hi banker!(and to all as well) i just got a message from Ana of ACCI, accredited HSBC collector kuno, saying i have 3pm today to pay my debt. Otherwise, this result to legal action daw. I just did what you said: DELETE. ^_^ gusto ko ngang replyan na "go ahead and sue me in court" kaso baka maburaot lang hahaha
Jeff
@ry4n, hwag na....sayang piso.
it's a pain on the neck when you have multiple ca's calling you at home, on the cell and at work.. what more if you have a co-worker putting you on the spot.. announcing your cc obligation on the social network.. this is new right?! can someone help me.. i need to give this co-worker a lesson.. this isn't just a mildly insulting situation.. stressful really!!! banker/team help me po! i need some consultation.. thank you very much..
Art. 353. libelArt. 354. Requirement for publicity. — Every defamatory imputation is presumed to be malicious, even if it be true, if no good intention and justifiable motive for making it is shown.Preliminary investigation of criminal action for written defamations as provided for in the chapter shall be conducted by the provincial or city fiscal.Art. 1147. The following actions must be filed within one year: (1) For forcible entry and detainer; (2) For defamation. (n)
san po ako pwede magfile ng complaint banker? what if nde nag name drop? wala na ba ako laban? the only proof i have are my co-workers knowing that i am the only one being called by ca's..
announcing your cc obligation on the social network..libel.are your co-workers doing it verbally?oral defamation na yan.execute an affidavit-complaint w/ the city prosecutor.pero kung ako? debt is a humbling, and not a humiliating, experience. you did not steal naman. buti ka nga daming tumawatag. baka ingit lang siya. :))
banker you just made my day.. :) fyi lang po..just a co-worker, he may have done some verbal lashing about my cc obligation to his friends and other people.. di pa naman po nakakarating sa akin.. ito lang when my debt was announced in his profile.. yun lang he did not mention my name but it was easy for my other co-workers to find out that i was the one he was referring to.. baka nga po inggit.. mind you, sya rin po tinatawagan ng ca's way back.. gusto ko lang po talgang matuto sya sa ginagawa nya..
Banker,Good day! This regards with my complaint about DMLO. Tumawag kanina sa ofis. Nagpakilalang taga-HSBC daw cya. I asked them kung nagooffer sila ng amnesty.
I called HSBC hotline nga pala after maputol yung paguusap namin ni Ms. Joy Sese. I told them na naputol pag-uusap namin ni Ms. Joy dahil nawala sa line si Ms. Joy. According to one of the CSR, wala daw naka-record na call sa kanila regarding my account. Thanks po and God bless!ScaredGal
Another advice please, Banker.Thanks.ScaredGal

i've done research on the exact term of credit runaway.... NO, it does not mean na tumakbo ka sa utang mo.it simply means that you are spending more than what you can afford. link here...http://ezinearticles.com/?Remedies-For-Runaway-Credit-Card-Debt&id=1163422
"out of control":)
This SP Madrid Collectors are bugging me. Tumawag ako sa HSBC kanina hoping to settle it with them, sabi nung sa collection dept ng HSBC wala na daw sila magagawa. kung anu na daw ang mapag-uusapan nmin ng SPMadrid yun na daw un..ayaw ko naman makipag-away sa kanila coz it's so stressful. how can I make them go away???banker, panu sumali sa forum nyo? Thanks.stressDrilon

Hi Banker and Diskarte Team:I have several questions regarding all these people calling me:1. EastWest Bank and Standard Chartered are offering promos for re-payment at zero percent interest, but I need to pay a certain amount in order to qualify : BUT, I do not have the means to pay due to poor cash flow I cannot. They then said that the account will go to the collection agency where I will be billed in full and I will need to pay the 25% collection fee.Question: Is that 25% collection fee backed up by Law?2. Banks said that I their restructuring are promos and not available all the time.Question: Is this legal or can defaulters always negotiate for re-structuring and is there a specific banking law that says so?3. My main problem is that I want to recover first from my financial setback before I address my debts with the cards and banks. BUT, it seems they do not allow me since my personal financial problem is my problem and they are unconcerned or in their words "out na ang bangko sa problema mo." Question: If I did not have the financial problem then isn't it but logical that I will be able to pay and they will not call me in the first place?
good afternoon..i am Jonathan, isa ako sa mga may panangutan sa credit card. ask ko lang sana banker, nag sign ako ng payment contract na binigay sa akin ang DML law offices, na sana babayaran ko within 1 week, hoping that my check will be release before friday last week. kaso di ko nahabol ang payment, so ngayon pinadalhan nila ako ng demand letter na i will pay one time payment sa total account ko with 5 days, failure to do so they will file me a case..what will i do banker? thanks -Jonathan
Jonathan, that is good news.after you paid, they will runaway.:))guide:http://failuretopaycreditcard.blogspot.com/2010/10/i-want-to-pay.html
what happen banker, if i will not pay the said amout? thank you
that means hinde na sayang ang pera mo.you believe those collectors?are you sure your arrangement is legal?
mon:1. the 25% is the collectors commission. but as i have always said, if you cannot pay, then don't. 2. there is no such thing as an amnesty. if you would take a look at it closely, you would still pay interest over that amnesty amount. and if you look at the word amnesty sa dictionary, it means "forgiveness." parang amnesty nila trillanes... pinatawad, as in buong pinatawad ang mga kasalanan.normally, you can negotiate, but the banks do not want to negotiate. it is because they will tell you to negotiate to the CA handling your account. they are not concerned with your account anymore, but the CAs do. (diba banker?)3. correct. the reason why you cannot pay is because you are in dire financial problems. basic economics state that if the cash flows are lacking, then its time to prioritize domestic spending first (in our case, our basic needs first). this was even done by the american government during the great depression. mon, i have always been texting you on how to handle this. forget all the technical matters. we just have to use our common sense.
good evening..thank you po banker..now i know..more power, GODBLESS
good evening banker..salamat sa lahat, marami akong natutunan dito..anyway, may tanong lang ako banker, paano mo malaman na ang demand letter o yong non-compliance of re-payment agreement ay totoo at tama? thanks and GODBLESS
Thank you cooldude for the reply. I realized that during calls I get really rattled about what I'm going to say. My common sense keeps going away.1. Bottomline - if the account goes to the ca, is it time for me to feel a little sense of relief?2. Now I understand what that 25% collection fee is. If I don't pay, the ca doesn't have a right to it because by non-payment, they weren't "effective in collection." In short they didn't do their job, and therefore they aren't entitled to a commission. Am I right?3. Why do banks refuse to negotiate when the account is in the ca already? Thank you Diskarte Team.
Why do banks refuse to negotiate when the account is in the ca already?once an account is classified as "loss"why would a bank employee add burden tohis work?
monadditional work kasi sa bank yun. they have to report to the ca the payment they receive.
hi banker!i have the same situation of unpaid loans and credit card in DUBAI last year march2010 umuwi ako nang pinas nagstay ako 3weeks then i tried my luck in singapore, salamat naman sa DIYOS nkahanap ako nang work dito, gusto kung magbakasyon sa pinas kasi namatay yung papa and thats the reason why takot akong umuwi baka kasi ma hold ako sa immigration at ako lng kasi ang breadwinner takot ako baka hindi na ako mkabalik dito sa singapore sa work ko,ang tanong lng po hindi po ba ako ma hold sa immigration sa airport kung may naiwan akong utang sa UAE,and 2nd question ko po kasi magrerenew na ako nang passport ko ths december balak ko po dito nalng sa singapore e renew, hindi po ba mgkakaproblema sa renewal of passport ko if i have unpaid loans and credit cards in DUBAI?please po tulungan nya ako...salamat
JM.wag ka lang babalik sa dubai and you'll be okdefaulted ako 2008, nagrenew ako ng passport 2009 aksi pumunta ko ng hongkong. Walang hassle.go with your plans.
Dear Banker,I would like to thank you for a very informative site. I've spent several years being harassed by CA's over my BPI credit card non-payments.I have tried to ask for amnesty from BPI but the person I spoke to was just not helpful. From a debt of 80K in 2004 I was informed that I have to pay 2M.. yes 2 million pesos to clear my name and my account.I am aware that I cannot be imprisoned for not paying however... my main concern now is when I tried to apply for a US VISAwith my family, my BPI card account showed - na hindi binayaran... so automatic DENIED ako and my whole family for the VISA.The consul told me that unless I pay for the debt I will not be granted a VISA - nor my family.Do you have suggestions how I should handle this?If principal amount I can pay that in about a year but 2M- that's just ridiculous.I hope you can help me.Thank you.
The Consul can decide based on anything whether logical or not.Maybe during that time, he presumed that you are going on a TNT basis because you are running away from your debt.the main consideration for a visa is "the tie that binds you here" and he can interpret it anyway he wishes.p.s.US is now in recession.I dont even want to go there evenif CEPAC as a Piso Fare promo.
esl: 2M? pano naging ganun? and another question, how did the consul knew about the BPI debt? may connection and access ba sila sa credit card bureau dito?
hi banker..im also a defaulter of cc..if i will apply for visa for us or canada?will they able to check my account?pls help me..
Hi Banker and thank you for the reply. The first consul said that if I have an outstanding debt here - most likely I could just leech off the US government. He really didn't check any of our papers either. But since my family really wanted to go.. I tried applying again.. it was a different consul pero ganon pa rin... my intial denial is on record na and the reason it stated there as well. While the 2nd consul was nicer.. she said I have to pay the debt to show that whatever papers or documents I present are genuine. ( I can see her point naman but still...mabuburo ako sa Pilipinas with that 2M charge) My spouse tried to get a visa with my daughter na hindi ako kasama.. it still showed up@cooldude:I have no idea how it happened na ganon.. all the guy from BPI said was kasi sa interest and it has been years... PLUS it was ordered by the court that 2m was the amount I should pay. I asked him what court? He didn't say anything.. I should just go see him daw. Also the payments for the VISA interview is paid through BPI banks...that's how they know.Honestly, it will be hard to pay off the 80K debt in one payment but I really want to get it fixed kasi nga affected na my family.
banker,if you have bad credit can you still apply for a savings account?
jha, i know somebody with a case (bdo), nagkaron na nga ng garnishment eh pero, nasa Canada sya ngayon. malay mo magkita pa kayo dun.
banker im presently abroad and then just like the others i also have issues with my cc payments. However at this time, me and my wife are willing to settle our cc accounts yet here are my questions: 1) some of my accounts are forwarded to cas, does it mean that I have to pay directly to the CA or can i still pay directly to my cc bank? 2) can i authorize my sister in cavite to transact with my banks in my behalf (if yes what are needed requirements so that she will qualify as my authorize contact?), i havent receive statements of account for my other cards, will I still pay them without receiving first my statement of accounts? thanks a lot banker for your points....they have enlighten me a lot.....
what do you mean by garnishment? is it pulling out my properties inside the house?
ESL,if you present a court clearance, maybe it will do.well, if you really want to go to the US, you really have to beg them.sad for you.
my pending immigrant application din ako sa australia - does this mean makikita rin ng australian consuls ang aking mga kautangan at madedeny din ang chance ko to live abroad. banker, sad din ako :(
it's merely a civil case, not a criminal case but consuls can do crazy things.:))in the US Visa Case, you can present a court clearance indicating BPI has not filed a case against you because the claimed amount is "excessive, unconscionable therefore contrary to public morals - biro mo P 80,000.00 now its P2Million!" what does a consul think of that?but just like I said, Consuls do crazy things, especially if they are having a bad hair day.
refer mo din pala sila sa "Macalinao vs. BPI" which BPI lost precisely for that reason.
pls help me..what bank ang nag aalow sa mga credit card defaulter to open a savings account?
banker, i read the macalinao vs bpi - ang intindi ko macalinao was made to pay bpi some pesos 100+ pero u said bpi lost. paper victory lang ba ang tawag dun?
Thank you Banker for you advice.I've been carrying this burden for too long. The information at this site and your answers toall the queries takes such a load off.Thank you
thanks po banker..
if the person will work in singapore and has a cc debt with citi bank and other debts in the philippines will they be able to trace the person and deport or jail the person?
BPI lost their "excessive, unconscionable and therefore contrary to morals" interest charges.BPI lost their 25% attorney's fee. instead, only P 10,000.00 was awarded.A sum of money case is simple. may utang ka?the decision is always " You Pay".BUT not whatever they want.
jehan, how big is your debt that they will go all the way around the world to find you?your debts stay in the country where you incur it.that is the principle of civil rights.Si Gen. Garcia nga, "nahihirapan" pa ang Ombudsman.hehehe...( oh, well, its another story)http://failuretopaycreditcard.blogspot.com/2010/08/dubai-debts.html
I recieved a text message yesterday stating " (Name)Warrant of seizure has been released for the violation of Art 315 of the revised penal code and Bp 22. You are advise not to remove, dispose, sell or transfer your real and personal properties not to withdraw your deposits or your salaries and wages. For immediate withdrawal of the case we are giving you 24 hours to coordinate w/ Atty. Juanito Crisostomo at 4116358."Kung wala naman akong natatanggap na case na nag file na sila bakit may seizure?WAla naman akong real or personal properties, kundi wages and salaries lang, may karapatan ba sila na i freeze ito?o i garnish?5 months na po akong delingquent sa Chinatrust.
nok,a warrant of seizure is if you did not pay your custom duties of BIR tax.kaya ito ang dapat na text :"Warrant of Seizure issued for you because of Credit Runaway":))
Hi banker,Thank God i found your blog... i should have found this long time ago. It's been 2 years now that i have been suffereng from paranoia. I left Duabi 2009. Just like the others I received an e-mail from ENzi demandng me to pay the whole amount. I replied them saying how much i would have wanted to pay my debt but at the moment I do not have any means to pay them now. They were quiet gentle this time... telling me that they are not forcing me to pay the whole amount but instead only 30% of the whole amount. I was so afraid that I borrowed money from my friend so i can get rid of them just for a whole ( for how long i do not know). This week we are arranging for the 30%payment. I read on some previous comments that others on my situation actually did the same thing. They paid the initial amount and continue to pay the remaining on installment basis. I was requesting the CA to ask the bank for a possible discount, she replied saying she is waiting for the bank's reply if I could pay only the credit limit. My questions are:1. After paying the initial payment... when will they start to ball break me for the the succeeding payments?2. How true it is that the bank can offer discounts and requesting only to pay the "credit limit" stated in the SOA.3. Will the bank still charge me for some interest? Thanks you so much.1.
banker i am now willing to pay the initial payment of 30% and deposit it to enzi corp. is my decision correct or i just need to contact the HSBC credit management for some negotiations.
alen, are you sure they are authorized?Hint:get back to this site tomorrow for the answer.
Hi banker,I am waiting for your hint. Thanks!
alen,hahaha....see the latest post of this blog.

HI BANKER IT MEANS BA PAG UMABOT NA UNG UTANG U S CC NG 100K PDE KN MAKASUHAN??
hi to all. . .hi banker, bago lang po ako d2 but im so happy reading all those comments kasi natatanggal po ang worries ko, same story i have 1 loan to hsbc and several cc's na hindi ko na mabayadan, that was only started last quarter of 2010, dami po kaseng naging problema. i have many questions but nakikita ko na po yung mga sagot from other post..until now banker nagtatago pa rin ako sa mg ca,yung mga tel.& cp no na iniiwan sa bahay para tawagan ko sila, hindi ko po tinatawagan. then sa ofc. po pag may naghahanap sa kin since superior ako sa knila eh pinagtatakpan naman nila ako na hindi na po ako connected sa company. ok lang po ba yun na magtago na lang ako?pati sa barangay namin nag-iwan sila ng no. to give them a call. Hindi ko po alam kung pano ko sila haharapin, please help me po. thanks u so much-oyie-
oyie, just take their calls.tell them : "according to my lawyer, sa court na lang daw natin pag-usapan ito, ayaw mo pa nyan?"so, what else can they threaten you with?
hi.I would like to ask if it is true that PSBank can sue me for Credit Run Away.thanks
