    2. Banker yun balance ko sa ccard is 120k since august hanggand di ko na po nabayaran umabot na sa 200k.May mga nagpupunta na po collector sa house nananakot at yun mom ko ang nakikipagusap Ano po manyayari at dapat gawin?

  2. Help. 2nd time na magpadala ng "love letter" as FINAL DEMAND ng CA MC RAmiro & Associates. Sabi need ko na bayaran ng full kasi inignore ko yung first letter nila. Magpa File na daw sa Metropolitan Trial Court MAkati ng Statement of Claim. Ignore ko pa din ba ito? Thanks.

      and filing of case simply means the end of the kotong-collectors...waley ng commission hu hu hu
      and some of these kotong-collectors can be soooo desperate me case filed na with matching decision gusto pa mang-scam like offering one-time discounted payment...haler... ano sila hilo

    4. Correct. I been in your shoes before, i keep ignoring lahat ng calls, letters tapon agad, house visits with police.tawag sa baranggay.etc..napagdaanan ko na lahat. Natakot din ako nung una nagbayad pa nga ako sa kanila medyo malaki din pero nung nabasa ko mga blog dito. I stop paying them. Ngaun tuloy pa din letters pero deadma na lahat. And i learned my lessons na hinay hinay kase dumarating talaga yung point na mahirap magbayad.kaya mga kadefaulters huwag matakot sa mga ca's

  4. hi banker and the rest of the people reading this blog. Need lang po ng advice ok lang po ba na di ko sinasagot ang mga tawag sa bankard wala kc akong pambayad eh.Tumawag sila sa bahay , sa office pero kahit ako ang kausap sabi ko wala dito, sa cp pero d ko sinasagot pag unknown number. Nagtataka nga ako bat alam nila ang phone number sa bahay at office cp # lang naman ang binigay ko sa kanila. If ever na sagutin ko ano naman kaya ung magandang sabihin sa kanila? Mag two months palang akong d nakabayad so c bank followup pa lang ang ginagawa i know the worse scenario is about to come eh walang magawa walang pambayad eh. Mahirap ang buhay pero mas mahirap ang maging defaulter nakaka stress. Although this blog is so helpfull pero grabe pa rin ang kaba.

    Dito po ako sa doha ngayon and plan ko po magbakasyon jan sa pinas this march. And worry ko po baka ma-offload or ma-hold ako sa immigration pauwi o kaya pabalik dito sa doha since cc defaulter po ako 2 years na. Wala pa kcng sapat para pang-bayad lalo pa ngayon kaka 1 yr old pa lang ng anak ko. Please help! Thanks po!

      -kotong-collector lang ang magsasabi sa iyo nya
      i guess though na ma-ho-hold ka if sinakal mo si kotong-collector for telling loads of lies
      have a good and safe trip and yes just focus on basic needs ni kiddo

  6. Good evening to Banker and admin. My summon napo ako galing RCBC. Tanong lang po pag my summon napo ba ma-garnish ng bank ang hinuhulugan ko pong nag iisang bahay at sasakyan na gamit ko sa panghanap buhay pag na fully paid ko na? Pls help me po. Salamat po. Sobra napo me na stress.

      Kelan ka nag default sa RCBC? defaulter din ako sa RCBC. naka payment restructure ako sakanila nuong 2015-2016 kaso nawalan ako ng work due to illness. since october pa ako default..

  9. Banker, nagsimula nanaman mag pardam ang mga kotong kolektor. Nung tumawag sakin eh agad nag verify ng bdate ko. Sinagot ko ng isang malaking "SINO KA?" tapos nung sinabing taga SP MADRID and Assoc. Law Firm eh biglang ni call ended ko. Okay lang po ba yun? Timing din kasi nasa sasakyan ako at pauwi nung tumatawag sila. Pag dating ko sa st. Namin nakita ko yung pamilyar na mssngr nila. Kaya di muna ako pumasok agad ng bahay hangang umalis nlng sya. Na inip ata kaka antay kasi walang tao sa bahay kahit bukas gate (may pagkabingi kasi kasambahay namin) at nakita ata uniporme ng mister ko sa sampayan kaya di na rin nagtangkang mag hanap pa.

    Tama lang po ba na inignore ko nalang?

Hi banker and ms.cherry, ung cellphone namin ni missis naka silent na pag unknown number, ung landline namin cut na, para di na namin masagot ung tawag ng CA..haha tapos pumunta dito ung admerex, buti nalang nabasa namin tong blog ninyo at alam namin gagawin namin..haha di na namin sila inisiip.. Yung bahay nalang na nakaloan sa pagibig balak ko ipassume sa kapatid ko, para safe talaga.. Thanks banker and ms.cherry..

    What if 10 years ago na yung loan sa Chinatrust po na may cheques involved. Recently naghahabol ang Ultado Law office. I contacted the bank to negotiate pero sa collection agency pa rin ako pina diretso. Gusto ko i-settle na but ang kaya ko lang yung principal amount. Ang remaining amount ko nasa 38K. Ang negotiated payable amount na binibigay sa ken nasa 78K. Gusto ko lang malaman if pano ko masettle na nasa tama ang proseso kase ayaw naman mag provide ng process ng in-house collection dept. ng bank. Thanks...

    2. Just wanted to share my experience also.

      Last month may tumawag dito sa office landline, nasa ibang bansa na ako. Maybe nakuha nila info ko sa Linkedin. Nagpakilala na taga DFA and meron daw complaint against me with criminal and civil cases. Sabi, yung complainant ay gusto ako ipa-deport and requesting to block my passport, mag rereport daw sila sa Phil. Embassy dito.

      Unsettled CC and yung loan since 2006 pa ang naiisip ko na hahabulin sa ken. I asked the caller if taga DFA sya papano nya ako matutulungan, wala naman ako alam na case about me except if collection agency, may nakukulong ba sa CC and that was 10 years ago na. After a week tumawag ulit with the complainant daw. And yun nga about defaulted loan. I asked the collection agent na mag send sa ken details by e-mail in order to check and verify. Ang nareceived ko na SOA is from 38K remaining principal nasa 465K na, with payment options. I tried to contact the bank also to verify pero hirap naman maka connect. The next day tumawag ulit yung agent. I wanted to settle it na lang sana with the principal amount given they have to provide me the proof of loan. I'm trying to negotiate and of course sana valid agent sya. When I asked for the proof of loan kase wala na ako hawak na documents, nagalit po sya. He said only the bank could provide and if only it is already in the court, and he started throwing foul words. Hindi po ako makapag communicate properly kase maliit lang office namin and hindi naman related sa work ang calls, and yung boss ko opposite table ko lang. Then, he started mentioning name ng colleagues ko na tatawagan daw nya. I'm so worried that day kaya nag explain ako sa boss ko and told them about the caller and the reason of calls. Nag logged din ako ng calls nila, they are using different numbers and unknown.

      I tried to contact the bank again thru their customer care, I was endorse to in house collection dept. I e-mailed them, may response naman, pero nung tinawagan ko directly, sa collection agency din ako pina pa settle and that first caller na taga DFA daw, kaboses nya yung nakausap ko na taga in house collection dept.

      After a while, nag e-mail sa ken yung collection agency na ipoforward nila yung formal complaint sa MTC Taguig. Nag send pa sila ng copy ng draft complaint and also Promisory Note. Never ako nag reply. The next day po nag message sila with the amount to be settled is 78K. Still pano ko naman to mababayaran and mavalidate if legit. After all na pang haharass nila magbabayad ako agad... pwede naman makipag usap ng maayos para sa settlement.

      Anyway po, nakausap nya yung boss ko one time na tumawag sya and siniraan nya ako, swindler daw ako, etc. as if may pakialam ang ibang lahi especially hindi naman related sa business ang calls. He was told instead not to call again as it is not authorized.

      I was off sa work for the past 2-weeks, pagbalik ko I was informed na may tumawag ulit and again sinabihan sya na wag na tatawag ulit as he is just wasting his time, effort and money sa calls. The caller instead started swearing to my boss.

      At this time, yan yung latest situation. Not sure if tatawag pa sya ulit, pero gusto ko naman sana i-settle with the principal amount given mabigyan ako ng copy ng proof of loan.

    4. @Aemelia, hi creditors/banks are only given 10 years to collect and loan defaulted in 2006, so parang nag-lapse na po yung collection period
      just don`t waste your time with the kotong-collector and bec. the crazy collector is talking about the huge amt. defaulted from 38k naging 465k sya...wow ha masyadong dreamer si scammer
      fyi you were only issued payment stubs by chinatrust...di po sya pdcs
      well if i were you i won`t resurrect a dead issue...

      May nareceived ako e-mail from the recovery dept. of the bank, asking for my feedback saying na a review of my accounts showed that it is still unpaid with several returned cheques since 2006 and they already provided me options on how to settle my loan dahil kailangan nya daw magreport sa Management.

      The bank did not provide me options (yung rude na collection agent yung nag provide). I'm wondering baket nya pa hinahabol yung feedback ko eh nag e-mail nga sa ken yung agent na nag undergo na sila ng legal proceedings. Maayos naman ang e-mail ng bank rep... Aemelia.

  13. 2 mons na akong walang payment sa cc ko and banks keep on calling me. Walang pambayad kahit minimum due. Kung meron nga lang sino ba gugustuhin na lagi may nangungulit. Bdo texted me to pay para daw maiwasan maipasa sa CA's ang account ko pero wala pa naman formal letter from bank na naipasa na nga sa CA account ko. Do u think ms cherrylou and banker ipapasa nga nila sa CA account ko and hindi cla magfile ng case sa court? Tnx

    1. @Nancy, hi after defaulting for 3 consecutive months, account will be endorsed to the 3rd party collector
      filing of case depends on the policy of the bank and from what i have noticed kahit me policy si bank to file case and medyo huge ang defaulted amount...at the end of the day no case filed pa rin... so i guess swertehan din ang case filing and really no big deal lalo na`t walang money sa bank

    2. Stressmom. Banks are not offering like 5 yrs to pay. I tried so many times so ang sinabi ko wala ako magagawa kung ganun. Kasi sa ngayon wala ako pambayad kahit minimum due 6k plus ang minimum due ko and inatake na naman ng asthma ang anak ko. No extra money talaga. Thank you ms cherrylou for sharing ur experiences so we know how to deal with this collectors. And banker for creating a blog like this big help po talaga. Kailangan natin ng tatag ng loob at tibay ng dibdib sabayan ng dasal na malampasan natin to.

      yes ayaw ng banks ng mas realistic way para mabayaran sila and mas gusto nila to endorse defaulters sa 3rd party kotong-collector nila na mas imbes maka-tulong eh mas walang gustong mag-bayad kasi nga po mas feelingero/a sa mga defaulted banks
      and the least that banks can do is to file a case to legally recover their money thru garnishment of bank accounts... but you will see in my post kahit me decision na si court, guma-gawa pa rin ng desperate move si kotong-collector to offer the discounted one-time payment... and why should i give them the satisfaction na mag-paloko sa offer nila, eh mismong si sheriff nag-adv na wag magbayad lalo na`t wala pera n di naman solution ang mangutang para bayaran ang isa pang utang...ano yun financial marathon na lang ang ending...lol

    4. @stressmom, from what i have experienced i was able to request for a 4 years repayment with citibank and 3 years with union bank kasi nasa in-house collection pa sila
      but pag nasa 3rd party kotong-collectors na mukhang malabo na po kasi gusto nila madali ang kitahan

    If defaulter is from province, let's say region 1, talagang pinupuntahan din ng Collection Agencies? Regarding Sum of Money case kapag me hinuhulugang kotse from Toyota Financial, possible din po ba eto na magarnish kahit Hindi pa tapos bayaran?

    1. @Summer Reese, if me branch ang kotong-collector sa place nyo, malamang they will send their messenger to deliver the final-never-ending demand letters, pag wala...di na po siguro mahal ang pamasahe
      cheapest way to make you pay is of course to send you sms/emails and demand letters thru snail mail
      if there has been a decided case for sum of money, defaulted bank will only go after bank deposits

    hi just to share my experience...so i had a decided case for sum of money and as i understand writ of execution has been approved after 2 years
    "kotong-collector texted me earlier to call their office as they are requesting court to issue writ of execution...omg di na inform si kotong-collector and mas safe daw if i will pay bank at discounted amt. for one-time payment or 12 months to pay... hay naku malamang tina-tamad si kotong-collector to request from issuing-court the sheriff who will try to garnish my bank accounts... parang meron `no...ha ha ha sorry po sila... waley bank accounts
    so i guess banker this garnishment is legal-counsel/kotong-collector initiated pa rin like sila mag-bibigay ng pang-gasolina ni sheriff to go around banks... kaya ayan nag-o-offer na naman ng repayment options, but sorry to tell them am not that stupid to buy their offers... ngayon pa ( and di naman mawawala sum of money case...so what is there to lose pa...

    1. hi you can only request for repayment schemes pag nag-default na yung account mo n nasa inhouse-collection pa
      -if direct sa bank, mas less ang interest n longer repayment scheme and maybe you will still be given a decent soa
      -pag nsa 3rd party ca, bloated na po yung defaulted amount n of course gusto ni kotong-collector ng madaling kitahan...
      banker is not initiating non-payment of utang ang gusto lang nya is maka-taong treatment sa mga defaulters n maka-bayad ayon sa kakayaning budget ng creditcard-holder

A certain cellphone number texted me just a few minutes ago saying that my bdo cc was already forwarded to a collection agency and there is a landline number i need to call for inquiries or also im incourage to settle the minimum due to update my account. Im doubtful about the landline number ms cherrylou and banker d cya hotline number of bdo and bdo has no collections dept na pwede ka makatawag direct sa kanila. Need mo muna tumawag sa hotline then sila ang nakikipag coordinate. My question now do you think po sa collection office nga kaya maiforward account ko and they are not going to file a case against me? Mas ok sana kung sa court para less ang makukulit na collectors. Im very much willing sana to settle kung maifile sa court so the penalties and interets will be lesser and longer payments. Wala talaga pambayad sa minimum due nila may asthma pa anak ko. Thanks po

And from what i understand re issued order of banko sentral, banks should notify defaulted cc holder 7 days before the actual endorsement of account to CA via registered mail.i havent receive one. Siguro di pa talaga endorse and bank still hoping that i will pay my minimum due. Do think ms cherrylou nasa inhouse dept pa ni bank account ko? Kapag tumawag kaya ako do you think mag ooffer sila ng payment option na kaya ko? Thanks po pasensya na makulit ako. Para kasing mas maganda sa court kesa kulitin ako ng collectors madali pa naman ako ma stress po.

    1. @Nancy, hi you`re right bank should notify cc holders about the endorsement of their accounts (but other banks and sa totoo lang most banks don`t do that)
      yeah something fishy about the sms, na forward na nga account mo request pa sila ng payment (masyadong contradicting, pag nsa 3rd party kotong-collector, di na po pwede magbayad ng min. due kasi defaulted na yung account (now kung one-month pa lang yung default, nasa inhouse collection ka pa or poss ma endorse for a while sa 3rd party collector, but once magbayad ka balik sa active status yung account mo)
      -oh if ever don`t be stressed out sa mga kotong-collectors and just let them ang ma-stress sa iyo simply bec. they cannot pull your leg
      remember ikaw po me hawak ng finances mo and ikaw lang po me right where to put your money

    Good pm! ako ulit si Worried Mom :) ako yun nakatanggap ng summons last Dec 2016 at ngayon mainit init pa may pinadala naman na Notice of Hearing.... kaya lang yun date ng hearing noong March 10 pa dapat pero March 21 ko na natanggap ang letter. Gusto ko sana mag-attend kahit ako lang kasi wala naman ako pambayad sa abogado gusto ko lang ipakita sa kanila na wala ako intensyon na takasan utang ko kya gusto ko mag attend pero hindi pa lang tlga sa ngayon kasi wala pa talaga pambayad kaya lang late na dumating ang letter nila. Ano pa po ba ang susunod dito?

    1. @Worried mom, hi as per my experience after 3 hearings, legal counsel/kotong-collector will request for the resolution and the whole process hearings and resolution took about 6 months and writ of execution was approved after 2 years and that was last year and now nagma-maganda si legal counsel and offering AGAIN a one-time discounted payment
      -as what i have posted above malamang ayaw mag-aksaya ng effort to get the sheriff with court order to garnish my bank accounts (na maliwanag naman na WALA... sabi nga ni banker "pambayad utang wala nga...bank accounts pa ba)

    3. worried mom, hi if you have the money to get yourself a lawyer for defaulted amount of 200k and above, you will be able to question the defaulted amt.; but of course the decision is to pay back bank
      now do you have the money to pay the bank/like bank deposits
      sending of summons will depend on the recent address that you have provided the bank
      -and as what i have posted earlier, after all the legalities have been extended...hirit pa rin ni kotong collector "discounted amt. for one time payment or pag di kaya ng powers meron pang promo na one-year to pay...lol
      -malamang kotong-collector just feeling lazy to look after my bank accounts and kahit pa abutin sila ng 10 years waley silang makikita... maybe after 4 years meron, yung nga lang sss pension account ko and AGAIN exempted sya for execution

  22. just received a text from cc. plaintiff vs ... the bank decided to file a complaint for defrauding of creditors under sec 14 presumption and prima facie evidence of intend fraud. we are giving you a chance to settle worth 2,700 today to hold temporarily legal actions. saan ko ito i settle? magbabayad naman ako pero doon lang sa principal amount. kc nga nanghiram pa ako ng pambayad. di ako sure if nasa CA na ba ito or sa banks pa? may kausap nga ako taga banko daw i rerequest daw nya sa banks na yon lang certain amt na kaya kung bayaran so sabi ko sa kanya i send mo thru email ung agreement na yun na talaga ang babayaran ko tapos d nama siya nagsend. paano ako magbayad d ba?? baka pagkatapos ko magbayad sabihin nanam nila ay forfeit na yun.. just like sa isa kung card one time settlement daw 70K tapos nka partial ako ng 20K so dapat 50k na lang ang balance. hala ibang CA na naman ang nka handle naging 201K pa. e saan ba napunta ung binayad ko.

    1. Same happen to me..nagbayad ako almost 80k sa restructuring program nila..then di ako nakabayad agad. Lumipat ibang ca ganun pa din balance ko di nabawasan. Sa inis ko di na ko nagbayad kahit kelan.   23. 2 SOA na po akong hindi nagbabayad. I sent payment proposal thru email dati pa 1 month in default pa lang pero walang reply. I just did that to show that my intention to pay kaso no response. Tama po bahala sila. Pero unlike other banks na sige tawag to follow up payment. Ang bdo ni minsan hindi po ako tinawagan thru texts lang lahat. This is our year 2017 and sana as the months pass by mabawasan pang haharass ng CA. baka CA na po yon pinapakagat lang ako heheh.. Sayang din kung magbabayad ako income din nila un and kung magbabayad ako mapupunta lang sa wala hindi mababawasan principal. Thanks po

    now if you have made a partial payment earlier...malamang napunta lang po yun sa commission ni kotong-collector
    just pls. remember kotong-collectors are bunch of liars and impersonators ...so wag po silang seryosohin
    and if bank is dead serious to file a sum of money case...di po ito pinag-tatagal (like within the first year of defaulting...as gusto po nila to recover their money the soonest possible time... and yun po if you are keeping fat-bank accounts; otherwise nganga si bank and the kotong-collector

  26. Sir Banker/ Maam cherrylou, ask ko lng po, originally po arounf 60-70k po yung amount sa defaulted CC ko, ngyon sbe ni CA, 186k na daw po. Kapag po ba ngfile cla ng case (wag nmn po sana) yung 186k po ba yung iffile nila? Thank you po.

  29. Hi Banker and Ms. Cherry. Kakatawag lang ulit ng taga SP Madrid. Sabi nanaman nila ano daw nangyari. Binara ko nalang sabi ko kung gusto kasuhan eh di go ahead. Sabi nila kun gusto ko daw ba na ma iforward na talaga ang account ko kasi by 4pm ipapasa na daw nila sa clerk of court ang mga delinquent account. Eh di go sabi ko. After exactly 5mins tumawag ulit parang supervisor ata nung unang tumawag nag tatanong kung bakit daw wala kami napag usapan nung tao nya. Eh di sabi ko sabi nya kakasuhan ako. Eh di sabi ko ganun na nga lang gawin. Tapos sabi ah sige atleast alam namin na wala po kayong balak sa account. At kakasuhan nalang daw ako.

    Ano na po dapat ang nxt move ko? At ano na po magiging next move nila.

    1. hi nancy, 2014 pako na default... nka avail pa ako ng amnesty program pero di ko na din kinaya after 5mos ko na nabayaran kaya ang os balance ko ay lumaki na naman. Then sunod sunod na demand letter ang natanggap ko at ito nga December 2016 summons naman then Notice of Hearing nitong March 2017 na late ng 1 week sa date ng hearing bago ko matanggap. BPI credit card sya.

Nag consult din ako sa pangalawang lawyer ang sabi naman pwede din daw ako makulong kaya hindi din ako nakakapagkatulog noon at feeling ko maloloka nako buti na lang nakita ko ang blog na to nagkaroon ako ng peace of mind.   34. Hinahabol po ba talaga ng mga banko ang properties lalo na po bahay ng defaulter? Medyo malaki po kasi ang defaulted amount at sabi ng lawyer na nahingan ko ng advice, pwede daw po hatakin ang bahay. Lalo po nakalagay sa application ko dati sa kanila na ang bahay namin ay owned.

    Sa totoo lang mga ka-diskarte, kahit ano pang gawin mong pagbabayad, if bank reported already or submitted your name on CIC (Credit Information Corporation) o kahit anong credit bureaus, hinde na mabubura ang pangalan mo duon. it will haunt you forever. Unless, mag effort din si bank na ipabura ang name mo duon after certification has been issued to you. Take note, EFFORT NI BANK PARA IPABURA ang name mo. So endless explanation din gagawin mo sa mga bank na uutangan mo in the future.

    Nabasa ko po dito na exempted ang payroll sa garnishment upon execution of writ pero meron po pala currerntly sa company namin na naka garnish ang wages because of cases filed against them.

    1. generally, it is exempted although the exemption are clearly stated ( with court order etc.)
      banks do not garnish wages ( patayin mo yung tao? coercion is bawal as stated in our Bill of Rights!
      however, there are greedy bank that does it anyway like Metrobank, unless challenged in court.
      remember "No one shall be deprived of life and liberty"?

If ever mangyari po ito, ano p po ang natitirang praan? I dont have the money to attend to the hearings and challenge the decision if ever po.

    5. Sorry banker medyo malabo ako. BPI ang defaulted card ko and BDO ang payroll account namin. Gngawa po din ba ng BDO yun? Kapag pala me court order ka, pwede po pala. Then wala ako pang represent sa hearings kaya malamang talo naman ako sa decision and would need to pay.

My salary po kasi is in landbank. Do u think po they can garnish it kahit walang court order and without filing a case and writ of execution issued?       the auto debit of deposits is based on the card agreement but it is ILLEGAL to get your salary.

      it is only Metrobank which includes salary for auto-debit "if your card and your payroll is with them"

    This letter shall serve as a FINAL DEMAND for and on behalf of Metrobank to settle immediately your past due and outstanding obligation under the account of xxxx amounting to Php 368,352.73, inclusive of interest,charges and attorney's fee.

    Despite repeated demands to settle your outstanding balance, no payment has been made and the account remains to be unpaid. Hence, we are constrained to formally recommend, to our client, the urgent filling a Complaint for Collection of Sum of Monies with prayer for premilnary attchment againts you and your spouse, if any, before the court.

      yes ganyan din ako early part of 2013, sa totoo lang I was soooo paranoid, tulaley na on the way home and also the crazy wish also popped into my mind na sana di na ako magising the next morning as talagang di sanay sa utang (Mother just got sick and was hospitalized for months and was hooked into the ventilator...so no choice but to prioritize the medical needs of my dearest Nanay)
      and then heaven-sent I came across the blogsite of banker and everything went back to normal (kahit na me decided case for sum of money...)
      and am now paying forward sa lahat ng naitulong ni banker to bring back my sanity and of course peace of mind... so kung nakaya ko (inspite of all the rude na collectors na na-encounter ko along the way...) kaya nyo rin (and of course dapat kasama lots of prayers)

  47. @EM Big amount ang debt mo. But still mcc did not file a case. Sabi po ni banker nothing to worry if ever mag file ng case if you dont have bank accounts. House and payroll is exempted as per banker pwera na lang kung metro din payroll as metro is doing auto debit of salary. Natawa ako sa letter po sabi for recommendation pa lang filing of case meaning wala pa naifile tapos sa baba kung magbabayad pwede ma withdraw case? Ano iwithdraw eh no case filed. Malamang po hindi na edit man lang ang letter or sadyang mali mali sila. Hehe.. Maybe kapag ang mcc ko maforward na sa CA same din maghandle.     1. @ nancy, 89k lang utang ko dun tas last payment ko was september 2016 tas ngayon march nasa 362k+ na. yung nakusap ko CA sabi ko pahingi ng SOA sabi nya kahit anung request ko daw di na nila ko mabibigyan ng SOA at ang nakaktawa pa dun after ko mareceived yung letter from their messenger bigla tumawag at nag email yung Eric Villanueva may promo daw sila from 362k ang babayaran ko nalang daw is 195k until march 31. tas nagalit pa sakin nun sinabi kong ifile nila yung case tas dun ko icocontest yung amount na naibill nila sakin. tas yun bigla nagalit.. pupuntahan daw ako dito sa opis. hay... buti nalang meron blog nila nakakwala ng stress. thanks po banker at Ms cherrylou...

      Then tell your supervisor about the unpaid cc and your plan and when you can pay..you said you can pay it within the year? Then next year ka na lang pa promote. Choose between rushing your promotion or rushing the cc payment.. in any case you lose in both..(walang pera sa promotion sabi ni banker)..lol

      But if you are really an exceptional employee your company will reward you no matter what personal situation you are in.

      But you really want to care about cmap..unpaid cc after 180 days is being written off. The bank may or may not report..most probably kinalimutan ka na.

      So dont worry because your unpaid cc and non promotion will not decide your future.

      As required by BSP on their Manuals of Regulations for Banks (MORB), You cannot be promoted nor to be an officer in a high rank if you violate the Section x143.1.

      I think, this tainted your records and also in the future may become their reference in process of promoting you, the damage has already done, so nothing to do with this but to settle and clear yourself on your monetary obligations specially in banks...well, i wish you luck.

      yeah most of us nagamit ang cc for good intentions, but we just forgot one thing na there will be problems which wl prevent us from paying diligently our cc (much that we wanted to pay but money is not simply enough and kahit naman po paano i was able to fully pay my citibank and union bank repayment directly with the bank "not assisted by pesteng kotong-collectors"...these two banks were sensible in giving me amount/terms na kaya ng budget

  51. Good morning! Medyo nakakaluwag po ng loob na meron din po plang ng mga katulad ko na nararamdaman at naeexperience. Araw lagi kang kabado na baka may magpunta sa bahay o opisina pra magiskandalo. Im guilty na hndi ko namanage ang finances ko ng maayos kaya hndi ko na nakayanan bayaran ang cc ko. Kung may reasoanble amount at tama nmn ang calculations ng utang ko e babayaran ko nmn cla. Naiinis lng akong mkita na napakalaking patong ang inilalagay nila tpos uubligahin ka nila magbayad. Sino ba nmn magbbayad ng gnung kalaki tpos hndi nmn nababawasan ang utang mo. Pag may tunatawag sa landline at celfon ayoko na sagutin dahil maiistress lng ako at hndi ako makakatulog sa sobrang pagiisip at pagwworry.     1. Sa bank lang ako makipag usap tungkol sa cc ko.. why hide sa mga scammers? Umiwas sa scam pero wag mahiya when the collector call or visit..remember..ikaw ang mag de-decide for your money hindi ang ka officemate o kapit bahay.

  52. Paano po kaya mangyari na principal amount nalang po bayaran sa bank or sa court? Kapag po ba sa court matatanggal na po finance charges at interest? Lumaki po ang defaulted amount ko dahil di parin po sya nagsa-stop ngayon sa mga installment na di pa po tapos. Ang laki na po sobra. Hoping parin po makabayad sa future. Ano pong advice nyo para makagaan ang pagbabayad para po sa may mga planong makapagipon at magbayad sa future. May paraan po ba para mapaliit man lang po yung babayaran. Nawalan lang po ako ng trabaho ngayon. Salamat po.

  56. Hello, question lang... I am currently applying for a housing loan in Pagibig and I am quite paranoid if my default/debts from BPI, Eastwest and PSbank will affect the approval of my loan? FYI, I've been defaulted because of life and emergency circumtances that happened in the past; I resorted in using my credit card on max. Yun lang di ko na talaga kayang bayaran pa so di ko na lang pinansin lahat ng summons, calls, at kung anu anu pang pangungulit ng mga collectors..

  57. Good pm po. Hindi ko na nabayaran ang BPI credit card ko due to family issues. Bread winner kasi ako nagkasakit ang tatay ko. Ngayon ang father in law ko may gustong bilhin na property na ipapangalan sa brother in law ko at sa husband ko, automatic pala na pati spouse kasama dun. Actually hindi ko alam ang mga ganyang usapan sa family nila kasi hindi ako gusto ng parents ng asawa ko dahil hindi kami mayaman at hindi nila pinapaalam yang mga ganyan. tumawag sila sa husband ko at gusto ako at nagtanong abt my background sa BPI ( though pagkadalagang name naman andun but still syempre nadetect nila). Ngayon sabi nila kailangan ko bayaran yun bago daw maapprove ang property na binibili ng pamilya ng asawa ko. Una sa lahat hindi nila alam yun, dahil iba ugali nila pagdating sa pera (sadly pati asawa ko) at hindi nila maiintidihan yun worst eh takot ako ilayo ang mga anak ko pag nalalaman nila na lumobo na 380k ang utang ko. Tanong ko lang, talaga bang hindi maaaprove ang loan nila kahit spouse lang ako? Sa totoo lang pagod na ako mag isip, naiisip ko na lang mag suicide dahil malaking problema ito. Advice naman po.

    2. Your problem is not your unpaid cc but the arrogant people around you. The loan being not approved is no longer your problem..dont blame yourself. bakit hindi nila bilhin na cash? Them being out of cash puts you in equal footing..wala ka ring cash that is why you have unpaid cc..

      Talaga 'tong story mo ha. Una, parents in law mo ang mag lo-loan, hindi ikaw, irrelevant yung credit history mo dun, IMO. Sila naman ang magbabayad, hindi ikaw. Kung immaculate credit history nila and may capacity to pay bakit naman aayaw ang bank. Kung na disapprove yung loan, I doubt may kinalaman ka dun, ano?

      You said na "detect" nila ang Unpaid Debts mo sa BPI? Sensor lang ang peg ha. Baka naghahanap lang ng rason may masabi lng na masama tungkol sa'yo.

    Matagal na din ako nagbabasa ng mga advice mo since 2015. May question lang po ako about pag garnish ni bank ng salary. Payroll ko kasi ay under ng metrobank, and defaulted ako sa metrobank since 2015. Medyo confused lang ako about sa garnishment, tapos notorius pa pala tong metrobank sa pag garnish ng salary. Hehehe

Banker tanong ko lang yung number 2, inonotify ba muna ni bank si company sa salary garnishment and dapat may court order ito ng garnishmeny of salary? Tapos yung number 4 na pay metrobank banker, if it is initiated by bank ha hindi ni collector? Kasi never akong makikipag deal sa collector. Hehehe Parang ito kasi yung general rule. Hahahaha! Kasi nga sa court pay when able and based on defaulted amount with 12% interest per annum.

    3. Kapag po ba sa court, mawawala na po ba lumobong finance charges at interests ni bank? Lumaki na po kasi ng sobra dahil sa dami lang po ng installment, mas madali po sana bayaran kung principal lang. Ano po bang basehan ng defaulted amount? Yung principal lang po ba?
      Di parin po kasi tumitigil sa pagtaas yung account ko po.

      ayaw pa po ipa-cut yung account ko kasi madami pa daw pong installment at patuloy sa finance charges. Lumaki din po sya dahil sa puro minimum lang naibayad at ngayon wala na talaga akong pambayad. Kung yung principal lang po sana baka kayanin ko pa bayaran sa future. Pero po yung patong ni bank sobra na po. Paano po kaya mapaliit ang babayaran sa future?

      pag na-default ka for one or two months all your installments will be billed in-full, like the bank will demand payment in full
      yes when one is just paying just the min. due pls. expect na halos di mababawasan yung bill mo sa bank (bec. of the rising interest rate)
      now these 2 banks are notorious in filing for a sum of money case, bpi and bankard
      when a bank files for a case it will simply mean na mag-i-stop na sa pag-incur ng interest yung account mo
      pay when able... pag walang pambayad eh di wala
      now when your account had been endorsed to the 3rd party kotong-collector, you just need to learn how to deal with all the lies and kalokohan na gagawin ni crazy collector, but you must also bear in mind na walang forever with the ca
      -and if you want before your account completely defaulted, try to request for a repayment scheme directly with the bank, lesser interest and longer terms

    6. @Justine: Metrobank will not bother to notify you regarding your salary garnishment. Ano nalang makukuha nila sayo kung iaadvise ka pa nila. As far as my knowledge is concern, you have to settle the unpaid obligations, wether you like it or not. Tama yung option 1, unahan si bank magwithdraw ng pera mo upon crediting your salary sa iyong metrobank account.

    I am a defaulter in three banks and I am thinking of opening an account in BDO. This is so I can back my visa application with sound financial records... Would there be any case na other banks I have debted from will be able to garnish/coerce sa BDO account ko? As I read above, banks only want cash to have their money back.. so I am not sure if they can only do such things if you happen to have a same account on them... hence an account from other banks will not matter...

      now pag me decided case for sum of money all bank accounts (except payroll and savings acct for sss/gsis pensions are exempted for execution)

    1. @Rosauro Misayah, hi from what i understand exempted daw po ang payroll account sa auto-debit but i also heard from other defaulters na khit bawal na-subject pa rin ng metrobank yung payroll account nila sa auto-debit
      -so best diskarte is to withdraw the whole salary as soon as amount is credited

    Matagal tagal narin po akong nagbabasa ng blog ninyo. May kilala po ako na from 600k naging 60k nalang daw po ang binayaran nya sa CA after so many years, kumpleto naman daw po ng papeles at may kasama pa syang lawyer kaya siguradong ok naman daw po. Maaari po ba talagang magtiwalang magbayad sa Collector ng discounted amount at maging safe ito finally?

Hi banker and the rest of the team diskarte, last monday may tumawag na pulis sa brgy captain namin and saying may kaso daw ako, nireklamo daw ako ng panloloko kay karen lee, which is d ko kilala, nakausap ng misis ko yung pulis daw at may kaso daw ako kay karen lee, ibinigay ang number ng karen lee at tinawagan ng misis ko, attorney ang sumagot at may kaso nga daw ako dahil sa CC ng EWB. bibisita daw sa amin para i garnish ang mga gamit, sabi ko sa misis ko manloloko yan, d totoo. Tapos yung pulis pulisan pina verify namin sa hepe ng amadeo, and knowing na wala pa lang ganong pulis sa imus. Ask ko lang po ang civil case po ba ay ini issue han din ng subpoena? Sa pagkakaalam ko sa criminal case lang ang subpoena, correct me if I'm wrong. Salamat po

    kapag sinasagot po ba sa phone ang collector hindi na magfafile ng case?
    Dapat po bang sagutin pa sila sa phone?
    Nakakastress po boses nila e.

    Pero ayaw ko po sana umabot sa kaso ng sum of money kasi medyo hassle pagdi ako pwede magbank account.
    Paano po ba iwasan magkakakaso?
    Pwede rin ba yung sabihing walang nakatirang ganung pangalan kapag bumisita sila sa bahay para iwas stress sa pamilya ko?
    Di po ba access device (yung may prima facie) naman ang ikaso sakin?
    Hindi naman po sa magtatago pero need po ng peace of mind para mas makapagipon pang-settle sa future.


    How to deal po kaya banker? Hindi ako sanay ng may arogante kausap.
    Alam ko po nagkamali ako, hindi ko po sinasadyang lumaki ang bayarin ko at nawalan ako ng trabaho. Pero feeling ko po magbabago na buhay ko, nawala na po yung masayahing ako. Hindi ko po alam paano gawing normal po ulit buhay ko. Feeling ko may biglang maninigaw sakin, may naghahunting sakin, may kukuha ng account ko sa banko, may kukuha ng bahay namin.
    Nakakaloka po paggising ng umaga, tulala na po ako. :-(
    Hindi na po ako makapagtrabaho ng maayos.

    Bagong default palang po ako at malaki po defaulted amount.
