Signs - Animated
SECTION A - FEARS :
1. I will go to jail
Utang is a civil liability. Imprisonment is for criminal offenses.
Therefore walang pakialam ang :
a. Police - they handle peace & order
b. NBI - NBI Clearances cover criminal cases
It contains the entire criminal history record
(Criminal Incident History) from the different
judicial courts and law-enforcement agencies
c. Immigration - Hold Departure Orders are for criminal cases
d. DFA/Embassy - Passport/Visa issuance is not dependent on CCs
e. Barangay - They cannot entertain complaints from a corporation
f. Courts - They mediate not collect
g. Other Countries - Their laws are not applicable to us. Remember Contemplacion?
2. They will visit our house and get my properties/Cause a scandal
Trespass To Dwelling is a crime against security - kulong sila.
Is there a court order? file muna sila ng case!
Get your properties? does your name appears in your electric fan?
Sec.13 of Rule 39 of the Rules of Court outlines some properties
they cannot get from you :
- family home
- salary/pension
- furniture ( beds/dining tables etc.)
Check mo Crimes Against Honor - Art. 353(Libel);Oral Defamation etc.
3. They will charge me with RA 8484 because:
-I transferred residence/office/went abroad
without informing them;
-I am defrauding creditors by not paying.
Did you used a fake card and supplied faked information?
(reasons why you do not want to pay)
Did you left your place “surreptitiously”? (look for its meaning)
If your answer is “YES”. Then, maybe you are guilty indeed.
4. They will file a case.
The Worst They Can Do, or What You Have Been Afraid Of
They wont ; They cant. Impractical, expensive, waste of
time and pointless. What makes you more important than the
other 999,999 accounts?
You've been complaining about high interest before? Now is the time.
Our compassionate Judge usually reduces it to 12% Interest PER
ANNUM na lang, ayaw mo pa noon?
And, even if they file a thousand cases against you, if you do not
have the money or identifiable properties, That’s IT!
5. They will come and talk to our Manager/HR ; cause a scandal
See no. 2 above and some suggested diskartes below
6. I issued PDCs.
BP 22 has been decriminalized. Just attend when invited. That is the
only requirement.
7. My account will balloon because of continued interest and charges.
I surrendered already my card but the charges wont stop.
Your card is automatically suspended even without you asking for it.
Your account will continue to incur interest and other charges
"until fully paid" - That is what your Card Agreement says.
So, it will never stop, but collection efforts can.
8. I will be BLACKLISTED
You cannot erase an experience, even if you pay it now. but you can
justify it - nawalan ka ng trabaho e. A good credit officer( not them
CC officers)looks beyond that experience. Why not try to find it out?
A good number of people do get to be issued new credit cards despite
the experience. Try before you quit. Pakiusap lang,
LEARN FROM YOUR EXPERIENCE.
SECTION B - Sources of Harassments:
a. Collection Letters
You already know what's inside. Throw it right away without even
opening it. No good news there. It will just spoil your day.
b. Text - SMS & Calls
delete. avoid sending replies. sayang ang load
divert those calls.
c. Visits
Ask for their ID, authority as representative and/or Court Order.
You have the right to refuse them entry if they cannot show one.
Then call for police assistance (This is their ACTUAL function)
Ito ngayon ang may imprisonment:
c.1 Trespass To Dwelling ( Crime Against Security)
c.2 Fraud - Pretending to be somebody
c.3 Extortion
c.4 Robbery
c.5 Oral defamation
d.Calls - office and home landlines
We always assume they are from the bank
how can you be sure? ask them that.
d.1 Don't take the calls. You have other better things to do.
d.2 If you can't avoid it, just make your replies simple, even if you
do not mean it, to avoid prolonging your agony
d.3 No need to explain why you cannot pay, plead that you be given
time, nor engage in an argument - all pointless.
d.4 Can't take the call anymore? Bang the telephone! That is your right.
e. Call/Text Messages
e.1 A case has been file already. To stop, call this number
- You cannot stop a case if already filed. It has to be formally
withdrawn
- Did you actually received a Summons? Ano ito, shortcut?
e.2 You have a package for pick-up
- You should know better
SECTION C - Venues for Sama ng Loob
Bangko Sentral ng Pilipinas is our friend.
So is the Bank President.
IBP/Supreme Court can remind lawyers
This Blog reduces tensions
Your friends are willing to lend an ear
Our support group - Diskarte, Pilipinas ! is on your side.
SECTION D - The Golden Rules on Credit Card Paranoia
Rule No. 1 – If you cannot pay, don’t
Rule No. 2 – Prioritize your need ; not their greed
Rule No. 3 - Don’t let them control your life. It’s your life anyway
Rule No. 4 - Disregard….delete…..dedma
Rule No. 5 - Dare To Fight Back ; Dare Their Bluff

Good day Banker!
ReplyDeleteI have a question. I have 2 unsettled credit cards -- one from HSBC and one from citibank. Both are now in a collection agency. Now, I am planning to get a new credit card for a trip abroad, but of course this time, I will use it more wisely...
My question is this, is it still possible for me to get approved by other banks? Do these banks here in the Philippines share like a central database where they can check the credit history of a person?
Thanks for your answers, Banker!
I've posted a revision above.
ReplyDeletethanks for your inputs.
this is the chapter that answers all questions
I mean, people make mistakes but even criminals have the freedom to practice their rights.=) I love you banker! hulog ka ng langit! napakarami mong natutulungang tao. you dont even know us pero you help us out with no questions asked. we all love you banker!!!
ReplyDeleteDear Banker, All
ReplyDeleteWhat do you mean when you say "identifiable asssets"? Thank you
identifiable assets are properties which have your name like house and lot or car.
ReplyDelete3. They will charge me with RA 8484 because:
ReplyDelete-I transferred/went abroad without informing them;
-I am defrauding creditors by not paying.
Did you used a fake card and supplied faked information?
(reasons why you do not want to pay)
Did you left your place “surreptitiously”? (look for its meaning)
If your answer is “YES”. Then, maybe you are guilty indeed.
<<< Mr. Banker, what if in a few weeks lilipat na ako ng bahay? What do I need to do para maiwasan ang RA8484? Should I inform the CC company of my new address? More than 6 months na ako d nakakabayad kasi nawalan ako ng work, and now kaya ako lilipat kasi makikitira na lang ako sa bahay ng kapatid ko, pinapalayas na ako dito eh.
you may or may not.
ReplyDeletepossible thing that can happen if you inform them :
they will threaten you with RA 8484!
'wag na lang. ^-^
remember: RA8484 is for FAKE cardholders

ReplyDeleteCIBI handles credit data for banks.
but check mo No. 8 above.
Good day banker...can you post some suggestion on how to settle your credit card account when you already have the money to pay/ you are willing to pay by installment or full payment. Babayaran lang ang principal kung maari.
ReplyDeleteI hope this will help many people get ideas in paying their debts.
To anonymous asking how to settle if already have money (whew, haba..),
ReplyDeleteIf I may..
Check mo previous blog chapters ni banker.
Also click "anong gagawin" sa labels section.
Banker said;
1. ASk for a detailed and updated SOA, duly signed and certified correct by an authorized bank representative.
2. Review and reduce - propose reductions and waivers especially the bloated interests and charges. And then offer ONLY WHAT YOU CAN AFFORD.
3. If they agree, DOCUMENT IT.
4. If not, then let the courts decide.
This is the plan (from the blog din), in a nutshell..
Good luck, buti ka pa may pambayad na, hehe..
anonymous 8:33
ReplyDeletego to Paranoia Sypnosis for details of what reddraggon (thanks!) said.
how do we document the agreement, sana may sample letter of agreement. does the bank provide or we initiate?
ReplyDeletecheck mo under " Sample Pro-forma Letters and Documents" (2006)
Banker,
Minsan kasi may nakasulat na "pag naka miss ka ng isang bayad, balik sa dati yung utang mo as if hindi ka nag bayad.."
hi reddragon,
ReplyDeletedo you still receive calls and letters from our "friends" .
Hello ms hopeful,
ReplyDeleteFrom November to March, straight yan, ,more or less 3x a week may tumatawag, dumadating na letter. But I wrote BSP re harassments nila, nung end of march.
Sabi nga ni banker, 3 strikes your out! (can't wait).
How about you?
look at the bright side:
ReplyDeletebaka madevelop pa yung caller sa yo.
selos ang asawa noon. heheheh.....
Hi Banker! Im back! I have questions po ulit. My family just told me that there's still some callers who keep looking for me and also may nagpupunta pa din po na tao para ideliver yung statement ko from HSBC. So far wala na din po nagttext sa roaming number ko about my utang! Thank banker! More power! :D
ReplyDeleteAnnaBanana,
ReplyDeletewelcome back! now you family knows how to make diskarte eh? yes.
5. They will come to my house/office and talk to our Manager/HR
ReplyDeleteSee some suggested diskartes below
hi banker,
sorry i didn't get you on this.
this f "law firm" already called our HR and told them about my status.
do you think our company could fire me because of this ?
Thanks and more power !
puroutang,
ReplyDeleteDEBT is a personal matter, just like your religious belief, except if there is conflict of interest ( a priest w/ you-know-what, a banker who frequents casino, etc.)
puroutang,
ReplyDeletebanker is perfectly right! I remember yung isang officemate ko ang daming utang sa aming lahat na kasamahan nya. ultimo rent nya sa bahay di sya nagbabayad until na may nagpunta na tao na pinagkakautangan nya sa HR para i-hold ang sweldo nya at bayaran lahat ng utang nya, but HR told that it is indeed personal matters at di sila nakikielam dun. In short, hindi nahold ang sweldo nya at nakuha pa nya ang back pay nya! wise sya di ba?! haha
right, how about a finance manager but could not manage his personal finance , does it matter.
ReplyDeleteConflict of interest covers possible personal interest interfering with official decision. The ultimate test here is “Trust”.
ReplyDeleteTo avoid temptation, some alternatives are:
1.transfer from that awkward position
2.disclose the possible conflict
3.inhibit deciding on major issues
thanks guys !
ReplyDeletenow i can breath .. hehehe ..
puroutang,
ReplyDeleteLOL! Nice one banker!
Puroutang,
Didn't they also violated your rights by disclosing your account information sa ibang tao? If that's the case, maybe sila naman ang harasin mo. You can tell bsp their illegal tactics.. just a thought..
"Didn't they also violated your rights by disclosing your account information sa ibang tao? If that's the case, maybe sila naman ang harasin mo. You can tell bsp their illegal tactics.. just a thought.."
ReplyDeletei've also thought about that last night.
my question now is how do i communicate with bsp ?
you can email bsp, we have here our email address provided by sir banker.
ReplyDelete...it's under "Unfair Collection Practices" chapter ( 5/07)
ReplyDeleteTo Puroutang,
ReplyDeleteI am also an HR practitioner. it is no longer part of HR's job na pakaialaman pati personal mong utang and you can not be terminated just because you were not able to pay your debts sa mga CC companies na yan. unless nalang siguro kung yung HR nyo has negotiations with the collector to get some percentage of the collection...hehhehe...
sir rene....
so, there is no use to cancel it kapag wala pang pambayad ng buo..
new daddy,
ReplyDeletecard is only a medium. canceling it does not negate your utang nor the interest and charges accruing from it.
what you can "save" is the renewal charges associated with the card.
if you are a past due card holder, it is a natural course to cancel it in order to preclude further and additional credit exposure for the card company.
hello banker... i have CC debt last payment ko september pa kasi nag-abroad ako then now balik ako pinas pero alis din ako this May, ang question ko baka i-hold nila ako di na ako makaalis, posible po ba yon? please sagutin mo ako ASAP kasi di na ako makatulog...
ReplyDeletethanks
anonymous 2:07
ReplyDeletehey, you might really be too scared to notice anything.
the answer is up there - "Natatakot
Ako kasi......."
hello banker di ko maintindihan eh your answer can you expalin it please
ReplyDeleteAnonymous 11:14
ReplyDeleteUtang is a civil liability.
Therefore walang pakialam ang :
c. Immigration - Hold Departure Orders are for criminal cases
thanks a lot!..........muahhhhhhhhh
ReplyDeleteHi banker,
ReplyDeletesorry po ah,but i need to ask related question tungkol sa hold departure order. I know it's for criminal case lang Pero what if po, bumalik ako ng pinas for vacation. At gamitin ko yung credit card ko here sa U.S for my transaction sa pinas. Madedetect po ba ng hsbc na nasa pinas ako bcuz of my transaction? aT Magiging criminal case na po ba yung di nila ako malocate or makontak for let's just say 2yrs and they just found out na dumating ako ng pinas at ihold nila ako sa immigration?!
AnnaBanana,
ReplyDeleteyour US card is different from Pinas card despite that similar logo. walang pakialam ang isa't-isa.
but maybe if you are a really BIG-time Platimum card holder who did not pay....
the case could be a criminal case IF you faked your info to obtain a credit card and then, di ka na ma-locate.
ei banker!
ReplyDeleteYou are such an answer to my mom's prayer!!!! thank heavens that such "banker" exists!
I used to be a "debt collector" myself and worked at a call center at ABSCBN premise. I quit because I didn't like the nature of my job... messing up with the American people.
I would always give my mom an advise because working there really gave me knowledge on how this F ked up industry works so as not to give my mom another emotional and financial burden. same as with my tita who happens to be on the same boat. But of course, I have the "US" knowledge not the local so back in my mind there would be a point where I doubt my judgement, then there came your blog! and whew! a great relief to our family!
my mom has been a good payer for almost 20 years.it's just then that now, we have personal problems that greatly affected our financial status. we do have the intentions of paying it but it must be on our terms, right? but then, they kept calling and threatening my mom about this. NOW I HAVE A WHAT YOU CALL THIS AHH... THIS BLOG to convince my mom that there's nothing to worry much about... at least we have our intentions to pay.
Just now, I personally received a letter coming from and agent, for without a doubt, a newbie, saying he is doing an ocular inspection so that they will know what they will get as sufficient payment for the debt. Being a bi-a-tch myself and meanie cause it was early in the AM,I just woke up, I just told them "ok" with an attitude for him sounding so threatening a while a go, which by the way, lead me to find your blog.
biruin nyo.... isu-sue na daw kami after 2 days kung hindi pa raw kami naka-gawa ng paraan at kukunin pa ang bahay at kotse.... my mom kept on telling this so-called law offices na she is willing naman magbayad but not now pero soon sa tamang amount that she can afford. pero ang tigas ng ulo nila eh, kaya ngayon hahayaan ko na silang mapagod at masayang ang gasolina kakapunta... lalo pa ngayon that oil price has increased.
thanks banker! pababasa ko na to sa mom ko when she comes back home
hi banker,
ReplyDeletejust received a message from someone.
Attn: puroutang, ** vs. your civil case no. ####-# under MTC branch67, subpoena will be served by Sheriff Castro & SPO2 Hidalgo for violation of R.A.8484 and Article 315 of the Revised Penal Code. You are being summoned to appear in court hearing. Coordinate with Atty. Mercado at 0919#######.
although i've already read your blog, i'm still kind of worried about this.
what should i do ?
thanks!
puroutang,
ReplyDeleteYour got your Joke of The Day!
1. Branch 67 is an RTC,not MTC ^-^
located in Pasig.
2. Text na pala ngayon ang Summons?
3. Art. 315 is under Civil Code of
the Phils. just in case Mr.
Atty. forgets it.
4. coordinate with Atty...? puede
ba yun? Summons yun - "appear in
court" not coordinate.
What you should do? see Rule No. 4
and roll on the floor laughing.
hahaha ..thanks banker ...
ReplyDeleteyou really made me laugh!
btw, i just receive a print out of the "Complaint" that they are going to submit to court ..
grrrr ...
greetings! I would like share my case.. Im out of the country since jan.2008,one thing biglaan po kasi yun pagpunta ko ng ibang bansa that is i have no time to inform them.my problem is when i get here until now I didnt find job thats and I have unsettled credit card from HSBC since march this year. Then I received an email from HSBC redit management informing me that im eligible to avail full settlement discount offer and they wil allow me to pay in full of my credit card balance with discount rates.from then i just ignore this email. But I got worried when I received yesterday a text message from my roaming saying that they reffered them to do for a approapriate legal action regarding unsetted acct. And therefore they formally demanding from me to pay my accountability.
ReplyDeleteBanker can you please help me on what i am going to do.this is my first time to experienced this problem that is why i feel worried.can you please explain to me what are they trying to say that they reffered to me for appropriate legal action? are they tellin thy going to file a case on me? need help banker!
hi anonymous,
ReplyDeletewelcome to the group, i guess you are new here, suggest ko lang, you should choose an identity. we were like you, they are false threatsand collection strategies, have you read the postings in this blog. banker have summarized the remedies and antidotes. and you can follow the rules posted and you can also email banker, his email address is in his profile. no need to worry.

ReplyDeletethank you!
anonymous ( pls get an ID puede?)
ReplyDeleteRule No. 4 states :
disregard....delete....dedma
You've seen the flashing sign in the blog? I put it there to remind people what happens kung bigyan pansin sila.
In this chapter, I also placed here about them filing a case - they wont; they cant.
thanks banker for the advice.. more power!
ReplyDeletethank you thank you salamat sa enlightenment, actually ngayon ko pa lang nararamdaman ang kalbaryo ng mga credit card ko na hindi ko na nababayaran going two months ko na ang they keep on calling me sa office mabuti na lang nga e naputulan na kami ng phone sa bahay at yung cellphone ko always off. medyo naguguluhan na rin ako hindi ko alam ang gagawin until nahanap ko ang blogsite na ito.
ReplyDeletesir salamat sa mga advices mo, if you mind give me other things to do and expect sa mga credit card companies. for sure ngayon pa lang sila nagsisimula ng panggugulo sa akin.
crazyoverdebt,
ReplyDeletethey will do anything to harass you if they see that madali kang takutin.
1. this is atty... you have a pending case in xx court. better call this number to suspend your case
ikaw naman innocente, you call the number. guess who is on the other line?
2. You have a package waiting at xxx claim it by calling xxxx
guess again who is at the other end of the line
DONT BELIEVE EVERYTHING THEY SAY.
crazyoverdebt,
ReplyDeletecheck mo the Golder Rules
if you talk to them, check Paranoia Prescription naman.
good. ano ba ang blogsite mo? will try to visit it.
ren,
ReplyDeletemay nag share sa diskarte group natin sa yahoo regarding DML's strategy to refer cc debtors to bgy tanod, how are we going to deal with this.
see above post, but here's the basis:
ReplyDeletePD 1508, referral of a dispute to the Barangay Lupon is required only where the parties thereto are “individuals”. The law applies only to cases involving natural persons, and not where any of the parties is a as a corporation, partnership, corporation sole, testate or intestate, estate, etc.
banker nagpadala ng demand letter ang domingo and molaer law offices. nag advise ng not to dispose, sell, and/ or transfer properties e.g daw po house and/or lot, CARS, tv, etc., which may have been conditionally listed down daw ng officers nila, nor to withdraw bank deposits and/or salary and wages, if any, in the event the necessary and appropriate complaint/s has been filed and necessary Writ of Preliminary Attachment, has been issued by the court concerned, and then served upon them, under pain of Contempt of Court.
ReplyDeletee2 pa: our deafening silence and/or non-response to their said Demands indicate malicious and unjustified refusal to pay a just and demandable obligation to their said client.
everydayibleed,
ReplyDeleteplease re-read the Source of Harassments and what to do.
Look at the choice of word "advise"
it is not an "Order" kasi they cannt do it legally.
You can also write them "to advise that they stop sending your letters" heheheh.....
This is only one of their techniques to instill fears to those INNOCENT borrowers.
What to do? read Rule no. 4
thank you banker!
ReplyDeleteidol kita!
i guess dapat i should have more time reading this whole blog para fully informed ako. call center agent din me nsa collections din pero pang-america that's why i quit dahil i didn't like what i was doing... thinking it could be me experiencing those phone calls and being wisely tricked.
thank you ulit! follow ko advise mo! pabasa ko kay mama ulit to!
hi banker,
ReplyDeleteone question again.
why can't they charge us "estafa" ?
puroutang,
ReplyDelete...because you do not intend to defraud them. you just simply cannot pay!
-did you use a fake credit card?
-did you supply fake information?
-did you sign a Trust Receipt Agreement?
- did you issue PDCs?
Hi banker,
ReplyDeleteI have been reading this blog for a long time but this is the first time i post a comment. Just one question. can you elaborate
Sec.13 of Rule 39 of the Rules of Court outlines some properties
they cannot get from you :
- family home
What is covered by family home?
Family Code of the Phils.
ReplyDeleteArt. 153. The family home is deemed constituted on a house and lot from the time it is occupied as a family residence. From the time of its constitution and so long as any of its beneficiaries actually resides therein, the family home continues to be such and is exempt from execution, forced sale or attachment except as hereinafter provided and to the extent of the value allowed by law. (223a)
Art. 153. The family home is deemed constituted on a house and lot from the time it is occupied as a family residence.
Art. 158. The family home may be sold, alienated, donated, assigned or encumbered by the owner or owners thereof with the written consent of the person constituting the same, the latter's spouse, and a majority of the beneficiaries of legal age. In case of conflict, the court shall decide. (235a)
hi banker..question po. i have a friend who has 7CCs and a personal loan from HSBC. ngayon yung loan na lang nya binabayaran nya monthly (10k/month) and cards nya sa BPI at HSBC. she has work pero andaming pinagkakagastusan...siya kasi ang breadwinner ng fmily nya (single). anyways, ang utang nya lahat lahat sa mga hindi nya nababayarang card is nasa 300k. she tried to pay the minimum for all those cards amountng to almost 40k pero hindi na niya kinaya. wala pa naman siyang natatanggap na kahit ano kundi calls from eastwest bank na hindi na nya sinasagot. sabi ng isang ofcmate namin, kung sobra daw sa 50k ang utang, idedemanda daw talaga saka daw magsasama-sama yung mga banks na pinagkakautangan nya para habulin siya. is this true?
ReplyDeletethanks in advance!
hi banker,
ReplyDeleteam interested in what annie mentioned "magsasama-sama yung mga banks na pinagkakautangan nya para habulin siya. is this true?"
pwede ba yun?
why should I "join forces" with my enemy to collect from you? grabeh na ba talaga ang utang? hehehe....
ReplyDeleteno logical reason behind that idea.
This comment has been removed by the author.
ReplyDeletehi again banker. thanks sa previous answer mo. kasi yun nga parang mashado daw malaki ung utang..like sa metrobank meron shang 103k, sa citibank 150k..e ang max lang daw na "pedeng" nde na magdemanda ang bank kasi nga shadong abala is 50k lang. higher than that talagang hahabulin ka na daw. is that true?
ReplyDeletethanks in advance again!
@ annie and sir rene.... minimum, 50 thou? are we talking about the principal amount here.. o ksama na yung mga excessive charges?
ReplyDeletebut i remember Sir rene saying na ang thinking ng mga collectors is "sino ang madali at puwede nating takutin"
annie,
ReplyDeleteif they give a cut-off amount, I will not question that. but the logic behind collection effort is - the prospect of collection.
Kahit one million ang utang mo, if the prospect is "nil" would you still go on, right new daddy?
dear banker
thanks banker and more power
jorget
jorget,
ReplyDeletejust follow the suggested steps found in the Chapters " Paranoia Prescriptions" and " Utang, What I'd Do". you will never go astray.
If no compromise - dare them to file a case, they wont. ( yan lang naman parati panakot nila)
how about setting a coffee meeting kahit mga 1hr. lang, para naman maliwanagan ang ibang pa nating concerns at mabigyan tayo ng thoughts ni sir rene about our credit cards. suggestions lang po.
ReplyDeletebanker, thanks so much sa mga nababasa kong advices at points mo. dalaw ka naman sa blogsite ko hehe.
hi banker,
ReplyDeleteon daring them to file a case,
i did say to one of the collector when she asked me to pay an amount which i replied i cannot pay now since i dont have the money - then she told me " so mam, file na lang kami ng case " - then i replied - cge file na lang. (the conversation ended,- walana syang masagot)
now my question is - will they use it against me? that i conceded to let them file the case?
crazy over debt,
ReplyDeletethat's a good suggestion - meet and discuss - then I can discuss it here.
just visited your blog. sige, i-labas mo na lahat na sama ng loob mo. its a good catharsis. hehehe....
ms. hopeful,
they need not get your consent for them to file a case? its their prerogative ( the bank)
remember, these are collectors? what makes you so important from the other 999,999 accounts out there? kung wala akong makuha sa yo, bakit kita pag-tyagaan? I NEED MY COMMISSION ASAP. wahhhhhh......
hi banker! thanks for all the good advices. you're really heaven sent. thank God for giving you to us. :-)
ReplyDeleteI'm on the same boat with the rest of the people here but thanks to all of you (most especially to you, banker), my paranoia has lessened...minsan kasi natatakot pa rin ako pag may tawag, texts at letters. Everytime I feel afraid I open this site then I feel fine again after reading the blogs...hehehe...I find solace here.
I'm not taking their calls and I'm not replying to the texts messages, though I am worried that they will use this against me. Baka sabihin nila nagtatago ako. I just don't want to talk to them coz wala naman akong pambayad. Dinedeadma ko sila. Ayoko lang masira ang araw ko. I'd rather spend it doting on my daughter. Ok lang po ba yun banker?
singlemom,
ReplyDeletecongratulations. you are doing the right diskarte!
you are right. spend the time with your daughter, not with those @#$%% collectors (Heavens forgive them)^)^
Good day!!!!
ReplyDeleteYou have no idea on the kind of reliefs that you provided on your your blogs. I recently got a hit on my nbi clearance, (which I will be needing in my job application overseas) no idea what that is all about but it immediately reminded me of my credit cards and post paid plan debts which was unpaid about 5 years ago though I was even given a clearance 4 years ago with no record on file remarks, now I am having sleepless nights and health issues caused by tensions due to possible consequences of my deliquency. I find relief by reading your blogs everyday to ease my worries.I appreciate it a lot and with a lot of people going through temporary hardships and unable to pay their bills you are really one great help. Thanks again and God bless always!
hay sana makakakuha ako ng nbi ko this june4 kase pinabalik nila ako e. may kapangalan daw kasi ako but its only renewal and i got my nbi last 4years ago pa. baka naman makaapektado sa hindi ko pagbabayad ng credis :(
ReplyDeletehello miss praning,
ReplyDeletesana ako rin makuha ko yung nbi ko sa june 5, sobrang worried ako dahil nahit ako at isa lang naman ang alam kong ginawa ko, di ko binayaran ang credit cards ko coz i got fed up sa mga threatening letters nila, since then i promised myself to use cash on all my transactions!
cynicalgal,
I just updated this chapter.
ReplyDeleteNBI handles criminal cases;
Utang is a civil case.
so....GO!
(nobody is stopping you)
thanks banker,
got my nbi clearance na just as banker assured "no record on file"!thanks a lot banker!
ReplyDeletegot mine too :)
ReplyDeleteHi, Rene. This site is very helpful. I'm linking you up in my website para naman din makatulong sa mga taong namamasyal sa site ko na kasalukuyang hinaharrass ng mga collectors. There was a time na nangyari din sa akin yan, pero wala silang panama sa nanay ko haha Sabihan ba na mapupunta sila sa impyerno dahil sa grabeng interest at panggigipit sa kapwa haha..takot lang nila, noh.
ReplyDeleteAnyway, thank you for doing a lot of people a big favor. At least, thousands can get their sound sleep back.
Hello Banker,
ReplyDeleteThis blog is awesome and great! :)
BTW, everybody does have a problemin paying CC
's. Im my part,I am willing to pay or settle it naman eh, kaya lang wala pa ako ibabayad as of the moment nag-iipon kasi kami para sa new house namin ng parents ko. Medyo natakot lang ako kasi ung mga ginagamit na terms sa demands letters from a law firm, are 'court', 'warrant', 'sue', 'file a case against you', etc...
That law firm is asking me to pay 15-20k this month. If ever na hindi ko mabayaran yung hinihingi nilang amount in full, itutuloy pa kaya nila ung case against me (criminal case, daw)...?
The said law office who sent me a letter is collection ageny, too? -please correct me if I'm wrong.
Guys, to be honest this is my first time to be involved in this kind of issues, so please help me what to do and on how to face those people... I am really willing to pay, but still, cannot afford to do it as of the moment... Maybe next year, I can, but not this year... Please help me...
Banker, can you be my attorney if ever? or can I divert my calls to you...? :-) ...just an inquiry... :-)
Thanks,
Awit
Awit,
ReplyDeleteyou wont need an attorney. reason? the wont/cant file a case.
but for our peace of mind - divert mo call nila sa akin. ( I'll bill you later. heheheh....j.k. )
to awit,
ReplyDeleteu know wat? disregard mo na lang sila, edi kung magfile sila ng case go lang, every letter naman may due date sila na magbayad ka ng ganito date at amount.ako nga wala work eh at wala ako pambayad talaga. panakot lang nila yan para magipitan ka at magbayad. Just like me, una takot na takot but everyday reading of this blog, nagkakadiskarte ako.
Hello Banker,
ReplyDeleteThanks a lot for making me feel comfty na... I have read your comments and articles on this blog, and upon reading some, it gives me 'diskarte' on how to face those people... :)
So, can i divert their calls to you? :) (hi hi hi... im not kidding... :)it's a serious question... hehe :) you can email me anyway: awit.awit@yahoo.com
Thanks! :)
To Ms Praning,
Thanks also for sharing your thoughts... :) Thanks for listening to my issue. Sana one of these days magkaron ng reunion lahat ng members ng blog na to para naman magkita-kita tayo... :) kahit sa isang food chain lang... hehehe :)
Many thanks at mabuhay tayong lahat! :))
Thanks,
Awit

good day to all!
ReplyDeletethis blog site really helps a lot of people having problems with the cc and the loans. grabeh talaga ang pagiging bastos ng mga collectors na yan. there's this one from CASES na nagsabi na pupunta sila sa bahay namin ngayon. since yesterday ng may tumawag sa kin na magkasunod from their agency at nambulabog sa kin dito sa ofc e ginawan ko na ng paraan to search for some forums about sa ganitong prob and i found the thread sa gov.ph. imagine they even intro that they have a parcel for you and yun pala e echos na demanda. it really enlightens me on wat to do. if we can't beat them then better join them by scaring them too. anyways may karma rin sa mga nambubully.
thanks banker and all of the other bloggers who contributed here. GOD BLESS U ALL and may he blessed u more wisdom.

Hi banker,
ReplyDeleteI need your advice, I have a CC's in which i could not pay at the moment, I receive demand letters coming from a collecting agency.
I have 5 CC's which is unpaid but it never reaches 50K before pero ngayon nasa 70K na yata dahil sa interest and charges mas lalo pa ako ngayong mahihirapan bayaran ang mga yan. kapag ginawa ko yun gutom ang pamilya ko. I've been a good payer for 2 years it so happened na kinapos na kami ngayon sa dami din ng problema na dumating.
ReplyDeleteAnonymous,
ReplyDeletenope. see Section A-3
Banker,
ReplyDeleteThank you very much for the info. Makakatulog na ako ng mahimbing kahit papaano. Salamat pong muli.
Hello Banker,
ReplyDeleteI keep on reading your blog every time I get the feeling of paranoia when it comes to my credit card. I have a question, the card company sent me a letter which I dont know what letter, the place I previously stayed refuse to accept the letter from the post man. Am I in trouble in this way? What should be done here.
You know lately that prices on all of the goods are very high and I cant keep paying my credit card since I just transferred to a new job and I have my own priorities to attend. Tell me banker what should be done here. Thank you.
Hello Banker,
ReplyDeleteGreat Blog!!!
I have a question with regards to cc that is. The card company sent a demand letter at home, but I transferred place where my new work is. The people where they send the letter did not receive the letter they told the post man that Im not staying there anymore, is there anything I should do? At the moment I really cannot pay the bills coz Im still at my new job and I need to priorities my family not the credit card bills.
1.Am I doing the right thing?
2.What will happen to me if I wont accept the demand letter?
Thank you banker and more power.
anonymous,
ReplyDeletepls. get an ID by click the "name" button.
what to do? nothing. those are the usual FINAL demand letters which you will receive several times.
Good Day To all of you!! Just in case? Thanks
ReplyDeletenormally NO. it is covered by Act 1405 Secrecy of Deposit, unless there's an inside mole (you can charge the person though)

ReplyDeletehello banker,

ReplyDeletewhat kind of "letter" is that? a summons?
good day banker! just read almost all of the blogs here and it really did give me an idea what to do with all of my CC. i have been a good payer (no late charges) for almost 4 yrs and until now they haven't gone down to even a half, though sometimes i only pay the minimum amount, still it's frustrating. me and my hubby were planning to have a baby soon, but whenever we received all the SOA we are backing out on our plan.=( nways, i will do some of your advices here so that once and for all we'll be debt-free and start our family. one question though, banker... if i had 2 cards with one bank and i decided not to pay the other, would they cancel the other one? thanks for the help. God bless us all!=)
ReplyDeleteplaning2bmom,
ReplyDeleteif you have two cards with one bank, the other one will automatically be due and demandable if you go past due with the other card. However, it would depend on the person handling your account. Like a computer, it is only as good as the one operating it.
Prioritize your need, not their greed. Go ahead, have that baby. ninong ako ha? ^-^
Good day banker,
ReplyDeleteI don't know kung dito ko dapat magtanong sa topic na to. kc po nde nman ako sa cc may utang. what if sa citifinancial ako may utang at d na rin nakakabayad. d ba po may mga form din ako na pinirmahan. makakasuhan po ba ko dun?
CC and yours are all loan availments.
ReplyDeleteboth are similar.yes. theoretically,
they can, but will they?
ReplyDeleteGood Day Banker,
ReplyDeleteMy officemate received a summon from MTC Makati City Branch 66. There's a civil case number on it and with title "For: Sum of Money". He was given 10 days to to respond. There are lot of attachment on it like the notice of hearing and SOA. We are not sure if this is a valid summon. Kindly advise if he needs to answer this.
Thanks..
It appears so. Makati Br. 66 has been designated as Small Claims Court. Is the complainant Citibank?
ReplyDeleteEven if you answer it, what is there to answer - totoo naman may utang ka.even if you hire the best lawyers in the world, talo ka pa rin. so,dedma.
The question now is "Do you have money to pay" if none, that's IT.
Hello Banker,
ReplyDeleteJust for example I was given a summon, how long will it take will the sheriff go to my place just in case I ignore the summon? Will they give me a notice first or will they just surprise me?
the sheriff will execute the judgment. so you will know "if the sheriff comes" because there is a judgment.
ReplyDeleteThe sheriff will normally report back:
"No Assets Can Be Found"
end.
Hello Banker,
ReplyDeleteThanks for answering my inquiries. You are very helpful sir.
Pasensya na again. I have another question kasi regarding the "Property exempt from execution" on rule 39 sec.13. Kasama ba yung appliances like TV, ref, electric fan and computer sa exemption? Kasi yung "Household furniture and utensils" sa sec. 13 parang hindi specific, masyadong general.
Lito,
ReplyDeletethose are small and insignificant items na kung pag tyaga-an ng bangko, will look them CHEAP - maybe "bankrupt" na talaga.
at any rate, bigay mo yung luma mo na electric fan and buy a new one na China made! mura pa. ^-^
ReplyDeleteSiya ng pala can I just send you load? at yung cell number niyo pala hindi ko makita dito sa blog.
Lito,
ReplyDeletee-mail me na lang.
somebody tried to sabotage this blog kasi last week
^-^
Ok sir I'll just email you nalang.
ReplyDeleteGood day Banker!
ReplyDeletei also have problem regarding CC, medyo confused sa Section A-2(Sec.13 of Rule 39). i got a motorcycle, installment for 36 months(tipid pamasahe/avoid lates), since under my name, is it possible for the collector or anyone to get my motor before or after installment period? medyo worried lang ako. bka kc nagsasayang lang ako ng money ko then kukunin din pla s akin. tnx!
aldwin
they have to file a case first
ReplyDelete(malabo)
they have to obtain a decision
(matagal)
only the sheriff can get it, not the collector.
(seldom they get)
they can only get equivalent to your utang.
dami din diskarte dyan....
Good Day Banker,
ReplyDeleteSir, malaking tulong po opinion nyo.
thanks po sa reply!
tnx! :)

I have a personal loan with HSBC and the remaining amount should be around 14 thousand. I missed two payments or a total of 4thousand. Last Friday morning, I found a letter in our dining room table from Enzi Corporation threatening about a judicial process if I do not contact them and make arrangements. The scary part is, I was alone at home with my baby and we were sleeping. Our gate was closed, but not locked, and our screen door was closed. Somehow, the person who delivered the letter got into our house. Nobody else was around and my parents came back at a much later time. There was a part in the letter which said something like 'a member of our group came to visit you today'...It was literally true. Isn't that breaking and entering, attempted robbery, or trespassing at the very least? No matter how much the debt, no person deserves to have his/her house broken into.
ReplyDeleteI already sent an email to bsp regarding this.
RC
instead of BSP, you can file a complaint with the police - unjust vexation and trespass to dwelling - both criminal cases.
ReplyDeletehi banker,
Dear Banker and all,
ReplyDeleteI wanted to ask, in all of us who have been harrassed with a 'warrant of arrest...' and 'a civil case has been filed against you...' has anyone here ever been or knows anyone who has been arrested or has has in fact a case placed before the courts?
Oh and just to add Mr Banker, my history is that I set up a small business and opened a CC account with an CL of about 250K which I used to the fullest degree. Unfortunately the business went bust, so no cash. Now i'm worried about these threats. I know your PS states it all but I want someone to shout at me that I will not go to jail for this nor have to appear in court. I sometimes live in my parents house, which I stated in my CC form but also stay at friends place since I work far from home. Twice my home was visited and they even asked such questions on my living there. The reponce of my neighbors where that I do..sometimes. Any issues here? None right since I'm still technically living there....
ReplyDeletea warrant of arrest is for criminals.
ReplyDeletenot being able to pay is merely a civil case.
in case it reaches the court :
1. you have an utang - yes
2. can you pay - no
3. case dismiss - what else can you do? sell your kidneys for corporate greed?
THank you Banker!
ReplyDeleteSo they can file a case. What are the percentages that they will file a civil case?
How long on an average till they stop harrassing? I plean to go abroad for a job and I don't want my parents to be harrassed constantly while they are here. My mom refuses to change the house number since she lost her address book (i.e. cellphone) and can't inform all her contacts new number if ever.
Going abroad, would it be an issue with the article 8484 that they say on change of on address?
Incidentally, I was planning only to sell one kidney to pay off my debt..not both, either that or head off to prostitution :-) If you see me at the corner of makati ave please ensure to leave me a tip

hahaha. that's funny.
you dont owe them even a cent.
question lang po. ako di na ko natatakot sa mga kalokohan ng mga collections agency, pero if ung kapatid or parents ko ung hinarass nila dahil sa utang ko. lets say may pinapirma sa kanila out of fear na makulong ako, like sila ang sasalo ng utang ko. pede ba un?

hi there, i was hoping you can help me with my worries... i have a huge loan left in dubai. i worked for a year and had to head back home because of health problems. after months of staying here in the philippines, the time has come that i have to repay my left unpaid debts in dubai. it is a huge loan which amounts to Dhs 100k or around Php1M. I was contacted by this Bilkish Outsource Company which I believe is a collecting agency here and has asked mo to respond to their email within 48hrs or they will conduct drastic measures towards me. The problem is that I do not have the money anymore and I know they have my address and I am afraid that they will pursue to collect from
ReplyDeleteme by harrassing my parents. My question besides how to avoid such harrassments is that will they be able to sue me if it entails a big amount of money? Please do help me... thanks.

dear banker,
ReplyDeletehow can i stop the cc company from calling my mom? union bank in the person of arlene cabrillos keep on calling my mom because i don't entertain calls from them. every time they get hold of my mom, my mom send someone to the bank to pay 2600, thats the amount they are asking for. they won't stop calling my mom until she gave them the transaction details. i told my mom not to entertain their calls but she won't listen to me. i told her i'll settle my debts with union bank next year because im still paying my hsbc debts which will end this year. i can't stop her from answering their calls and from paying. i don't want her to get harassed because she's suffering from highblood pressure and she has a medical history of mild stroke. how can i stop this arlene cabrillos from harssing my mom? please please help me banker...i don't want my mom to get sick because of their harassment.
drownin,
ReplyDelete1. please tell your mom that her payment does not go to the bank but to the deposit account of the collector. she is not even arlene cabrillos!
2. she is also paying just by "assuming". it's a scam. she does not even have any formal agreement with the bank.
3. write BSP about the harassment of Arlene Carbillos who may turn out a FAKE.
4. you take the call instead and dare her to file a case.
thanks a lot banker. i talked to my mom about the money going to the collector. i also emailed bsp about the harassment and i'm waiting for their response. thank you very much banker your blog is such a big help.
ReplyDeletemy cousin who is now in saudi arabia left a substantial amount of loan with QNB when he used to work in qatar. when he lost his job, he went home to the phils with an unpaid loan. my question is, will he be apprehended in saudi airport now that the account is past due and being followed up by bilkish philippines? up to what extent can bilkish force the family in the phils to pay? will he also have problems in the philippine airports? will he be apprehended in his own country? thanks very much
ReplyDeleteNo.

hello! call me willow. ask ko lang sana kung ano gagawin ko sa mga utang ko sa 5-6. di na matapos tapos, bayad ako ng bayad ng interest lang, kasi un lang kaya ko. pag di ako nakakahulog, idedemanda na raw talaga ako. takot ako kasi may mga pdc silang hawak at ung isa nasa kanya ang passport ko as collateral. what must i do?
ReplyDeletehello banker and everyone..
ReplyDeletethank you so much sa mga encouraging words na nababasa ko dito. thanks to my friend na nagrecommend sa akin ng site na ito.
i have the same problem ng karamihan dito. lately ive been receiving emails and phone calls from a collecting agency name bilkish. at the same time may pumupunta din daw sa bahay namin. hindi na kasi ako nakatira dun. pati mama ko tinatawagan nila and they keep on saying na kapag hindi daw ako nakipagusap sa kanila bukas daw (08/10) ay magpapadala na sila ng demand letter at makikipagcoordinate sila sa barangay namin at sa police. although marami na akong nabasang sagot dito ni banker, im still worried for my mother of course the other members of the family. i had cc and loan kasi with citibank (and another 2 from diff bank in abu dhabi) and unfortunately, i wasnt able to settle the outstanding balance after i went home back 2008. i lost my job after i resigned. the first time na nakausap ko yung agent was ok naman. maganda naman syang makipagusap. eto naman ako at walang kaalam alam na ganyan nga pala ang mangyayari super bait naman ako kasi alam ko nga may fault naman ako. kaya lang sabi nga, what to do? wala naman talaga akong work at namention ko pa na meron akong kapatid dun and willing to help me. hanggang sa kinulit na ako at the same time my mum. until such time na nabasa ko na nga ito. susme! parang nagisip tuloy ako kung tama ba yung revelation ko sa kanya. kasi sympre may priority din yung kapatid ko.
banker pls do advice me kung tama ba yung ginawa ko? do i need to tell them na yung brother ko na ang bahalang makipagcoordinate sa bank? although ganun nga talaga ang plan namin but not this time coz merong mga nakaset na priorities. as what you have said, need ko muna esp my twin.
thanks a lot and honestly, ur advices helps me a lot, mentally and emotionally.. :)

Hi Banker,
ReplyDeleteCan I file a complaint to the cc bank or to any entity concerning a rude Collector?
I have a deliquent credit card, they say the amount is around 200k, I can only pay 1k a month and been doing it for the past 2 months, but they keep on insisting that they are going to file a case against me because I am not paying the amount that they want which is 10k. I been asking for the SOA but they only provide me with the Billing Statement. The agent recently used inappropriate words in his text message because of my constant request of SOA.
Kindly help me on this matter.
Thanks

ReplyDeleteof course you can file a case against those collectors. you can file a complain sa bsp or kung may proof ka talaga at willing to go over it, file a criminal case
Buti nahanap ko to..
Maraming salamat!!

Dear Banker,
ReplyDeleteThank you for this blog and for your generosity in helping people like us who are suffering from stress because of these collectors.
I have an oustanding CC w/ BPI amounting to P223,000 which I wasn't able to pay for 5 months now. Actually it was only P170,00 but I received a notice for Luzano Law Office that I have to pay the P223,000 by March 24 or they will file a civil case against me. I emailed them and told them I'm not running from my obligations but I'm just experiencing financial difficulties right now. I asked them if they could restructure my account and I offered to pay P3000 monthly which I can afford. They replied to my email and gave me options to pay for 48 months for a monthly payment of P9000, but I was shocked because instead of P223,000, my outstanding balance skyrocketed to P440,000 which is times 2. I told them I couldn't afford the P9000 and I pleaded again that I can only afford a maximum of P3500 monthly and that asked them to lower the interest. What should I do and what should I tell them banker? Please help me.

Dear Banker,
ReplyDeleteJust this afternoon nang makareceive ako ng demand letter from GCCS & Associates.
