Legally Right ; Morally Wrong




Collectors ( and Self-style Moralists) are fond of quoting this :

" Ang Utang Dapat Bayaran"

To which the Supreme Court says :
We can not consider the rate "usurious" because this Court has consistently held that Circular No. 905 of the Central Bank, adopted on December 22, 1982, has expressly removed the interest ceilings prescribed by the Usury Law and that the Usury Law is now "legally inexistent."

However,The Supreme Court further says :

Nevertheless, we find the interest at 5.5% per month, or 66% per annum, stipulated upon by the parties in the promissory note iniquitous or unconscionable, and, hence, contrary to morals ("contra bonos mores"), if not against the law.

If not being able to pay is immoral, what can you say about THEM?

    di porke may utang tayo sa kanila e pwede nila tayong takutin at ipahiya.

    we can pay our financial obligation once we have the means.

    pero, can they bring back one's reputation and dignity na sinira nila just so they can collect debts?? i don't think so.

    May tumawag na naman kasi sa akin from citibank daw again. Medyo halata talaga yung mga collectors na yun. It's like the right hand does not know what the left hand is doing. Medyo mahaba nga kwento ko at parang paulit-ulit na comment dito sa blog niyo katulad ng ibang experience ng ibang card holders.

    One example is yung isang officer daw ng citibank(pero later on sinabi rin niya taga LAURON Law office siya) na nakipagusap sakin last week then I told her na wala talaga akong pambayad then she haggled from 18k down to 4k. Then this morning tumawag again from citibank daw and demanding me to pay 18k for the two cards or else i-lilegal na raw niya ako(pero nagbayad naman ako ng 500 last month na alam din niya kasi bakit yun lang daw binayad ko). Dinedma nga niya yung tanong ko kung sino yung kausap ko last week na nag-demand ng 4k.

    Di ko alam kung maaasar ako o matatawa o matatakot kasi last month pa dalawang legal firms na yung tumatawag at nagbibigay ng demand letters sa akin at wala pang abiso yung banko sa akin noon bago nangyari to. Bigla na lang sumulpot mga collectors.

    Anyway tanong ko lang po, if ever na nag-file sila ng case kahit nag-babayad pa rin ako ng P500 monthly(bluff nga siguro yung case), what step will I have to take?

    And also, for my peace of mind, ano po ba yung batas na pag-nagbabayad pa rin ay di pwedeng mag-file ng case yung complainant? Parang nabasa ko na rin yun kaya lang nakalimutan ko kung anong republic act yun.

    dont ever believe what these collectors are saying. ang mga ibinabayad ay napupunta lang sa wala and it's such a waste (para sa akin ha). ipunin mo na lang muna then pag may enough na pambayad ka na, saka ka magbayad. yung mga demand letters, just thro them away, walang magandang balita dun. i just received two demand letters today, binuksan ko, and find nothing new, lahat sila pare-0pareho iba iba lang ang mga wording. tapon kolang agad, andami na kasi eh.

    Hello belated happy birthday nga pala. I'm very happy I found this site kasi I desperately need help. To start my story I have a CC which has a limit of P20,000. The time I received the card, I was already unemployed. Happy naman ako kasi matagal na akong nag aaply ng card pero kasi I get denied palagi kasi siguro ayaw nila ng mga call center people, that was my job before. Siguro binigyan nila ako kasi may savings account ako sa kanila which meron namang lamang kaunti. So I used it naman for 4 months and nababayaran ko naman palagi in full.

    I love to play poker if you know the game? I play paminsanminsan with my friends and family. Until 1 day a friend introduced me to online gaming. Sabi niya if I have a CC pwede kana maglaro online ng poker. So I tried it, I used the CC and played online poker nga. Nung una $20 dollars lang ang kinukuha ko then pag natalo $50 dollars na. Hanggang namaximize ko nga ung P20,000 na limit ko kakadeposit online. Sabi ko this is it ayoko na sugal to at matatalo lang ako.. Pero in the back of my mind gusto kong mabawi ung talo ko. Sabi ko pag nabawi ko na titigil na ko. Pero my problem was na maximize ko na ung CC ko at di na ko pwede mag deposit ulit. Pero 1 day sabi ko sige nga try ko baka pumasok. Then I tried to type in $200 as my deposit, walahhh! naaprove ung deposit ko kahit over the limit na ung card ko. I tried it the second time na approve ulet. Tanong ko sa sarili ko baket kaya naaaprove ung request ko eh over the limit na nga ung card ko. To make the story short over 200k and nakuha ko sa card hoping na mababawi ko ung first 20k na kinuha ko. Pero hindi naman in a matter of 1 month ko lang nakuha un within 6 months. Tapos nga may tumawag na sakin na taga bank na kung ako daw ang gumagawa ng mga transactions na un. I said yes naman ksi ako naman talaga gumawa nun. Di ko daw ba alam na P20,000 lang ang limit ko at over P200,000 na and nakuha ko.

    Now I'm in deep trouble kasi natalo ko nga lahat un. I know this is a different story, ung nangyari sakin kaya ngayon meron akong utang ng over 200K. I dont know what to do. Alam ko naman na ako ang gumawa ng sarili kong problema nagsugal ako at hindi nagisip. Ganun pala ang mentality ng nagsusugal gustong bumawi ng bumawi hangang matalo lng naman. kasi honestly hindi naman ako sugarol ewan ko ba kung baket ako ngayon nandito sa kinakatayuan ko ngayon. Curse me!!!!

    Tatangapin ko naman lahat ng sasabihin ng mga readers dito kasi sa sugal ko ginamit ung inutang ko at hindi naman sa iba. Pero sa isip isip ko baket ksi pinayagan ng bank na makakuha ako ng ganung kalaking halaga kaya nabaon ako sa utang.. Hindi ba nila control ang mga transactions online? Kasalanan ko naman oo pero I have no capacity to pay them back lalo wala akong trabaho ngayon.. Pls help any advice kahit harsh advice pwede na din.. I feel so down right now. I did not ever imagine na I will be in this kind of situation... They are starting to call me na at hindi ko alam kung pano ko sasabihin na wala akong ibabayad sa kanila. Makukulong ba ako kasi kakaiba itong kaso ko? Kasi sa sugal ko ginamit ung pera? Pls banker help!?

    Nope.I wont blame,curse nor despise you.You are also like the others who borrows from Juan to pay Pedro. similar situation,ibang paraan.

    Please go over the paranoia prescription chapter (5/08) on how to negotiate your debts. but it is always a better option to see them in court where its formal,legal,you pay what you can afford only and most of all, no lawyers! ^-^

    The problem is already there. no amount of blame,despising or cursing can change that fact. only a HELP.

    Thanks for the reply especially banker kahit you assigned na ms hopeful & dragon76 to make the replies to readers thank you. By the way I like the alias onlinegamer hehe I will use it na.

    Sa nangyari saken ngayon ewan ko na lang po kung uulitin ko pa e2.. I dont like this kind of life. Sleepness nights, parati kang irritable kasi nga natatalo ka sa sugal pati relationship ko sa wife and kid ko naaapektuhan kasi nga I'm always grumpy. Grabe talaga and nangyayari sakin ngayon.. Pero I already told my wife about it.. Thank God naintindihan niya ako and she is supporting me all the way khit anong mangyari.. I cried my heart out sa kanya na hindi naman ganun ang gusto kung buhay para sa kanila.. I really love my family and ayoko mawala sila sakin.

    Kaya sabi ko sa sarili ko I need to move on with my life. This is just a test maybe a trial in life para mapulutan ng aral. Get up and start a new life kahit may parating na obstacles. Makakaahon din ako. Parang sabi nga ni kuya Kim, and buhay ay weather weather lang hehe. Sometimes nasa itaas ka minsan ay nasa ibaba. Learn from bad experiences and do not do it again. Do not pity yourself and that is a no no kasi hindi ka aasenso lalo.

    Parang kinausap ko na din ang sarili ko diba hehe.. Pero from the buttom of my heart thanks for the uplifting words from all of u. I know someday (I wish it would be sooner hehe!) na malalampasan ko din ito. Now that I'm equipt with the knowledge and confidence to handle the situation KAYA KO 2!!!

    For the people who are in the same shoes as mine, malalampasan din natin ito. Aasenso din tyo lahat at pwede na din tyong makatulong sa mga nangangailangan.

    Thanks for the response. Ganun nga ginagawa ko, wag na buksan at wala namang good news pero sometime sinisilip ko sa lamp shade kung ano laman he he he. Anyway as banker have said, just follow the golden rule.

    Ewan ko ba hindi ko na siguro dapat intindihin yung republic act na tinatanong ko. Phyrric victory nga rin pala in case na mag-file sila.

    Pareho rin pala situation natin tungkol sa binigyan ka ng card kung kelan wala ka nang work. Pero hindi ko naman ginamit sa sugal. Puro basic neccessities at konting luho. Kasi nga pati mother-in-law ko at ibang in-laws ko kasama sa budget ko. Ganun talaga buhay, wala ka ngang work ikaw pa rin sinasandalan.

    Ako nga kung kelan na retrench tsaka nag-bigay ng dalawang gold cards 149k each and credit limit. Tapos kahit ovelimit na nag-aallow pa sila mag-charge hanggang 200k. Talagang ibabaon ka sa utang. Hindi natin kasalanan yung kapabayaan nila. Mayroon nga sa circular 398 sa banko sentral na regulation, I will quote:

    "Subsecs. X320.3 and 4301N.3 .....credit card companies must exercise proper diligence by ascertaining that applicants possess good credit standing"

    Kasi dapat nag-background check muna sila bago sila mag-bibigay ng cards. Kasi kung tayo pa mag-sasabi sa kanila nito, then lumalabas incompetent sila.

    ewan ko kung tama ba na nandito ako, nag wo-work ako sa isang collection agency :D pero hindi ako collector or lawyer.

    naawa talaga ako sa mga tao na niloloko nila. madalas may mga tao na pumupunta upang mag settle ng account. kita mo ung worry at takot sa kanila. gusto ko sila tulungan.

    ano kaya maganda kong gawin? madalas may mga pumupunta pa dito nag rereklamo, ung mga collector kc sobra kung mambastos ng borrower.

    yung isang barrower sa galit sinabi nya sa mga tao dito "grabe mga collector nyo, makasingil lang ipapahiya kami, grabe uod pinapakain nyo sa mga pamilya nyo" ayun tameme mga collectors.

    ano po maganda kong gawin???

    thank you for such an information. just don't dont like them. it will be enough.we are trying to reach as much borrowers as we can para hinde nagkakaron ng ganoong eksena, napuno na sila ng husto that's why they went down their level.we have limited means of reaching them maggie,if we can talk to those borrowers we can can help them cope with the situation.

    Actually hindi po nila alam may ganitong blog at forum.

    Malaki po kinikita nila, sa accounting po kasi ako work kaya nakikita ko
    mga figures millions din po kinikita nila. At per territory po sila. Divided per region
    Ang isang collection officer kaylangan po maka quota ng 12 million sa isang buwan, para
    malaki din ang commision nila.

    pag malaki commsion ayun sarap buhay po sila.

    Actually meron din po sila mga utang sa mga credit card, pero nakaka bayad nman sila.
    Actually meron din po mga parang mapia sa collection agency, may mga nakaka collecta
    pero hindi nag reremit, binubulsa nila. sasabihin wala sila na collecta. pero yung borrower
    bayad ng bayad.

    Gusto ko na nga po maka lipat ng ibang work, hindi ko kaya sikmurain ganito gawain nila.

    Wala rin po ako against personally sa kanila, kaya lang po yung paraan nila ng pag collecta at
    pag harass. Gumagamit po kasi sila ng alias pag sa phone conversation, pag may pumupunta
    po na nag rereklamo na borrower sasabihin nila wala na yung collector na yun, ang hindi
    alam ng borrower kausap na nya mismo yung ng harass sa kanya sa phone.

    Marami rin po mga collector na nag reresign, yung mga hindi kinakaya. Pero yung mga natitira
    ang katwiran nila kung di nila gagawin yun hindi sila maka quota at sila daw ang kawawa sa management.

    Lahat po tayo may kanya kanyan problema. Kahit ang mga kasama ko dito meron din sila mga problem
    AT MAS MABIGAT PA PO KESA SA FINANCIAL PROBLEMS NINYO.

    my 2 cc are now in restructure program,naka 2 months na po ako ng pagbabayad at kinukulit na ako ng CA para naman sa personal loan ko. as to what maggie said, talaga bang hindi napupunta sa bangko ang mga ibinayad ko? san na po ito napupunta? sa mga CA na ba? does this mean na ihinto ko na ang pagbabayad? baka nga napupunta lang sa wala ang binabayad ko.. hindi ko na ba dapat intindihin ung isang CA na tawag ng tawag sa akin about dun sa personal loan ko? baka din kasi ganun ang mangyari.ang inaalala ko lang mejo malaki ang utang ko sa loan kasi nag accumulate lahat ng natitira ko pang dapat bayaran..pls. help..maraming salamat!!

  24. ganito po kasi yun, once na delinquent na yung account, collection department muna ng banks ang mangongolekta.(mas mababait po ang mga tao dun kasi mismo bank and ni rerepresent nila). if wala pa ring magawa yung sarili nilang collection dept. ililipat na po sa external collection agency (na usually affiliates din nila) para yung collection agency na mangolekta (eto na po yung mga gagawin na lahat para maka collecta). kasi bad publicity po sa bangko kung ganun ang paraan nila ng pag kolekta.

    - if nag babayad ka man be sure na ang card number/ pn number ay yung mismo dati mo. wag sa kung saan ka nila gusto mag bayad.

    I just read awhile ago in one forum about this CMAP or Credit Investigation system thing. Sabi dun sa forum once ma-implement daw ito sa Pilipinas pwede ng direct na kumuha ng payment ang banks sa sweldo ng mga may utang? Is it true? How about yung savings account pakikialaman din ba nila yun?

    Actually worried ako kung magkataon na too kasi I have unpaid bills sa 2 credit card company. Honestly I don't have enough money to pay the bills kahit na may work na ulit ako dahil di naman ganoon kalaki ang sahod ko unlike my previous job. So kung ma-implement nga ito di lalo lang akong malulubog sa utang dahil di ko na mapagkakasya yung income ko.

Hello po, question lang banker...I have 2 credit cards and 1 loan sa hsbc..all are delinquent..But I managed to restructure my Loan with a very nice gentleman (collector) who offered me a reasonable amount for 11 months..Is it safe to assume that HSBC can't file a civil case against me for my credit cards kasi binabayaran ko ung isang Loan ko with them? Thank you so much at talagang di mapapalitan ang peace of mind na binibigay nio sa amin...kulang ang word na salamat..Mabuhay kayo...

    their system won't recognize it as correct or even reasonable, mali parin yun sa system nila, but you can try talking to them. tell them you're fixing thing one at a time kasi hinde mo kakayanain kung sabysaby sila

  31. hi banker..a certain Paul Sison just called me this morning naniningil sa utang ko from hsbc..nakakainis tagala dahil he's really harassing.i just cant voice out my side since i was inside the office w/ my boss around..i really told him "why dont you just sue me"..tapos sabi nya i seemed confident that i can pay all the atty's fee and other filing fees when reached to the court..he said why not just pay the 8.6k as arranged by the bank.kasi banker im requesting the bank to have me a programm that can help me settle the acct.but the it requires me to pay 8.6k first and then 1.6k for the rest of the months until paid for 1 year.he even asked me if i do have appliances at home and i said no..i am aware his bluffing all the way and kung pwede sana i will bluff him back and tell him na why not talk to my atty..(kung pwede sana banker yung tinutukoy ko na atty is you)..
