Whether you attend or not, the decision is always :
" Pay your debt plus 12% interest UNTIL FULLY PAID"
meaning - pay when able but with interest based on time.

  2. Ask ko po sana kung nagpupunta din po ba sa bahay at opisina ang mga 3rd party collectors ng Citibank at HSBC. Mag 3rd month na po kasi ako mag default sa kanila. Araw araw po sila tumatawag pero hindi ko nasasagot dahil tulog ako sa uma hanggang hapon. Aabot na sa 500k plus yung sa citibank dahil sa late charges at interest, nasa 300k naman na yung hsbc. Hindi ko na sila kayang bayaran ngayon dahil mas marami po pangangailangan. Ano po ba mga dapat kong gawin? Maraming Salamat po.

      pls. don't worry kahit mag-visit pa ang kotong-collector, but normally what the crooks do is to send a messenger to deliver the final-never-ending demand letter which you can receive but di need seryosohin
      -when newly defaulted pls. expect the kotong-collectors to be more persistent...and pls. hang around para you would know how to handle the crooks

    2. Kapag po ba na-verify na ang address mo ng mga ca, mas may chance po ba na kasuhan ng bank?
      Galing po sa nabasa kong reply nyo sa previous article, na kapag po hindi nareceive properly ang summons ma-archive ang case kaya smart na mga banks ngayon they make the collectors verify your address. May mga paraan pa po ba para di makasuhan?

    3. @Chris, hi it doesn't mean na pag-nag verify ng address si kotong-collector magka-karoon ka na agad ng case...maybe gusto lang nila masigurado where to send the final-never-ending-demand letters
      -and what i have stated before these are the 2 banks notorious in filing for a case bpi and bankard and i guess defaulted amt. should go 100k and above
      -otherwise sayang po ang effort nila sa pag-bayad ng legal counsel

  3. Banker if meron akong cc na hnde nabayaran in 2007 mga 20k po balance sa standard chartered, and plan ko ipasok sa BPI ang housing loan aftr paying the equity in 2019. Maaaprove po kaya ako? salamat po.

  4. mam cherry good afternoon po. ayan, andto na nman po ako dahil may tumawag na nman na collector ng PBCom Loan ko. due & demandable na po dw mam cherry. kelangan ko na po dw mgbayad ng kht 10K this april 18. medyo nasindak po ako sa sbi ng collector kc nkpgIssue ako ng PDC mam cherry. 11 months na po akng d nkpgbayad dhl nga sa stwasyon ko ngaun na ako na lng po ang ngttrabho. payo nman po mam cherry, pampagaan loob lng dhl, kht pa ano cgro ggwin nla skn, wla pa tlga akng pambayad.

      -no worries kahit nag-issued ka pa ng pdcs
      if ever nag-file ng bp22 case ang bank, just attend when summoned and explain your side
      -court is aware that pdcs were issued to pay-off loans and not to defraud (just keep on hand the cleared checks)

    Hope you can enlighten me with this I have debt with Eastwestbank and my credit limit was 20k and I am delinquent now due to financial problems, I lost my job and recently I had a miscarriage, my outstanding balance was reached now into 31k with interest and charges, today someone from eastwest bank emailed me for the amnesty program he stated that my current oustanding balance was P67,831.30 and they offering me an amnesty program I know this is too much and ridiculous, inclusive of attorneys fee daw. what will I do on this? do I have the rights for this? Thank you

I received a text message from another collection agency. Dati Telan Hipes,Receivers and Liquidators and then now this new one. Nagbayad na po ako noon eh ng interest. Tapos mukang pineprerahan na naman ako ng bagong collection agency. I need some advice kung totoo po ito or part lang collection tactics? Annoying po kasi sobra. Gumagagamit pa ng ibang panagalan ang mga to at sobrang daming bad reviews sa kanila esp pag dating sa collections na pasa pasa. Looking forward to your response.     3. frend, eto full circle. nagdefault, na demanda, na issuehan ng write of execution, napuntahan ng sheriff. eto ang sabi namin sa sherap,(together with picture), 'sherap, kung may dala ka ng listahan ka ng properties na gustong hilahin ng bangko, ibibigay kong lahat ang listahan provided na mapatunayan mong akin yan. walang aruguments, hands down ibibigay ko sa iyo basta mapatunayan mong nasa pangalan ko. iyo na.' that was 2016, today i received a letter from the the same collectors (mike salazar) giving me options to pay the amount. full circle na ulit ulit. sige lang. wala naman akong magagawa, walang pambayad.

    I have been default on my credit cards, HSBC and Standard Chartered since 2009. Sometimes I do get the occasional calls from collecting agency until now Mar2017. I have been following your advise to ignore, and I'm really thankful to you and this blog for the last 7 years. Peace of mind is hard to come by when you get harassed by these people.

    My pressing concern right now is my need to invest for a home. I plan to avail of Pag-I big loan but I'm really fearful that my credit card debts will have me disapproved after the credit check by (CIC). Can we still avail Pag-ibig loans despite being credit card defaulters? Or no na talaga. It is a consequence we have to pay for a lifetime?

Hi Good Pm si liel po ito..what if po nakatanggap na ng sumon sa una..tapos nakalagay po dismissed kasi lumaki na ung acct ko at dapat daw sa RTC na..then after 2weeks nakatanggap uli ako sumon na inapprove ang petition nila na dalhin na sa RTC ano na po ba sunod na mangyayari natatakot kasi ako...BPI po kasi un at ang may hawak is MAdrid Collection Agency...thank you po

    don't worry mag-attend ka or not decision will be to pay defaulted bank
    -in my case the whole process took about 6 months hearings to resolution and another 2 years for the approval of writ of execution...again pag walang pambayad/bank deposits eh di wala (mapapagod lang si sheriff looking around for your bank accounts ...and di nya gusto yun; he can just put "no assets found"

  15. Good Day Banker Hellboy po ito ano po ba dapat ko gawin nito wala pa kasi akong ipambayad ng minimun due sa CC ko. So far po may payment ako monthly pero kulang kulang kaya't na endorced parin ako sa third party collection agency.     1. once na fully pay ang car loan, defaulted bank has the option not to release the chattel mortgage until you have paid the defaulted cc

    1. hi when a bank is serious to file a sum of money case it will surely happen within the first year of defaulting (as what had banker had said "di po pinag-tatagal ng bank ang filing of case simply bec. it is in their policy)
      process (in my case) took about 6 months and another 2 years for the approval of the writ of execution
      bpi, bankard and lending companies aka 5/6 banks are the ones filing for a case

  20. @banker...very interesting itong gabing to. Kanina kausap ko yung kaibigan ko at sinabi na may naghahanap daw sa akin sa favebook messenger to call legal dept. Tinanong ko kung saan galing kaso sabi ng kaibigan ko nabura daw nya kasi akala nya bogus yung message pero ang pagkakatanong sa kanya sa fb messenger is kilala mo na tong si mr. Ganito and please tell contact legal dept. Part ba ng harrasment yun?

  22. Hi maloupitt here. Umabot na sa 600k ang bill ko to date sa Metrobank cc then may mga installment pa na unbilled. I'm worried kasi baka makasuhan ako at malaking kahihiyan yon. My account is not yet defaulted pero baka papunta na dun since di ko na mabayaran kasi Ang laki ng interest then minimum due. Do you have an idea if pumapayag sila to restructure and remove interest if I will inform then na may certain amount monthly Lang ako na kayang bayaran?

    2. @Maloupitt, hi or other option is to request for balance conversion for the billed amt while the account is still active., mas lesser ang interest and you can do up to 3 years (or depending on your account officer)
      or pag di na kaya ng budget like masa-sacrifice na needs ng family ok lang to default rather than go deeper with debt

  23. Hi Banker, naka receive po ako ng email pero naka copy furnish lang ako. The email is from Unionbank. Nag email siya kay atty molaer na pinapa file na nila ng case un debts ko sa kanila. Then naka state din sa email na they will send the CA necessary documents for the case. Meron po ba talagang nang yayari na ganito? Pwede po ba yun?

Hi banker ..I'm back coz the evil collectors ay nabuhay na nman..after holy week I received a demand letter coming from new agency..anchor collection services to be exact..2014 pa ako defaulted pro yearly cla kulit ng kulit..pro dis time d na nila ako maloloko kasi anjan na kayo...kung Hindi mdaan sa mgandang usapan say the magic words nlng.. since wla pa akong work dahil sa 2batang anak ko na binabantayan...

Nde nmn makikita ni bpi ung savings mo sa psbank eh saka na lang if ngdemanda na.at may garnishment ka sa pagkakaalam ko kasi pg may order na ng garnishment inonotify lahat ng banko pero not sure with it pa din......kung ayaw mo n sha i auto debit kindly ask their csr if pwedeng over the counter na lang payment mo..

  28. Hello,Gud Eve po Banker. Ask ko po sana,2013 pa po ako ng-default EWB,dhil nawalan ako ng trabaho until now. Hindi po aabot sa 50K ang naiwan Kong balance, yun nga lng po, syempre lumaki ng lumaki ang interest. Hindi po akoh tinigilan na puntahan at padalhan ng demand letters mula noong 2013 hanggang last quarter ng 2016.Pti emails ngppadala din. Pero lahat po yun in-ignore no. Dhil nga po sa mga nababasa kong advice, nyo na malaking tulong po at nabawasan stress ko. Akala ko po ng pumasok ang 2017, wala na po manggugulo skin dahil mula Jan. hanggang ngaung April eh tahimik na mga kotong collectors. Kaso ngaung araw na to, biglang may ng-email skin na Atty. Ferdinand Chua daw at sinasabing.. In-attached daw nila ang property ko at mgpe-preliminary investigation daw sila ngaung Friday at 3:p. m kasama daw ang Barangay Captain dito sa lugar nmin at pupuntahan ako. Kung gusto ko daw maiwasan mangyari un.. Eh tumawag daw ako sa kanya. Possible po ba na mangyari un na puntahan ako at kasama pa Brgy. Captain? Nanlalambot na po ako at sobrang stress. Need ko po ang advice nyo. Salamat po.

      now if they find time to visit you just prepare a SUPER HOT na coffee for them (para magkaron ng nerbyos kahit konte

    mataray na bading daw po ung tumatawag.

But my metrobank currently admerex pa din ang naghahandle. Bakit po kaya admerex pareho unang naghandle ng 2 cc ko or nagkataon lang? Tapos po ngaun i just received text message armcollections daw naghandlw ng bdo ko. Any idea po regarding arm collections kung makulit din po ba sila? Bale 2nd CA na cla sa bdo ko. Because even if bdo file for case wala ako kahit anong assets lalo na savings. Ive read po in your earlier posts na kahit 1st CA pa lang if bank is dead serious to file a case kahit isang CA pa lang nagfifile na agad. In my case 2nd na ang arm collections. Ibig po ba sabihin maliit na possibility na magfile ng case si bdo against me? Thanks a lot po

      yes nagkataon lang po na parehong admirex ang nag-handle ng 2 accounts mo and haven't encountered arm collection yet; i guess same diskarte lang, pag nag-maldita... mag-maganda ka rin ( asar talo kasi ang game sa mga kotong-collectors)
      well in my case with my 2 accounts bpi and bankard filing of case happened within the first year of defaulting and after the writ of execution had been approved...same diskarte pa rin sila "offering a discounted amt. for one-time payment" whoa
      and am not buying their offer, case been filed so what is there to fear pa

    I am a credit card holder before in the Philippines (EWB & HSBC). I used my credit card for emergencies and other necessities. Until such time that I was unable to pay my credit card bills due to financial problems which also urged me to go abroad. But not lucky as the others, I got a job here in the UAE getting only a low salary. And I must admit that I cannot pay my credit card obligations anymore, especially that the amount becomes higher due to charges and penalties.

    The collecting agency kept on calling my mother and asking for my whereabouts (address, telephone number, etc) and even told my mother that they will give me Warrant of Arrest, they will communicate with PAO, DFA or BI and I will be DEPORTED.

    Please, I need your help on what to do? Will I be deported? or go to jail?

    Looking forward to your earliest response.

      and pls. tell Mother to ignore the kotong-collectors, they were trained to harass defaulters and crooks are bunch of liars and some of them are good at impersonation (like they can be pulis-patola, attorney-no-case etc...)
      so kalma lang po and pls. continue to move on
      of course you will not be deported nor put to jail (unless you kill the kotong-collector....)

    1. @Ms Despirada: As per Manual of Regulation of Bank, hinde pinahihintulot na magkaroon ng negative record ang isang empleyado ng bangko lalo na kung ito ay may mataas na posisyon sa bangko. Pero kung sa iyong palagay ay hinde ka naman sakop nito, walang dapat ikabahala. Usually, kung ito ay makakarating sa inyong HO-HR, ikaw ay bibigyan ng palugit para magkaroon o makagawa ng settlement/arrangement dito at matapos ang iyong obligasyon sa ibang bangko. Eto ang disadvantage ng mga nagtatrabaho sa bank at may pagkakautang din sa ibang bangko. Ang advise ko lang, kung kaya mong magawan ng paraang malutas ang pananagutan mo, gawin mo, otherwise, you have the option to choose other industry/company but not in the banking sector. God Bless!

    thousand n po oustanding ko. april 18 mY tumawag po sa akin ma miss joy na tga s.p.madrigal law firm na sinasabing dapat ko pong bayaran ng buo ang utang ko . Kung s ko daw mabayatan kahit 15 000 na lang daw parA ipropeocess daw ang papers ko para yung remaining balance ko ay maimonthly ko n lang daw. April 20 tawah ulit kung nabayaran ko n daw ang 15000 sabi ko wala akong pera . Cge daq po kahit 7500 n lang daw at dapat 3 pm mabayaran ko na. Ang sabi ko wAla pa rin akong pang bayad. Tanong ko po kung magbabayad po ako ng hinihingi nilang amount totoo po b na maaapprove yung balance ko na imonthly ko n lang. O mga nagsisinulanging lang sila ano po amg magandang gaqin ko po .     1. @busywife. Just ignore na lang po kotong collectors as they have a lot of tactics just to make believe defaulters. Me too 3 mons hindi nakakabayad. From 20k+ na pinapasettle nila umabot sa kahit 3k na lang daw isettle ko. But sorry i just told them no extra money. Hahha.. This blog is so helpful. Just hang out so you would know how to deal with crooks. Tapos sabi i field visit daw ako. Sabi ko go ahead wala pa din ako ibabayad. Dati wla pa 8am natawag na sila but now hapon na kung tumawag at kung minsan wala. Huwag mo sila paasahin. Maniwala ka sa mga sinasabi ni ms cherrylou, sir banker, justinfever, sir dhastan and others kasi naranasan an nila yan lahat. We are all defaulters here.

    2. @Ella: if you can't pay, don't pay. sabi nga nila banker, never ending financial marathon yang gagawin mo. Kung wala kang maibayad, just say them straight that you don't have money. Kung kelan ka makakabayad, sabihin mo na kapag nagkapera, kung itatanong naman kung kelan, sabihin mo tatawagan mo sila or dahil araw araw naman silang tumatawag, eh di malalaman nila kung may pera ka sa araw na yun o wala. Don't negotiate if nothing to negotiate.

I did not post this to scare but just use this as a guideline. Kasi ako meron din akong property under ny name. Thanks!

      or if i may add, if mcc is serious to file a case it will surely happen within the first year of defaulting

  50. good day po sa nyo lahat diskarte team. just want to ask advise. I received a court decision for sum of money case. Actually, i was surprised coz last feb 2017 lang start mga notices of hearings then this april may court decision na. I did not attend any hearings, and tama po kau decision is to pay Phpxxxxxxx at 6%pa plus lawsuit costs +++, etc until fully paid. Thank you po, God is good...the court is really fair in the computation; natakot ako kala ko the amount will reach the highest level of interest. Ask ko lang po since may decision na, what will I do? At this time po kasi gipit pa rin ako, no extra money. Puede po ba installment or pay if i have extra money. Where will i pay? sa bank po ba or do i need to go to the court? Parang me nabasa po ako dito, thru sheriff po ba? Paano po yon? Honestly po, until now hindi pa alam ng family ko coz ayaw ko po magworry sila esp my spouse. Please help po. Thank u so much!!   51. Ive noticed kapag friday mas persistent mga crooks pero ngayon friday aba wala pong tawag from 2 CAs. And ms cherrylou sakto lang din po ang arm collections. Sabi ng admerex i field visit daw ako sabi ko naku wala din po ako ibibigay na pamasahe sa inyo baka singilin nyo din ako sa pamasahe nagmahal pa naman na. Hehhe.. Tapos sabi kaya nga magbayad na daw ako kahit 2k muna tapos 2k ulit tapos 2k ulit kahit weekly daw ako magbayad 2k hanggan masettle ko minimum due heheh.. Sabi ko hindi ko kaya kitain ang 2k weekly. Tapos sabi gawan ko daw ng paraan sa mga kamag anak kaibigan ibig sabihin mangutang po ako hehhe.. Sabi ko wala din sila pera. Mas lalong masama kung gagawa ako ng masama para lang makabayad. Medyo humaba usapan medyo makulit admerex po hanggan sa huli sabi inote na lang daw nya possible ma audit daw ako ng bangko at ma endorse sa higher collection account ko at pabayaran ng full. Hindi na ako nagsalita po kasi natatawa na ako. Pero dati hindi ko din alam gagawin ko kaya super thankfull po talaga sa ngayon nakakatulog na ako ng mahimbing kahit manggulo pa sila i will try my best na ipaglaban ang karapatan ko.     and in my case with bpi and bankard the whole process took about 2 1/2 years from hearings which i never attended to judgement to approval of writ of execution
    -am not keeping bank accounts and diskarte of legal counsel formerly the kotong-collectors were to offer discounted one-time payment or can do 12 months
    -which of course i will NEVER buy !!!

  61. I am a defaulted payer for almost a year now. With debts for East West Bank(1M+),Metrobank(1M+),BPI(balooned to 672k),HSBC,RCBC and BDO. I am a bank employee and I sign a semi-annual Statement of Declaration for BSP. I signed the declaration twice stating that I have no existing delinquent account/s. I have been visited here at the office several times by CAs of East West Bank, namely MDES and Admerex. Last Saturday,I was visited at home by Admerex. I told him that I will just receive the letter. He insists that he explains the payment arrangement and that I need to sign it. I suddenly lost my temper and said, Are you forcing me to sign? He said No. I just acknowledged the letter by signing received by. My hands were shaking in disgust. He even asked me, What is my plan about my Credit Card? I just answered, I will just talk/call to your office. I received 14 missed calls since I didn't answer their calls.

    I am very much concerned about the visits they make, I can't answer "Wala akong pera", since someone in my office or neighbor might overhear our conversation. I don't want to be humiliated, I need to know how to address these CAs during their visits. I am planning to resign on my work just to avoid their office calls and visits. I need your input/s about my case. Thank you in advance!

    1. mam @cherrylou ask ko lang how much yung bebt mo sa RCBC at bakit nag decide sila to file a case? ako kasi just dafaulted my RCBC isang VISA gold P100k amd isang JCB P100k din. mejo na stress lang ako sa mga mangyayari kasi may isang property naka pangalan sakin. amd i have bank deposits around P150K pero kasi pang emergency ng family ko savings ko kaya di ko maibayad. As per sa mga previous sum of money cases na nabasa ko nag levy ang court sa isang porperty ng losing party

      -before i have read bout a defaulter who also had a decided case for sum of money and apparently nagkaron daw ng lien or hold sa property ( but this was not verified as di masyadong naging active yung poster )
      if rcbc files for a sum of money case better withdraw your savings and just open an account under a trusted relative's account ( sa mga kiddos mo perhaps )
      and sabi nga ni banker di po superman si sheriff to check on every registry of deeds/lto para maghanap lang ng asset ni defaulter
      -again family home is exempted from execution

  64. Banker nakakaloka. Tumawag na naman dito sa uae si kotong collector, nangungulit na naman sila. At ngayon dami nilang sinabi.na pagdi ako nakabayad.pag uwi ko daw ng pinas madami na ako kaso. And if ever na lalabas ako ng bansa.hindi na daw ako makakalabas.kasi mahold na ako sa immigration. Yung utang ko na dati 40000. 80000 na ngayon.pwede ko naman daw bayaran 60000 lang.kaso one time payment lang daw.dahil kung hindi yun nga daw.kakasohan na nila ako.

    Nagapply po ng home loan ang husband ko sa bdo and automatic pala na pag nagapply kasama ang spouse sa co-maker. 2 years na po akong delinquent pero yun ay nung dpa kmi married. Machechek pa din ba ng bank ang cc standing mo pag nagchange ka na ng surname (fr single to married name) and makakaaffect po ba sa loan ng husband ko. Thank you!

    1. @Happy me... hi am not sure if bdo will be able to check your unpaid cc, but just in case they ask just tell them the reason
      -home loan is a guaranteed loan, meaning if you default they can always foreclose your property
      and have been exchanging private messages to defaulters and they were able naman to get a car/home loan approved
      -again just give it a try and good luck po

  66. hello ms cherrylou and banker matagal na akong card defaulter 2012 pa of around 36k sa rcbc na ngayon huli 107k na umabot at simula na sa tawag at sa padala nila messenger sinasabi ko na wala ng nakatira ganoon na name dito kahit ako na yung kausap..natigil ng mga 2yrs tapos na ulit na may sulat ganon din minsan may nakatanggap basta tinatapon ko na lng tapos sabay pray ko sana wala na.last feb may dumatinng wala tumanggap iniwan so nakita ko tinapon ko tapos after 2 weeks may sulat nanamanmay bago nakatira sa amin kinuha so nakita ko ikakaso na daw sa rtc ng pasig tapos may mga annexes.tinapon ko din. ngayon araw may pumunta tapos ako nakausap sabi ko wala na yan dito,di ko kilala..tapos ask ng messenger bago na ba nakatira dyan sabi ko oo , ano apelyido nagsabi ako ng surname ng kasama ko sa haws.. tapos umalis sabay sabi sss kasi ito sabi nya tapos may nadaanan sya matanda kilala ako sa name pero di sa surname tapos sabi daw susan yun? sabi matanda oo yun alam ko pero di ako sigurado sabi daw.tapos umalis na.natatakot ako kasi di alam dito sa amin yan kaya di ko alam gagawain. tama ba ginagawa ko kasi wala naman ako ibayad wala ako trabaho tsaka yung cc wala ako finil apan pinadala lng sa haws kaya nagamit ko. ngayon ano ba pwede nila gawin ngayon sa akin?helpless mommy

    I have a defaulted account with BPI around 500k, Dec 2016 pa ko huli nakabayad and I decided not to pay anymore since need ko iprioritize ang car loan ko para sa travel ko (bulacan to pasay). They call every day pero 2 different CAs na ito, Synergy at Admerex.

    -Ano pong experiences nyo sa Synergy at Admerex?
    -Di pa po sila tumatawag sa landline namen which is un ang knakatakot ko dahil baka mastress ang mama ko. Normal po ba un na sa CP lang sila tmatawag? once or twice a day, minsan di pa complete ang ring.
    - me existing Car Loan ako with UCPB, then I use EWB checking to pay. Pano po pag may case decided pano po gagawin ko?
    - I work in our HR department and they said that we have employees na naka-garnish ang payroll because of court order from a debt case. Paano po yun nangyari?

    Salamat po, sobrang worried lang po.

      spoke to the liaison office of the ca (this ca is also our corporate lawyer) and told me that what they did to a defaulter who had a decided case for sum of money was just to look around for his bank deposits... )
      pag me decided case for sum of money, sensible to close the checking account and request ucpb that you will pay in cash/over the counter
      -i guess ucpb will request you to pay a number of days before due date para nila ma-pull-out yung pdc mo
      -this will work promise...

    3. Ms. Cherrylou, pwede kaya ipa close ang checking account kapag may decided case for sum of money na? or dapat ngayon pa lang na pino-process ang case e ipa close ko na? I have a checking account sa PSBank ginagamit ko pambayad sa isa ko loan kasi yun ang requirement nila. Sa ngayon meron na din ako ongoing case with BPI cc.. nasa 2nd notice of hearing na ako. Thank you!

      ako po at the start pa lang ng sum of money case nag-close na ako ng bank accounts/checking account- as i had no idea then how long would the case take/drag
      as i was then trying to fully pay my citibank/payment arrangement po directly with the bank and had to issue pdcs and yun po i requested citibank that am gonna pay in cash/over the counter and was told to pay about 7 days prior to the due date of the pdc so that they will be able to pull-out my pdc... and that is what i did and with God's help fully paid na po ako sa citibank
      -so pls. use this diskarte po with your psbloan
      and kalma lang po... am good

  70. Good day! Right move po ba to request for validation of debt from Collection Agency who implies that my amount due is more than half of my actual amount I owe to the bank? I would also like to request them to provide the following:

    • Agreement with your client that grants you the authority to collect on this alleged debt.
    • Agreement that bears the signature of the alleged debtor wherein he/she agreed to pay the creditor.
    • Any insurance claims been made by any creditor regarding this account.
    • Any Judgments obtained by any creditor regarding this account.
    • Name and address of alleged creditor.
    • Name on file of alleged debtor.
    • Alleged account number.
    • Amount of alleged debt.
    • Date this alleged debt became payable.
    • Date of original charge off or delinquency.
    • True and certified copy of the complete audit trail of the said account. Furthermore, in order to validate the alleged debt, please provide verification through audit certification of debt entry in accordance with G.A.A.P., PFRS, and BASEL 3 accord.
    • Verification that this debt was assigned or sold to collector.
    • Commission for debt collector if collection efforts are successful.
    • Collection Agency's Tax Registration Certificate.

    1. of course you can request the kotong-collector to provide you with all that stuff
      but promise the ca will get mad at you for the simple reason that they are not blessed with intelligence...kita mo nga po me "higher collection pala sa mundo ng kotong-collectors"
      -in my case i took all the calls of the kotong collectors and tell their faces " sorry no extra money to pay" period, i never bothered to tell them my life story ( they don't care and just after my money...)
      i took their calls as i don't want them leaving messages with my workmates and mahirap na baka pati sila ma-harass
      and lastly sabi po ni banker 'NEVER LET THE COLLECTORS CONTROL OUR LIFE", no forever with them...they just come and go and di po dapat seryosohin
      pag newly defaulted pls. expect the crooks to be persistent and parang sisterhood lang ni lucifer and after a year or two defaulter na ang makaka-miss sa kanila ( joke !!! )

It's me worried mom... just an update sa case ko. i received a letter from MTC (2nd notice of hearing) they want me to submit the forgoing Motion to Declare Defendant in Default for the consideration and approval of the Honorable Court. Kaya lang late na naman natanggap tulad ng 1st notice of hearing... nakalagay on April 20 pero ngayon ko lang natanggap April 25.

    This is it! tuloy tuloy na nga ito.. pero wala naman ako magagawa e wala talaga pa ako ibabayad :(

      -fyi there was an earlier post of problemado (who also had a decided case for sum of money in 2008/9) and no sign of sheriff at his doorstep for the past years when suddenly it was the legal counsel/formerly kotong-collector who made a follow-up on his utang and of course the amt. is nakaka-lurkey na, so he gathered all his sanity and went to the court na nag-issue ng judgement to see kung poss mabawasan yung defaulted amt.and fortunately he was able to speak with one of the sheriffs around and he was advised na having no extra money to pay to just forget the idea of paying-up and to prioritize the education of his children and pag nagmaldita pa si legal counsel i-reklamo ng violation of rep. act 10870- after all the case been filed and decided upon so di na sila pwede umeksena
      -and in my case after the writ of execution been approved eto si kotong collector humi-hirit pa rin ng discounted amt. for one time payment....whoa !!!
      -of course am not buying... para que ???
