sana bayaran pero ang consequences nun is mahihirapan na ko kumuha uli ng card and nakablocked na ako. By the way, nasa CA na yung profile ko and ineemail lang nila ako.

    I have been a silent reader so long. Palagi akong naka-kalma pag binabasa ko itong blog/comments.
    Salamat sa inyong dalawa sa mga advices and support.

    I'm a new defaulter po of 3 months. I have not paid 3 CCs.

    I owe the following:
    EW - Php 485K principal po ito. For 2 years I have only been paying minimum amount due, ndi nga lang nababa ang balance.
    MTBC - 183K outstanding balance + 100K of installment (due to balance transfer).
    PNB - 150K outstanding balance + 163k of installment (insta-cash).

    Before, ang MTBC and PNB, I pay 3k more + minimum amount due. But last May, yung budget ko for both, ndi ko na kinaya. Ang EW, ndi ko talaga kaya ang budget. Minsan hinihiram ko ang pang-puno sa minimum amt due. Minsan naman, tinitipid ko ang panggastos sa bahay para me pang puno sa bayad.

    Last few months, wala nang nagpapahiram.

    Aminin ko po, kalahati po ng outstanding sa bawat card, ndi ko po nagamit sa magandang paraan. Ginastos ko sa pansarili. Ang natitirang kalahati sa bawat card, dun ko po kinuha ang mga panggastos sa bahay, at pambayad ko sa house and business loans nung nawalan ako ng trabaho ng 2 years.

    Ndi kumita ang business. Tinakbuhan pa ako ng partner ko. At ako po ay bread winner.


    Nag email ako sa BSP na tulungan ako kausapin ang mga CCs na magkaron ng payment restructure sa amount na kaya ko.

    Ang reply ang BSP na kaya lang nila mag facilitate but cannot dictate the CCs. Tumawag naman ang 3 CCs. Kaso, ndi ko po kaya ang monthly amortization. Mas higit pa sa minimum amount due na binabayaran ko. Plus me downpayment pa muna ako na Php 20,000. In fairness, wala namang PDCs na hiningi. OTC payment lang daw ang next payments.


    Sa ngayon, ndi ko pa talaga kaya mag bayad. Sa ngayon, ang individuals muna ang binabayaran ko unti2x at yung CITI Ready Credit (na matatapos this Oct2018), at CITI CC (na sa Oct2019 naman matapos)


    Ang mga tanong ko sana ay:
    1. I-inform ko ba ang BSP na nagcocoordinate naman ang 3CCs pero di ko nga lang kaya ang proposal?
    2. Me emails po ako nareceive from 3 CCs. ndi ko pa na-open. Natatakot ako sa laman ng email. Replyan ko po ba email nila ? Paano kung me Read-Receipt feature na kinabit sa email?
    3. Me snail mail akong natanggap from 3 CCs sa bahay. Ang mama ko nakatanggap. Natatakot din akong basahin kasi, naka brown letter envelope. Usually, white envelope ang sulat. Paano kung ako ang na-tyempuhan ng CCs sa bahay? Pede ko bang i-received ang snail mail?


    Naka-silent po ang fon ko since nag default ako. Minsan po sinsagot ko ang tawag. Pag sa office tumawag, no choice naman, kailangan sagutin.

  86. @Tinuk88, hi understand you have defaulted on your cc for the past 2 months and i guess when newly defaulted given na madalas ang follow-ups ng inhouse collection or sometimes after one month of non-payment 3rd party collector agad (but once settled babalik po sa current status
    and ok po to prioritize muna yung ibang payables like sa mga tao and with citibank
    -kahit paano you will be able to pull through with one account at one given-time
    1. no need to coordinate with bsp, as you are aware na di naman po kakayanin ang amortization
    2. nothing to worry with emails from the bank (they are just making follow-ups on your payment)
    3. again ok lang to open the brown envelopes- just a demand letter and okey for you to receive and sign...
    yes, you have the option not to take calls on your mobile and it's also my diskarte as much as possible to take calls in the office to prevent the comedians from leaving nasty messages with my officemates
    and no postings yet on your defaulted banks in filing for sum of money cases and if ever they do
    -it will just mean the end of the collection and co-terminus the end of the abusadong collectors
    and pls. hang around... and yeah someday when finances get better ok naman po to pay bank directly
    -pag pumayag... well and good
    pag ayaw... it is simply their lost
