Hello there. A policeman went here and gave me the phone number of a certain Fiscal of Makati Regional Trial Court. So I called and referred me to the collection agency. He said that my OB is P47K.I asked for amnesty and an arrangement but the CA insisted that if I cannot pay P20K today, he will pursue with the case. I told him that I only have P5K but did not listen and hang up.What to do? I asked for a SOA and he said will I pay the whole amt if I see it? I told him I have the right to review it and dispute excessive charges.What is SUM of MOney? Yun daw yung kaso.

ReplyDeleteFirst post ko po ito pero matagal-tagal na rin akong bumibisita dito sa site nyo. Katulad din ako ng karamihan dito na baon sa utang sa cc, at dito na lang sa site nyo kumukuha ng lakas ng loob.
Yung ibang card ko po kc inuumpisahan ko ng bayaran kaya lang ang problema yung ibang card ko eh ndi na makapaghintay. Kung anu-ano ng pananakot ang ginagawa, (letters, phone calls, text, visitation) kahapon lang may natanggap akong letter from beukhen international, final warning na raw yun kc ndi ako nagre-reply or tumatawag sa kanila.
Tama po ba na magpadala ako ng letter sa bangko at makiusap na kung puede bigyan pa nila ako ng panahon na maayos ko muna yung pagbabayad dun sa ibang pinagkakautangan at pagkatapos eh saka ko sila unti-unti rin na babayaran? P150k kc ang limit ko dun pero kung tutuusin halos 75% na ang nabayaran ko kaya lang since january 2008 di nako nakabayad kaya umabot na sa P240k yung kabuuang utang ko. Iniisp ko kc bka gamitin lang nila laban sa akin yung sulat para lalo nila akong magipit? Bka mamaya palagpasin lang nila yung 1 buwan tapos dahil dun sa sulat ko eh kasuhan pa nila ako lalo...Sir sana po mabigyan nyo ko ng advice.

ReplyDeletei requested for a statement of account from the CA (molaer) and informed me that they are still contacting metrobank for my request ...
just this morning they faxed to me, according to them, the statement of account from january till april. the figures reflecting(prev. balance, payments, purchases, and new balance) are correct upon checking with the monthly SOA that i have on hand for the previous months that was issued by the bank... but what i noticed is that it is not signed and just in a plain paper and not in metrobank letterhead....
please advise next step....

The billing statement (they call it SOA)merely gets the previous balance then multiply it by the stated rate to arrive at your "new" balance. in effect, it is interest earning interest that earns interest etc....

HI everyone. I've been reading posts here and want to share my 2 cents.. I've been through a tedious court case involving a loan with usurious interest. It's now in CA on appeal by the other party claiming i need to pay principal + interest + compounded interests. My claim is to pay only the principal since we don't have any written agreement. Nanalo na ko sa RTC, so inelevate nila sa CA. Being involved in a case like this opened my eyes to our civil rights and legal rememdies available to people na nababaon sa utang. Believe me, DON'T GET INTIMIDATED BY THE PROSPECT OF BEING SUMMONED TO COURT. Judges favor mediation between parties. Pag umabot na sa court, mas malaki nga ang mase-save niyo lalo na if you tell the judge you can only afford a certain amount to pay. Ex: may judge na sa isang BP22 case may utang na 78T, e 10T lang ang pinabayad ng judge dun sa pinagka-utangan nung tao na may case filed na bouncing check. Maniwala kayo, di kayo pakukulong ng judge sa utang.

Hi ms. Hopeful. I commented earlier as anonymous. Yes, my case is against a couple. The amount we're talking is in the millions. Actually nag claim na ako na bayad na ang utang ko, sa laki ng interest na naibayad ko na sa couple na ito. Sabi nga ng RTC may utang pa sila sa akin na P2M. Kumbaga, I already overpaid due to the unconscionable interest charged me, e wala naman kasing written agreement. However in the case of credit card, may agreement tayong pinipirmahan right? Kaya lang super unconscionable din ang interest nila. Ang point ko lang, most of the concerns here are apprehensions about being haled to court for credit card debt. Gusto ko lang iparating sa lahat na HUWAG MATAKOT SA COURT ORDER kung totoong umabot na sa demandahan (however in the case of most cc companies e pananakot lang ang ginagawa). Based on my experience (meron na din akong several experiences on failure to pay cc dahil nga dito sa malaking pagkakautang ko sa couple na ito, di ko na nabayaran cc bills ko), I would rather face a judge in court than face creditors na tatakutin ka sa garnishment, etc. Alam nyo bang mag-file ka lang ng case e malaki na gastos mo? You have to pay filing fees, lawyers fees, not to mention the hassle of attending hearings.. cc companies avoid going thru all this expense and hassle, kaya inaasahan nalang nila ang collection agencies or insurance.
ReplyDeletealam ng mga cc companies na pagdating sa court ng collection case, e sa mediation lang ang bagsak, meaning, magkakatawaran din sa harap ng judge. this is what usually takes place before the judge during a mediation between creditor and debtor:

debtor: Php xx amount, say P100t
judge: both parties are willing to settle?
both: yes
judge: debtor, how much can you afford to pay?
debtor dictates the amount. kahit sabihin mo P5t lang kaya mo ibayad the judge will accept that.
judge: creditor, can you accept that amount?
usually pag sinabi ng creditor unacceptable, the judge will encourage tawaran between parties to arrive at a settlement beneficial to both parties. the judge knows how much cc companies suck on the blood of debtors kaya mas pinapaboran nya ang pobreng debtor.
ayan, narinig ko na ito while sitting in several courtrooms during the course of my case. sana mapanatag na kayo.
siempre this is not always the case but ito lang yung sinasabi kong reality.

Hi, I also have a problem with my Citibank card now. I wasn't able to pay the in complete the minimum payment required. My OB is around 35k now. I was so depressed because I was not able to pay the amount in full every month, my budget for credit card payments which is 2k per month is only enough to cover the finance charges and late payment dues. =( Hindi nababawasan yung actual na utang. So I have been receiving calls everyday, kahit 7am from this 02795#### number. I have been ignoring their calls dahil wala naman ako maisasagot sa kanila. They also sent me a notice letter. Then yesterday, got a text from a 2327 telling me that Citi is offering a unique payment assistance program to help me settle my bill for a limited time only. They gave the number 9955001 to call and avail. Should I go and call this number?

never call a collector, they will call you and it's up to you whether to entertain them or not.
why not just save your money and if you have enough, call the bank directly and deal with them directly. nagyon if the bank doesn't want to deal with you, see them in court na lang, it's legal and formal and sure ka pa sa transaction mo

ReplyDeletegus2 k lng po sana humingi ng advice tungkol sa hindi ko nbbyarang utang ko sa credit card ko from metrobank...noong month po ng july nd august parati po akong pinadadalhan ng letter galing sa iba-iba law firm ng metrobank.tapos po bukod dun lagi din clang ngkokol at nagtetext...pro i kept on ignoring them.
last july po may pumunta s bhay n collector,inadvice po ako nila n byaran ko dw po ung utang ko na P34k at that time.binigyan lng po nila ako ng letter tpos ung tao n dpat icontact para mkipagcoordinate daw po ako....nung araw din po n un kinontak ko po ung binigay nila sa akin n person...from Molaer law firm po pla ung mga collector n pumunta....nkibargain po cla sa akin ng amount n dapat kng isettle..mintikan n po sana akong bumigay dun sa inoffer nilang un...pero cnbi ko po sa knila n hindi ko po kayang bayaran un kc wala po akong trabaho sa ngaun at buntis p po ako....nung pngalawa nmn po nilang pagpunta,ganun p din po ang bingay nila pero d n po ako ngaksaya ng time n icontact p un....hinyaan ko n lng po hnaggang sa lumipas ang ilang buwan n wla n akong ntanggap n khit n anung letter sa knila...
but, recently lng po,nung 10/14/11 nkatanggap po ako ng text from a fiscal saying na "this is fiscal PEREZ of makati prosecutors office.this is to inform u that your court summon and subpoena will be served within 24 hours regarding your breach of contact,violation of RA 8484 /CRIMINAL CASE filed by Atty. FERDINAND TAÑADA which is due for court litigation.To be assisted by the laguna PNP......tpos nakaCC p po ang NBI TAFT....
cmula po ng nareciv k tong text n to ay hindi n po ako makapag-icp ng maaus at puro kaba n po ang nararamdaman ko...which is hindi dapat kc mkakasama sa 1 tulad ko n buntis...

ReplyDeletethis is tuts...gusto ko lang po sabihin, may tumawag po sa akin na ca, pinipilit ako magbayad ng 8T na utang ko sa cc, originally, 36T umabot ung cc ko cause of a nth times na palipat lipat ng CA, puro patong ng CA kaya ganun kataas, pero hiniingan ako ng 8T to fully settle, ive read all the comments here, and indeed, malaking tulong sa mga kagaya namin, ginawa ko, humingi ako ng SOA from the collection agency na nagsasabing law firm sila, nagalit sa akin at gusto pumunta dito at pakaltas sa sahod ko ung utang ko...i know hindi nila pwede gawin un, pero kaya nilang gawin, ung nakakahiya ang eskandalong gagawin nila dito ang inaalala ko... sinunod ko ung payo mo banker, pero nung time na kausap ko sila, i almost broke down sa sobrang galit, iba pala talaga pag kausap mo na sila... di ko kayang makipagsabayan sa kanila, i need help, pwede po ba ako tumawag sa iyo ngaun banker, kung pwede lang ikaw ang ipakausap ko sa mga CA na iyon...pero i know busy ka...what will i do, please help me...

ReplyDeletea collector called me today and demand me to pay all my creditcard balance today, i ask her to send me a copy of SOA but she demanded to settle the full amount once i recieve the SOA. she doesn't hang-up, because she want me to promise to her that i will pay my credit card balance in full once i recieve the SOA.....

ReplyDeletea cc collector called to me last tuesday, i asked for a soa but she demanded me to pay the whole amount if she provided me a soa, that cc collector is so rude she didnt stop calling me and saying bad words against me such as “di ka ba nahihiya gagamit-gamit ka ng cc wala ka naman palang pambayad”, kung nagbabayad ka ng utang mo eh di sana di mo ako kausap ngayon”, magbayad ka na kase…. mahiya ka naman!” iniiwasan ko na pong sumagot ng fone baka kase ung collector yun.ano po ang pwede kong gawin? thank you po!

ReplyDeleteI have received this letter from Cases Corpus and Associates regarding amnesty program to close my Citibank account at a discounted price. My OB is 40k and they're asking me to pay 15k. How do I know if this is real or a scam? They're asking me to pay it right away. How will I know that this payment option is acknowledged and agreed by citibank.

I also have problems with my husband's cc debt. we've been good payers and when he lost his job we couldn't make payments anymore.We've been receiving demand letter.But what can i do,but just ignore it.I couldn't make the payments.
Early this month I was able to talk to an agent representing east west bank.My debt is 20T and he was offering me 3 choices, to pay monthly for months totalling to 60T ,pay a lumpsum of 20T immediately or pay 10T by March 15 and another 10T by end of the month.And I'll be receiving a clearance from the bank in 3 weeks time.
The 20T offer sounded good and I said ok I will try to come up with the payment.
But when the 15th came, I was not able to make it.My kid got sick and of course that would be my priority.
Then I received a text message from that agent, stating "kapag wal ang payment niyo magpapapunta ako ng tao sa baranggay ninyo, magpapasama kami kay Chairman for Occular Inspection.Mapapahiya ho kayo jan sa lugar ninyo"
I'm having sleepless nights and I am always worried sick while at work,that they would indeed come by my house and scare my 5 little kids.My spouse and I are at work during the weekdays.And I am being threatened by this.
What should I do?

Hi! Good day! Magmatter ba if the credit is more than a hundred thousand? It's like this hindu naman dapat aabot ng ganyan if not of the interest. Now they are demanding me to pay 100K this 27th. I don't know where to get that amt. before it reached that amt months before i called them and asked for an amnesty but they won't unless i pay 20% of it. I tried paying pero got tired coz wla namang nangyayari sa binabayad ko. Ngaun pati sa office tinatawagan at pinupuntahan ako.

ReplyDeleteI'm currently working abroad. May nareceive ako na call sa office namin from a CA mula sa pinas. I cant take his calls kse super busy ng work load ko. And to my surprise, sinabi nia sa officemate ko un tungkol sa unsettled accounts ko.
Alam ko kse classified un diba? I dont like to entertain his calls pero he went beyond his limits. My uncle who happens to be a banker too, told me i can tell the CA na pede ko sia sagutin na LIBEL un ginawa nia.
What should I do? kse hinde sia tumitigil ng pagtawag sa office namin.

ReplyDeleteI am so thankful I found this forum, it has enlightened me in so many ways about my credit card woes.
I do have a Q regarding din sa credit card ko. Actually, supplementary ako ng sis ko, and I was the one who used up most of the credit limit. I currently owe the creditcard company 50k. I have been paying a minimum of 2k for the past 8 months, unfortunately hindi sya lumiliit. And this time nagalit na sa akin yung sister ko kasi sya yung hinaharass ng collector. So I called up EW and ask if I can just cut the card and I will pay for the remaining balance in installment. The CSR told me hindi daw yun pwede, kasi I still have to pay the whole amount or at least the minimum. So my question is, is that possible na ayaw nila pa cut yung card? kasi i think it's my right to have the credit card cut na, we dont use it naman na, and my sister gave me the go signal na pacut na din para wala ng mangharass sa kanya. So ako I want to settle sana in installment, kaya nga i called them up para to ask how will I go about it, para naman hindi sayang yung binabayad ko na 2k monthly. Parang im helpless naman if I continue to pay 2k tapos wala naman bawas sa utang, and hangang dun lang talaga yung alloted na budget ko to pay. I want to know if they do have the right to say na "hindi pwede icut kasi may utang pa kayo." Actually, gets ko naman na they want to earn pa from people like me na hirap magbayad ng minimum, and syempre I am forced to keep paying at wala naman nababawas, so sila lang yung kumikita.

ReplyDeleteI wanna know if for instance,I Asked and the CA was able to provide SOA from the credit Card Company....Does it mean na kailangang pumunta sa Credit Card Co. office at magkaroon ng agreement para sa settlement?and possible na rin ba na may access na maningil ang CA ng law firm na nagissue ng "Motion to declare in default" letter sa debtor? Please reply. Many thanks!
when you ask of soa from them, it should the detailed one, not the onthly billling we used to received before. when you believe your collectors' words, you will just make yourself worry.
