I made a terrible mistake today :D
I answered the phone and talked with a collector form PSBank. The good news is the collector was very polite. Maybe its because I told him I was the "sister" of the one he was looking for. Hehehe
I guess he was following a script because he was reciting the usual lines.... the account has been referred to us blah blah blah... pay or we will file... blah blah blah.
Maybe its because I never spoke with any collectors since my account became delinquent or maybe I feel a bit tougher, knowing about my rights and such --- I found myself lecturing the collector! about criminal case vs civil case, estafa vs failure to pay due to financial constraints, and even about negotiating with the CC directly.
The collector was actually at a loss for words. I told him there is no point in calling again since my sister (me) refuses to have anything to do with collection agencies and is negotiating with Metrobank (owner of PSBank) directly. I said goodbye and that was that.
after 30 minutes, the phone was ringing again and I let the maid answer it. Hahaha! Surprise! Supposedly it was a long distance call from Metrobank! I guess the first collector talked to his supervisor and decided to retaliate.
Of course, I did not speak with the person! Even as I am writing this, I am berating myself for answering the first call. Now, I can probably expect daily calls!
Sigh!

ReplyDeleteeh paano naman kung may work ka nga pero di mo na kayong abutin ang minimum payment due dahil binaon ka na nila sa interest, late payment charges, annualfees etc.
mas mabuti pa di mo na lang sagutin ang calls. ok ba

ReplyDeletebasta ang masasabi ko lang, natutuo na ako sa vredit cards, mga kapatid ko, pinapangaralan ko na about this, and insted, i encouraged them to apply for a debit card instead. we're waiting for their unionbank debit na para next week. :-)

Ang text back nya, "hus dis.." so text ako ulit sabi ko, katatawag mo lang sa akin, then I gave my name. text back sya ulit sabi, secretary to ni atty, relay ko na lang ang message mo. ano yun, address lang lang hinihingi ko di pa nya mabigay eh "secretary" naman pala sya... so text ulit ako sabi ko, im only asking for his email address and office address, can you not provide that? Until now wala di pa nag text back ang secretary ni atty... hahahah...
ReplyDeletemay ginawa akong kalokohan, kasi feeling ko di sya secretary so I used another number and called her, di nya sinagot ang call ko, then text back sya, "hus dis pls" so I called, sumagot babae, sabi ko in british accent (para kunwari foreigner) Hello, is this the secretary of Atty (I mentioned another person's surname)... sabi nya huh.. ahh.. this is regarding what... di ko sinagot tanong nya, instead sabi ko "Im looking for Atty... is he around? tapos parang natranta sya, tanong ulit, regarding what? sabi ko, is this his secretary? I need to talk to Atty... tapos sabi nya, si Atty (yung tumatawag sa akin) ang nandito.. so I said, oh, sorry I got a wrong number.. bye! hahahaha!! hindi naman sya secretary parang asawa ata ng collector yun.. di nya alam isasagot nya eh..

ReplyDeleteI understand that the likelihood of a credit card company pushing for a court case is slim to none. But how about in the case of those who issued PDCs? Do you think the banks would push for a court case? I have defaulted payment for a month (for this January) because of an unexpected problem in my family. I have been paying for more than a year and this is the first time I missed payment.
Patanong na rin po: Do you think the bank would allow for a, say, request to hold encashing the checks that I issued for 3 months (for example) so that I can find enough cash to fund the PDCs?
My case is similar to one of the posters here with personal salary loan (Citibank Savings, to be specific).

ReplyDeletehad an unpleasant experience this pm, nasagot ko ang call from citibank collector, naghingi ako ng detailed statement of account, sabi nya magabayad daw muna ako, then i told her na kailangan ko mareceive ang detailed statement, ang taray at ang kulit, binaba ko na lang ang phone, kasi she keeps on insisting that i must pay. paulit ulit. nakakapikon.
filing a case is a business decision
ReplyDeletebut having PDCs means a stronger position for the lender. Holding these for clearing will depend on your negotiations but normally, they wont agree(that's how uncaring they are of other people's plight)

kakaiba lang sa sitwasyon namin, pag tatawag na yung agent, pinapaalam ng father ko sa mother ko, who relishes a good argument any time. hayun, tawag naman si mother sa agent at cla na ang nag-argue. ang nakakatawa, ang agent naman ang sumusuko sa mother ko at kadalasan binabaan sa ng phone...feel ko na-harass din cya na mom ko...

ReplyDeleteYou don't have a case until you receive a subpoena(pero I'm sure hindi mangyayari yun). Ibig sabihin, wala kang kaso, walang sheriff, at yung number na binigay sa 'yo, ay sa kanila din yun. Niloloko/pinipiga at tinatakot ka lang nila para sa commission nila, pag bumalik, wag mo papasukin, wala silang karapatan (walang warrant)ipahabol mo sa aso nyo he..he.

Local HSBC cc? Alam ko pwede, sa pagkaintindi ko to some of banker's posts, walang pakialam ang local sa international (and vice versa). Lalo na kung di HSBC (other bank) yung bubuksan mo ng account abroad.

ReplyDeletetoday the collector called up and said he talked to the court clerk and the bank itself and agreed to give me some few days to settle my accts or post a payment instead. i demand him to give me SOA but said no more soa coz what is written in the letter is the actual amt ive to pay na daw. ctbank could not issue me either coz my acct was already sold to their agency together with other accts.is it possible that a firm such as ctbank will sell a delinquent accts to collection agency?

Do not force yourself to pay kung di kaya talaga. Would you rather feed them than your family?
The rule is you must obtain an updated and detailed SOA first before even thinking of paying. Kahit sabihin nila na inutos ni Pres. Arroyo na pagbayarin kayo, SOA muna ang kailangan.
Also, do not take your word for it. Kung sinabi nila kung sino sila, ask for their name, agency, phone number sa office. And then call them back. My experience, may tumawag sabi Citibank daw siya, pero nung hiningan ko na ng info bigla na lang binaba at di na tumawag. Kasi its easy to say na lawyer o taga bank sila, pero is it true?
If Citibank sold your account.. then they must have considered it as loss already... (yehey?)

Tumawag sila kaninag umaga sa akin.. iba naman ang style ng bank na to... sabi pinatawag daw sya ng assistant ni atty, so I said, "yes, what can I do for you?" sabi kung pwede daw akong magbayad "ngayon..." I laughed at them, sabi ko kahit pigain nyo ako wala akong ibabayad ngayon.. sabi nya, eh bukas pwede? hahahah...sabi ko wala until the end of the month, baka sa February meron. Then sabi nya, di i-file ko na lang tong kaso mo... sabi ko cge, wala naman akong magagawa. I can't pay you today or tomorrow, you can't wait until Feb na magkapera ako so sue me... tapos ang usapan... Then in the afternoon, bago magsarado ang bank, nag text sila, "Gud PM Ms. --- Remind ko lng po ang payment nyo sa CC. Magremit po kyo at least 2K para ma-hold po ang document nyo for filing of civil case.." Hmm...akala ko i-file na bakit nagbargain pa? tsk tsk tsk...

the collection agency currently handling my hsbc acct is atty. cases with address in cityland, makati. i told them i can start the payment scheme they offered 2 weeks ago that allows me to finish the payment in 10 months. however i can't start paying till february and i told them that. they won't accept it since my deadline is jan 16. and they will file case kuno. ano ba yun, magbabayad naman eh :(
i read from someone here that he wrote the VP and CEO instead of hsbc. my question is (hehe sorry po haba ng pasakalye) what would you recommend? that i request an SOA from the collection agency or write instead to the VP/CEO of hsbc directly? sino po ba mas matinong kausap?
(by the way, i just learned about this SOA 'medicine' from you. i think it's a great medicine next to biogesic for harassed people like me)

banks sell their acquired assets to others (Special Purpose Asset Vehicle or SPAV) at a discount;
they enter into a Collection Agreement naman with Collection Agencies on "commission basis"

hi dane actually talagang delinquent na acct ko. i just pay only if i have extra kc i really am financially hard up after some work problem arises.nakailang collection agency na nga yong natawag sa akin.good thing is that i never miss informing them that im willing to pay anytime i have enough money.till last year that this latest agency is so makulit to make me raise up an amount asap.gusto ko na barahin but still being civil im trying to control my temper.i always talk in a nice manner and saying that im grateful to have an agent like him so understanding.oops sorry nobela na ata to.try to ask again nxt tym okey.im always reading this blog na after the incident.ok ba

ReplyDeleteTakot ko lang kasi baka in my case totohanin nila banta sa akin coz i have two cards with ctbank they offer me right away another card dahil cguro before nakita nila na good payor ako....until last year na nanganak kasi ako sa magkasunod na taon kaya gipit ako ngayon sa pera...
laki na kasi utang ko sa kanila aabot na ata ng 150T sa dalawang card including interest kaya cguro wala ring tigil yong pagtatawag nila sa akin...
kayo nalang naging inspirasyon ko umaasa sa payo nyo.....

ReplyDeleteLike banker said do not worry, 150T for 2 cards is not a big amount for the banks to be bothered with. Meron pa nga (and banker would concur to this) 200T PER CARD! So, sino sa inyo dalawa ang uunahin ng bank if and when they decide to sue somebody. The collection agencies kasi they sense kung sinong tao ang madaling masindak at matakot kaya yun ang pinag iinitan nila. Arm yourself with the info banker has given us, para next time, sila naman ang sindakin mo. Hehehe.
If you are afraid of being sued, remember this, uunahin nila ako kesa sa iyo. So kung na demanda ako, I'll give you a heads up. But until then, relax lang.. Hard to enjoy life if you are not focusing on the more important things.. Good luck and God Bless. Hope this helps..

Last Wednesday, police came to our house, dahil a certain fiscal called them up to look for me and inform me na meron daw akong pending case, para daw hindi matuloy, I need to settle the account, actually husband ko ang nakausap nila kasi at work ako so tinawagan ako ng hubby ko dahil merong iniwan na number ang mga pulis daw.
ReplyDeleteSa taranta ko call ko agad si fiscal (long distance), ayaw pa sabihin nung nakasagot anong office pero nung hinanap ko si fiscal, prosecutor’s office daw yun. Sabi naman ni fiscal tawagan ko si atty. Tinawagan ko naman si atty (long distance pa rin). Nagbargain kami ni atty at para matapos commit ako magbabayad after a week.
Ngayon tumawag si atty para sa settlement ko, sabi ko di ako naka-utang magpartial na lang ako, ayaw nya, dapat full kundi tuloy ang kaso.
Sabi ko sige, pero anong kaso, sabi naman nya RA8484, ask ko ano yun pwede paki-explain. Lalong nagalit si atty, sa iba na lang daw ako magtanong. I told him di ba atty ka, so alam mo anong case yon.
Sinabihan ba naman ako, ah basta, ako ang magfi-file ng case tapos ako pa mag-i-explain, sabay baba nang phone.
so ngayon maghihintay na lang ako ng case, 12,500 lang credit limit ko sa Unionbank, pero sinisingil nila ako ng 35,000 (one time payment pa)
hi sir rene, with xvirgo's case? how do we deal with policemen if they come to the house. you said if they are polite, let them in. but is that visit "lawful"? is that visit included in the "duties" of the police? what about the fiscal, is that included in his duties to be used by these lawyers? how can we retaliate in a lawful manner?

One always assumes that he is a policeman or a fiscal, he's not. he's a collector.
ReplyDeletebut if ever, you have the right to refuse entry ( Trespass to Dwelling, a Crime Against Security). If he has no written authority, call for a real police for assistance on "extortion".
If a real policeman, he might have been requested/paid to give you something - a small note to call "fiscal" or "attorney" otherwise....the collector naman is

ill keep everyone poste. because i have another card (metrobank) to deal with. :)

the police that came to our house were really police kasi tinawagan ko ang police station. I was able to talked to the police who received the call from a certain fiscal. i asked him kung kilala nya ang fiscal and aside from that call meron pa bang ibang suporting docs na binigay ang fiscal. sabi nya wala, nakiusap lang daw since under ng jurisdiction nila.
ReplyDeleteSo I asked the police na pwede pala yun, isang tawag lang w/o even asking the identity of the fiscal, kung saan prosecutor's office eh action agad sila. Kaya medyo napahiya ang pulis (buti na lang sa phone ko lang kausap) kasi medyo tumaas ang boses nya, xplain nya na napakiusapan lang daw siya. So sabi ko na hindi naman talaga fiscal yung tumawag, collector lang yun, modus ng ibang collector and nagamit lang sila para takutin ang mga sinisingil niya.
I asked the police na lang na i'll leave my number if ever meron na namang ibang fiscal na tatawag at asked them to visit our house or lokk for me ay tawagan na lang ako at wag na lang puntahan sa bahay.
Nag-agree naman yung police and even told me na kung alam ko talaga na walang case at pananakot lang yon ay hindi raw ako dapat matakot kahit na ilang pulis ang papuntahin sa house. I told him naman na hindi naman ako natatakot, pero syempre nakakahiya kapag ganun ang situation.

You can even tell yung pulis na, "sir, collection agency lang yun, bakit nag papagamit ka?" para matauhan di ba? Pati ba naman pulis niloloko nila? (at bakit naman nag papaloko itong pulis?.. haay..)
If you really have a case;
1. - You should be informed through summons from the court(not subpoena, not warrant of arrest). Given by Sheriff. I actually haven't seen a sample of a summons but it should contain the case number (which you could double check with the court where it is filed. Kasi ako kayang ko gumawa ng case number ex: RD12-345678, pero malay ba natin kung ganyan nga ba ang case number di ba?)the date, time and venue of the hearing, the judge who issued it (i think), banker, tama ba? The thing is you can check this with the court concerned kung totoo o hindi. Kung hindi naman and harrassments lang lahat yan, file a complaint citing bsp circular 454 with the bank, also write to consumeraffairs@bsp.gov.ph detailing the illegal practices (include the collector's name, number, agency and bank they represent). In banker's words "tayo naman mang harrass sa kanila", hehe.
Pag may tumatawag na nga sa akin at tinatanong ko yung info nila bago ako sumagot, di nila sinasabi yung buong pangalan nila, usually Mr. Joseph or Mr. Sanchez, lang ang sinasabi e. Tapos medyo agitated na sila, hehe..
Hi banker, And I hope si banker talaga ang sasagot sa akin, no offense meant sa ibang tumutulong ha. mas kampante lang ako pag si banker talaga sasagot sa akin. I will ask again i have 2 unpaid cc sa hsbc, unpaid means nagkaroon na ng amnesty and nagkapirmahan na, 2 yr-term yong amnesty. In the middle of the first year hindi natuloy ang bayaran and hindi na talaga binayaran ng tuluyan, meaning hindi natupad yong pinirmahan sa amnesty. Question is, pag andon na ako sa Hongkong or singapore makakapag open ba ako ng account sa hsbc doon? Please banker ikaw nalang sagot please. Thanks! -akoparinto.

yung mga sumagot sa iyo in behalf of banker are the ones who are just concerned about your case, baka nangangailangan ng urgent na sagot para na din sa katahimikan ng loob/isip mo.
ikalawa, tumutulong lang sila kay banker kasi di naman to full time na trabaho ni banker. e ikokorek naman ni banker yan for sure kapag may nakita siyang mali.
pasensya na, i just feel for those who are trying to help, tumutulong na nga, e medyo nababalewala pa, e ang sagot naman nila e galing din sa posts dito ni banker.

I understand you're anxiety. Believe me, I've been there. If you wanted banker to personally answer your question, I have no problem with that. I assume that what you need is not the confirmation of the fact, but instead how to be strong and courageous in dealing with it. That I think is what you were asking banker..
However, I feel you should understand that the past due credit card community, originated from the gov.ph forums (search: failure to pay credit card), and nag spill over lang dito sa blogs ni Banker kasi di na yata gumagana yung forums. Aside from the things derek said (thanks ulit,). It is an unwritten rule in the community to help and support one another, among sa mga tumutulong dun ay si mercurio, not a lawyer, rrcamby, guardian_angel, hotelier at marami pang iba. Pero most popular si banker kasi siya ang madalas sumagot dun. Since bago ka, ok lang that you're not aware of it. So if you want banker to be the only one to answer your question, then I strongly suggest that you email him personally. Because if you post your question here, then naturally, anyone from our helpful and supportive community would try and give assistance right away. There is no doubt banker can help us and answer all our questions, no matter how complicated, but the thing is, he doesn't have to be alone, we (the people he had helped and is still helping) pay him back by assisting and comforting others too. So, I just wanted to say, no hard feelings, and I sincerely wish you good luck and God Bless.

You're right. Siguro aside from limiting our outgoing cash (expenses) we should increase din our income. How? Off the top of my head.. 2nd job (yeah right, parang ang daling makakita ng job), part time job, sideline (eload, etc), overtime sa work, sell stuff you dont need, lotto (joke), etc. Or start a small business (extremely risky, and needs capital din). Ano pa ba? Mahirap kumita ng pera ngayong panahon..

ms. hopeful, hayaan mo lang yung calls nila. if you can avoid it, much better. magsasawa rin yang mga collectors/lawyers na yan. sa case ng brother ko almost 1 1/2 years talaga siyang kinukulit at pinupuntahan pa sa bahay ng mga collectors. sinasabi na lang na lumipat na ng bahay. yung napagtatanungan (mother) ang hina-harass nila kasi nagtatago daw sila ng criminal. eh matapang din si mommy kaya sympre sinasagot nya yung mga nanghaharass na collectors. ngayon almost 3 years nang wala nang tumatawag or pumupunta sa bahay. nagsawa rin sila or nalaman nilang hindi na talaga magbabayad yung brother ko. actually pabalik-balik na sa middle east ang brother ko at wala naman siyang nagiging problem sa airport (para dun sa ibang natatakot ipa-hold sila sa airport kung bumalik/umalis ng Pinas) and recently nakakuha pa sya ng NBI clearance (para dun sa mga may fear na hindi makakakuha ng NBI). :)

ReplyDeleteako may demand letter from JAB Credit and Collection Services, affillate of Zialcita law office, ung dumating sa bahay naka open din, should i ignore those demand letters? The letter says that i should call the assigned legal officer. tinawagan mo ba sila nung na received mo ung demand letters?
curious lang ako kung tinatawagan nyo ba yung mga collection agencies/law offices kapag nakaka-received kayo ng mga legal/demand letters?
ReplyDeleteako kasi hindi ko na sila tinatawagan. wala pa naman kasi akong pambayad and besides wala akong balak magbayad with an add on rate of 25% collection fees, etc. nadoble-triple na yung utang ko dahil sa add-on rates nila!

Tapos pinipilit akong magbayad until tomorrow na lang daw dahil yan lang daw yung pwede nilang maibibigay na tulong sa akin...
Sinabihin ba ako na kung hindi daw ako makabayad until tommorrow they gonna file a case na daw on me dahil utang ko kasi more that 150T tapos may bago daw law ngayon from sentral bank na if more 50t na daw yung utang pwede na daw makapagfile ng case..

hi banker! naka-amnesty acount ko sa hsbc.supossedly settled na yun.but i failed to pay the last 6 monthly dues. sa kwenta ko naman, sobra na naibayad ko. but domingo & molaer law offices is demanding that i to settle the original amount plus the interest incurred. every month,atty. molaer has been sending colectors to ur house since last year. dati nahaharang pa ni hubby. but recently, nakausap nila sis ko and they handed her a note demanding me to settle my acount in 4 days. how can i stop these colectors from dropping by the house? my hbby and i agreed to communicate with hsbc once we hav the finances. pero ngayon, gipit talaga kami. can you please telll me how to top muna these collectors from dropping by the house? naiisakanalo na po kasi kami. thank you so much and god bless.

ReplyDeletei just learned today na yong pinapabayaran kong loan wasn't paid on time and there was an issued check.bale date of the cheque issued is Nov. 16 tapos nabayaran Dec 06 na sinabay sa next due date. bale deposited 2x the amount due on dec 6 kase next due date is dec 16. Madedemanda po pa ako ng estafa nito? what could be the repercussion for the delayed payment ng may checque na issued. please enlighten me.Ok, banker's friends' help would also be appreciated pero sana may maririnig din ako from banker hehehe.Thanks so much! -akoparinto.

ReplyDeleteif subsequently covered or honored, what will happen naman is magkagulo na ang succeeding PDCs kasi iba na ang amounts due every month dahil yung nag-bounced( and subsequently redeposited/honored)na check payment will be applied first to penalty,additional interest and ang sobra will be applied to the principal.
what you should do is to cover the deficiencies para the other PDCs' amount will not be disturbed.

ReplyDeleteyeah, inignore ko lang. i mean, i didn't call them. but i did not completely ignore the letters in its stricktest sense. i mean, they are still causing me sleepless nights NOT because i am afraid of the collectors, but because of my financial status in general.
so, its like this:
1. i am not afraid of them collectors. just read this blog. do your research, and you'll know wala talaga silang magagawa sa iyo.
2. i am concerned, because i know kung anong nagawa ko, and i know may magagawa ako para maayos ko ang overall financial condition ko.
so, yun. after those demand letters by the way. the FINAL demand letters, nagpapadala na sila ngayon ng mga letters para sa restructuring ng debts. di ko pa rin sila tinatawagan.

I got my BANKARD credit card last 2003 pa tapos by March 2004 hindi ko na po siya nabayaran
kasi nagkasunod sunod financial problems namin. 2004, nagresign ako sa aking previous job then
got another job by June, plano ko naman talaga silang bayaran that year kaso my mom was diagnosed with cancer tapos naoperahan pa siya, and had to undergo with various treatments like chemo, radiation and etc., lahat ng ginastos namin ay inutang lang namin, tapos hindi pa kami nakaka luwag, last year naman namatay erpats ko. Ngayon pa lang ako nakakahinga ng konti sa mga utang ko na hinuhulugan ko for the past years.
Tapos last NOV 2007, nagpadala nga ng demand letter yung MOLAER law firm asking me to pay yung utang
ko sa BANKARD, yung OUTSTANDING BALANCE ko with BANKARD is around 24K daw, tapos naging 30K+
kasama yung mga attorney's fees. Ang problema wala naman akong ibabayad kasi pinapabayaran nila lahat, at isa pa may mga previous pa akong utang na binabayaran pa.
The second letter naman was demanding me to pay the full price after 5 days and the last letter nga is may naka attach na affidavit na parang yun yung finile nila sa RTC.
Ang problema ko kasi, yung ermats ko yung nakakausap nila sa bahay namin sa probinsya kasi dito ako sa Manila nag wowork. Lagi ako tinetext ng nanay ko na may tumatawag daw sa akin, tapos fifile-an daw ako ng kaso,
lagi nya akong napapagalitan at sinasabihan na asikasuhin ko daw at baka daw siya ay mamatay sa nerbyos.
Hindi ko pa kinokontak yung firm kasi, ano ang sasabihin ko? Kahit magbigay sila ng payment terms hindi ko naman mababayaran lahat sa madaling panahon.
May nabasa ako dun sa mga posts dito sa blog na ang pinaka first step ay humingi ako ng Statement of Accounts nung utang ko then from there dun ako makakapag decide ng next kong gagawin. Pano po ako makakaobtain nun?

As of now meron po akong defaulted cc sa hsbc. Nag-resign po kc ako sa work ko last april 2007 kc na-diagnosed po ako na meron akong PTB,so i have to leave our registered address para magpahinga sa province. So to cut-the story, nawalan ako ng work kya di ako nakapagbayad ng obligation ko sa cc. ung dati kong utang na almost 15K lng umabot na ng almost 100K according to my sister na nakakatanggap ng mga demand letters pra sakin. pero prior to the resignation i informed the collecting agency na nag-follow-up sakin na mag-re2sign ako due to my medical condition. Ngayon po medyo nakak-recover na po ako sa sakit and nagkaroon ako ng bagong work d2 sa province since favorable po ung sakin pra sa health condition ko. Ang problema ko po kc nag-apply po ako ng NBI clearance, pero na-classify po ung pangalan ko sa "HIT" ng NBI.Pinapa-follow-up po ako sa mar 10 for verification po. Ang kinakatakot ko po kc is baka may naisampa ng kaso laban sakin ung CC company, pero according sa sister ko wla nmn daw dumadating na subpeona or any summons or any claim na may demanda na sakin. I am so worried kc bka dahil d2 maging grounds un para matanggal ako sa trabaho..lalo akong mawalan ng pag-asa na mbayaran ko ung utang ko. Please help me po, am-enlighten po ako.

2. also, utang is a civil case,"hits" are criminal cases
3.EVEN if you have a negative CI, it is fully explainable and any reasonable employer can understand it.

ReplyDeleteDati ang diskarte ko pag alam ko na sila yung tatawag, sinasabi ko wla, umalis, leave, etc. Pero may time na pinapunta na nila yung isang tao dito sa office namin, shempre napilitan ako na harapin at makipagsettle! Pahiyang pahiya ba ako sa sarili ko kasi naman feeling ko para na akong kriminal.
Yung mga agent nila, walang pakisama, tinatapat ko na nga sila na wala akong pambayad, sabi ba naman naisip ko daw ba yun nung kinakaskas ko yung credit card ko?! Shempre nasaktan ego ko dun, pero ano magagawa ko wala talaga ako pambayad.
Nung nakaluwag ako nagstart ako ng amnesty sa kanila, malapit na ako maka-1 year pero now, nagipit na ako at di na ako nakakabayad ng 2 months. Ayan, tawag na naman sila ng tawag at pinagtataguan ko na nga ulit kasi nga nung iexplain ko na wala akong pera eh nagalet na naman.. worry ko eh baka puntahan na naman ako at baka pag pinagtaguan ko sila eh ipahiya nila ako sa company namin..

1. if they visit you acting "AS IF" ask for their credentials - ID, authority from the collection agency, bank arrangement. pag-wala - call for police assistance - extortion yan!
2. once you get the details, write a complaint DIRECT to the bank president, cc:consumeraffairs@bsp.gov.ph

ReplyDeleteit's as simple as this: tinutuloy ko ang daily routine ko. sa tulong ni sir rene at sa ibang nagpost dito na nagshare sa kanilang experience, wala nang bumabagabag sa akin. anyways, i'm still finding a way para mabayaran paunti-unti ang utang ko pero sa ngayon all i can say is "sorry wala pa talaga akong pambayad" at pag nagbayad ako wala na rin akong pangkain at pambayad ng upa sa bahay.
so, kung minamadali ako ng mga collection agency na yan "pasensiyahan na dahil wala pa talaga". i have to go on with my life dahil hindi na ako apektado. kung mangungulit talaga sila...DEADMA..
sa ngayon hanggang sa email sila mangungulit dahil hindi ko binigay ang bagong number ko..hehehe

Hi to all most especially to banker who has been of great help to us. For years i had really been suffering sleepless nights thinking about my credit card debts. Couldn't even put a smile on my face and most often tulala kasi i didnt really know what to do with my situation. Ang dami ko rin kasing CC which nahihirapan na akong bayaran but when i found this blog, hayun i have the idea now on how to face or handle these collectors. Before i was so ashamed to tell anyone here in the office about my situation kasi nga im handling a managerial position din. But now, im no longer ashamed to tell my staff and even inform them ahead not to be surprised if there would be a lot of collectors from different CC companies who would be looking for me.

ReplyDeleteim having the same..problem .. ang difference lang is.. its a telephone bill that i am ignoring to pay..for a year.... later ko na lang nalaman when i received a letter from a collection firm.. that my debt sa telephone company... tumaas siya ... im confused paano gagawin ko.... makakasuhan din kaya ako ng defrauding the creditor.... im in the same location/house ....ang laki ng talaga ng babayaran ko.... ano po ba maganda ninyong maipapayo.. thanks.....

ricomambo, how big is BIG. so far, wala akong naririnig about sum of money cases for telephone. the reason kasi is - they can cut it off naman right away when certain limits are reached.

hello Banker, hello everyone. I received a Notice of Hearing from MeTC Makati. I called dem and was answered by someone and irritably said, "marami kaming nare received na calls dito na nagve verify nang case no. tungkol din sa credit card. malalaki ho ang sulat ng civil case no. namin." then i said, the civil case no. in the letter i got is typewritten. then she said "ay wala ho yan, me branch no. na ba yan?" then i said yes. She then told me to call the branch. So i did. The woman i talked to said "totoo ho yan, puntahan niyo na lang dito at hanapin yung lawyer niyo si atty olivia. baka ho kasi mahila na ng bangko mga gamit niyo. puntahan niyo na ngayon baka sakali maagapan".

what's the consequence of not attending the hearing? if i attend it naman, i'm afraid that they might ask me to sign something that would incriminate me. what do you advise i do?

ReplyDeleteif you will not/ can not attend the hearing, that means you are waiving your rights to be heard of your side of the issue.
on the second thought, what is there to dispute? talaga naman may utang tayo? The judge will then decide " You Pay" ( but of course!). yun lang,
He usually reduces those excessive charges nila (mabait si Judge kasi)
if i don't attend, will i be issued a warrant of arrest? and will the judge readily pass judgement to attach properties that can be attached?

refer to Sec. 13 Rule 39 of the Rules of Court and check what they cant get from you - family home, salary, your bed, your dining table etc.

I was thinking, this is just another ploy of the collection agency to get us to pay. baka meron lang silang tao inside metc that tells everyone that inquires na totoo yung case para mapilitan kami pumunta at makipag ayos sa kanila. what do you think mr. banker?
it is the sheriff who will do the job AFTER a court decision. just check Rule 39 of the Rules of Court for the process.

My experience with scum of the earth collectors led me one time to say this to one from an HSBC collection agency who i started to talk with in a good manner but once he said to me " di ka ba nahihiya sa utang mo?" i told him "alam mo sa katulad naming mga may cards, di kami tinatamaan sa mga sinasabi ng mga katulad mo na walang pinag-aralan, di tinuruan ng magulang, inutil, bobo. Di ako nanood ng telenovela na katulad mo so i don't understand yang mga pa-drama drama mo at sinasabi mong hiya-hiya! I can pay my card anytime, but since bastos ang sumingil sa akin before, wag na! ang cheap mo at bastos ka sa babae, ikaw ang sasampahan ko ng kaso ng harassment ng babae, kung kaya mo asawo mo ako hindi! Bumalik ka na jan sa trabaho mong walang kuenta at jan sa mga ka-opisina mong walang kuenta, maghirap kayo magrtrabaho ha!"
the funny thing is he texted me na nilait lait ko daw pagkatao nya, haha! that's for all the people they harrassed & continue to harrass! So i texted him that "The collector is considered the lowest form of life even in the bible, same as prostitutes and murderers"!
He never texted nor called me after that.
I have a question Mr.Banker, if another CA comes to my home, can i show him our guns? Is that a crime to do so or to even tell him on the phone that if he wants, he can talk to my Glock (gun)? Do they record our conversations with them?
I'm truly serious since this new style of this CA from another bank started corresponding directly to a relative who has no obligations naman to my cc.What case/complaint can i file against this CA who is trying to get money from my relative? Is this considered "extortion?" And if he does not stop, will it be held against me if i threaten them over the phone & get someone to threaten them ? Also can i file charges directly against the bank for allowing this to happen & colluding with these CAs in trying to extort money from a non-client such as my relative?
I want your opinion on a good diskarte so i can also harrass back & frighten this scumbag out of his wits. I hardly sleep so i can call their cell using a different sim. What do you think honestly? I also think that these people should be on the "hit list" of all militant groups in the Philippines, as this will teach them to treat their fellow pinoys better, and it'll put them in the same place as they have put all cc victims.
I'm serious about making serious steps to stop & teach these sub-human collectors a lesson! I also want to know a good diskarte how i can get their own personal information such as home address & home phone numbers and even post notices of their faces publicly, like common criminals.
I do not feel a moral obligation to pay these CCs if i already gave them hundreds of thousands of pesos previously, only to be treated like this after a couple of missed payments. They have already gotten so much profit from interests alone. The Phils has one of the highest interest rates in credit & borrowing! Even the U.S. has cheaper rates than us, only 6% i think compared to our 20%! This is just a form oppression from Big Corporations/Banks who do not fully inform their clients the consequences of getting a credit card. i mean who can even read the microscopic prints on the agreement forms? These cards should have warning labels like they do now in cigarette packs.
Sorry, lastly with a bank that i find ok & has not harrassed me for non-payment since i pay them some minimum monthly fee, should i call them re a settlement if i want to keep my savings account with them? I don't want them to freeze my savings, do you think they will? Unfortunately their bank has the most ATMs & debit services in Manila so i do want to keep banking with them, your opinion would be most valuable.
Again your blog is the most helpful thing a Pinoy has ever done yet...you're a hero. Even if you never step in a church again, you will surely, undoubtedly go to Heaven!! Thanks to all the other contributors who also give advice, good karma to you guys as well!! All opinions on my comment will be highly appreciated.

2.Demanding payment from your relatives? that is extortion. yes, you can have him arrested. Puede din thru an NBI entrapment operations.
3.The CC staff are care-less although the intelligently challenged ones are really the collectors. "goons". dont stoop to their level or take them seriously.
With that alone, you already have won half your battle.like:
"do you know saan ang asawa mo, habang nangongolekta ka sa akin?"

so i decided to change the number. it only took 24 hours for this application. i didnt realize na a voice recording would say "this number has been changed blah, blah"
am i guilty na po ng ra 8484? please reply soon. do i have to call the bank that i owe for the new number i have? or what can you advise me please?

hi.pls help. tumawag sa akin yung Domingo & Molaer pinipilit ako magpirma ng arrangement na 8k every month. last January 30, may promo dw HSBC bayad daw ako ng 8k then ipadala nila clearance. pero 3k lang naibayad ko..ngayon ifile na daw nila case kc di dw ako nagpayag ng arrangement. told them even w/o arrangement, magbayad ko monthly. ang problem lang is yung previous na naghawak, nagbigay ko ng 30 PDC's. nag good yung 19 checks, but unfortunately yung 11 checks nag bounce...pero every month naman nagbabayad ako ng minimum 3k a month. ok lang ba to?pls help...or panakot lang nila to?

Ang name ng agent ay ARISTOTLE JIMENEZ (bka po me tumawag n din sa inyo n ganito ang name) regarding daw sa hsbc credit card ko. Matagal ko na po kasing di ito nabayaran dahil sa mga naging problema ko financially. According to him meron daw promo ngayon at pwd daw iwaive ung utang ko na umabot na daw ng 100k+. i had a bad bad experience yesterday. i haven't paid my monthly dues which was converted to easy payment dahil sa hirap ng buhay. i was shocked that may pumunta na pulis sa bahay and may warrant of arrest pero di naman ako nakatangap ng any demand letter or subpoena. ano pa pwede kung gawin? tinawagan kung yung # na iniwan nila and naka usap ko yung abogado nila i was shocked kasi yung utang ko mga 20k na lang umaabot sya ng 88k. what can i do bah? i can't sleep and scared to death.

As much as possible I don't want to go to court even though the chances of them filing a case against me is very slim. good day! nakareceived me ng summon from metropolitan trial court makati,dinala nila here sa bahay, then naka pirma lng ung clerk , then yung summon nakalagay DADU AND ASSOCIATES lawa office yun ng BPI, then sabi answwer me in 10days,pag ganun po ba at di reply ng 10days saka sila mag decide kung ano gagawin sa case ko, kasi wla naman nakalagay na date ng hearing wla din judge pero may case number, sna ma help moko pano kung di ako mag attend if evr, na stress me bigla pano kung gusto ko makipag settle kasi for now di ko kaya mag pay wla akong work, hirap pa ako, sino ba dpt tawagn , yung bank or ung law office? kasi nasa court,thanks god bless hope matulungan mo ako

hi banker, this is rocky88, got the same case din with my credit cards...i recvd letter from citibank and they told me na after months of calling/negotiating and sending me demand letter with regards to my accounts w/c until now remains unsettled, that's why they come up with the decision to finally file the case against me for CIVIL complaint and will be served to our ofc...Now my concern is, will they really file the case against me my obligations is now 150k with ctbnk which i cannot pay due to due to my financial status and they also give me an option to settle it in a deffered payment with 6k per month for 2yrs. but my problem is im really down and broke so what will i do, pls. help me....hope to hear from you im having headache and sleepless nights. Pero kahapon nman po (05/04/11) may brgy n ngpunta sa bahay, since ns work aq, nagiwan ng # n dapat q dw twagan tungkol daw s warrant ko. Anu po kayang warrant yun? Anyway, ngprint po aq ng Article 14-93, if in case bumalik yun brgy s amin, sabi ko s ksama q s bahay, ipbasa mo lang yan, kun di nya naintindihan dapat n sya mgresign as brgy tanghod este tanod. hehe! Anyway banker, pwede po bang malamn cp# nyo? Kasi po minsan pag may collector n pmupunta d2 smin, d q p rn po maiwasan nerbyosin, d namn po kasi tlaga aq sanay makipagusap s mga ganung tao. ReplyDeleteMy father is working here in Qatar before and unfortunately her sponsor business permit is been canceled and all the visa he issue is been cancel also,and my father is sent to the deportation for a month just to be deported.but he just have this debt with standard char.bank amounting to 7000 Q.riyal.but now he cannot pay because he don't have any source of income to pay.and currently he is ill and suffering in a traumatic experience being held in deportation for a month,because is not joke for a 58yrs old man who suffering in high blood pressure to be lock up.
just this morning a receive a call from their agent asking me to pay the monthly due of 580 Q.riyal but i told her that i cannot afford to pay this amount due to my current salary and that my salary is enough to cover my family needs and that my wife will soon undergo in delivering our son, my question is do i have any responsibilities in this credit card just because we are related and can i disregard their call because they are asking me for the information of my father were about,but with my father recent situation i cannot afford to give her this problem because this might worsen her health.]

the debt is fully paid.
dont worry, the prison in Qatar is what we call "pension house" here.

Sir,can the bank or the collector forces me to pay my fathers debt and can i ignore all their call and can they do some legal action against me if i will not cooperate with them because i don't what to turn my father were about coz i know that they will harass him and that they will used all their dirty tactics against him..

ReplyDeleteask kolang po kung ano po gagawin ko kasi po my nahiram po kami sa kapitbahay namin ng 2k eh nagkaproblema po kami sapera kaya hindi ko sya nabayaran hinaharass po kami lagi sa text o kahit personal kung hindi daw kami makakabayad kinabukasan papabarangay daw po nya kami.
