COLLECTOR REDUCED MY P1,000,000.00 DEBT!

If I were a collector,
I will tell defaulters that they owe the bank some P100,000.00
(kahit hinde totoo)
then ask him how much can he afford to pay IMMEDIATELY.
that way, I can easily collect my commission!
konting scam and greed lang ang kailangan actually.
hahaha....

  1. Hi banker,

    Thank you po.

    Salamat po.

    3. Ms. Cherrylou, good evening. I am from Dagupan City, Pangasinan. What are the chances na mag ocular inspection dito ang Collection Agency. Defaulter kasi ako ng eastwest. Mejo aggresive yung Cases Chun Law Office kasi. Tactics ba nila to or talagang ginagawa nila. And if ever tawagan ba ang HR ng company, may right ba sila na tanggalin ako sa work. I work for a pre-need company and i am managing dagupan branch. It's just unfair dahil personal matter namin itong pagkakautang ko sa CC pero bakit need pa nila idamay ang company. Sana makapagbigay ka ng advise for me. Thank you.

  21. Hi Banker and Ms. Cherry Lou,

How are you? I recently received a summon from BPI. It's for a sum of money case but I am not sure if it is for my credit card or personal loan. For my personal loan, I did not release any personal checks. The arrangement was to auto debit from my savings account.

    Here are my questions:
    1. Since I do not have money yet to pay, Is it ok not attend the hearing?
    2. If I dont attend the hearing, what will happen?
    3. If I attend the hearing, what will happen?

What do you think is the best thing for me to do?

Thanks and I keep on reading this forum for years now and the information I'm getting is really so helpful.

    Thanks again.

    1. whether you attend or not, the decision is always:
" pay your debt plus 12%p.a. interest UNTIL FULLY PAID"
      meaning:
      pay when able.
      lol!

      Delete
    2. you got a summons from bpi? or you got a summons from the court? If you can't pay, but you acknowledge the debt, then don't go. If you want to have "some fun" attend the hearing and ask bpi for the ff documents: 1)contract between you and bpi for the credit card (not the terms of payments but the contract); 2)all charge slips that you have signed so you can understand how they arrived at the figure. Without the charge slips the bank cannot charge you. Read Citibank vs Teodoro. google it. The supreme court ruled that only original documents are valid as evidence (there are exceptions though). Citibank could only produce original charge slips of amounting to 24K.
The Supreme Court ruled that is all that Teodoro has to pay citibank, 24k and not 200k as the bank petitioned.

      Delete
    3. @Manny Bondoc, yes ok not to attend
one will only attend if he got money for his lawyer, would like to question the defaulted amt. and got the money to pay the bank
      b. whether you attend or not, resolution will be to pay back bank and have read from earlier posts it's now .5% or 6% per year since the time na nag-file ng case si bank
      c. legal counsel of bank will request for summary of judgement
-in my case it took 6 months for the whole proceeding
and another 2 years for writ of execution to be approved and issued (and that was jan. of 2016)
and yes just recently legal counsel/formerly the kotong-collector offering discounted one-time payment or repayment schemes and just last week asking me to pay 5k unfront para daw ma-avail ang offer... ha ha ha, ano ako bale
well maybe, ayaw mag-effort/mag-shell out pang-gasolina ni sheriff to look around for my bank deposits (na PROMISE negative lang...) and having been in this blogsite for years i definitely learned the right diskarte to protect my interest...
so Manny chill ka lang and everything will be ok

Salamat.

      Delete
    5. @bryce: citibank vs teodoro simply states that 1)transaction forms are needed for them to prove that you owe citibank - that's the one you sign when you purchase something. IT MUST BE ORIGINAL accdg to the supreme court. If the bank cannot find the original, they must have a good reason why they cannot give the original (perhaps war or natural catastrophies). Only then will the court consider Secondary evidence (like xeros of the original).

  30. Hi Banker and Ms. Cherrylou, i need your legal advice. I have unpaid loan with doctor cash almost a year 10x of the loan amount ung balance ko. My account was endorsed to telan hipes before then the usual routine of collection agencies na panginigil same tactics, then my account was endorsed to Recievers and Liquidators, i recieved a Demand Letter, i just keep ignoring then almost a month. Then now i received a call from;Prosecutor Carla Borromeo Taguig Hall of Justice kuno? 639101157044 (Mejo irate tone) they said I need to call Atty. Carmela Ablaza on this number  09095655097 about my case before they file my pending bench warrant for Estafa RA8484, then sabi ko kelan naging fraduelent ang unpaid loan at anong pagkakaintindi mo sa RA8484?

Based on my research Atty. Carmela Ablaza is one of the officer of PAO.

So aun they said i need to pay 20k na lang then installement ung iba para di nila pipush ung bench warrant since na endorse na daw sa taguig pnp.

  35. @Girly, hi from what i understand there are banks who will impose certain fees for over-limit, if di kaya magbayad ng min. due this period, bank will just request you to pay immediately your min. due plus late payments for the next month... if for the next 3 months di naka-bayad kahit min. due, bank will declare your account to be indefault and said account will be endorsed to the 3rd party ca...now kung di pa talaga defaulted you can try to request for balance conversation, lesser interest and you can do payments up to 3 years... mas manageable ang account mo and di pa maka-cancel ang account mo (like you will be able to use cc for emergencies...)

  60. Hi everyone! I have sleepless nights with the collectors of east west. After defaulting from them last year lumobo na ng lumobo yung interests and finance charges. I was a good payer before pero dahil sa nagkasunud sunod yung nagkasakit sa amin and now yung bunso ko naman having leukemia, di ko nabayaran yung credit card.

  63. Hi Mr. Alex!

I think we are being handled by the same collection agency. This was last April 1 and may supposed bench warrant ako kahapon. May binanggit na sherrif sa text tas Camp Bagong Diwa, Taguig. Ginamit naman ang name ni PS/SUPT RHODERICK ARMAMENTO. OIC director dun. Bsta pag may text, i just read it but i do not reply to their msgs. If they call, i don't answer. Hehehehe

  66. Hi Banker,

I have an unpaid remains sa loan ko sa Chinatrust way back 2009. I wanted to clear that na. I asked Chinatrust how can I settle that pero they referred me to a collection agency na sobrang nakakaharass. Anyway, I requested an SOA. Based sa SOA my outstanding balance is 11,428.29 then ang sinisingil sakin ay 91k (wtf!!!). What do you suggest I do so I can just pay my outstanding and not 91k???
