My Guide To BP 22



Long ago, in a far away place called the Philippines, the Supreme Court noticed that they are being made collectors of lenders thereby clogging the courts. To remedy, they decided to implement the following rules and procedures:

1.Umutang ka ,covered by PDCs at hinde makabayaq?

Filing for violation of BP 22 is now deemed to necessarily include the
corresponding civil action. Therefore, complainant must pay filing fees.

Failure to pay the same within 10 days, the case shall be archived;
After the lapse of two months the records of the case shall be disposed of.

2.Criminal actions for violation of BP 22 were also included among
those offenses where the civil aspect may be the subject of
mediation.

Thus :

IV Rules on Summary Procedures

Sec. 16. Arrest of accused. — The court shall not order the arrest of
the accused except for failure to appear whenever required. Release
of the person arrested shall either be on bail or on recognizance by a
responsible citizen acceptable to the court.

VI. Bail Bond Requirement

P 2,000.00 for the first P40,000.00 face value of the check;
plus P1,000.00 for every P10,000.00 in excess of P40,000.00 ;
but bail shall not exceed P30,000.00

3.Issued Administrative Circular No. 12-2000, later on clarified by
A.M. No. 00-11-01-SC dated February 13, 2001 that :

the intention of this circular was not to remove imprisonment as
an alternative penalty, but to lay down a rule of preference
in the application of the penalties provided for in B.P. Blg. 22:

(a) imprisonment only;
(b) fine only; OR
(c) both.

V Penalty under BP 22:

30 days to 1 year imprisonment and/or
fine of not more than double the amount of the check
but not exceeding P200,000.00

However, judges now rarely impose imprisonment as a penalty.

In the event of imprisonment:

VII Presidential Decree No. 968 dated July 24, 1976

Section 4. Grant of Probation.
The court may, after it shall have convicted and sentenced a
defendant and upon application at any time of said defendant,
suspend the execution of said sentence and place the
defendant on probation for such period and upon such terms
and conditions as it may deem best.

RULINGS:

In G.R. No. 138669 dated June 6, 2002 the Supreme Court has this to say:

Nevertheless, while we recognize the noble objective of B.P.22, we
deem it proper to consider the underlying circumstances of the
case such that if the situation calls for the imposition of the
alternative penalty of fine rather than imprisonment, the courts
should not hesitate to do so.


On the 1999 decision of the Supreme Court in King vs. People of the Philippines (G.R. No. 131540), PANGANIBAN, J. wrote:

Under Batas Pambansa Blg. 22 (BP 22), the prosecution must prove not only that the:
1.accused issued a check that was subsequently dishonored.
2.It must also establish that the accused was actually notified that the check was dishonored, and
3.that he or she failed, within five banking days from receipt of the notice, to pay the holder of the check the amount due thereon or to make arrangement for its payment.
Absent proof that the accused received such notice, a prosecution for violation of the Bouncing Checks Law cannot prosper.

“True, complainant sent petitioner a registered mail,.. but the records show that petitioner did not receive it . .”

However, in the 2005 case of Yulo vs. People of the Philippines (G.R. 142762),the Supreme Court seemed to have disregarded this “notice” requirement, perhaps, since it also considered the underlying circumstances of this particular case.

Thus, Jaromay Laurente Pamaos Law Office opined that:
“ In other words, at this stage, both sides could logically argue either way.”

    worried ako ngayon at kinakabahan pa. a while ago tumawag taga citibank CC(Mr. Tuazon daw).ngtanong bakit hindi akong ngbyad ng due ko dahil ngpromise ako na sa jun15 mgbbyad ako.mrami cya sinasabi kaya hindi ako mkpagbutt in tapos sinabihan nya ako na bakit daw ako hindi ngsasalita.sabi nya ppuntahan daw nya ako sa ofis ng taw pra mkpagsign ng notice for case filing daw.mdali lgn daw nya ako ppuntahan kasi may agent cla dito sa lugar tapos mlaki daw ang utang ko na 94K.sinabi pa nya na hindi daw ngbibiro ang citibank.sinabi pa nya na f hndi talaga ako ngbyad ngayon ung notice is ppipirmahan daw nila sa boss ko.naiyak ako sa kaba banker. ano gagawin ko?

    I would like to ask advise po if may utang ako sa Credit Card then kukuha kami ng aking asawas ng House & Lot throug PAG-IBIG Funds. Posible ba na hindi ma aaprove yung application namin sa PAG-IBIG?

    Is there a connection ang mga bangko sa PAG-IBIG Funds?

    Pa advise po. May nakausap po ako ngayon na taga Citibank regarding on my unpaid credit card. May program daw sila na ibibigay sa utang ko, payable for 36 months. kaso lang one of the requirements is a co-maker. Ayaw ko pong mangdamay pa sa ibang tao sa sarili kung problema. Agree naman ako kahit 1K/month pero yung may co-maker ang ayaw ko.

    If incase daw d ako makaprovide ng co-maker by next for case filing na daw.

    Pls advise po if necessary ba yung co-maker. Thanks

    maganda yung iniisip mo. once you defaulted, hantingin naman nila yung co-maker mo, at aawayin ka pa nun. banker is right, better settle it sa court na lang, (with a big "IF")

    normal na panakot na yan ng mga ca. kahit sa akin ginawa nila yan. pagdating sa office, hinde naman nakaporma ang ca, yn nga lang dianakdakan ako nung girl thru phone (baghan ako non dito). isa, remember that our company has nthing to do with our personal problems like utang, hinde nila pwedeng patulan yun.

    Don't believe on their amnesty fantasy. Sa akin nga gusto nila may co-maker na, may post dated checks pa. Kasi wala silang magagawa sa atin kung hindi tayo kakagat sa bitag nila. Always remember, it's a trap.

    Nakakatawa pa ay tawag ng tawag at mananakot ng demanda. Then the next day makiki-usap parang nasa deal or no deal kami. Parang nasa palengke ako na nakikipag-baratan.

    Bayaan mo lang silang kahol ng kahol na parang aso. Bugawin mo na lang....tsu! tsu! alis! he he he (their bark is worst than their bite)

    Worried ako ngayon at kinakabahan kasi may dumating na sulat saking galing ng Domingo & Molaer Law Offices "Please be informed that we have personally visited you today, we will be scheduling a meeting w/ your immediate superior or your's company's Human Resources Group Head Office, in the meantime you are given an additional 2 days otherwise we will have to sue you and your spouse, if married as mandatory party, under Rule 3 section 4 of the new rules of court, in court to recover what you owe to our client without further notice"

    I was also a victim of harrassment happen last week. My grandmother got a call from a guy who just informed that they're looking for me.Sabi darating daw sila agad sa bahay namin for occular and for my "warrant" and that i have a case filed by someone!, Of course my grandmother is shocked and nearly fainted. I speak to the guy who called. First and foremost it is not proper to speak to any person dapat ako kauspin nila if this is a legal matter. So I speak to them and ask what about the warrant, di nila masabi kung anu violation ko nagpahaging na about account payables. Since I only have 1 unsettled account (HSBC) alam ko na yun. Sabi ko sinu complainant, binigay lng skin ang isang mobile no. w/c is ky Atty. raw yun ang my hawak ng case ko. So i called that no. and speak to Atty. ****, there he informed me that he has a client who file a case against me. I ask what client but he did not mention basta isipin ko daw kung anu yung di ko pa nasesettle na account I said (HSBC) so he replied na baka yan na raw madami raw kasi sya clients and mga cases na hawak. In our conversation isa lng gusto nya mngyari dapat magbayad nako ng full amount agad agad di na pwede ptagalin ng 2 days. Actually its been 2 mos na wla pako nahulog cause I was now jobless since April na terminate ako, and one of the victims of global crisis. But I had paid a certain amount (3K)to HSBC this morning but not the whole amount (16K). If ever i cannot comply the full 16K they will come to our house and present the warrant. At first i negotiated with them to try if i will have the amount but on my mind, i am going to investigate about this. Good thing I have read blogs about this and read articles and learned. Also tumwag ako sa bank mismu ng HSBC and sinabi duon na di nila inaallow ang mga ganung pngyayari na harrassment. And most importantly di pwede masali ang court and atty. about credit cards.
    Now I again receieve a text from certain name saying that they will come to our house now for the temporary restarining order kasi need na nila ako actionan asap.


    Banker please give your comment on this.. nag bayad lng ako 3K this morning, ang utang ko pa malaki pa.

  17. CHINATRUST.

    Chinatrust requires in house PDC for payment of loan. I have been in default for the last 4 months, because of series of unfortunate circumstances - closure of business, piling of of debts, pregnant wife, and just recently I was diagnosed with stage 2 cancer.

    I have forseen this financial problem shall occur, so i took the initiative to call Chinatrust and asked for a restructuring of payments ... however they declined and informed me that they dont have restructuring plans.

    I have been trying to talk to them every now and then ,,, but to no avail. They've asked me to pay 15K, minimum, anything lower than that will not be accepted by the bank.

    According to the person from the office of a certain Atty. Benjamin Salva, there is already a warrant of siesure of property, and anytime the police shall pick me up at my office or residence. He further informed that they shall immediately pullout anything of value from my house as payment of my debts, he even asked me to have my lawyer ready (e kapos na nga ako, mag lawyer pa ako) .... WOW, talk about misfortunes ... that would surely add more stress to my pregnant wife ... WHEW.

    Can they really do this? I acknowledge my liabilities to them, and even offered a plan to repay them, but not to the amount theyre asking. Im ready to face them anytime to discuss my concern.

    sad to know u are diagnosed with stage 2 cancer, hope u could overcome these trials.

    it is obvious that these people from the collection agency are giving you false threats, there is no such thing as warrant of seizure of property for non payment of debts and they cannot just pullout anything from your house without a court order. Did they file a case na ba>?
    did u receive any summon from the court?
    do not believe these guys.

    kung ako ang nasa posisyon mo, tama na yung ginawa kong pagtawag. just wait for them in the house kung talagang darating, magaabot lang yan ng piece of paper, kung papel nga silang dala kasi madalas, yung may ari pa ng bahay ang hinihingian nila ng papel eh. nakasulat lang dun ang name and number na gusto nilang tawagan mo, but never ever call them back. wala silang magagawang sa yo ang taktin ka. dare their bluff and see how they will react. tell the magic word "sue me!"

Lahat ng kasinungalingan sinabi na sa yo. tell your pregnan wife in case na makausap nya, never believe them ok. para hinde siya ma stress. Kasi, ang pag pull out ng mga gamit sa bahay requires a court order, warrant of arrest is for criminals only and you are not one of them, at isa pa, hinde natin kailangan magkaron ng lawyer in case na magkaron tayo ng kaso. May ka na ba? wala pa. kaya never believe ever believe them. take care of yourself na rin since may sakit ka, unahin mo muna ang needs nyong mag-asawa, wag mo na silang intindihin.

  24. good morning banker, ms hopeful, dragon76, lito and to all members of this blog, gusto ko lang ipaabot ang pasasalamat sa inyo kasi malaki ang tulong ng blog na ito sa akin, actually itong mga cc collector na ito wala ng magagawa pag 15/30 naghahabol na ng commission nila un at sa totoo lang ung citibank tumatawag pa nga dito sa bahay namin ang inooferan pa ako ng 1 loan para mabayaran ko "daw" ang utang ko sa kanila sabi ko lalo nyo ko binabaon sa utang mga inutil kayo dahil sa inyo nagkautang2 ako hehehe. ngayon nagmamakaawa sila kahit 500/mo na lang daw para di mawala sa kanila ang account ko sa RS SANTOS LAW FIRM daw po sila.

  25. Hello,Im so happy that I found this site..I think I can call it a haven cause me too, Im also a victim of collection harassment.

    I have an unpaid loan at SCB (Standard Chartered Bank) and like other people I have my series of misfortunes. I already paid half of the amount of my personal loan when suddenly the company that I've been working with hit it's the end of the line of their business so in short I was not able to pay the rest of the balance because i was laid off.

    I really don't have any intentions of leaving my financial responsibility behind but what irritates me is they been calling my residence to make a reminder and insult me at 6 in the morning.How was that? I gave them my assurance that I will settle it in due time because at that point i was jobless,until they told me that it's not their fault if I don't have a job...Business is Business they said.

    So I decided to ignore their call and yes you were right Banker that every time I received a notice from them I don't read them anymore and they go straight in my rubbish.

    What only worries me is that I'm leaving for Australia and Do you think that there will be a possible problem because of this? They also sent me a text message that there will be some person by the name of SPO4 wannabe or whatever you may call it will serve my warrant of arrest?

    I owe SCB 20K now and you think at this amount I'll be in prison and keep me from going out of the country?

    Sir Banker, NBIisscary po uli ito..."nabuhay na po uli ako"...matagal tagal din po bago ako uli nakapgpost dito after malaman ko na meron akong 10-year old pending warrant of arrest because of BP 22 Case filed against me sa San Juan MTC noong April 19, 1998 according to my NBI Records (naaalala nyo na po ba ako?)

    Praise be to God! Naayos ko na po ang problema ko after 2 months. Natagalan lang po kasi niloko lang ako noong abogado na hiningan ko ng tulong (kikwartahan lang ako!)Pinatagal tagal nya ung paghahanap doon sa kumpanyang pinagkautangan ko para lang makakuha nang makakuha ng pera sa akin! May mga abogado po palang ganoon?! Marami po siyang alibi noon na kesyo hindi raw po nya makita yung opisina...once a week lang po kasi siyang pumunta sa Maynila (dito po kasi kami sa probinsya). Hanggang magdecide po siya na magbayad na lang daw po ako ng piyansa dito sa Regional Court sa probinsya namin para daw po magkaroon na lang ng hearing at para daw po mag-appear yung allianz capital corp. na pinagkautangan ko. Nung hiningi po ng RTC dito sa amin yung original copy ng warrant, pinapunta ko po sa San Juan MTC yung kapatid ko at buti na lang po nangyari yun dahil isa po sa mga tauhan ng court ang nagsabi na parati naman daw pong may representative ng allianz ang pumupunta roon dahil marami pa po silang ibang mga kaso na naka-file doon! Ang pinagtataka ko po bakit hindi nalaman yun ng abogado ko?!! From then on kami na lang po ng kapatid ko ang nakipag-usap sa allianz..binigyan po nila ako ng amnesty...pero malaki-laki rin po ang ibinayad ko sa kanila. Within a week nasettle ko po yung kaso ko! Hindi na po nila ako pinagpiyansa! June 9 nagbayad po ako ng 2nd payment (full payment na rin po) at nakakuha rin po ako ng affidavit of desistance at court order ng araw ding iyon...ibinalik na rin po nila lahat sa akin ang mga tseke ko at meron po akong certficate of full payment! (Salamat sa Diyos)

    Kailan lang din po nakakuha na ako ng NBI Clearance ko. Laking pasasalamat ko po dahil hindi nakareflect doon yung kaso ko...ang nakasulat po doon "NO CRIMINAL RECORDS". Nakakuha na rin po ako ng passport ( nauna ko pa pong kinuha ito bago ako nagclear sa NBI at binigyan naman po ako ng DFA).

    Isang napakalaking aral po ang nagyaring ito sa akin at sana po hindi rin mangyari sa iba. Marami po akong natutuhan. Nakilala ko ang mga tunay kong kaibigan...yung hindi po nagkondena sa akin sa halip po nagbigay ng suporta at hindi ako iniwan. Sana maging aral din po sa iba. Hanggat maaari makapitumpung beses po nating isipin at timbangin kapag tayoy gagamit ng tseke.

    Ngayon po masaya na ako. Salamat Banker, sana po magsilbing aral sa iba ang naranasan ko.

    Hindi po eto CC pero loan but i think the harassment is similar.
    A few months ago nagloan po ako ng pera sa chinatrust worth 40k 18 mos. to pay. Then i went here to the Netherlands since my mother invited me here to work. I have all the intentions of paying every sent of my loan knowing that the value of money here is a lot more. Then just a few days ago I received a txt from my brother in the philippines. In the text it said that "A warrant of seizure" has been filed against me. ordered by Judge Oscar Aguilar of Makati MTC br. 72 and for me to contact a certain "atty. Benjamine salva", so i contacted this atty, he picked up the phone, i introduced myself then he that he was just finished talking with my father. I mentioned that the call was overseas, then suddenly he said that is coordinating with the immigration/deportation office (he didnt specify which country). He told me that i have to pay 20k by friday to pay for my loan which bloated to 57k as of july 6, 2009. Then i asked if we can negotiate a lower amount since i didnt find a job here yet. Then he started yelling and cursing "P.I. mo", bobo, he threated me that he has the power to have me deported and that he can have me killed here or in the Philippines once im "deported". So i followed what he said and I sent the 20k to my brother (since there are no Union bank here or any other bank wherein chinatrust accepts loan payments). He even threated my brother that he would have me deported if the 20k is not payed by friday. The 20k is paid now so 37k remaining which i plan to pay all soon. Tired of all the deportation and death treats he gave me. I opened the topic to my mother (who is a Dutch Citizen, but im not a Dutch citizen since i grew up in the philippines but were working on getting my Dutch Citizen ship although it will take a while). I was asking to myself kung pwede ko lapitan ang Philippine embassy here sa Netherlands(since my mother is close friends with the diplomats sa Philippine embassy). I know that the death threats he gave me are not right. but does he "atty benjamine salva" really have the power to have someone deported because of the loan or because if he wants to? I payed 20k already. O pwede ko po ba cya idemanda even though im here in the Netherlands? Thanks po Banker for sharing your wisdom. Hopefully you can answer my question. More Power po sa inyo!!!

    i have a very worrying problem re chinatrust. i had a loan from them payable for 3 years and i wasn't able to pay them for 6 mos already due to financial crisis na hinaharap namin ng family ko. then this certain atty texted me and filed a criminal case warrant of distraint and violation of B.P. 22 against me and anytime daw may pupuntang mga pulis sa bahay to arrest me. All i have to do daw is to get myself a lawyer, accept the warrant and post bail daw. Wala nga akong pera pambayad eh, kukuha pa ako ng lawyer. gusto nila bayadan ko full amount ng utang ko that day mismo. will u please enlighten me with this problem? thanks...im getting worried na po.

    this is dragon76. you wont get a warrant kung wala kang subpoena na natatangap. and only people from the court will hand you such documents so that you would know na meron case against you. be not afraid, bp 22 is decriminalized and all you have to do is attend the hearing kung talagang aabot dun. never believe what those collectors are saying.

    kung magkataon na magkita kayo ng collector? it's something na dapat mong katakutan. hanapan mo ng mga documents like id, collection agreement, authorization, soa. im sure wala sya ng mga yan. kung wala, ano yung sinisingil nya? paalisin mo agad, kung ayaw umalis, ipapulis mo.

  37. Ang laking relief sa akin nung nabasa ko itong blog na ito kasi nagkaroon din kami ng wife ko ng medyo misfortune sa negosyo namin. Dati rati nakakabayad kami ng mga utang namin nung kalakasan pa ng negosyo namin bago magkaroon ng financial crisis. Nung humina ang negosyo namin, tuluyan na akong hindi nakabayad. Ang daming tumatawag sa cellphone ko at sa landline namin na nanghaharass tunkol sa pagkulekta ng payments namin. Nagpadala na nga ang MOLAER law office ng draft ng case na ifa-file daw nila kapag hindi ako nagbayad in full. Eh ano magagawa ko? Ibabayad ko ebak? Wala talaga eh. I am really glad talaga na nabasa ko itong blog at medyo mababawasan ang stress namin sa mga problema. Salamat Banker!

  38. hI, i'M NEW HERE. kc yung pinsan ko may utang sa isang lending group before para magamit nya sa pag abroad and 1 year maturity. nagkataon na napauwi sa pinas pinsan ko dahil sa pagsara ng pabrika. Hindi na nya nahulugan dahil sa kapos. Ngayon may subpoena para sa pinsan ko for BP 22 Violation. Anu ba dapat namin gawin sakali umattend kami dun. ngayon sales lady lang sya. willing naman pinsan ko bayzran in easy terms. panu kami haharap dun ngayong pinapapunta xa dun sa prosecutor's office sa city hall ng manil? anu dapat namin i-expect once we get there? nakakakaba kasi... pls shed light po ASAP.     I availed of personal loans from 2 banks. HSBC and GE Money @ P250K and P160 respectively. Sa latter, I issued PDCs. (Note: This is used sa isang business venture na di nagpick-up. Sakin lang nakaname mga utang. Right, stupid. but moving on.)

    On both loans, nakapagpay pa ko ng 4-5mos. tuloy tuloy through cash advances sa credit cards ko.

    Sa HSBC, mga 2-3 months nako di nakapay pero tahimik pa sila.

    GE, everyday na mangulit. As in. So I appointed one of my biz partners through special power of attonery para sya naman makipag-usap while I attend to our things (selling our salon to pay of our debts. tsaka para fair, sila naman ma-harass.) But ayaw pumayag ng bank makipag-usap sa kanya (I assume syempre, wala naman sila ma-achive kung hindi ung debtor ang makausap nila mismo.) so they're not threatening to sue with BP22. Una natakot ako, now, naisip ko, what's so terrifying about it? I have no intentions of not paying and tried to make arrangements verbally and in writing but they won't budge. Damay na ngayon ang iba kong cards na pinagcash-advance-an ko. Specifically yung citibank at hsbc. Pati sila, tumatawag na din. Si citibank nag-offer payment scheme but inolving PDC na naman which I do not want to subject myself to again (per legal advise from some friends.)Anyway, ako in good faith lang. Mabenta ko lang yung salon, I will pay. In full. I'm just wondering what I should prepare myself with sa darating pang panghaharass.

    I still have copies of the letter of request for restructure stating the reasons why I can't pay (suffering business).

    Note: I've always had a clean record with my CCs since 2005. Always in full ako magbayad ng dues at never late.

  42. UPDATE: HOPE YOU CAN REPLY. JUST TODAY I RECEIVED A LETTER FROM HSBC DEMANDING THAT I PAY IN FULL THE ENTIRE 168+++ REMAINING OF THE LOAN. Are Personal Loans different matter from Credit Card Debts as regards to how these banks deal with them?

  44. Thanks Banker. I want to sell na din kasi 2 nalang kami na super effort sa business. We seemed to be the only 2 "really" burdened out of the five partners. Although, in fairness dun sa isa, naghelp out naman when told. Pero ang hirap kasi nung emotional and financial burden. It's not only the debts that we need to worry about, pati overhead expenses kasi it's really not earning. Madami akong natutunan sa experience nato. Na bad decisions even out of good faith are still bad decisions. Be wise when money and involved.

    Super laking tulong nitong blog na to Mr. Banker. I think us, the people you help, can't tell you enough how much we appreciate the thoughts. I've seen you around the internet while researching this matter and napansin ko madaming detractors and what I do appreciate is the humble manner you present your case. Hindi condemning unlike the others. You know, even before things got worse, I already considered that kung sakali man, I think I have a good case. Considering my excellent credit background. And my intent to negotiate with them even BEFORE I wasn't able to pay.

    Mejo frustrating lang at times kasi I felt like I didn't deserve the harassment considering where the money went (basta, mahirap magtiwala). I have saved a small amount of money which I am not about make "abono" again. I've already tainted my name and record, I've shelled out 33k (and more) of my personal money for that business and I'm no longer willing to sacrifice more cause I think it is undeserved.

    I hope all this will be resolved soon and hopefully, as smoothly as possible (tough luck.)

    So, steady lang muna ako while I let them file their case. Nakadivert na sa business partners ko yung calls nila.

    Nagtataka lang ako sa HSBC bakit parang di sila makulit. Tahimik lang tapos all of a sudden my letter letter na. Oh well. Ano't anoman, as long as in good faith ako, I guess wala akong dapat ikatakot.

    Salamat po uli. Sana magkabuyer nako. Kahit magkapera pa ko di ako papayag na pabayaran nila sakin yung malaking interest. I hope they provoke me well during nego kasi mas nagiging agressive ako pag provoked. Submissive ako pag calm. hahaha.

    Update: I received my SOA from citibank. Nakakatawa naman sila, ung call for cash ko (similar to loan) they billed bigla in full because I availed of the restructure program which I in fact turned down (as mentioned.) So ngayon, super laki ng finance charge at may overlimit charge pa!

    They even hostaged my replacement card. Last month they told me to pay the 3k ata un or something para ma-update kuno ang account. Wala naman nangyari after I paid.

    Sad considering how much of a good payer ako to them all these years.

But I read somewhere in this site na there's no need to worry kasi the PDC are considered as collateral lang and parang considered not good from the date of issue kasi PDC nga eh (or something along those lines).

I was right with the start of the week harrassment of the collections agency.. about 2 hours ago nkreceive ako ng text and it was the same as the text i got before -- "WARRANT WILL BE SERVE BY SHERIFF ESCOBAR AND SPO1 SANTOS. BE PREPARED ans PLS COOPERATE." --- i replied and asked for what case it would be? i also asked why warrant of szure kase i was told that for tax cases lang un. also i told them as far as i know warrant of arrest should be served once the sued party did not show up for the case.. i also told them that as far as I know di ako tumatakbo sa obligasyon ko kase 2 mos lang ung palya ko.. but since sept every month ang bayad ko so no intention to run away from it... and reply sken... 'SA KORTE KA NALANG MAG APILA'

    what will I do next? honestly i dont want to call the atty salva kase bastos cia.. i consulted a lawyer na kakilala and he wants to see the loan agreement but i dont have it anymore.. nsama sa baha nung ondoy...

    Would like to seek your advise,
    I do have a a Chinatrust
    non-collateral personal loan payable via PDC inhouse check of Chinatrust last January 2008 payable for three years. I have been delinquent for the last 8 months.

    I received a text message from Chinatrust collections department asking to pay the amount of Php 35,000.00 as part of my unpaid account for the last 8 months. Failure to pay within 3 days from receipt of this message they will sue me for violation of BP 22.

    If they sue me in court and I don't attend the court hearings , will the court penalize me for not attending? Assuming I received a formal notice of hearing.

    If I attend the hearing and tell the judge I don't have the money to settle the amount Chinatrust is asking, what are the possible decision that maybe rendered to me?

    Would like to seek your advise.

    Finally, I was able to pay my cc debt from Citi, i paid half of the amount of my total obligation. I guess my question is, will this completely free me from the records. Coz, im planning to grow my business and may put up a new one, and i am going to need some help, like a loan and i also want to be have a chance to own a CC. I have been declined from all my applications since 2003. also they told me that they will give me a certificate. would i be able to use the certificate in applying for a loan or cc in other banks?

    yung certificate of full payment nagamit namin dati nung nag-apply ng loan ang company. ang mga signatories kasi may mga defaulted cards before kaya hinanapan sila ng certificate of full payment. sa individuals, im not really sure kasi most of the time sa credit cards, hinde naman sinasabi kung bakit declined.

    mali reese, magkakaron ka lang ng KUNG: nagfile ng demanda ang bangko, pinadalhan ka ng summon tapos hinde ka umattend ng hearing, you will be granted a warrant.

    tungkol sa china trust, hinde makapagdemanda ang china trust kasi ang mga checking account na yun ay hinde naman nakapangalan dun sa may utang.

    nagkautang kami ng wife ko sa global dominion lending company dito sa makati. nakuha lang namin 50k out of the 70k na napirmahan namin with pdc issued. my wife went to qatar.
    medyo delayed parati ang sahod nya and ako naman dito ang sumasalo din ng gastusin kse may work naman ako dito.
    it has been a year na medyo di kami nakakabayad and 2 times na ako nagopen ng cheque sa kanila as per their request for the restructured payment and sobrang lobo na ng ginawa nilang interest.
    medyo di ko na nakikitang reasonable ang interest so i decided that i leave my faith sa court if they file a case. which in fact ginawa nga nila and may kasama pang pangiinsulto. nung una sabi nila estafa ang case and makukulong ako and papauwiin nila wife ko. then kanina may nareceive akong document na pilit nilang pinapapirmahan sa mother in law ko. upon checking pag dating ko from work, i saw na its an Investigation Data Form filed at Office of the Provincial Prosecution of Rizal....sa Taytay Rizal? ang layo ata.
    May stamp na nareceive ng office na yun and may document number na sila. 5 counts of bp 22. meron ding nakapirmang prosecutor.

    ask ko lang sana what if tumawag tong office na to and invited me to go there for investigation? pupunta ba ako? parang kilala nila tong office na to kse Tanay Rural Bank ang accredited bank nila and thats in Rizal.....hindi kaya trap lang to pag pumunta ako dun? ano ang magiging consequence pag di ako pumunta sa invitation nila?

    can i also do something sa pananakot nila...aatakihin ang mother-in-law ko sa ginagawa nila...and may i ask, makakaapekto ba to sa work ko? i mean do they have the right to go to my office and dun mang harass?(although di naman nila ginagawa for a year na).

    tumawag sila kanina and asking kung ano gagawin ko na daw sa account ko. i told them since di naman nila pinakikinggan ang request ko on how i can pay them...they asked me to produce 16k as partial payment para maayos na uli yung payment scheme. When i said i dont have anything to pay them now, he told me na itutuloy na daw nila yung kaso. Nung sinabi ko na sige di ituloy nila, bumanat ng di na daw dadaan sa court yung case, direcho arrest na daw.....

    tama ba ang pagkaintindi ko sa mga previous posts here na only the court can issue a warrant of arrest if di ako makasipot sa hearing? so there is no way na kahit may kilala silang pulis eh pumunta sa bahay para hatakin ako? or legal ba na may pumunta dun at magpanggap na pulis and takutin ako? is there anything that i can do kung gawin nila yun?

  73. I had exactly the same problem last week, the only difference was that hndi ako ang may utang sa chinatrust kundi yun ate ko, pero yun landline number at address ko ang ginamit ng ate ko. Nun hndi nla makontak ang ate ko, ako nman ang hinarass nla at pinagbantaan na kukunin ang mga property ko dito sa bahay, and in fact on the way na nga daw yun mga pulis. Sa taranta ko dali-daling kong inimpake mga gamit ko, imagine that! Nun na-realize ko na hndi na cla darating, saka pa lang ako nagpa-blotter sa brgy. My question is, pde bang sila nmn ang ireklamo ko ng harassment and threat, including usurpation of authority dahil sa nagpakilala silang SPO3 something?

    Worried po ako ngaun sir kasi may nakafile po na case sa akin BP22. Nalaman ko lang po na may case pla noong kumuha po ako ng nbi clearance recently. Nag resisgn kasi ako sa previous company ko at lumipat sa iba. Dapat po ay start na po ako mag work. Yun case po ay nafile daw date 8-22-2006, pero noong 2007 nakakuha po ako ng nbi clearance at wala po problema.May live-in partner po ako dati at nagkaroon kmi ng maliit na business. Since kulang sa capital nag loan po kmi sa lending company. Nabayaran ko po un 1st na utang. Yun 2nd loan nagkahiwalay na po kmi ng live-in partner ko at usapan namin cya magbayad kasi in the first place wala po ako nahawakan sa pera nasa kanya napunta lahat.di ko na po mahanap yun ex ko ngaun. Gusto ko po sana mangyari ay gumawa ng payment arrangement o settlement dun sa lending para maayos yun name ko. Problema ko po eh wala ako work. Gusto ko sana bayarin ko cla montly hanggang matapos utang.Sana po matulungan nyo ako para mag desist cla at mabigyan ako clearance at mabayarain ko po cla. thank you.

    i am citibank credit card holder since 2001. super okay ang credit standing ko with them. whatever yung na purchase ko, i always pay in full come my due date. hindi minimum balance, total payment due talaga binabayaran ko. they granted me another card because of that. Master Clear Card and A Gold Visa card. My problem started 2 years ago, syempre global crisis. Di ako nakabayad in full, minimum due lang. Kaso last year, around July, na bedrest ako dahil medyo maselan yung pagbubuntis ko. I was advised na mag leave from work for for 2 months, so ubos for sure ang leave ko sa office. no work no pay pa naman. So super worried ako kasi all of a sudden broke ako bigla.

  76. What I did was, I called Citibank to inform them yung situation ko. Nalungkot ako kasi although nice naman sila sa akin, pakiramdam ko napaka dilingkwente ko kasi super sila mag follow up. Sobrang diko afford na magbayad nun kasi nga nasabay din sa turn over ng house namin, andaming gastusin so nakiusap ako sa kanila if they could give me parang payment plan. Meron naman sinuggest na mag issue ako PDC kaso malalagay daw sa block list yung name ko. Di naman ako pumayag so diko tinuloy. Actually, dinededma ko na nga calls nila.

As in alam ko yung number nila eh so may caller ID sa office, kahit pagbalik ko sa work, syempre diko muna sila priority bayaran pero di ko naman intention to run away from my utang, kaya nung dumating bonus namin, i paid the first card around 30k and the second card 50k (pero may balance pa din na around 160k total na ng both cards) para maging current ang account ko. Problem is, they are supposed to re-send my replacement card eh. They sent it initially sa dati naming house eh dahil kakalipat namin, di ko nareceive. Nakakainis lang kasi antagal ko na pinapalitan ang address naka address na sa office namin and yet sa bahay pa rin ni deliver although all the billings are being sent sa office na. I was asking them for the replacement card, it turned out suspended na raw ang card ko kasi nga bale 3 months ako di nakabayad nung na bedrest ako, so I need to wait daw for another 3 months before they can send me the replacement cards. Three months have passed, dapat by February 2010 nanjan na yung replacement card, aba wala pa din kasi kailangan ko daw magbayad ulit ng at least 50% pa. So naisip ko, naku ayoko naman nun no, so naisip ko pay pa din ako ng minimum due hukling bayad ko nga is February kasi nanganak ako, so on leave, kahit binayaran ako ng office, malaki naman ang nagastos sa hospital, CS pa ako, so di ko nabayaran ang due nung March, super call na sila deadma ako talaga. Plan kko magbayad by May na pag nakabalik na ako sa work. Nainis lang ako kasi nung una kilala ko pa yung number na kumo kontak sa akin, diko nga sinasagot kasi alam ko citibank. Wednesday morning huli sila call, deadma ako. Nung afternoon, may tumawag cellphone na hindi na landline, missed call una tapos, another number ulit, nung sinagot ko, diko masyado naintindihan choppy kasi ang line, pero parang may narinig ak na SANTOS tapos asking me to pay. So nagtataka ako, naisip ko, aba parang 2 months and 1 day delayed pa lang naka endorse na sa collection agency? ang kulit pero mali mali mag english. so sabi ko try ko nga by next week magbayad, ask nya specific date kelangan daw nila. Nagtaka ako kasi parang iba na nag follow up unlike yung taga citibank talaga before. Iba na rin number, cellphone, parang private number na.

    Tapos kanina mga 7pm naka receive ako text. Patawa pa kasi iba ib ayung letter, may naka caps lock, may small letters. Di naman sinabi kung taga saan sila. May binigay na number na kelangan ko daw kontakin. I only have until april 21 daw para magbayad para di masama sa negative account ni review daw kasi nila account ko. Eh naguguluhan ako, doest it mena ba na naka endorse na sa collection agency ang account ko? Eh bat ayaw magpakilala sinasabi taga citibank pero iba kasi ngayun, bakit hindi number ng citibank ang gamit? Eh plan ko magbayad ng May pa, kasi natatakot ako baka mademanda ako malaki payung 160k, baka habulin ako o i harass sa office. okay lang yung calls, kaya ko sila deadmahin ano ba magagawa nila pag tawag ng tawag. Kahit nagtatapang tapangan ako natatakot pa din po kasi ako.

    Pano kung guluhin ako? Magagawa ba nila yun? Madedemanda ba ako? Pag pnadalan ako ng demand letter, sabi kasi sa thread nabasa ko advise ni banker wag basahin at itapon, safe ba talaga gawin yun? Dipo ba ako makukulong lalo pag diko inintindi yung mga demand letters na yun?

    bago lng po ako rito. may problema rin ho ako sa dalawang cc ko. cb at scb. just this jan2010 di nko naka pag post ng payment sa due ko nang december. mangyari kasi, from august na nanganak ako at lumipat, nag rent kami nang asawa ko nung october. di na ko nakabayad. nung april, sa kaka-follow up nang cb nakabayad ako nang 5k pa tingi-tingi nga lang. taz may tumawag for interview para sa payment assistance. kaso di ako na appprove kasi nag negative income ako base sa mga sagot ko, eh, totoo lng po kasi yung sinagot ko na at least me 1k na maiiwan sa salary ko. in short po, ask ko lang if pde at least 1k na lang babayaran ko sa kanila para makabayad ako. pero hindi kasi ganun yun, at hindi pweding masusunod yung gusto ko. eh, di ko na kasi makaya yung gusto nila. para maka apply ako ulit sa payment assistance nila, kelangan bayad ulit ako ng at least 5k at prepare ako nang co-maker, checking account, and may pirmhan na agreement kasama si co-maker.
    sabi nila, naka blocked na ang account ko march palang nung 3 months due ko. i'm expecting na hindi na tutubo yun pero lst wk lng na tanggap ko yung billing from them, 95k+ na ang singil nila at immediate payment.
    sa scb naman, yun parin, asked ko if maka apply ako nang amnesty program. problema ko sa scb banker, tawag ng tawag everyday sa opisina at tatawag ng 8:30 or 9AM. hirap nito, matatanggal ako sa trabaho nito kasi sa ka-telebabad ko sa kanila. in addition, hindi nila ako binibigyan nang option, dapat mag bayad daw ako at least hindi pa mag 2PM. or, ipa cancel ko nalng para kinabukasan, may ahente na pupunta sa kin at mag sisingil nang 15k. sabi ko mas lalo hindi ako makabayad, eh sabi nila i-forward nila yung accounts ko for legal actions. ayaw pa nila na ang isagot ko during phone conversation na 'ita-try' ko kailangan daw 'hanapan ko nang paraan'. pag sinabi ko naman na hanapan nang paraan, kelangan i-sure ko na mahahanapan nang paraan at ora-mismo.
    ano po ang dapat kong gawin?
    di po ba pwedeng bayarang cla nang 1k at least man lang ma gaanan yung loob ko sa kanila. pls po, tulong. salamat ng advance.

    ( watch their reactions - magagalit yan, or they will discourage you kesyo mahal ang lawyer, etc.)

    pwede bang bayaran sila nang certain amount to permanently cancel all? kasi may nakapag sabi din sa akin na kunwari classic card at least 15k raw ang babayaran tapos, tapos na. sa kaso ko gold yun eh, at least 30k daw. yung ka trabaho nang asawa ko bago land din daw dumating yung ipapabayad sa kanya na at least 14k sa 30k nya na utang at ang utang na yun, mga 2yrs na ang nakalipas. eh, ang sa isip ko hihintayin ko pa ba yung 2yrs? at titiisin yung mga tawag nila araw-araw sa opisina? hindi ba pweding byaran sila nang ganun kung mag kakapera ako?
    yung katrabaho ko rin dati, may due rin sya sa hsbc, pero at least 13k ang nabayad nya kasi tinwagn siya at sinabihan na 'promo' daw yun. pagkatapos nun, wla na. tapos.
    gusto ko nga rin ganunin sana pag mag kapera ako.

    hinde tayo pakikinggan ng bangko. they will never accept our proposal coz they would want more. the best thing you can do right now is to stop paying. yung mga tumatawag sa yo, accept mo lang, but make the conversation short. stop explaining coz they won't listen anyway. just tell them na wala kang pambayad. pag tinakot ka ng demandahan, tell them to "go ahead". they cant really file a case, bangko lang ang pwede.

    tnx for the advice. actually just now tumawag yung scb sinabihan ko magbabayad ako this afternoon. pero, di talaga ako makabayad ngayon. hihintayin ko nlng cguro yung tawag na naman nila. ann de guzman yung laging tumatawag sakin from head office daw.parang galit sya sa kin kasi lagi lang daw ako nag co-comit na magbayad tapos sabi nya pa na pag nakapag settle na ako, ako na raw ang tatawag sa kanila kasi lagi daw sila tumatawag sa kin nakaka istorbo na sila sa akin,.. natawa ako kasi dapat ako ang mag sasabi nun. inunahan pa nila ako. pero sa totoo lang po, araw-araw may kaba ako pag pupunta nako sa opisina kasi yun nga, ayaw ko kasing mang away sa telepono kasi nanginginig ako kaya yun naisip ko na bayaran nlng sila nang certain amount para tahimik na kami lahat. pero, sa tingin ko, parang malayo pang mangyari yun.

    meron akong friend na nasa italy nagpatulong sya sakin na mag loan here sa pinas asialink since kumare ko even na wala sya sa pinas pumayag ako nakapag loan sya using me and my wife and his uncle as a co-maker now ung bayad pinapadala niya sa uncle nya one day nakalimutan nang uncle nya magbayad na delay nang isang araw akala nang uncle nya ok lang madelay eh may PDC kaming pinirmahan sa Tanay Rural bank kasi wala kaming check dun kami pinag open at tumalbog nga po hanggang sa matapos na ang pag bayad nagulat po ako may dumating na subpoena samin umattend naman ako submitted na for resolution nagulat ako almost 40k pa utang daw namin kasi sa penalties at legal fees wala po akong trabao ngyn dahil bagong opera ako sa gallbladder wala po kaming pera ngyn hinaharras kami nang mga collector tumawag sila sakin today na magpapadala sila nang tao at pupunta daw sila sa barangay namin may paparecieve daw po sila ano pong dapat ko gawin sir, yung isang collector hinamon pa ako nang suntukan grabe sila sana po makatulong kayo sa akin, isa pang problema ko di ko na macontact yung kaibigan ko.

    i was wondering bakit ka pa gugulluhin nung collector eh nasa korte na ang kaso. nung umattend ka ng hearing anong nangyari dun? kung sakaling dumating man ulit ang collector, tell them na sa korte na kayo magusap since andun na yung case. you have to talk to the borrower para malaman kung anong dapat gawin

  87. May plano po kasi akong umuwi kaso lang natatakot po ako baka pagdating ko pa lang sa airport, they'll arrest me na. Pwede ba yung kung may lawyer (mag-hire na lang po ako), sya na yung magbabayad ng bail? Pwede bang magkaroon ng 2 warrant of arrests dahil sa hindi nakapag-attend (nung una sa arraignment tapos meron na naman sa pre-trial)? Salamat Banker.

    i'm very relieved that i came across this blog. kami rin po ay may problem na very similar. i have a personal loan sa citifinancial. they required me to issue PDC's. i was able to pay initially pero after 4 months na close po yung checking account ko so tumalbog na po lahat ng mga PDC's. ang alam ko last check was march 2010. total na 14 checks p lahat yun na tg-11T each. dati po madami din tumatawag sa akin pero ang ginawa ko is nagchange ako ng cp number at pinachange ko dn landline number namin. kaso surprisingly very quiet ngayon, wala na letters and wala na nagpupunta sa bahay. i'm just worried baka bigla na lang ako damputin ng mga police. what can u advice po, hintay na lang ako na magfile sila? summons po ba muna before subpoena? tnx po.. i'll be waiting for ur replies po.. tnx

Nag loan ako sa Asialink ng 100k, OFW loan, the day before ng departure ko, naterminate ang contract ko ng employer ko, di ako nakabayad sa original sked ng payment ko, pina re structure ko till the third time, ngayon, ang total ng binabayaran ko ay 180k, payable within 24 mos. Before ng restructuring, tinawagan ako at sinabing iwwave daw ang interest basta pumunta ako sa office nila,at mag produce ng 8k. Yun ang ginawa ko, nangutang ako para ma avail ko yung promo nila na walang interest. Nagbigay naman sila ng copy ng schedule of payments ko, wala talagang interest. On my third month of payment, may tumawag sa akin, pinapupunta ako sa office, asking for any amount, tinanong ko para saan yun, sabi para daw sa interest kasi nakalimutan daw nila lagyan ng interest ng nirestructure nila, hindi ko pinansin yung tawag, after six months, nagpadala sila ng statemtn of account, may interest na, eh hindi na ako pumalya ng payments ko. Di ko pa din pinansin dahil para sa akin, may copy ako ng payments na dapat ko bayaran monthly. Matatapos na ang pagbabayad ko by october, paano kung after oct sabihin na naman nila di pako fully paid? Lahat ng receipts tinatago ko, never ako pumalya ng payments ko. Ano gagawin ko kung sakaling sabihin nila, dapat may interest?

  96. hi po. Nakakatuwa nung nakita ko tong blog nyo. Actually isa ako sa mga taong may utang sa credit card companies. Nagkabaon baon ako sa utang at inde ko nabayaran un monthly dues ko because of personal reasons. Nagkasunod sunod kasi financial prob sa bahay namin. May mga tanong po ako.

    Kasi un 3 CCs ko (HSBC, CB at MB) un ung mga hindi ko na nabayaran, mga 3 months na po. Hate na hate kong sumagot ng mga calls from credit card companies kaya what I did was di ko sinasagot un calls basta from an unknown number. Pati un phone sa office hindi ko na rin cnasagot for peace of mind ika nga (kasi im pregnant at ayaw kong mastress out kaht na ppnu, alam kong may konting stress na nadudulot tong ginagawa ko).

    May nagpunta daw po sa house namin the other day looking for me. Eh cympre nagaalala ang nanay ko, kasi hinahanap nga ako at dumadating yung bills sa bahay. Anu po ba ang mga pde pa gawin ng mga collectors na yan? Pag pupnta po ba cla sa mga bahay bahay, pde ba nilang sabhn sa mga kaptbahay na ichismis n ako ay may utang?

    Medyo mahina po kasi loob ko sa ganyan at gusto ko sana humingi ng advise kung anu ang mainam kong gawin para matigil sila sa pagpnta sa bahay.

    Yung sa phone calls po kasi madali na eh, pde akong magpachange ng number if ever.

    I share the same sentiment with CHINATRUST loans, I felt so harassed by their collections agency, they keep on saying na if you wont be able to make a payment your account will be forwarded to their legal department, if so you will make a payment for their attorney's fee. System generated daw ang forwarding ng account sa legal if the system detected na there is no payment made on the account. Kanina I received a call from them asking me to make a payment for 3 months that were due april-june. I recently lost my job and my backpay wont be in until 45 days. I am willing to make a partial payment naman so they ask me to pay 8600 by june 21st. I'm not sure if I can raise that amount given na I am jobless right now. Pero ang hirap nila parating pakiusapan.

    There was a time na they ask me to make a payment and it was a Friday I was stuck in traffic on my way to a bank. I called the collections officer and told them the situation sabi ko masasaraduhan ako ng bank pwede bang sa Monday ko na ihulog yung payment dahil hindi gumagalaw yung sinasakyan kong jeep. Sabi nya sakin habulin ko Makati office nila na until 5pm. Sabi ko sa kanya nasa QC ako at papupuntahin nya pa ako ng Makati para lang dun? Ieendorse na daw nila ako sa legal, I felt so harassed I am more than willing to make that payment and ako pa ang naginitiate ng call to inform them ending sabi ko sa kanila iendorse na nila sa legal. Turned out Monday holiday pala so Tuesday na ako nakapagbayad. Did not receive any call from them for that month.

    Although my question is yung about sa 12+ debt na they are asking me to pay atleast 8600, paano kung di ko mabuo yung amount na yun by june 21? Nakakastress na kasi to deal with them and grabe talaga sila kung magsalita panakot nila parati legal etc. my mom has heart problems and everytime tumatawag sila hinahighblood mom ko sa takot.
    Please enlighten me on what to do.

  100. thank you banker, atleast now mas confident ako and hindi paranoid about my loan.

    I know naman my obligation to pay and hindi ko naman sila tatakbuhan kahit paano I make payments naman kung meron akong maibabayad lalo na when I had a job I even make advance payments. I know na delayed yung bayad ko for this and I was trying to make arrangements for it, kasi sabi nila wala silang department na pwede akong makipag payment arrangements.

    if I understand my situation correctly, kahit takutin pa nila ako about legal and everything or may sinasabi pa silang pirmahan ko yung notice na dadating, if wala naman talaga akong maibabayad right now since im jobless they cant sue for that, kasi ang pinananakot pa nila sakin is I'll pay for their attorney since naendorsed sa legal yung account ko, then they will ask me to make a full payment of the amount that I owed them even if wala pa sa maturity kasi nga I failed to make payments for 3 months na. I read the link na pinost mo and nakahinga ako ng maluwag knowing na hindi ganun kagrabe yung situation and now I can assure my mom na she dont need to panic everytime the bank threatens.

    I received a letter just today from a certain Atty. Rolando V. Vicerra nakalagay dun na I failed and refused to pay daw my obligation and their foist is to take necessary legal action to collect from me.

    They demand an amount of P65,129.70 inclusive of penalty and charges if I failed to pay the said amount by June 21 daw they will be constrained to file appropriate criminal and/or civil actions against me.

    Banker the amount I am supposed to pay the bank is 12,300 for the 3 months unpaid obligation but their letter stated more than 65,000. I know told me before to dare their bluff, my backpay won't be available until July 5 which is the amount I am reserving for their payment. my mom received the letter and as expected we had a fight over it and she is still unconvinced when I tried explaining her the situation.

    Banker, can you please tell me how serious this is and if I am not able to make a payment on June 21 what are the possible things that might happen I really don't have money to pay them this June 21, my money won't be available until July 5. Please help. :(

Gdpm banker. i posted here sometime in april. banker, hanggang ngayon hindi ko parin nababayaran ang cc ko sa scb. last monday lang, sinabihan ko yung tumawag na 'bahala kayo kung ano ang gusto nyo', pero yung sagot naman nya eh, ano ba daw ang ibig kong sabihin doon. hindi ko pa rin kaya i-dare yung 'sue me'. tapos kaninang umaga, may tumawag sa kin sa head ofc daw sya c ms. aligato (?), sabi nya sa kin marami na raw natatangap na feedback na 'pahirapan' daw ako kung kausapin. tapos, sabi nya kung hindi ko mabayran ang kahit na php1,800 as partial payment sa visa lang daw muna, kahit na daw wag ko muna bayaran ang ez pay. ang alam ko nung monday lang ako sumagot-sagot sa kanila.
    tapos, gusto ipasiguro na kung hindi ko mababayaran bukas, para ma-i blocked na daw nila ang account ko this evening, para bukas ipapasa daw nila yung account ko sa mga collecting agency nila. . para tomorrow then, sisingil na cla nang whole outstanding balance ko.
    banker, para nkong paranoid talaga sa scb, sa opisina kasi tumatawag tapos alam na nang mga kasamhan ko dito na araw-araw may tumatawag skin na banko pero di lng nila sinasabi sakin. wla talaga akong ibang matakbuhan banker, ni pwede kong pagkautangan. kahit 1,800 lng di parin kaya.
    kung sakaling, sabihan ko sila na 'idemanda' nila ako. ano ang maaasahan ko mula sa kanila? aside sa mga pananakot. salamat po talaga sa tulong..

    Im from cebu,and im very much worried kasi someone from a collection agency name Giovanni,actually the name of the collection agency is ANCHOR COLLECTION SERVICES.They are sending me a demand letter to pay my unpaid credit in Citibank.Umaabot na daw sa 117,000 yun utang ko.Im so worried with it kasi I dont have money to pay. Im so broke that I couldn't pay it anymore. Hindi ko alam kung kelan aq magka money.So what I did is nagtatago nalng.Pag may tumatawag sa akin pinasabi ko sa ka officemates ko na wala na.But today somone came name Giovanni from the collection agency I mention above.He brought a demand letter to pay the amount of 117k. so My questions are:
    1.Can they bring a policeman here to pick me up?
    2.Can I just hide my identity here para pagpumunta cla dito sa office they won't harass me?
    3. The person was threatening that he will bring pics of me..meron ba silang picture sa akin talaga?

    4. Can I just neglect them no matter how they harrass me?

    5.paano if they will bring subphoena here in the office,legal ba yun?

    second - bail is P 2,000.00/check so
    if the bounced checks amounts to P 4,000.00 better pay it na lang instead of posting bail then let them execute an Affidavit of Desistance.
    third- napaka-cheap naman ng lending company na yan? lol!

    update ko lang po kayo regarding sa mga transaction ko sa scb & cb.
    since this month po, both banks di-nare ko na cge ipa legal nyo na lng ako. sa scb, sinabihan ko yung tumwag na, "kayo bahala kayo kung anong gusto nyo", taz sinabi niya sa kin na "anong ibig mong sabihin mam?" sabi ko kayo bahala na kayo sabay baba ng telepono. that was jun 7. sa mga nagdaan na araw, tumatawg pa rin sila at pinapabayad pa rin ako, but till now, wla pa rin akong naibabayad sa kanila.
    sa citi naman ho, jun 15 tumawag sila tapos sinabihan ko yung ruby dela cruz na cge ipa-legal nyo nlng ako. pina-prepare nya yung sarili ko, taz mag expect daw ako na pababayaran sa kin ang 50% of 100k na due ko as of this month (70k+ po yung due ko nang mag start ako na hindi na magbayad). sinabihan ko c ruby na cge, kako pag sa legal na pwede naman cguro yan ma arrange. sagot nya sa kin, pag nasa legal na daw yung account ko, wla na daw arrangement yon, kung magkano yung ipababayad sakin, bayaran ko raw. tinanong ko kung anong mangyayari pag hindi ko nabayaran, kasi kahit 5,4k+ di ko na nga mabayran. sabi nya sa kin yun daw consequences ko. further, hindi nya alam ang detalyeng mangyayari sakin if ever di ako makapagbyad nang hinihingi nila kasi sa legal na daw yun. tinanong ko kung anong case, sabi nya "credit abandonment" kasi 5 months na raw akong di nakapag bayad.
    meron ho bang ganun na legal case, tapos hindi na pwede i arrange as to how much i can afford?
    nagdadalawang isip tuloy ako.
    tapos kahapon, absent po ako, may tumawag na taga scb, joel adahar, sinabihan yung kasamahan ko na pupunta daw xa dito ngayon.

    Yesterday may tumawag po dito sa office a certain SPO2 Lawrence Hilario of Cubao Police District just to inform daw na pupunta daw sila sa office para kunin ako for questioning? May kaso daw po laban sakin. Tinanong ko kung sino ang complainant a certain Atty. Nicanor Reynoso daw. E sabi ko wala naman akong alam na kaso. I asked for the attorney's number and he gave me. Pero nagtatanong sya kung sino daw po ang HR officer na pwede nila e address yong sulat para kunin ako pero d ko binigay. I insist of calling the lawyer instead (in which i regret i did).

    Nong tinawagan ko yong number sinabi nya about my HSBC ...e sinabe ko ang problema kesyo ganyan d ko kaya. Tinanong ako kung magkano kaya ko sabi ko at the most 2k. Tapos sabi nya e connect daw nya ako sa collecting officer at babawiin na daw nila ang kaso sa Cubao. Tapos nong kinausap ko naman yong collecting agent gusto nya gawin kung 3k e ang sweldo ko 5k lang pano na yon. Single mom pa naman ako..

    Takot na takot ako banker kaya nawala yong common sense ko tuloy kasi ba naman ginamit pang bluff madadamay nanay ko dahil sa supplementary sya. Tsaka wala talaga ako sa sirili dahil sa ngayon nasa critical condition yong only brother ko at financially unstable pa kami since last year.

    Ngayon ang tanong ko banker is hindi ko nasunod ang promise kung bumayad kahapon... Hindi ko talaga kaya kasi. And what will be the worst scenario if i wont be paying attention to them? What if pumunta cla dito sa office and e harass ako? And natatakot akong mawalan ng trabaho. Pano na ang anak kong 2 years old lang.

    I have a loan sa China Trust. 5 mos na ako di nakabayad due to financial problems. May mga collector na tutmatawag, nagttxt at nagpapadala ng sulat pero I'm ignoring them kasi I want to transact directly to the bank. If I go to the bank and pay the accumulated amount from the last 5 mos will there be interest that I need to pay? And will they allow me to pay my monthly payment afterwards. Ang fear ko kasi baka bigla ako singilin ng total amount. Thanks

    when it comes to citibank, i have had lots of experience with them, and they are so nice and pleasant. My utang is a lot higher than yours. At one time, i told them i would cancel the card na lang,cause i couldnt pay, they begged me not to do that. BEGGED. Because the BEGGED, and FLATTERED AND COMPLIMENTED me by saying, "i was a valued client", I somehow produced the money equivalent to one month payment (ma 90 days overdue). I looked for the extra money, no longer for myself, but i felt i owed it to the collector, who PLEADED, to me to give it one more chance. I did, naka suerte ako, i was able to get the money. But never, never did Citibank threaten me like the way they did to you. I doubt if that was Citibank. And they just cannot go to your boss. That is harrasment. Mentality ng construction worker yan at ang sari-sari store. When there are construction workers, they usually have their snacks in the sari2 store. Then they make utang to the sari2 store. When they refuse to pay the sari2 store owner talks to the contractor and the contractor now "garnishes" the worker's salary but paying a portion the to store. I know coz my cousin has a store. In conclusion, I hab my doubts if that was citibank.

They can ask the court however to garnish your property (if you can't pay, they will get your property instead)but that takes toooo looooong, and they (CC) are not interested in property, they are interested in Cash.

    Those amnesty programs actually help. My experience, your name is already in that list of "not-so-good-payers" despite the fact that citibank will tell you that they will keep your deliquency and failure to pay only within the bank (in-house arrangement). Nah,that's what they say, but other cards are already alerted. In other words, in my experience, damage has been done. Tama si Banker, settle in court, cheaper. They can only charge you 1%-2% a month.

Pero yung tao po na yun ay kakilala ng Loan Agent na kakilala ko. 1 day yung agent nag offer sa akin na kung gus2 ko daw co-maker bibigyan daw nila ako ng pera. Hindi ako pumayag ayoko kasi ng problema. Hindi sila tumigil, napilit nila ako and nangailanagn din kasi ako ng pera pang enroll ng anak ko. After 3 months ito na. May mga sulat nadumating sa akin. Na yung borrower daw ay hindi nakakabayad. So natakot ko kasi baka ako yung habulin. Yung borrower po ay isang OFW. D ko din alam kung saan sila hahanapin. nagtxt ako sa kanya na ayusin, oo daw. pero after a week ito na naman. may pulis na nagpunta sa amin. na ako daw ang mananagot pag d nabayaran yung utang. Nakausap ko yung Lawyer nila thru txt. sabi kung d daw maayos gagamitin daw yung Default. Pati ako daw mananagot. wala po akong pambayad sa ganuns utang. natatakot ako baka madamay ako, and magkaroon ng kaso.

    March 2009 po,nag loan po ako sa isang lending company dito sa Manila..OFW loan amounting to 30k.Pagdating ko sa abroad na ospital anak at mother ko at nagka utang utang din po ako sa abroad kaya for the first 3 months di po ako nkbayad sa bank na nag released ng pera but the succeeding months po unti unti nkbayad na po ako thru kwarta padala but di po ako nakakatanggap ng any notice of acknowledgement from the lending company. At Minumura na po ako sa email ng isang employee ng lending company.I replied na nagpapadala naman ako ng bayad. I emailed to them the reciept numbers at name ng employee ng lending company na pinadalhan ko.Sabi po sa email nila di na daw po connected yong employee na pinadalhan ko so binigyan nila ako ulit ng another name at nagpadala po ako ulit pero same story di po nila ako binigyan ng statement of account. Dapat daw magbayad muna ako ng malaki amount before nila ako mapadalhan ng statement of account kasi daw po talbog na daw po ung PDC issued by the bank ( pag release po kasi ng 30k may kasama 1 check book na pinirmahan ko and 14 checks stating the amount and date of payment at ang remaining blank check booklet po ay kinuha ng lending company, as i remember meron pa po 4 checks na pinapirmahan lang without any amount written on it ,in case daw po magka problema sa payment gagamitin nila yon )
    December 2009 kamuntik nag suicide anak ko dalaga kasi po nag txt sila ng ng txt sa anak ko.Masasakit po tlga na salita same what im recieving in my email.

    Please po tulungan nyo nman ako what to do..Ma hold po ba ako sa pag alis ko? sa immigration? ready na po pag alis ko as in my visa at medical na po ako.

    Gustuhin ko man po pumunta sa office nila takot na takot po ako na baka ipahuli ako sa pulis at di na nila ako pakawalan kasi sa ngayon po wala po tlga akong pera pambayad.

    hindi ko na po kasi nabayaran yung utang ko sa CC(metrobank).. mga 2 years ago na po.. ang huling alm ko sa utang ko sa CC mga 20thou+ .. hindi ko na po alam kung magkano ngayon yun.. 17 0r 18 lang ako nung binigyan nila ako CC.. hindi ko naman po alm yung responsibilidad kapag CC holder ka noon.. akala ko nga po atm card ang binigay sakin.. dati po updated ako sa pagbayad kasi tinutulungan ako ng mom.. then nung nagkaroon kami ng problem financially hindi na po ako nakapag bayad.. before po nung nasa manila pa ako.. lagi din po akong nakakareceived ng mga letters.. pero ini ignore ko lang po.. ngayon sa cavite na ako nagsstay.. hindi ko na settle nang lumipat kami dito.. may balak po kasi akong mag abroad, ang kinakatakot ko lang po baka mag reflect ito kapag kukuha na ako ng NBI CLEARANCE.. first time ko pa naman po kukuha.. ano po ba yung puwede kong gawin?!

    May tumawag sa kin kahapon pupunta daw sila sa bahay to serve my arrest warrant. Di nila masabi kung anong kaso ko. Kaya binigyan nila ko ng pangalan ng atty. saka landline nos. utang ko pala sa chinatrust. nagbabayad ako monthly. pero di ko mabayaran minimum payment ko. wala pa akong narereceive na subphoena. pwede ba nila ko damputin sa bahay? nakakahiya pag ganun. saka bat nila ko ikukulong di ako masamang tao. tumalbog daw mga tseke na inisyu ko. pero tseke ng chinatrust yun na pinapirmahan sa kin ng bangko nung kukunin ko na yung loan ko.

    tinawagan ko si atty. magbayad daw ako ng 50k within the day. hanggang 1 pm lang daw. kung hindi dadamputin na nila ko. ano yun. warrant of arrest without subphoena. pwede po ba yun?

  126. KAtulad po ng mga ibang nagsulat sa blog nyo may BP.22 Case din po ako sa CHINATRUST. And the case is under PALISOC & GO ASSOCIATES LAW FIRM.
    Tumawag na po ako sa kanila kasi i wanna settle all the damages na nagawa ko. Ive agreed na to pay all in two payments. PInapagawa nila ako agad ng promisory note. SAbi ko buaks na lang.
    And sabi ko wla na ako sa office namin unemployed na ako. PAra lang po wag na akong kulitin sa office kasi nakakaistorbo po.
    Kung may plano po akong takbuhan sila sana inignore ko na lang sila. Pero magsesettle n anga po ako ang ginawa nila tawag sila ng tawag sa office eh na-hang yung tawag.
    Ginagawa po nila sa receptionist namin minumura po ex. putangina. At mga grave threat po katulad ng "Umuwi kana kasi patay na anak mo" meron pang "MAbaho yugn p*ki mo".
    Ginawa ko po tumawag ako kasi ako yung kailangan nila. Sabi po di daw sila ang guamgawa nun. Impossible naman po. Kasi sila algn gagawa nun. Ngayon lang may nangyaring ganun. Sabi pa nila pupunta sila sa office namin para pahiyain kami ng receptionist namin na walang kinalaman sa kaso ko..

    Please po help naman. Im settling down with them tapos ito pa gagawin nila. NAtatakot po ako na baka pumunta sa bahay namin at manggulo pa.

    May kakilala po ba kayo sa BDO na pwede makausap at makatulong regarding sa unpaid BDO CC?
    May cc ako sa BDO year 2007 at ang credit limit ko is 10k. naka address sa dating office ko yung billing nun at nung lumipat ako ng work ay hindi ko na napagtuunan ng pansin yung pagbayad kasi yung sinasahod ko kulang pa sa pang araw araw ko na gastusin, ngayon po gusto ko na ito masettle pero ayaw ko makausap yung mga CA. Gusto ko sana may makausap ng directly sa BDO to settle my payables at kung pwede makadiscount its been 4 years now at hindi ko na alam kung magkano na inabot ng CC ko.

    may loan po ak sa chinatrust. yun first term ko was excellent paid in time and in fact na renew ko pa which means good payer ako. after a few months nun na renew ko, nagkaron kami ng financial problem at ako health problems. i was also robbed. i tried to call them several time sent emails and communicate with them that i am willing to restart payment - of course in installement because there is just simply no way for me to pay onetime my remaining balance. the most daw they can do is divide it in 6 months pero un amount is mas malaki pa sa basic salary ko. sabi ko nun sa officer na kausap ko i will pay 2000 a month to the same account pero sibanihan ako na mapupunta din sa wala. so bakit ako magbibitaw ng 2000 monthly having told it will go nowhere. when i was robbed i had to transfer house because of threat to my life, nasa bag ko kasi nun un organizer ko with all information about me so i dont attend to anonymous calls or open letters or anything dahil once eh nasundan pa ako ng the same robber.
    may nagemail sakin using just an ordinary yahoo mail and not even like, normally from bank mismo. anu po ba ang stand ko dito willing naman po ako magsettle sa kanila like what ive always told them pero nagiinsist sila ng full amount. i did every effort from my part makipagnegotiate pero ayaw nila tumanggap ng installment, gusto nila onetime bigtime payment. wala po akong pagkukunan nun dahil ordinary employee lang ko supporting my family and has health maintenance- if may say the least, yung mga lumps na nakita sakin eh cancerous. kaya my health is my priority and my 2 sisters had to resign kesa ma lay-off sila. kaya i support my family.

    Sir, here is my problem. I had received a CC from creditor, the name indicated on the card used my middle name in replaced my surname (vice versa). Due I really needed a cash to solve my financial problem on that day, I had edited my ID to follow the name written on my CC and the account was approved and already made some transactions. I had made payment transfer for the 1st 3-4 months but due of financial incapability I had stop paying them. Now they are chasing me via phone. Will I be sue for a fraud or any criminal case using my incorrect name?

Banker, may i know if charging collection fee lawful? i was so surprised when i saw this item added in my statement of account. the collection fee charged to me is almost 100% of my outstanding balance. the bank said there is collection fee because my account was already referred to their collection agent. i told the Bank that i refused to deal with anyone except the Bank. i already have difficulty in paying the principal balance and interest plus penalties; it would be worst and getting impossible settling my loan account if collection fee is added.

    I really need your advice po.
    I had a loan sa chinatrust before. 1st loan ko ok lahat, then they offered me a second loan. Bata pa kasi ako so tanggap lang. Now lumipat ako ng house noon, then informed them. Wala naman akong natanggap na letter or anything na nagiindicate na alam na nila. Hinayaan ko na basta bayad lang ako ng bayad. Nag resign ako sa work since kailangan po ng tutok sa anak ko. Ok pa din, nakakabayad pa din ako on time. Kaso nag Ondoy. Nawala lahat ng pinaghirapan naming mag asawa, tapos na simula pa mag theraphy anak ko since baka may Autism sya. Mula November 2009 hindi ko na nabayaran Chinatrust loan ko. Yung celphone ko napalitan na kasi lumubog lahat sa baha. Nag try kami mag settle ng new payment arrangements kaso may dapat I email si Chinatrust, and dun na natapos ang storya.
    Kanina bago ako pumasok may nakita akong nakasuksok na mail sa gate. Binasa ko and galing sa isang law office. Tinawagan ng wife ko and yung nga, BP 22 Bouncing Check Law. Natakot kami mag asawa dahil madami na nga kami gastos as it is, hindi pa din naming kaya sabaya eto pa. Naki pag negotiate asawa ko, to the point na hinihingan kami ng P 175++ k, P 298 na daw kasi yung utang namin. Sabi naming hindi naming kaya, willing naman kami magbayad basta ok yung terms. Hinihingan asawa ko ng 3 IDs nya and specimen signature, plus yung mga med docs ng anak ko. Sabi ko sa asawa ko wag mag bibigay ng docs na kahit ano. Sabi kasi nila, kailangan daw magpasok ng 100k sa account bago mag apply ng restructure ng loan. Hindi pa daw sure kung papayag yung Chinatrust sa restructure.

    Ok lang naman kung mag babayad kami basta ok din yung plan. Ang ayoko kasi yung magbabayad kami tapos mapupunta sa wala. Ano po ba pinaka magandang gawin ko? Thanks po!

    1. Wag ako magbabayad hanggan walang : a) SOA ko, b) letter of Chinatrust endorsing the account to the CA, c) summons to a hearing

    2. Next time they call, I say that I would prefer kung sa court na lang sila mag file para mas formal?

    Also I forgot to note that they recorded the call without our consent….

  148. @yawna: ibig mong sabihin since 2009 ka pa ngstop magbayad pero may pinapadala pa ring demand letter? atty palisoc go ba yan? kasi ako nagstop lang ako magbayad nung dec 2010 pero eto nakatanggap ng demand letter. grabe mag3months default pa lang ako eto finorward na sa collections. tsk tsk..

    yup yan din ang pagkakaintindi ko sa advices ni banker kapag nagback thread ka sa blog na to. super informative talaga si banker at marami syang natulungan tulad kong matagal n walang peace of mind. hintayin ko na lang maisettle ang lahat sa court, sana by that time makapagipon ng pambyad kasi sa ngayon talagang ala kahit 1k pa. more power to banker!

    How do I issue loan payment? "Payments will be made via issuance of post-dated checks for the duration of your loan, which maybe from 12 to 36 months. If you do not have a checking account, we will facilitate opening one for you right before the release of your loan. Minimum deposit and maintaining balance is P2,000. You will need to present three valid IDs such as your SSS, TIN, Driver's License, POstal ID, NBI clearance, and passport among others."

    d ko pa kasi nacheck sa chinatrust kung sa akin ba talaga nakapangalan ung checking account or sa chinatrust salary stretch loan. may nakita akong check na binalik sa kin before nung nagbabayad pa ko. walang account name pero may account number. 3rd loan ko na nung nadefault ako last year. posible bang d talaga sakin nakapangalan un or hindi? takot ako mademanda ng BP 22. ayaw ko na po kasi tawagan ung chinatrust kasi finorward na nila sa collections ung account ko kahit 2 months palng ako d nakabayad :( Salamat po banker, More power sa inyo!   150. I just received a text message from a number +6325421775 stating that they will publish my Name & Picture on count of ESTAFA at all leading news paper because of my unpaid Credit Card Bill.   151. nangyari na din po sa akin yan..Kse many times na ako tinwagan ng mga collector from philippines..Nut sad to say diko sila binayadan.Ignore ko mga demands letter nila..May mga credit card kse ako naiwan sa dubai..Umalis na ako sa dubai at sa awa ng DIYOS 2 years na ako dito saudi..khit patuloy sila nagpapadala sa akin ng written notice ignore ko sila kay tumigil na sila...Sbi ko na lang sa kanila cge handa na ako magpakulong ayun tumigil na sila..Wla nmn sila habol kse kpag kumuha ka ng credit card yun ay may insurance..So due to global crisis nwalan ako ng trabaho at pinili ko na umuwi na lang ng pinas to apply sa ibang bansa..Sa ngayon wla na ako problema kse dina nangu2lit ang mga collector na yan...Bsta pwede nmn hindi na kayo magbayad khit na may work kayo ngayon.>Ang pagkkaalam ko kpag may credit card ka sa bank at tumagal yun ng almost 120 days or lumampasa na sa isang taon sinasama na ng bank yun as expenses nila for the whole year...At wla na problema kahit di nila yun masingil..mahabang explanation basta ako yung 2 ko credit card dina nila mahabol sa akin..basta be calm na lang tyo...Hayaan nyo sila maningil..Dami na nila ginwa sa akin pananakot.Kesehoda na hindi ako makakaalis ng bansa kse mahold ako upon departure pero nakailang balik na ako sa abroad sa awa at tulong ng diyos wala nmn nagging problema..thanks//

    anu mangyayari kapag huling letter na nareceive ko ay parang subpoena na at mentioned na ang regional trial court pero sinisingil ka pa rin ng certain amount? nakareceive ako ng letter na iyan mga 1 year ago. hindi ko pinansin at inignore ko lang. Ngayon, wala na kahit anong letter.

    pwede ba ako makasuhan ng kung anu mang kaso dahil hindi ako nagpakita sa korte?

    naging concerned lang ako kasi kukuha ako ng passport so kukuha ako ng nbi clearance. if so, kung kukuha ba ako ng nbi clearance ay magkakarecord ako dahil nasa korte na ang kaso?

    if nasa korte na, kung magkaroon ng settlement, ilang months magtatagal para maging okay ang nbi clearance ko? kasi employer ko ay kailangan na ako makaalis by august.

  154. Hello Banker,

    Nagloan po kami ng misis ko ng 40k sa isang lending company. ang total na nakuha namin ay 31k dahil yung 9k po ay for processing fees at yung half month na hulog. Nag issue po kami ng 18 checks dahil payable yung loan ng 6 months tapos required nila na yung natitirang anim ay if ever magkamali.

    Yung first two months ang total na binabayaran namin ay 11,000/month. Nagrequest po kami na iparestructure dahil nanganak si misis at di na kaya magwork. Supposedly, 4700/month for a year ang babayaran. So total of 57,000+. Nakapagbigay kami sa first two months kaya lang po di na binalik samin ang mga checks na inissue before. Nawalan ako ng work at up until now wala pa rin. Last month po nagstart yung hindi namin pagkakabayad ng 4,700 so ang sabi nung collections ay may penalty daw po. at ang total na pinababayaran sakin this month ay 7300(para sa late payment po last month) + 4700(this month).

    Ang iniisip ko po kasi, till now wala pa rin kami mapagkunan ng pera, nakikitira na lang kami sa mother ko pati panggastos, tapos nananakot pa sila na idedemanda misis ko based sa BP 22 daw. Natatakot lang po kami dahil iisue-han daw kami ng warrant of arrest pag di nakabayad.

    I hope you can give me some advise for my situation. Di naman po kami nagtatago, pinaalam po namin agad sa collections na yun na nawalan ako ng work kaya di makakabayad. Ano po magandang gawin.? Salamat po.

  157. good da Banker!meron po akong unpaid cc sa metrobak..hinde naman po malaki ung pagkakaalam ko sa unpaid bills ko pero lumaki dhil sa interest nila..actually po alm ko is less than 10k yung isa at more than 10k yung 2nd cc ko..but unfortunately nagkaron ako ng financial problem kya ndi ko nasettle hanggan sa lumaki nga dhil sa interests nila n umabot n sa more tha 20k..last march nkarcvd po ako ng letter from a certain collection agency..nakpagcompromise po ako about sa payment at nabawasan naman po..pero hinde n po ako ulit nkpagbayad..meron n namn po akong nrcvd na txt message.hinde po nakaindicate kung anung company cla bsta sbi po n i should contact a certain atty na nkaindicate sa txt to confirm daw kung anu yun..i assumed n metrobank po yun kc wla naman po akong ibang utang..hinde ko po pinansin but today i received another txt from the same number today that if i don't settle may debt today ay ipopost daw po nila sa newspaper yung pictures ko..anu po ba yun?is it possible?i'm 'willing to pay my obligations po pag nakaluwag na...please enlighten me po..naguguluhan kao..thanks!

  158. good day banker & all the member of this blog...gusto ko lang po sana humingi ng advise regarding din po sa utang ko sa cc, to start the story po, meron po akong outstanding na utang sa cc ko almost 100k year 2000, nakakabayad naman po ako pero hindi po yung full minimun amount kaya po lumaki siya ng 400k bcoz of penalty & interest. pumunta po ako sa bank to talk to them & make a settlement para bumaba kahit papano ang utang ko pumayag naman po sila, after ng settlement nakakabyad naman po ako pero still di pa rin sumapat sa min required nila gusto po nila kasi 12k monthly bayad ko nakakabayad lang po ako ng 7k to 8k lang po monthly...then sa pagminamalas ka nga naman po nawala po ako ng work by 2005 isang ordinaryong empleyado lang po ako na sumusuweldo ng minimum a day nawalan pa ako ng trabaho kaya hindi ko po nabayaran yun cc for long time...then by 2007-2008 kinokontak po ako ng collection agent ng RAMIRO LAW OFFICE, at nagpadala po sila ng demand letter ng 2 beses..nag worry po at nag isip po talaga ako noong time na yun kasi wala po akong trabaho, hanggang pumunta po ulet ako sa banko at nakipag usap ulet for settlement by 2009 lumaki po ang utang ko ng nasa 700k pumayag po ulet sila na mabawasan ang 700k ko utang naging 400k na lang po kaya pumayag na rin po ako kaya po kahit wala akong work pinipilit ko pong mabayaran yung settlement ko sa bank para wag masira sa kanila, nag business po ako ng kung ano ano para may pambayad po ako sa kanila at pati po sweldo ng asawa ko ay nababawasan ko para lang may pambayad po ako sa banko so nakakabayad po ako ng maliit na amount sa bank na tuloy tuloy po pero form 2009-until may 2011 nagbabayad po ako kahit pa 2k to 3k basta tuloy tuloy lang po bayad ko, eto po ngayon ang problema, hindi ko ako nakabayad ng june 2011 & july 2011 ngayon pong august 8 nakabayad po ako ng 1500 lang natira po sa pera na panggastos namin sa bahay, pero naka received po ako ng text sa kanila na nai-file na daw po nila yung kaso ko sa makati RTC, wala naman po akong intensyon na hindi magbayad sa kanila 2 months lang po ako pumalya eh naifile na agad nila ang kaso ko, totoo po ba yun na naka demanda na po ako kung ang nakalagay sa message nila ay to call them for settlement...please help po hindi ko po alam ang gagawin ko, balisang balisa po ako simula natanggap ko po yung text nila noong aug 8..

    yan po ang text sa akin. Ano po ba maganda kong gawin? Replyan sila at sabihin Go ahead? o antayin ko na lang action nila?

    Ang nakakainis neto yung gagamitin nilang case eh yung nagbounce kong check before ako nagparestructure ng pagbabayad sa kanila.

    Nakakareceive pa rin po kasi kami ng letter galing sa "legal counsel" daw ng lending company. Ang napansin lang po namin, everytime magpapadala sila ng letter, iba ng iba ang nakalagay na check number. E matagal na pong sarado yung checking account ko. Ano po ba magandang gawin? Wag ko na lang po sila pansinin??

  174. Hi Banker, i have loan po from chinatrust, they keep on calling me and saying bad words to the person who answers the call. They keep on sending a lot of demand letters as well. Just recently, they said to me that they already filed a case against me and to avaoid this, they want me to pay my loan. Nattakot po akong makulong, just like others, gusto ko po bayaran ang utang ko kaso sobrang gipit po ako ngayon dahil nawalan po ng work ang brother ko so ako lang po ang nag shoulder ng lahat ng gastusin sa amin. Makukulong po ba ako sa kaso na isasampa nila?

    After 6 mos.na nanahimik si Telan Law Office eto na naman sila nagpaparamdam dahil ba eto ay malapit na ang December? Early today nagpadala sila ng Demand letter and mag file na daw sila after 5 banking days na di ko settle ung payable ko na from 14K umabot na ng 70K. Kakaloka diba..sinabi ko nalang sa messenger nila wala akong pambabayad lalo pa at manganganak ako ngayon november..

    kahit na may issued pdc ka sa kanila, kung magkaron ng case, attend ka lang ng hearing. kasi hind emo mo sure kungyung payment mo ay nakaktulong talaga ng buo sa account mo. let them file a case and there tell them how much you can pay lang.

    Just got out of a relationship wherein yung ex ko used my credit card well with my consent naman at trusted naman siya. Abot 100k lahat ng naswupe nya sa card. For the first 2months nakapagbayad naman siya kasi installment ng mga gadgets na binili nya. Now ang twist nag tayago na siya. Hinahabol ako ng bangko at pati yung mga collectors hinaharass ako! Ang worry ko bala magpadala ng letter sa bahay ng parents ko. Paano ko to malulusutan? Could i file a case vs my ex? Nagtatago na kasi siya eh. Pahelp naman po. Thanks!

    I have a question. I have this loan with Tong Yang Bank which I issued PDC's. I have been a long time client until in 2010 when I have started to be late in paying my dues and my checking account got closed. This is a personal loan which pdc's are issued. I have written them a letter stating that I have a medical condition and I am having problems in paying that was in Feb. 2010. I have been still diligent in paying until September 2010. When due to my medical condition it rendered me unable to pay my dues. I talked to someone from they collections department who advised me to reissue checks. I told them I don't even have the money to pay for opening a checking account. Thus the follow-ups which to which I replied however when it got nasty I started to disregard them kasi kulang na lang patayin ako sa mura saka kung sigawan ako sa telepono ganun ganun na lang. My condition got worse until I was operated in Jan and Feb, as well as in July when the doctors removed some cysts in my intestinal area. Just yesterday I got a letter from the Makati City Prosecutors office informing me that a case will filed for me in court. I verified the signatory and indeed it came from the prosecutor's office in Makati. My outstanding due is less than 100k. Can you suggest how I will handle this? Since my understanding is that the case based on the letter I got is yet to be filed in court. Parang ninonotify lang ako na a case will be filed against me. I have been out of a job and undergoing hospitalization in-out since last year. I have undergone an operation and clearly I don't have the funds to pay. Pwede ko gawan ng paraan siguro para makapagbayad pero they already refused my request for restructuring before so I don't know how to handle this. Is BP 22 a criminal case? Alam ko kasi it has been decriminalized. I really need your help so I am able to handle this properly. My doctor says she will issue a medical certificate to back-up my defense and all my medical records are ready also. Really need your advise. God bless you! You are doing us a great service!

    kalimutan mo na muna ang utang mo. focus on your medical issues. yung sa tongyang mo, let them file it court para lumabas kung magkano lang talaga ang utang mo. ang important lang, pag nagfile sila ng case, umattend ka ng hearing. kasi dun sa court, you can tell the court to pay them the amount you can afford only lalot ay maedical issues ka. again, yung mga demand letters mo, just check kung summon yan at kung hinde, wag mo ng intindihin at itapon na lang. ngayon pag may summon na for bp22, attend ka lang ng hearing (importante yan). kung may maipapangako ka ng payment shceme, do it. pero kung wala, ok langdin since may sakit ka.

    your message is such a relief. it's not a summon it's just a notice that they have a valid case to file against me in court at galing sa makati city prosecutors office. sabi nga ng doctor ko she will back me up with all the medical records. and i guess she was right in saying they are just trying to scare me. sabi nga nya sa they will spend more in court. i'll follow your advice. and if anything more, i'll post my questions here. it gets confusing na kasi if i read through all the posts here. andami naming pare-pareho ang problema but God is good there are people like you out there! thanks much!

  191. hi, in relation to the previous post.. i also have a problem with tongyang, nakapagsecure ako ng loan sa kanila last year, sept 2010, nakapagbayad pa ako ng 1st month ko kso due to some personal problems, di ko nabayaran young mga sumunod na payments, so lumabas na "account closed", nakapaghulog ulit ako around march or april 2011, so total of 2 months ang nabayaran ko kso d n nasundan till i received some letters from them about the demand for the payment.. tumawag ako nung august requesting for a payment arrangement, kaso puro mura ang inabot ko.. they are requiring me to pay the full amount.. so di ko pa din binayaran kasi wala akong pambayad sa ganung halaga.. nagpadala na sila ng mga demands at nito lng 1st week ng december, me notice na ako na me hearing ako sa february 8, 2012 sa makati.. kakatawag ko lang ngayon to make arrangment again, kaso ganun pa din, they are requesting me to pay the full amount of the loan, tapos sbi nila every month may 1.5% interest na papatong which could lead to 120,000.. sabi ko, i offered 25% payable in -2 weeks then we could make an arrangement with the remaining.. declined yung offer ko.. either full amount or 50% payable till tomorrow.. or else sa hearing on feb 08, 2012, full amount daw ang idedemand nila of which di naman kaya.. i tried explaining naman na kaya ako tumatawag ay to let them know my intent to pay at kung maaari na i-restructure yung amount.. kaso everytime na kakausapin ko sila, talagang matigas at kung anu anu ang mga sinasabi na medyo hindi na maganda.. hoping to hear from you.. medyo napapaisip ako d2.. thanks and more power to this blog/site as it helps people.. thanks

    question lang po. my wife received a demand letter from Municipal Trial Court, Tanay Rizal na nakalagay na agad People of the Philippines vs (my wife's name et al) informing her that she is being given 10 days to file her counter affidavit.

    My question is, what steps should we take? if gagawa kami ng counter affidavit, ano ang dapat naming ilagay? kelangan ba na attorney ang gumawa nun?

    marami kseng attachment ang kasama. meron ding document na nakalagay na " The undersigned 3rd Assistant Provincial Prosecutor accusses (my wife's name) of the crime of violation of BP22..." tapos sa dulo ng document nakalagay yung mga names ng witnesses nila plus "Bail Recommended : 4,000 " na may sign after the amount.

    Eh now lang namin nareceive yung documents na yun bakit nahatulan na agad ng ganon? valid ba to banker? mukhang legit kse yung envelope kung saan nakalagay yung documents na yun kse may stamp ng Registered Mail.

  195. banker, kelangan ba talaga namin gumawa ng counter-affidavit within 10 days? if yes, kelangan na ba namin magseek ng legal assistance? If no, what are the implications of ignoring it?

    medyo mahal kse yung attorney and we dont have money to afford it. Nsa court na yung case, ano na ba ang mas maganda naming gawin?

    medyo kinakabahan na kaming magasawa kse we feel like parang nsa kanila ang bola ngayon. what if pagdating sa mediation eh di sila pumayag sa settlement na kaya lang namin and they decided na ituloy ang case, ano ang puede naming gawin?

    Next friday na kse ang deadline namin sa counter-affidavit...medyo natatakot na kami.
