Kung di ko daw tatanggapin amnesty program nila, mapipilitan daw ang DMLO na iforward account ko sa Litigation Dept ng HSBC. Naconfuse ako kasi ang alam ko, kapag nasa CA na, di na bakit ibabalik account ko sa HSBC. Ganun ba yun, Banker?
Bayaran ko na lang daw ay 25k para wala ng problema. Sabi ko wala akong pambayad. Pinipilit nya akong makipagdeal sa kanya para matapos na daw usapan namin. This SP Madrid Collectors are bugging me. I have several questions regarding all these people calling me:
1. EastWest Bank and Standard Chartered are offering promos for re-payment at zero percent interest, but I need to pay a certain amount in order to qualify : BUT, I do not have the means to pay due to poor cash flow I cannot. They then said that the account will go to the collection agency where I will be billed in full and I will need to pay the 25% collection fee.
Question: Is that 25% collection fee backed up by Law?
2. Banks said that I their restructuring are promos and not available all the time.
Question: Is this legal or can defaulters always negotiate for re-structuring and is there a specific banking law that says so?
3. My main problem is that I want to recover first from my financial setback before I address my debts with the cards and banks. BUT, it seems they do not allow me since my personal financial problem is my problem and they are unconcerned or in their words "out na ang bangko sa problema mo."
Question: If I did not have the financial problem then isn't it but logical that I will be able to pay and they will not call me in the first place?

1. the 25% is the collectors commission. but as i have always said, if you cannot pay, then don't. 2. there is no such thing as an amnesty. if you would take a look at it closely, you would still pay interest over that amnesty amount. and if you look at the word amnesty sa dictionary, it means "forgiveness." parang amnesty nila trillanes... pinatawad, as in buong pinatawad ang mga kasalanan.
normally, you can negotiate, but the banks do not want to negotiate. it is because they will tell you to negotiate to the CA handling your account. they are not concerned with your account anymore, but the CAs do. (diba banker?)
3. correct. the reason why you cannot pay is because you are in dire financial problems. basic economics state that if the cash flows are lacking, then its time to prioritize domestic spending first (in our case, our basic needs first). this was even done by the american government during the great depression.
mon, i have always been texting you on how to handle this. forget all the technical matters. we just have to use our common sense.

Thank you cooldude for the reply. I realized that during calls I get really rattled about what I'm going to say. My common sense keeps going away.
1. Bottomline - if the account goes to the ca, is it time for me to feel a little sense of relief?
2. Now I understand what that 25% collection fee is. If I don't pay, the ca doesn't have a right to it because by non-payment, they weren't "effective in collection." In short they didn't do their job, and therefore they aren't entitled to a commission. Am I right?
3. Why do banks refuse to negotiate when the account is in the ca already?

I would like to thank you for a very informative site. I've spent several years being harassed by CA's over my BPI credit card non-payments. I have tried to ask for amnesty from BPI but the person I spoke to was just not helpful. From a debt of 80K in 2004 I was informed that I have to pay 2M.. yes 2 million pesos to clear my name and my account. I am aware that I cannot be imprisoned for not paying however... my main concern now is when I tried to apply for a US VISA with my family, my BPI card account showed - na hindi binayaran... so automatic DENIED ako and my whole family for the VISA. The consul told me that unless I pay for the debt I will not be granted a VISA - nor my family. Do you have suggestions how I should handle this? If principal amount I can pay that in about a year but 2M- that's just ridiculous.

Hi Banker and thank you for the reply. The first consul said that if I have an outstanding debt here - most likely I could just leech off the US government. He really didn't check any of our papers either. But since my family really wanted to go.. I tried applying again.. it was a different consul pero ganon pa rin... my intial denial is on record na and the reason it stated there as well. While the 2nd consul was nicer.. she said I have to pay the debt to show that whatever papers or documents I present are genuine. ( I can see her point naman but still...mabuburo ako sa Pilipinas with that 2M charge) My spouse tried to get a visa with my daughter na hindi ako kasama.. it still showed up
@cooldude: I have no idea how it happened na ganon.. all the guy from BPI said was kasi sa interest and it has been years... PLUS it was ordered by the court that 2m was the amount I should pay. I asked him what court? He didn't say anything.. I should just go see him daw. Also the payments for the VISA interview is paid through BPI banks...that's how they know.
Honestly, it will be hard to pay off the 80K debt in one payment but I really want to get it fixed kasi nga affected na my family.

it's merely a civil case, not a criminal case but consuls can do crazy things. :))
in the US Visa Case,you can present a court clearance indicating BPI has not filed a case against you because the claimed amount is "excessive, unconscionable therefore contrary to public morals - biro mo P 80,000.00 now its P2Million!" what does a consul think of that?
but just like I said, Consuls do crazy things, especially if they are having a bad hair day.

I recieved a text message yesterday stating " (Name)Warrant of seizure has been released for the violation of Art 315 of the revised penal code and Bp 22. You are advise not to remove, dispose, sell or transfer your real and personal properties not to withdraw your deposits or your salaries and wages. For immediate withdrawal of the case we are giving you 24 hours to coordinate w/ Atty. Juanito Crisostomo at 4116358." Kung wala naman akong natatanggap na case na nag file na sila bakit may seizure? WAla naman akong real or personal properties, kundi wages and salaries lang, may karapatan ba sila na i freeze ito?o i garnish? 5 months na po akong delingquent sa Chinatrust.
Thank God i found your blog... i should have found this long time ago. It's been 2 years now that i have been suffereng from paranoia. I left Duabi 2009. Just like the others I received an e-mail from ENzi demandng me to pay the whole amount. I replied them saying how much i would have wanted to pay my debt but at the moment I do not have any means to pay them now. They were quiet gentle this time... telling me that they are not forcing me to pay the whole amount but instead only 30% of the whole amount. I was so afraid that I borrowed money from my friend so i can get rid of them just for a whole ( for how long i do not know). This week we are arranging for the 30%payment. I read on some previous comments that others on my situation actually did the same thing. They paid the initial amount and continue to pay the remaining on installment basis. I was requesting the CA to ask the bank for a possible discount, she replied saying she is waiting for the bank's reply if I could pay only the credit limit. My questions are:
1. After paying the initial payment... when will they start to ball break me for the the succeeding payments?
2. How true it is that the bank can offer discounts and requesting only to pay the "credit limit" stated in the SOA.
3. Will the bank still charge me for some interest?

3. My main problem is that I want to recover first from my financial setback before I address my debts with the cards and banks. BUT, it seems they do not allow me since my personal financial problem is my problem and they are unconcerned or in their words "out na ang bangko sa problema mo."
Question: If I did not have the financial problem then isn't it but logical that I will be able to pay and they will not call me in the first place?
good afternoon..i am Jonathan, isa ako sa mga may panangutan sa credit card. ask ko lang sana banker, nag sign ako ng payment contract na binigay sa akin ang DML law offices, na sana babayaran ko within 1 week, hoping that my check will be release before friday last week. kaso di ko nahabol ang payment, so ngayon pinadalhan nila ako ng demand letter na i will pay one time payment sa total account ko with 5 days, failure to do so they will file me a case..what will i do banker? thanks -Jonathan

ReplyDelete1. the 25% is the collectors commission. but as i have always said, if you cannot pay, then don't.
2. there is no such thing as an amnesty. if you would take a look at it closely, you would still pay interest over that amnesty amount. and if you look at the word amnesty sa dictionary, it means "forgiveness." parang amnesty nila trillanes... pinatawad, as in buong pinatawad ang mga kasalanan.
normally, you can negotiate, but the banks do not want to negotiate. it is because they will tell you to negotiate to the CA handling your account. they are not concerned with your account anymore, but the CAs do. (diba banker?)
3. correct. the reason why you cannot pay is because you are in dire financial problems. basic economics state that if the cash flows are lacking, then its time to prioritize domestic spending first (in our case, our basic needs first). this was even done by the american government during the great depression.
mon, i have always been texting you on how to handle this. forget all the technical matters. we just have to use our common sense.

ReplyDeleteI would like to thank you for a very informative site. I've spent several years being harassed by CA's over my BPI credit card non-payments.
I have tried to ask for amnesty from BPI but the person I spoke to was just not helpful.
From a debt of 80K in 2004 I was informed that I have to pay 2M.. yes 2 million pesos to clear my name and my account.
I am aware that I cannot be imprisoned for not paying however... my main concern now is when I tried to apply for a US VISA
with my family, my BPI card account showed - na hindi binayaran... so automatic DENIED ako and my whole family for the VISA.
The consul told me that unless I pay for the debt I will not be granted a VISA - nor my family.
Do you have suggestions how I should handle this?
If principal amount I can pay that in about a year but 2M- that's just ridiculous.
I hope you can help me.

The Consul can decide based on anything whether logical or not.

the main consideration for a visa is "the tie that binds you here" and he can interpret it anyway he wishes.

ReplyDeleteThe first consul said that if I have an outstanding debt here - most likely I could just leech off the US government. He really didn't check any of our papers either. But since my family really wanted to go.. I tried applying again.. it was a different consul pero ganon pa rin... my intial denial is on record na and the reason it stated there as well. While the 2nd consul was nicer.. she said I have to pay the debt to show that whatever papers or documents I present are genuine. ( I can see her point naman but still...mabuburo ako sa Pilipinas with that 2M charge) My spouse tried to get a visa with my daughter na hindi ako kasama.. it still showed up

I have no idea how it happened na ganon.. all the guy from BPI said was kasi sa interest and it has been years... PLUS it was ordered by the court that 2m was the amount I should pay. I asked him what court? He didn't say anything.. I should just go see him daw.
Also the payments for the VISA interview is paid through BPI banks...that's how they know.
Honestly, it will be hard to pay off the 80K debt in one payment but I really want to get it fixed kasi nga affected na my family.

against you because the claimed amount is "excessive, unconscionable therefore contrary to public morals - biro mo P 80,000.00 now its P2Million!" what does a consul think of that?
but just like I said, Consuls do crazy things,
especially if they are having a bad hair day.

ReplyDeleteThank God i found your blog... i should have found this long time ago. It's been 2 years now that i have been suffereng from paranoia. I left Duabi 2009. Just like the others I received an e-mail from ENzi demandng me to pay the whole amount. I replied them saying how much i would have wanted to pay my debt but at the moment I do not have any means to pay them now. They were quiet gentle this time... telling me that they are not forcing me to pay the whole amount but instead only 30% of the whole amount. I was so afraid that I borrowed money from my friend so i can get rid of them just for a whole ( for how long i do not know). This week we are arranging for the 30%payment. I read on some previous comments that others on my situation actually did the same thing. They paid the initial amount and continue to pay the remaining on installment basis. I was requesting the CA to ask the bank for a possible discount, she replied saying she is waiting for the bank's reply if I could pay only the credit limit. My questions are:
1. After paying the initial payment... when will they start to ball break me for the the succeeding payments?
2. How true it is that the bank can offer discounts and requesting only to pay the "credit limit" stated in the SOA.
3. Will the bank still charge me for some interest?

ReplyDeleteeverytime mabasa ko blogs dito natutuwa ako. kasi meron isang banker na ready tumulong,magbigay ng advices sa mga taong lubog sa utang pero hindi ginustong takbuhan ang utang. isa rin akong cc user. 5 cc's ang meron ako. so far nababayaran ko pa naman kaya lang halos minimum lang so parang di rin nababawasan utang ko. good thing medyo may kakayanan pa akong magbayad dahil may work ako and ang husband ko nasa abroad. pero eto malaki kong problem hindi alam nga husband ko na may cc's ako. what if hindi ko na mabayaraan..pano na. natatakot ako sa pwedeng mangyari. lalo na merong mga ca's na ganid makakomisyon lang. thanks banker sa lahat ng advices mo..
