Afraid Of Being Sued?

Defaulter's paranoia stems from believing ANYTHING a collector say,
including the threat to be sued in court.

Afraid? dare their bluff!
"Let's talk in court para legal lahat. Ayaw mo pa nyan ?
should be the standard reply.

What is more legal and fair than the court?
Kotong Kolektors? you cannot trust them.
 mawawala lang ang bayad mo dyan.
the bank?
it will simply snub you.

Wait for the court.
the decision is ALWAYS :
" Pay Pxxx plus interest until fully paid"
meaning - pay when able!
oh, ha?

  1. Hi banker, yes po and pag yan po ang tnxt mo sa kanila lalo clang manggagalaiti. Base on my experience a while ago thru txt msg. Sobra po talaga cla mang bully. Lahat ng sasabihin mo babaligtarin nila. Kaya ang panakot ko din is hindi ko buburahin lahat ng txt nila gagamitin ko un para ipansagot sa mga pambubully nila. Sa government ako nag wowork. Ang cnabi nya pa po tatawag daw xia sa 888....huh hello 888??? Ei hotline ng smart un ei. Engerts!! Hindi naman un hotline ng government. Tapos inintay ko cla dumating ngaun kc sabi nila maghanap n daw ako ng lawyer ko kc i field visit nila ako at ipapahiya nila ako sa ofc. Hindi ko n cla cnagot. Intay lang ako ng intay wala naman dumating.

      meron ako business loan sa Asialink, 10,500 nalang balance ko sakanila. hindi ako nakapag bayad ng monthly ammortization ko last month and baka hindi rin ngayon month kasi my need akong isettle for my family. Etong collector ng asialink, pinuntahan work place ng comaker ko, nag announce dun na ipapa summon daw sa barangay kung hindi ng bayad. namahiya sya sa workplace ng comaker na hindi naman siya ang nangutang. please help me ano next steps ko

  3. Thank you ms cherrylou sa info about prime alliance. Mr marc p. Patatagan po ng loob. D nko stress sa kanila i always tell them to see me in court. Hintayin ko na lang with civil case number.   4. Hello po, kanina may dumating na letter na parang subpoena, galing ng rtc ng Makati. Totoo na po ba yun na dedemanda na ako ng bpi sa non-payment ng credit card? Been ignoring the agents for almost 2 years now pero nagulat ako kanina kasi from the trial court na galing yun letter nila. Ano po kaya gagawin ko?

    2. Yun summons po ba yun na ang demanda nila for the case sum of money against me for defaulting my credit card? Nabasa ko po dito na usually if magfile ng case ang bank di aabot ng more than a year, yun sakin po kasi almost 2 years na mga letter and email lang pinapadala sa akin na dinededma ko lang palagi.

    5. Banker, yun amount na naiwan kasi sa credit card na di nabayaran mga purchases ng mother ko na supplementary ko which unfortunately eh na scam at di nagbayad ng mga niride sa card ko. So wala kami pambayad talaga.

Hi bengbeng, ako naman i just received a call here sa office from CIDG daw sya at asking kung aware ako sa case ko sa Makati din, kesyo hindi daw matutuloy ang operation nila sa pag garnish ng house namen kung ndi daw ako mismo ang makaka received ng subpoena.. kaloka diba, ang daming problema ng bansa pati utang pinapakialaman na ng CIDG ngayon. hehehe.     3. civil case yun, not criminal. Even criminal cases, like estafa, they can still leave the country. Ako i went to thailand 2x with credit card debt. defaulter ako ng 2Mphp and i sleep well @ night.

Thank you po last nalang po until when po ung writ of execution kasi for example po may iiwan na savings po ang parents ko for me eh may decided case na po siguro paano po un sa kapatid ko po muna ipangalan? If ever po to pay mawawla po ba ung sum of money case and hindi na nila hahabulin ung deposit accts ko if i will pay them? Kaso ayoko po iburden sa magulang ko po ito and ung naipon po nila for sure sa retirment nila yun. Whats the best way po?

  6. Hello banker, arlene a here. I have a bdo cc loan since 2012 which ballooned to 132k, but recently got a letter from molaer that they will lower it to 108k na lang payable by july 21. Since i dont have a job anymore, i dont think i can pay that amount in 1 payment. Below are my questions:
    1. Im willing to settle 25k out of my savings just to close this matter - should i negotiate this with the bank directly? And will they accept this offer?
    2. If i dont settle, is there a waiting period wherein my loan will be removed from the list of the credit bureau and clear my record?
    3. Will this cc issue affect my visa application to australia and usa?

    4. LenC, my default with bdo, 3 cards is almost 1Mphp. That was 10 years ago. The collectors call me once in a while. I have no intention of paying them back because they cannot provide me an exact figure, supported by papers (evidence). So i decided not to pay them.Just remember, the more u talk to them,the more you encourage them to collect. Less talk, less collect.

    5. Hi planter, thanks for the response. So, if the CA still calls you after 10 yrs, does that mean you are still listed in the credit bureau? Or, masigasig lang talaga ang CA na maningil kahit technically wala na name ng defaulter sa credit bureau? Hope to get your response soon! Thanks

      from what i understand creditors were given 10 years to collect and mabi-break lang ito when a sum of money case is filed
      -but i guess masyadong lazy si defaulted bank to keep on passing on the defaulted account/s to the crocodiles (malamang sa hindi, di po sila nag-babasa WHEN an account got defaulted
      -if you have a friend working in a bank, pls. request him/her to check with credit bureau if your name is blacklisted
      -a fellow defaulter got his name checked...and wala po sya sa list

Sa bankard, mcc and EWB na for small claim amount Lang po(in case na Magfile Ng sum of money ) tpos Po lumubo Po siya because of interest at Hindi na babayaran. Possible po ba siya na mapunta sa MTC and RTC kung Ang amount po ay lumaki over the years in case Magfile Ng sum of money or base Sila parin sa principal or credit limit amount na small claims?
    2. EWB(credit limit 99k), MCC (Credit limit 113k and 15k)and RCBC (credit limit 40k) interested po ba small claims or mas interested Sila sa MTC and RTC.

  8. Hello sir.. may dalawang credit cards po ang asawa ko na hndi na mabayaran due to restructuring ng company.nkkipag areglo po kmi sa bangko pero napaka taas po ng compounding interes nila!! Ang utang po namin ang 50k lang pero papatak po ng 125k ang bbyaran namin in 5 years sa deal na bnibigay nila saamin. Sa ngayon po bangko pa ang kausap ng hubby ko..hintayin nalng po b namin na mpnta sa collections company ang utang para dun makipag areglo ng mas mababang interes?kng dun po kmi mgbabayad, mabubura po b ang record ng asawa ko sa bangko?salamat po sa time..

    meron tumawag sakin and said meron daw akong free insurance from phil plans and need ko daw pumunta ng ali mall cubao to sign the document to put rhe benificiary ... indeclined the offer... after 2 says tumawag na naman at nagalit na ako... then all of a sudden nagalit din siya at sinabi na ang dami ko daw sa CC at bayaran ko daw... all make sense now na CA pala to... hhhmmmm new modus? hahahaha kaloka lang... share ko lang guys ...have a pleasant monday!!!

  12. Pag may Restructuring po from EWB, then hindi natuloy and naforward na kami s CA..may chance ba magka-case? Nung una nababayaran pa, pero this year nahinto na. May pinirmahan kasi si hubby na mga docs. 33k ung Restructured, 23k pag Cash daw. Hina-harass na kami dito sa office everyday pumupunta ung kolektor. Please help po. Thanks in advance!

  13. Hi Banker, MJ nga pala. Di ako marunong ng may pangalan eh. hehehe. Chinatrust Loan yung sakin banker, way back 2011 na delinquent yung account kasi nawalan ako ng trabaho. I tried to go to the bank immediately nung nawalan ako ng work para magparestructure, kaso po, di sila pumayag. SO nung naforward na sa collections agency they were asking me to pay 25k para daw na restructure eh wala nga akong work san naman ako kukuha ng 25k. ngayon po, tawag sila ng tawag sa and it came to a pont na pati friends ko sa facebook minemessage nila.

    so tinawagan ko nalang, nakakahiya kasi yung pati ibang tao ako hinahanap. ang sabi nila, magfile daw cla ng case pero may papadala daw sila na letter na kailangan ko ireceive. sabi ko kasi i.file nalang nila yung case, kasi wala naman din ako maibabayad. Tinanong nila ako kung magkano kaya kong bayaran, sabi ko 1k per month. Sabi nya sa laki ng pricipal ko, yun lang daw kaya ko, e di pa daw yun makakacover sa interest. kaya po sabi ko i.file nalang nila yung case.

    Tamo po ba yung ginawa ko? ano po pwedeng mangyari sakin?

    Di ko po alam, pero nung nag loan ako, pina pirma nila ako ng check pero hindi cya checkbook. wala naman akong checking account, so di ko po alam kung pwede kong mafile.an ng BP22.

    ano pong possibilities ang pwede mangyari?

      -kotong collector now the legal counsel ang pag-uutusan ni bank to file a case
      -now this legal counsel will try to get you the out of court-settlement, parang monthly payments din sya (with huge interest) na when you fail to pay again...tuloy ang sum of money case...ang saya di ba
      after getting your money me case pa din....lol

  14. Hi banker! Ask ko lang, somewhat related naman yung concern ko. Meron kasi akong phone, which nakuha ko through installment sa isang company. My contract was for 18months to pay. Then nakapagbayad na ako for about 10months. Nawalan ako ng work and it's already 3 months na, kaya hindi na ulit ako nakkapagbayad for the phone. Now, I have been receiving text messages saying na taga Prosecutor's Office daw telling na "your summons will be served within 48hrs for violation of Article 315 for R.A 8484 which is due for court warrant and will be assisted by PNP Pasig City". Just want to confirm if this message is a legit message from the prosecutor's office? is this just one of the ways or pananakot ng collection agency para magbayad ako? Totoo ba na makukulong ako if hindi pa ako makapagbayad? Namention nila na kakasuhan daw ako estafa, do they have grounds for this? If iignore ko messages and calls nila, possible ground ba ito para kasuhan ako ng estafa? Thank you. I'm hoping for your quick response.

    1. @yeye madam FYI meron na pong cellphone na tig P500 sa market... wala pa po sa history na kasuhan ng estafa ng dahi sa isang cellphone... kahit na po may pinirmahan ka pang contract. at ang prosecutors office ay hindi nag ttxt yan ng ganyan. high office po yan so they a process .... relax and delete the message

  15. Hello po. Kapag may sum of money case na tapos never ako nakapag bayad. Pano po yun kapag mag sstart na akong tumanggap ng pension from sss. Diba po kailangan mag open ng bank account. Automatic na maggarnish po ba laman nun kapag nalagyan?

  17. Dear banker and Cherry Lou, Based on my past readings in your blog, here is to summarize what I understand (major issues only):
    1. When CA calls, just tell them "Just sue me para fair".
    2. Better to talk and negotiate only with the bank and not the Collection Agency or Law firm. If the bank still insist the CA will handle it, then it's their loss and end of story.
    3. Ok not to attend court hearings for cc cases. If you attend, the decision will be "pay when able".
    4. Do not keep bank deposits if there is a decision for writ of execution.
    5. For bp22 cases, attend hearings and negotiate. Keep all cleared cheques.
    6. Banks file cases within one year the account has been delinquent.
    7. Notorious on filing cases are BPI, RCBC, Citibank and financing institutions (other than banks).

      -and hirit pa rin ng legal counsel (formerly kotong-collectors) for a discounted amt. for one time payment (malamang bank is kuripot ayaw mag-bigay ng pang-gasolina ni sheriff)
      -am not buying offer, para que case been filed and decided upon and it is a blessing na wala akong pera (no bank deposits )lalo na sa di-makatarungang interest/surcharges ni defaulted bank

      and one more, pls. don't keep money when there is a defaulted cc/loans

      pag-ayaw mag-commit ng defaulter, will try to call your management/hr for the simple reason na ginamit mo ang name ng company in getting the cc
      will try to call you like every five minutes till you pay unpaid bill
      -sisterhood nila si lucifera (sobrang rude !!!)

Hi Banker, just received a call from CIDG PSI Joemar Mendoza daw, kesyo madami syang tanong about my identity birthdays, address etc. he asked also if im aware daw sa makati court na ibinaba saken kung may dumarating daw na subpoena, wala naman sinabi kung para saan ang subpoena, malumanay naman sya kausap kaya kinausap ko din ng ayos, kesyo nag file daw si atty,ek2 (nakalimutan ko name)from fraud dept daw si sir Joemar Mendoza, by 4pm daw ibaba na ng makati court ang decision to garnish daw sa bahay, sabi okay basta documented at legal. Though ngayon ko lang ito na encounter medyo may takot din pero di ko pinahalata. Any advice regarding this banker and mga kadiskarte. First encounter ko si CIDG achuchuchu ehh.. Nagsawa na siguro mga kotong kolektors sa palabas nila kaya nag iba ng character. hehehe.. Thanks po sa sasagot

Im having a conversation with my ninong retires police po sya sabi naman nya meron daw po fraud dept. sa cidg. pinapa confirm ko kung may ganung name nga po sa cidg. Sabi pa nya di daw matutuloy ung operation kung hindi daw ako mag rereceive ng subpoena kasi kelangan daw ako ang makareceive. Yun nga banker di ko masyado na enjoy pers time kasi saka ndi ako makapag salita dito sa opis, pero next time banker ma eenjoy ko na. hehehe.. Thanks banker

Hi Sir Banker, good morning po. isa po akong ofw dto sa mid east. may naiwan po akong loans: aub, psbank, hsbc sa pinas. more than 10 yrs na po. nawala na po ung mga nagpa-follow up until last week nalaman nila (law firm: The Law Office of Atty Marites Sortida) na nasa mideast po ako nagwo-work na. nakuha daw po nila details ko sa dfa sa pinas at nalaman ung kumpanya na pinagta-trabahuan ko. eto kol sila ng kol sa kumpanya at kaofcmate pero ndi nila (ofcmate) binibigay number ko. ask ko lang po: (1) possible po bang magbigay ang dfa ng details ng isang ofw sa isang kumpanya or law firm?; (2) papauwiin dw nila ako thru the embassy dto. possible po ba un?; wala naman po akong criminal case pero possible po bang maghain sila ng criminal case against me?; and lastly po, (3) anu pong gagawin ko? isettle? im sure super malaking interest na po un kasi more than 10 plus years ago na eto. hingin ko po payo nyo. salamat po at more power - Annie

    2. hi banker. salamat po sa reply. eto natawagan nila ako sa landline ng ofc namin. parang gangster kausap. demanding money and all. kelan dw ako magbabayad, etc. ndi ako hinahayaang magsalita na bigyan ako ng panahon. lumobo na sa 200k+ ung 30k na utang noong 2004.. then i dared their bluff. kako kung ganyan kayo kausap, cge file a case in court. at pag uwi ko eh dun n lang isettle. aba bigla bumawi at sabi "cge cge, wala lang kaso". pati ISIS ginamit na pantakot. threatening. so sabi ko ganun n lang, see you in court and then i hang up. tama po ba ginawa ko? nakakatakot po kasi..

      Creditors are just given 10 years to collect and mabi-break lang ito when the creditor files for a case
      -malamang bank is sooooo busy and di na-inform na past na sila sa prescriptive period of 10 years kaya na-endorsed pa sa mga crocodiles yung account mo...and collectors won't even care na matagal na nga pala yung account mo...so sobrang labo na to collect
      -pls. use the extra budget for your family or donate sa charity...that's the most sensible thing na pwedeng gawin
      -i myself had a sum of money case in 2014 and am good- ayaw ng bank ng money ko eh di wag
      -and sa totoo lang i was able to deal directly with citibank and union bank...no harassment and have paid them almost 500k and it was ok with me ( i never ever want to run away from utang...am just bidding for time )
      and sa ngayon i will use my extra money sa needs ng family...travels abroad...joke

Hingi po sana ako ng advice 5mos defaulted po ako sa RCBC worth 40K total standing balance, nawalan po kasi ako ng work kya hindi na rin po ako nkabayad at wala naman po ako balak takbuhan, pero sa ngaun po wala po ako pambayad. Naka received po ako lagi ng txt minsan na tawag hindi ko na rin po sinasagot. Etoh po ung txt nila.

    4. I had a credit card from RCBC, balance was less than P80k, they went ahead with the filing of the case, when my brother checked with Pasig Regional Courts, meron daw talagang case. I ended up paying it with the interest. super stressful.

  27. Hello guys! Goodmorning! Ask lang ako. I received a call from an agent in Eastwest. Pinapasettle ako ng balance nga min. due amount ko last month. Hindi ko kasi nabayaran full kasin financial problems. Sabi nia sa akin dapat tomorrow msettle ko na kasi kung hindi eh babayaran ko daw ang outstanding balance ko sa cc ko. Eh panu nia wala pa akong pera. Anu mangyayari kung di ko po mabayaran lahat? Makakasuhan ba ako?ang taray pa ng agent hindi pa mapakiusapan.

    1. @Michelle Remy Artates, hi yes most of the inhouse collecting agents ng ewb are rude, if you fail to pay for the next 3 months, they will offer you repayment for 60 months, yes gusto nila palakihin muna yung total amount due mo sa bank bago mag-offer ng repayment
      -pls. take this example, i was late in paying my monthly due for one month, so the next month i requested the least amount i can settle to keep my card active, when am finding it hard to pay i told them that i want repayment and they said not available yet...so for the past months i've been paying the least amount and this time the total amount due is 3 times my credit limit...OMG, so i stopped paying and this time they are offering a repayment for 60 months...past my retirement and i told them "NO" bec. for the longest time i've been requesting for repayment and as greedy as they are pinalaki lang talaga nila yung due ko sa bank (like my credit limit is 22 and now total amt. due is 65k... 43k just for interest (that's crazy man...)
      -pls. don't worry no case with ewb, sadyang pain in the ass lang mga agents nila...so just learn how to deal with them
      -if you're a member of pag-ibig/sss mas safe mag loan sa kanila

Sabi nila wala pa ngang ganyan program na available ngayon kung meron daw bakit daw hindi kung yan makakatulong sakin. Pero ang sungit pa the way na pagsabi nia. Nagresearch ako. Tapos nakita ko yung IDRP. Familiar ba kayo dun?

    I have a debt po sa bdo Credit card po and right now it's 195k already. Hindi ko din pinapansin calls at letters from Molaer Law office. I'm planning sana to pay 15k para mabawasan ung debt ko at di na ako kulitin, kaso wala ako work and I talked to the agent sa molaer na kung pwede habaan ung years na pwede ko sana i-installment after ko ma pay yng 15k. Ang sabi 2 years lang daw pinakamatagal nila at may interest pa daw un so magiging 200k+ pa ung debt ko at lalabas is 9k a month babayaran ko for 2 years. The prob is wala ako work. Un ang sabi ko sakanila. Kaso un lng daw terms na pwede nila ibigay. Ano po dapat kong gawin? Gusto ko sana mabayaran para wala ng mangungulit kaso wala din naman ako work. May konting kita lng ako from online business ko pero hindi din lagi may Kita. Babayaran ko pa ba sila or ignore ko na lang sila or kelangan ko ba sabihin everytime tatawag sila na wala ako work at not capable to pay them?

      and better use the 15k sa needs ng family
      if you buy the offer of the crooks you will only be feeding their greed and 9k/month is a huge amount... khit po for a person earning 50k a month...struggle po yung mag-bayad ng 9k
      -pls. tell the crooks when they call next na you are out of job period, no need to tell them your life story
      -now if you take the offer of the comedians and fail to pay, the more na iha-harass kayo ng c/a and promise wala pong mapupuntahan lahat ng ibinayad nyo
      -so focus lang po on your needs, wala pong forever with the crocodiles
      -someday pag ok na ang finances, try to speak with the bank directly and pay...pag ayaw nila eh di wag...it's their lost and not yours

  32. Sir Rene , ms cherrylou and mark. Marami akong cards na Hindi na babayaran kasi bumagsak ang business namin , sa mga cards alam ko bang isasagot sa mga buwayang collectors nayan. Mayroon din akong mga apat na personal loans , nagissue ako ng checks I think naka seven mos ako na good payer, closed na rin dahil nga bagsak ang business. Doon sa mga personal loans ko may chance bang magdemanda ang mga banko? Than you po! Mr Joe guisadio po.

    1. @ joe guisado, hi from what i understand it is the lending companies/5-6 banks who are quite serious in filing for bp22/estafa case
      -again as what banker had said, just attend when summoned/subpoenad, court is much aware that pdcs were issued to pay off loans (pls. keep the cleared checks on hand or kung di available the recent bank statement showing the cleared checks)
      -as per google, penalty is to replace checks na-nag-bounce or kung di pa kayang bayaran...walang magagawa si bank
      -kalma lang po and magiging ok ang lahat financially
      (lagi pong me awa ang Dios)

    4. @ Mommy Mae, hi with your defaulted amt. (if ever bank files for a case) it will just go to the small claims court
      as per google, one-day hearing, no need for lawyer (unless plaintiff or defendant is a lawyer)...para mediation
      and you will attend if you need to question the defaulted amt. (that is kung masyadong over ang mga charges), judge will more or less adjust all the surcharges...so mas maliit ang babayaran
      -now kung wala extra budget to pay, ok lang po not to attend

    This is Marichou,  please advice naman po.  May naiwan po akong credit card balance at bank loan sa UAE, sa totoo lang di po intensyun na iwan.  Masyado po na naging masalimout ang mga huling naging araw ko sa work doon. I got 2 warning for termination sa di ko naman responsibilidad. Mahaba po kwento eh basta yun po dahilan ng pag uwi ko ng di inaasahan. Masakit po talaga kasi yung gratuity ko na close to 1m pesos di ko na napakinabangan,  naging pugante pa ako.
    Mahahabol po ba ako dito sa pinas. May konting bank deposit at konting stocks investment po ako,  mahahabol po ba iyun?  Please help and advice naman po.

    1. @ Mommy Mae, hi pls. don't worry bdo is not that notorious in filing cases (notorious ones are bpi, bankard and lending companies aka 5/6 banks)
      and if BANK filed a case it is purely civil like an annulment case and i for one didn't attend any hearing and am ok
      so relax lang po and focus on basic needs of the family (food on the table and education of kids)

Advisable po ba talaga ung "Pay when able" kung lumalaki ang utang mo, nagbabayad po kami paunti-unti pero halos wala na natitira para sa family ko at parang interest lang ang binabayad namin. May pinadala sa kin ung collector na contract pero di ko pinirmahan, Basta nagbayad na lang ako pakonti-konti, thnx po -bong

      hinde yung sinabi lang sa iyo ni kotong kolektor.

      Rule No. 1 - If you cannot pay, don't.
      Rule No. 2 - Prioritize your need; not their greed.

      In theory, your debt will grow "until fully paid"
      but in reality, it is simply being written-off after 6 months.

      -and di po pinag-tatagal ng bank ang filing of case bec. it is their policy and the only legal way they can get their money ( na puro interest and surcharges naman) by garnishing bank accounts
      -when there is a decided case for sum of money
      after being in default for almost one year, i had my case with bpi and bankard and am good
      -just followed banker's words of wisdom

      -malamang kuripot si bank mag-bigay ng pang-gasolina sa sheriff to check on my bank accounts...and sorry na lang "am not keeping bank accounts
      -and i don't have that money para ibayad sa kanila, besides di naman mawawala yung sum of money case...so why would i pay them (i was asking them repayments before, but grabe offer nila..like di na kakain ang family ko and di naman pwede yun...as i was also doing repayments for citibank and union bank- deal done directly with bank...no harassment...yay and am not fully paid.

  40. hi banker, ms Cherrylou and everybody else. Thank you for this blog. I am a CC defaulter of EWB, CITI, MBTC, SCB and PSB loan. I defaulted Oct 2015 to July 2016. Nagsunod sunod kasi mga expense, naloko sa negosyo kaya nalubog sa utang. pambayad ke CITI, inutang kay SCB and so on. I tried to pay min amount lang for 2 years to save my credit score. kaso, di na talaga kinaya kaya isa isa na ako nag default sa mga credit card. I found this website sometime March of 2016. Simula nang magbasa ako naging tahimik naman po ang life ko na. May mga small issues lang that bothers me.

    1. Paano po kung may mga bank deposits ako sa BDO? you mentioned in one of your post na pwede magalaw yun kapag lumabas na ang writ of execution. (syempre court hearing etc muna before this). So, hanggat wala naman ako court hearing na summon, safe po ba mga deposits sa ibang bank?
    2. I read in one of ms. Cherrylou's post na sa anak (legal age) ipangalan ang bank deposits and title ng lupa (if any). Should I do that now kahit wala pa ako na receive na summon?
    3. kasali po ba ang junior savings account ng mga anak ko (with my name) kung sakali may lumabas na writ of execution?
    4. affected din po ba ang credit score ng asawa ko dahil defaulter ako?
    5. kung mag start po kami ng corporation today, pwede pa rin po ba ako maging one of the incorporator? natatakot kasi ako baka pati yun eh madamay.
    6. tama po ba understanding ko sa timeline.
    - if bank will file a case against your unpaid bills, it will happen within a year of nonpayment
    - if no case was filed within a year. move on na. di ka na fi-filan ng case for sure.
    - if case was indeed filed, you may choose not to attend court hearing
    - after the court hearing, 2 MONTHS bago magkaka resolution
    - 2 YEARS bago lalabas ang writ of execution
    - 10 YEARS bago mawawala bad credit score (paid or unpaid po ba?)

  43. Hi banker, after 2 yrs po eto i got a writ of execution. Summoned kami ng mr. ko pero the decision of court hindi na sya kasama sa liable to pay. Wala naman ako o kami ari arian kahit savings acct. Except payroll ng asawa ko. Ano po ba scenario to expect pag may ganitong event na po. Salamat po.

But she forgot to take a photo.. kaya hindi ko masyadong alam un details. There was also MTC Number given to her and a name of the Sheriff (if it's really true). Are you planning to go? Can you keep us posted, please?

    I am a Standard Chartered Bank Defaulter since 2013. Lately an agent from Aiqon called me to collect in behalf of Standard Chartered . They sent me a letter of assignment from Standared chartered dated January 2010. However Standard Chartered has been closed in the Philippines since 2016. When asked where my payment will be credited snce SCB is closed already, they said the payment will be credited to East West Bank since all credit cards and persoanl loan debts were already transferred to East West. But the certification of full payment will come from Aiqon because they already purchased my debt with SCB. But they said I can confirm with East West Bank. Since I emailed BSP consumer affairs and east WEst Bank to verify if my debt was transferred to them. East WEst Bank emailed me back and said that my debt was not included to those transferred accts and told me to coordinate directly with AIqon. My concern is this . Do Collection Agencies really purchase debts here in the Philippines? If so, what document should I ask from Aiqon to prove that its true? Please advise because I do not know where to ask anymore. I am not sure if I can ask BSP regarding this.. What will happen to my payment in case?
    I am really worried, especially when East WEst Bank directed me to Aiqon. I do not know whom to trust anymore.

    PS one reason why i emailed BSP is because i have been harassed by Aiqon's collection agent. According to EAst West my complaint on the handling of the agent was forwarded to them by BSP.

    I am also a CC defaulter. Just last year BPI called me an offered me a credit card, which I didn't apply for. They said, auto approved daw kasi yun, then I didn't wait for it kasi I really thought baka scam lang. After a week or two, dumating yun card, they even gave me a gold card with CL of 200K. I used some of it, then may mga naki-ride sa card ko, and they ended up not paying it. I had to shoulder the payments until May 2016. Then I decided since I didn't use most of it, hindi ko na din nahulugan due to budget constraints. I still have payables aside from the card. So I believe it went to different Collections Agency, 'coz I've been receiving different letters with different Law Offices. It's been over a year since I last paid, I'm not sure which Law office it is now, I do not open their letters kasi I'm not interested in reading bad news.

    Then just last Sunday - July 30, 2017, my mom told me someone went to our house looking for me. They were from BPI daw and told her that I owed them money amounting to 340K++. My mom told them that I wasn't living in that house anymore. Then sabi daw sa kanya, it was already filed in MTC Branch 14, and there is already a Sheriff assigned blah blah blah.. There was even an MTC number given to her. She was also told, na dapat pirmahan nya yung letter and to go to the MTC within 15 days to settle or attend the hearing. Summon daw yung letter na pinakita sa kanya. She refused to sign the letter, kasi sabi nga nya I don't live there anymore so why would she sign.

    The letter was open daw, hindi sya sealed or anything, and it wasn't in an envelope. She said she wouldn't receive anything, so the man left.

    My questions are:

    1. Is it legit to say that the delivery man was from the Law Office / Collections agency? or is it really from MTC?

    2. Why does he know the information of the letter if he was just a delivery man? And why did he shared the information to my mother where in fact hindi naman sya yung involved?

    3. Is there really a hearing happening at MTC Branch 14?

    4. Will there be a Sheriff going to our house to claim what we own?

    5. What should I do? Do I have to check with BPI? or do I have to contact the Law Office handling the case?

    My mother is stressed out, kasi daw iniisip nya baka bumalik yung delivery man or baka daw Sheriff na yung pumunta sa bahay namin and hulihin ako. Is there something we should do? Please help.

  51. I have been a credit card defaulter (HSBC) since last year.

    Been with HSBC since 2008 was been a good payer till 2016 kasi hindi na namin mahagilap yung naka-ride sa credit card namin.

    Since 2016 naka-ilan CAs na tumatawag sa bahay. Mostly na-mentioned na din dito mga naghunting sa akin. Dahil kay Banker natuto ako sumagot at iignore mga CAs na yan.

    Lesson learned wag pumayag sa mga ride ins sa credit card, ultimo kamag anak wag.

    Like defaulters here hindi ko din naman tatakbuhan, its just that enough lang sa pangsarili ko budget ko sa ngayon. At the same time sa kokonti earnings ko nakaka-ipon naman kahit paano.

    Slowly build wealth first and never forget the LESSON.

      na bother lang kasi si mother earth talaga.. lalo na nung sinabi sa kanya un word na SUMMON and SHERIFF. grabe sila manakot. And besides, para ishare yung information na yun sa ibang tao, that's also weird. Kasi I believe it should always be a confidential information especially kapag mga letters un dumadating, dapat naka envelope.

      The same way na pag may nag open ng letter na inde naman sila yung recipient diba pwede mo kasuhan yon technically. Parang ganon un dating sakin nun ginawa nila, but in their case, according to my mom, naka open daw talaga yun letter. Sayang lang at hindi nya na picturan.

      In this case, since one year mahigit na yung last na hulog ko sa BPI, I would really assume na hindi na si BPI yung nag hahabol sakin, am I right?

    -from what i understand, summons/notices must be properly received or the filed case will just be archived (case won't prosper)

    fyi i had a sum of money case in 2014, writ of execution in 2016...and no sight of sheriff in my doorstep and bec. bully si kotong-collector before and was mumbling about ownership of motor vehicles...what i did was to transfer ownership of same to my kids (now of legal age) and for further acquisition automatic na sa name ng mga anak ko
    -for me, useless in paying back the bank (halos interest/surcharges ang filed amt.) and i was offering them repayments Kahit me interest but ayaw nila...so de wag
    -and di naman mawawala yung sum of money case ko and am not stupid naman to put my money in the bank (kung meron man... besides my kids can keep my money in their bank accounts...)
    -if ever bank is not kuripot at nag-bigay ng pang-gasolina ni sheriff, he will just go after bank accounts
    5. yes you can check with the bank or sa crocodiles
    -as per my experience, crooks were offering repayments in 3-4 years like baloon payment, but the catch is; if i fail again to pay tuloy ang sum of money case
    -masaya sila, after getting my money me case pa rin...
    please Mom to relax and don't mind the crooks, and don't ever receive/sign the summons
    -after all you're not living with them anymore

      Sobrang doubtful din talaga kasi ako.. meron kasing case number na binigay.. then the name of the Sheriff Marvin Calma. When I googled the name, ang lumabas is yung drug related name. I am not sure if they are the same person or hindi. On my part, the only concern lang for me is, kasi na bobother yung mother ko. Pero sinabihan ko na din naman sya na don't sign anything nalang, and kahit anong sabihin nila or hingin sa kanya, do not get involve.

      Nagtataka lang din ako, may mga letters pa daw na dumadating sa bahay from BPI, with BPI envelope tlaga, that's why I'm unsure kung it was BPIs doing, or sa Collections agency na tlaga sya.

      This is stressful for me and my mom. Sana lang wag na silang bumalik. In any case din na may hearing, shempre I won't attend since I did not see any summon naman dba? I hope that what I'm doing is right. Besides, tama po kayong lahat, mas madaming mahalagang bagay ang dapat kong pag tuunan ng pansin rather than paying them.

      Sobrang thank you sa response. Nakahinga ako ng maluwag ng onti. Sana lang di na sila manggulo ulit.. knowing na wala na ko dun sa address..

  54. Hi po miss Cherry- tanong ko lang po pag may writ of execution na anytime the sheriff can go after your bank accounts and your properties? How long will the writ of execution take effect, and how long can they garnish what i have? is it going to be forever? I mean kunwari may writ na, i closed all my accounts para wal asilang makuka, pero in the future gsuto ko mag open ng account under my name.. will they still be able to go after my savings kahit years na ung writ?

      R.A. 9510 otherwise known as Credit Information System Act (CISA) is a law passed in. 2008 creating the Credit Information Corporation (CIC)
      if masipag si Globe, they will submit info on your unpaid globe account and you might have a hard time applying for a credit card/loans
      other than that ok lang
      now with your globe account, you can always pay your unpaid directly thru payment centers (if medyo malaki yung unpaid amt, pwede hulugan and pag ok na just submit all receipts to Globe...

    2. I have something to share din with Globe issue, my postpaid (well, used by others din before) eh hindi ko na nabayaran since 2014. Tumigil sila mag padala ng letters around 2015. Then just this year 2017 nakakuha ulit ako ng letter from Globe, asking to settle the account but this time with a smaller value. I am just wondering, kung nag baback track sila ng mga hindi paid a couple of years back?

    3. @April A. hi as per my experience with Globe, yes there are times di sila updated sa bills ng subscriber and one will just be surprised na the next time one gets a bill (kahit pa after a year or 2) bumaba yung demanded amount... syempre if you have the budget to pay just refer to the recent bill (yes poss hulugan... choosing between 2 evils... magbayad khit installment or totally wag mag-bayad... dun ako sa first option)

  63. Hi po banker at sa pwde po makahelp ng advise. Got around 500k++ cash loan from unionbank, coz i have 2 cards with them 200k+400k limit. They have a facility where u can loan ur limit and pay in instalment for up to 36 months. Since may offer sa akin i decided to take around 400k for my bro na gagamitin nya for business and sya mgbayad nun amortization. After around 8 months mukhang nalugi un pinasok ng bro ko at di n nya mahulugan un monthly sa unionbank. Syempre akin un loan ako hahabulin ng card. I plan to default na my dues with them since wala din po ko pang aabono na nag domino effect. Bka di ko n rh.n mabayaran iba kong cards security @ 35k balance and maybank @ 55k balance. Questions ko po:
    1. Are the given banks nagtutuloy po ba na mag file ng civil case? Lalo na po for unionbank may alam po ba ng reputation nila sa mga nagdedefault na cc holders nila? Given na nasa almost 600k ma default ko sa kanila without interest charges pa yun since i always pay in full.
    2. Will they endorse them lang sa mga CAs?
    3. Kung magtuloy po ng civil case ang unionbank dapat po ba akong mangamba? Ive had 2 weeks na of sleepless nights halos becoz of this.

      if ever nag-file ng case si bank, kalma lang... pag walang pambayad eh di wala (just don't keep bank accounts as per banker, exempted po ang payroll...and so with family home free from execution

    Additional bank po pala na i default ko si hsbc@195k. May alam po ba ng reputation nila at kung mag file po ba yan ng civil case for 195k?

Gud day po Banker cc defaulter of EWB and HSBC, combined amount of 52k, may ng punta s bahay nmin at ng pkillang sheriff at sinabing kukunin daw un bahy at lupa nmin kc d nkpag bayd s credit card, not sure kung alin s bank un CA, ng panic un kapatid ko pede b nila kunin s amin un eh nkapngalan un s lolo ng lolo ko, ng iwan sila ng number s kapatid should i contact or ignore them.
