Dear Sir,
Today I received a letter from our friend that says about RA 8484. For me to understand what is it all about, I read and read and learned that it talked about :
a. credit card that is counterfeit, fictitious, altered, or forged;
b. access device that is stolen, lost, expired, revoked, canceled,
suspended, or obtained with intent to defraud;
c. access device that was applied for or issued on account of the
use of falsified document, false information, fictitious identities
and addresses, or any form of false pretense or misrepresentation;
I pondered and said to myself - indeed these are really against the law.
But wait, a certain clause caught my attention :
"A cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application ...... shall be prima facie presumed to have used his credit card with intent to defraud."
Hmmmm....When I applied for a credit card, and until now, I am still staying in the same residence as indicated in my application form, although I have now lost my job.
Did I abandoned my residence or employment?
Did I left surreptitiously these addresses?
I looked up for that meaning and found out it means "secretly", like a thief leaving your house.
The letter said I could be charged, if evidence warrants.
I am holding their letter, therefore I can be found! They are right - there is no evidence to the contrary.
Thank God. It is Friday the 14th, a day before and I'd be damned.

Hay salamat sa walang sawa mong supporta banker, marami kming natutulangan mo, understanding what this collection agencies are threating us especially with RA8484 thing...btw the lawyers who are with this collection agencies, pasado ba sila sa board? or wala silang kaso na hinahawakan like the usual lawyers have? I mean talagang nananakot na lang ba sila? Meron bang clause to quote to them stating that what they are doing can revoke their license or we as victims of their actions can sue them since everything that they are doing purely threat just to have their commission?

I do have a friend whose CC is not yet paid and left for US and he didn't inform the CC company. and the collection agency is keep on calling the landline that is stated in the application form, although they informed already the agency that my friend already left for the US. If ever she decide to come back to the philippines, does she will have a civil case if incase the CC company will pursue a lawsuit? thanks in advance

ReplyDeletegive them the benefit of the doubt. hehehe......sum of money cases are really the simplest case. even a law student can win it. reason : the complaint is " you owe them money" so the judge will simply decide " you pay!" of course! pag-natalo ka pa dyan, ah... ewan..

ReplyDeletesorry, di ko po kasi nabasa kung nasagot nyo yung tanong na kapag lumipat ka na ng tirahan at hindi ka na makontak sa dati mong contact info...does it mean na pwede ka nilang kasuhan ng RA8484.
paano po kung let's say, you tried to contact the credt card companies to provide your new contact info like new add & tel #, but they never entertaind you since they already forwarded your acct w/ these stupid collection agencies, of course ayaw mo naman makipag deal sa mga ito...so there's no chance for you to update your contact info...kaso po ba ito sa ra8484?
ganito kasi ang case ko, lumipat na ako ng tirahan pero sige pa rin ang pagkontak nila sa akin sa old add ko....pulis pa nga daw ang tumawag at nananakot pa nga daw sila na may warrant of arrest na ako & they will get all my sister's things dahil yun daw ang dineclare ko...e wala namang katotohanan yun dahil wala akong dinedeclare na ganon!

Re: RA 8484
note the words "abandon" and "surreptitiously". are these words applicable to you? for both your office AND home?
I can cite 100 legal reasons why RA 8484 does not apply to you but for your own sake :
inform them of your address via registered mail with return card/ receipt.
will that serve your purpose now? enjoy your life. dont let them spoil it. :-)

ReplyDeletehow about in the case of cash loans where you signed post dated checks for them? is this a different case? i am still paying my citisavings loan. but in case there are readers who are in a situation where they cannot pay, and the case is that post dated checks were issued, is this a different case than credit cards?

BP 22 has been decriminalized,just attend when called by the court.that's the only requirement.

ReplyDeletethese are all credit availments thru different medium, covered by same documents ( contracts, loan
agreements, Promissory Notes etc.)and modes ( clean or secured or with collateral basis )
failure to pay means a violation of these agreements and one recourse is to foreclose your collateral if meron, file a BP 22 case if w/PDCs,
or simply file a "sum of money" complaint if on clean basis.

What's Not Allowed
There are a number of debt-collection practices prohibited by law. They include:
Harassment and abuse:
• The use or threats or violence;
• The use of obscene or profane language;
• The publication of a list of consumers who allegedly refuse to pay debts, except to a consumer reporting agency or others with a legitimate need to know;
• The advertisement for sale of any debt to coerce payment of the debt;
• Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number;
• The placement of telephone calls without meaningful disclosure of the caller's identity.
False or misleading representations. Debt collectors may not:
• Falsely imply that they are attorneys or government representatives;
• Falsely imply that you have committed a crime;
• Falsely represent that they operate or work for a credit bureau;
• Misrepresent the amount of your debt;
• Indicate that papers being sent to you are legal forms when they are not; or indicate that papers being sent to you are not legal forms when they are;
• Claim that you will be arrested if you do not pay your debt;
• Say that they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
• Claims that actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
• Give false credit information about you to anyone, including a credit bureau;
• Send you anything that looks like an official document from a court or government agency when it is not; or
• Use a false name.
Unfair practices. Collectors may not:
• Collect any amount greater than you owe, unless your state law permits a special charge for such collections;
• Deposit a post-dated check prematurely;
• Use deception to make you accept collect calls or pay for telegrams;
• Take or threaten to take your property unless this can be done legally; or
• Contact you by postcard

Here is my situation banker, kasi recently tinawagan na naman ako ng DM law office sa Equitable credit card ko at humihingi sila ng payment. I asked them kung bakit sila humihingi ng payment when I have already received a billing statement from the bank at nakasaad doon na zero balance na ang cc ko. Although naka state doon na transferred na sa collecting agency ang account ko. At the time na nareceive ko ang billing statement from the bank ibang agency pa ang naghandle ng account ko. My question is "if" magbabayad ako saan pupunta ang payment ko. and "IF" hindi, may habol pa ba ang banko sa akin kasi pinadalhan na nila ako nga statement na zero balance na ako.

ReplyDeletethanks for the post on debt collection practices not allowed, however, this is not applicable in the Phils., it is in US , they have the Fair Debt Collection Practices Act. I hope Congress will pass a bill on this to protect us. However, i have read in one of the posts here, that we have BSP circulars as mentioned by Sir Banker.

I have been paying faithfully for about 9 years until lately that I become delinquent. The collecting agency says that the bank can only retrieve up to 3 years, should I ask for my SOA from the start?

China Trust loan is a clean loan, while RA8484 is for CREDIT CARD FRAUDS. would you believe that lawyer?

Good pm. I had never missed paying my cc bills. However, just 2 weeks ago, meron ako di nabayaran as my dad passed away and marami akong inayos. The credit card company asked me 2 settle double the amount of my minimum payment as she said payment "for two months". Why is this so? Tama ba na magdemand cla ng 2 months payment because of my 2 weeks delay? I just paid my bill 2day pro pay ko lang is php500 more of my minimum payment. I tried inquiring of my credit balance pro ang reply ng machine 0.00 available. anu yun not accessible for the meantime ba credit line ko or they have permanently banned na me of using my card? Thanks po.

hi banker. etp situation ko last year napagpirma ako ng collecting agency ng bank ng parang promissory note na magbabayad ako ng 9k tapos 3.5k a month na hanggang maubos balance kaso hindi ko na nabayaran kahit yong initial payment na hinihingi nila na 5k. and nakapirma talaga ako. ano na mangyayari? it's been a year since pumirma ako and hindi ko na alam ano nangyari. Now, makakasuhan ba ako dahil sa pirma ko? would it affect if need kumuha ng nbi clearance? pls advise. Thanks. ---akoto!
ReplyDeletehi banker paano pag naka-amnesty program ka na sa citibank? may contract na kaayo and have been paying for few months tapos biglang pinutol ang pagbabayad. makakasuhan po ba ng breach of contract? magkakaron ng record sa nbi? nagppursue ba talaga ng case pag ganito? 4 years ang term at 800 ang monthly dalawang cards po yon tapos after a few months tinigil ang payment. pls shed light. thanks!

try to ask a certified Statement of Account. without that, what utang are they talking about?

Sec. 1152 is about prescription period for filing a case and not breach of contract.
kung mag-file sila, matagal na dapat. what are they waiting for? most probably, they cant.
cc scared: tinatakot ka lang nung mga credit card personnel/ collection/law firms. ang mas mabuti mong gawin, backread mo lahat ng posts (blog chapters) dito ni banker at ng ibang taong nag-share ng experiences nila. by doing this, marami ka nang malalaman at hindi ka na matatakot sa mga tumatawag sa'yo. remember knowledge is power.

We still continue the convenience of swiping, purchasing e-ticket etc... this time through our DEBIT CARD. (i.e. UBP e-Wallet) debited to our BANK ACCOUNT, wala pang INTEREST. kaya ko po naitanong ay dahil may tumawag po sa akin from a collection company at sinabing magsasampa na sila ng kaso laban sa akin kung h indi ko pa masesettle ang utang ko...sabi ko imposible yun dahil ako lang ang nagtatrabaho sa family ko at siyempre dapat unahin ko muna ang pangagailangan namin dahil nga po nagresign ang husband ko bec of health reason....sabi niya kailangan daw akong mag-appear sa court...so sabi ko, hind ako naniniwala hanggang wala akong notice or subphoena na natatanggap...then sabi nitong matabil na lalaki fr the collection company na may matatanggap na daw ako anytime soon...so sabi ko hihintayin ko po..sabi naman nya, baka makulong daw ako...e sabi ko hindi naman ako nagnakaw o pumatay para ikulong...may katotohanan po ba ang mga sinasabi nya? medyo ninerbiyos kasi ako sa mga terms na binitawan nya eh...thanks po in advance

However, if you want to save P3,000 monthly instead :
P 5,000.00 - P 3,000.00 =P 2,000.00 expense ceiling mo ito PROVIDED it is realistic enough.
Your BEV therefore is P 2,000.00. in excess of that would be your savings.( contribution margin)

ReplyDeleteMy Father died last June of 2007 and left us with unpaid credit card bills.
A week after his burial i asked my mom and my two siblings to send a copy of his death certificate to these banks
( citibank, hsbc and charter ) so they will be informed of the new situation. --we will try our best to settle all that but it makes me wonder...
in cases like this when the credit card holder dies...are we really obliged to pay these debts??
we will pay them if we have to but i feel that we're being harassed already with all these letters containning forms to seize all my father's assets.
I dont think they understand that my father's dead already and keep sending us letters to his name.
Citibank i give them props for being so nice...they communicated with us and now we signed a contract allowing us to pay the said debt for 2 years with minimal interest.
the problem now with HSBC and Charter is that..despite all our efforts to inform them that we
have infact sent their main office a copy of my father's death certificate the credit amounted already to 90k from 60k and continue sending us these letters with legal action to seize everything.
-- i think it's from the lawfirm that is tasked to collect from us.
it's from MOLAER , LAXA lawfirm...yeah we received two letters from two different collecting agencies telling us consider this as last warning.
We tried to call their office coz we're surprised but everytime we do they'd tell us that it's just the secretary that is left and the attorney is out of town or something.
I sent them an email once or twice but until now it's left unanswered.
the thing about Charter..the one with the smallest amount of debt 25000 php...
my sister recieved an email from this collection agency with this form she needs to sign imposing an 8% interest every month. --she didnt sign it yet.
I thought that was absurd..if Citibank gave us two years to pay that 70k...why cant they do the same?? i mean...we do not intend to ignore these responsibilities...
we will pay them if we have to but we need a a monthly paying scheme...
where do we stand on this matter?
how do we know that the letters they sent as are legal?
i hope you could help me on this...

I am very much interested to know if the principal cardholder died, will his children have to settle his unpaid accounts? In like manner, must the owner of the extension card pay the bills incurred by the principal cardholder?

did the cardholder took out a creditor's life insurance? that would settle the debt upon death.
as to the co-maker,they are jointly and severally liable, like a husband and wife, subject to other conditions which are maybe unknown to me.

They also sent us letters saying that they have already made an ocular inspection of our house pero wala nmn silang ginawang inspection and they also sent us numerous final demands pero up to now wala pa ring mangyari sa mga demands nila. Relax and don't worry. Wag mo silang intindihin, mga sira ulo nun.

1.husband and wife
2.principal and co-obligor or co-maker and/or surety
3.insurance ( contingent liabilities)
that is IF they really want to run after them.
Worrying is normal. when it becomes excessive, it is called Paranoia.^-^
These are pro-forma letters being sent and we have pro-forma letter-replies here. but writing them back normally does not illicit replies from them, would you believe?
on what do to, you may go to " Utang - What I'll Do?" chapter.
One of the legal remedies for debt collection against a dead person is to file a claim on his property i.e. real estate but only up to the amount of debt. that is again another "if" they do. tedious.....

these are jointly liable for debts:

1st thing we did as soon as after the libing was to give them copies of my father's death certificate.
--to our surprise we begin receiving letters warnings...and the amount that was just previosly close to 70,000 php now amounted to to almost 100,000 ( interest and attorney fees )--this is what we want to clear with them it seems they dont understand that my father is dead and we in fact informed them. and magulo sila one time we are receiving letters from this collection agency and then all of a sudden iba na.
Charter--- this is suppose to be the one that has the least amount of debt...25, 000 now 30 ( like they claim my father is neglecting hsi obligations)...if i wanted to i could have settled it but i know something is not right about it...wala kaming na receive na SOA ( only the letter they sent us telling us the amount we need to pay)...plus they want to impose an 8% interest...but my sister didnt sign the contract something wasnt right about it.
eto po sana gusto namin i clear sa kanilang dalawa.. but the problem here is that kung gano sila kasipag mag send ng final warning letters ganun din sila ka TAMAD mag reply. --why put their email address sa papers kung di naman din sila sasagot?
well, this is before we found out that we are not liable to these debts. should we worry about this that wala na yata kaming na receive na letters? we gave them our contact numbers but di naman tumtawag.

Banker, as much as we want to stop worrying and being paranoids cno po bang hindi kung maka receive ka ng mga letters with court letters of some sort. hehehe
like i said, we will try to pay them if we have tyo but kung hindi naman talaga kami liable ( my mom and my two siblings) ...we can keep the money for our future, diba? or pang party to thank you for helping us. lolz
i will definitely keep in touch and i was wondering if they decided to threaten/ harass us again...could we ask you to deal with them and whooopp their asses? :) or maybe i should ask na rin for pro-forma letter-replies you were saying. I want peace of mind...my dad's passed and now we're dealing with these collection agencies.

anyway, i was wondering if i could ask advice from you how to handle well these collection agencies who despite our efforts from the beginning since july 2007 faxing them my father's death certificate, calling and emailing to inform them of the new situation, we still receieved a new FINAL DEMAND LETTER (bold and in red) just now from another law office in davao the EDC LAW ( europa dacanay, cubelo europa and flores law office.
it's annoying already considering it's the 3rd collection agency ( why cant they just stick to one?)
we're still grieving up until now and it doesnt help when something like this knocks on our door. Im hoping you could help me put an end to these letters.
--i wanted to call them now but i lost my voice and probably a written letter or an email is something concrete.

I have the same story as all of you, I wasnt able to pay because I was out of a job, I tried countless of times to make an amicable settlement on my 25000 pesos Citibank CC debt. But after those vultures (Collection agencies) got hold of my account e alam nyo na ang sumunod.. naging 100K na ang utang ko! May tumawag pa nga na Girlfriend ko daw siya! Wow, and to think that the one who answered the call was my wife!

My mom and sis tried contacting Citibank again and tried to pay my original debt of 25000 cash, pero pinagtuturo lang sila kung san sang collection agency. So finally they gave up.
Just last month, my developer emailed me that they found details of adverse findings against me sa MTC Branch 44, Pasay City Sum of money case dated Jan 20, 1995. And to think that I was still in college and have no Credit Card at that time!
Can anyone advise me on what my next step should be?

2. the developer is NOT in the business of lending, unless in-house financing yan. this is the first time I heard of developers doing that. LOL!
3. even if you have adverse CI, turn around lang naman yan sa Pag-ibig, which is not interested in CIs. Against your home and benefits ang loans, so fully secured yan.
BTW, I am also into real estate.

The only reason stopping us from doing it is because these CC companies are the ones preventing us from doing it. good day! i appreciate this site kasi nakakarelate ako sa mga experience nila and at same time nagkakaroon ako ng idea sa pwede gawin ng mga collection firm, ask ko lang po kung ang bank loan na ginawa eh sa ibang bansa, then hindi nakapaghulog possible ba na magkaroon ng kaso here in philippines and for three years hindi nag padala yun bangko ng any notice basta na lang sumulpot itong mga taga collection firm.

ReplyDeletegaya ng iba may utang din akong hindi nabayaran sa HSBC siguro mga 5 months na.ang ginawa ko di ko na sinabi ang bagong cel number ko at sinabi ko na wala akong celfone para walng hassle pero sa email na lang ako nakikipagcommunicate.sinabi ko nong nagemail ako na magbabayad talaga ako pag may pambayad pero sa ngayon wala pa talaga.sinabi ko rin na ginagawa ko ang lahat para makahanap ng pera pero di pa talaga ako nakahanap ng pambayad.kung magbabayad ako ng credit card ako naman ang wala nang makain at di nako makapagbayad ng upa sa bahay.

if you transferred residence, it is not within RA8484.Iba yung "with intention to defraud" meaning during application, you put a "pseudo-address" then lumipat ka secretly... they can still contact you naman. daming ways.

May I ask, my sister issued post-dated checks to a lending company, now di na nya kaya bayaran, being a single-mom na. what will happen? at kung i-demanda sya gano katagal bago ma-process na ma-i-file ang demanda? at kung magreflect daw ba sa nbi records nya yun? ReplyDeleteif the utang is covered by PDCs,the lender may file a civil complaint plus violation of BP 22. just attend when called by the court. you will have conference with the lender for further compromise on amount you can afford to pay regularly. since BP 22 cases have been decriminalize, it wont reflect on NBI records.

ReplyDeleteBP 22 is the bouncing check law. BUT, dont worry. just attend when the court invites you to attend. no need for a lawyer.
if you have no money, that's alright. tell that to the court. it will understand naman.
but if she will not attend despite the invitation, she will be "forced" to attend for her own benefit. the court wants to hear her side of the story.
lastly, you are not alone. even our country is in deep s##t. hehehe...

In reference, to the PDCs issued & asked to appear in court. Will it be a formal letter or "SUBPOENA" that will be received? How will i know it is an authenticated documented?

Hi, banker. mcsmnt here. I got married last quarter of 2006. it took me a while to change name and adddress. i'm almost done with the legal id's and documents. been so busy, being a working wife and all. now i need to inform the credit card company that i changed my residence address. but i do still work in the same company and they do still call me and talk to me there. there are times they send letters there. though i noticed parang walang since before i got married. i do have an intention to inform them. but first i don't know how. i tried to call once (since i have a free phone time during office hours) but they said my account does not exist daw. so i decided to wait for their call if i'm still not able to contact any of them anytime soon since i know they will call me naman. they even have my cellphone number and they do call me there.

Banker, me tanong ako regarding sa change ng residence.ever since kasi ang billing address ko is sa work.when i transfered ng assignment, nagpachange billing adress ako, but ang residence address ko is hindi ko pinalitan.Nagresign ako from work due to health problems and hindi ko na napalitan ang billing address ko. Umuwi na rin ako sa province so wal;a na ako sa residence address ko. Pero natatanggap pa rin ng pinsan ko ang mga bills ko. When I apply for a credit card, an agent told me na i-address na lang sa relative ko na me landline phone para daw pag nag-CI eh approve agad ako. So I follow the agent's advice, I used my sister's address as my residence address sa CC ko. Tapos ibinilin pa nila na pag me tumawag raw na mag-CI eh sabihan ko mga kasambahay don na doon talaga ako nakatira. Pero nde naman talaga ako don nakatira. So na-approve ang CC ko. Ang billing address eh dito sa employer ko so lahat ng billing statement eh dito bumabagsak. Almost 6 months na ako nde nakakabyad ng mga CC bills ko. Wala akong nare-receive na demand letters cguro kase dahil nde ako kilala sa area na yon n doon nakatira. Nde naman kasisado ng mga kapitbahay nina ate ang married name ko. Tapos nagpalit na rin ng phone number ang sister ko. Ang tanong ko eh reliable ba ako sa RA8484 or defrauding kase ginamit ko ang address ng sis ko na nde naman talaga ako nakatira. Pero nde naman ako umaalis sa current employer ko, ito pa rin ang billing address ko. Me grounds n ba cla to file a civil/criminal case sa akin? Pls. advise po. Thanks!

why not try to rectify the "error" by filing an information that your present address is xxxxx " in accordance with your Card Agreement"?
I can't remember the name of the agent who advice to use my sister's address in the application?

ReplyDeleteYung asawa ko po ay na isuehan ng wrant of arrest ng isang lending firm dahil daw po sa hindi pagbabayad, ang petsa po sa warrant ay April 18,2008. Pero yung mga resibo po na hawak ng misis ko ay nagpapakita na nagbayad pa sya nung April 19, 2008 sa collector nung lending firm. Head office naman, thought they were not paying so they filed a BP 22 Case. Since sa province sila, hinde sila naka-attend, so may warrant if you fail to attend (remember?)

if a case has been filed against you for "Sum of Money" and you fail to attend, it means you waive your rights to be heard about your side of the issue and judgment will be based on what is available.

Yung question ko po baka ilang ulit na naitanong sayo pero gusto ko lang ulitin para mas sigurado.
Andito ako sa ibang bansa at bago po ako umalis sa Pilipinas, 6 years ago, meron akong naiwanang 3 CC na hindi ko nabayaran lahat dahil sa kakulangan sa pera dati.
Balak ko na sanang umuwi sa atin so gusto kong malaman kung advisable pa po ba na isettle ko lahat ito bago ako umuwi.
Wala naman akong natanggap na any document na may kaso pero alam ko lang tawag sila ng tawag sa bahay namin dati.
Ano ho ba ang pinakamagandang gawin? I am willing to settle it kung kailangan pero before doing it I have to make sure na hindi nila ako basta na lang pupulutin at ikulong.
Should I call them one by one to make an arrangement. Please advise me what to do.

ReplyDeletethe collection agencies are there to collect the "noncollectable" receivables for a commission.
here's what would most probably happen:
1. you contact them, now, they have found a new source of their commission without really trying.
2. they will not budge on their "demands" citing filing a case and starts harassing you until you give it.
3. you go to the bank? they will just refer you back to them. they are no longer interested in your account.

Pero may isa pong bank na standard chartered na tlaagang pinangatwanan ko ng di mabayaran dahil sa kabastudan ng agent na may hawak ng account ko ng mdelay ako ng bayad. Andon sinabi gagamit daw akong credit card tapos di naman daw ako marunong magbayad. Dpat inuuna ko raw yun at maraming salita pa akong natanggap kaya napika ako at di ko na talaga binyaran. Andoon na nagmimiscall pa sa akin at nang-aasar. Tumawag na ako sa standard at sinabi kong palitan ang agent na may hawak ng caard ko.Pero siya pa rin ang natawag at bastos talaga kasi bakla.Ngayon may nagpadala na sa akin ng demand letter galing sa Domingo & Molaer law office at laki na ng balance from 65 naging 101,205. Sabi nila pag di ra ako nagbayad within 5 days mag fifile sila ng charge sa akin ng civilly charge for collection of sum of money, before regional or metropolitan trial court of makati. Final demand na raw po yun. maedyo natakot po ako kasi maganda yung papel nila at nakalagay pa yung branches nila all over philippines. Ang name niya Alexis Molaer former member of house of representatives. Ang office na binigay nila Lex Citadel No.7 la salle st., cubao, quezon Totoo na po ba ito. magkakaroon po ba ako ng kaso sa makati tulungan niyo po ako. kasi masyadong madada ang agent e.

Sobrang sobrang worried po ako kc may pupunta daw sa haus with warrant of arrest for me because of failure to pay may credit card debts. I got the txt msg yesterday and nakalagay dun sa txt msg:

Kasi po as far as i know pagnaging deliquent k sa cards mabloblocklist ka sa credit card associated then after sa BAP.

ReplyDeleteI also recieve a letter froma law firm, sabi nila i will be charged of ra8484, because i intentionally abandoned the place of residence without informing the bank pero narerecieve ko naman mga letters nila dito sa office and hindi din naman ako permanently lumipat ng bahay kasi bahay ng mga relatives ko pa rin yun and i still go home their weekly, sabi nila i'll be arrested ny the police authority and magkakarecord sa nbi and bsp. is that true?

ReplyDeleteCanadian Embassy, or any embassy, does not do credit checkings. Hinde naman nag-papautang ang mga iyan. hehehe.....
BAP is association of banks. credit checkings are done by individual banks thru CIBI. it is up to individual banks na.

ReplyDeleteMy concern is I have an outstanding loan and filled out pdcs as part of that. I have been paying on time for the last year on a 2-year loan but my father passed away recently and I had to attend to that, also while transferring to a new company. I had missed 2 payments now but I am willing and able to pay for it and continue to pay on a timely basis by next month.
Although the creditor has not contacted with regards to this, I have heard that they deny payment if it does not include late fees. I have no problem paying the 2 months I owe but preventing me to pay because it is not "in full"? Is there any truth to this? Also, as I understand correctly from the previous posts, BP22 is decriminalized and if they have the gall to send a summons, all I have to do is show up and present my case? I plan to call them post-haste to discuss this matter and see if I can intimidate them for a change.

ReplyDeleteI have resigned from work last January this year. i have a Citibank CC(20k), and an HSBC personal loan(half of the term was already payed via salary deduction).
Citibank kept on contacting me, and i agreed na to pay under their AMNESTY program where I am paying 700/month for 4 years.
About the HSBC personal loan, i was not contacted for several months, i didnt know how to contact them. The HR from my previous company told me to give them my number but due to my celfone's broke and i still dont have the means to buy another, i dont use the number anymore. Im sure they could contact my landline anyway, diba. but there were no calls/letters whatsoever. Until last month, a letter from MOLAER law firm was handed to my sister (although i was at my house. my house kase was at the back of my mother's) dated May pa came stating they were contacting me daw and i refused to reply, that they will be filing a legal action against me if i dont pay the full amount.
so i emailed them as it was stated on the letter. i told them of my current condition why im not able to pay them: i resigned due to recurrent dizziness and want my health condition back. and i am currently pregnant, that is why i am having hard time to get employment.
Then they gave me payment options pa rin inspite of my inability to pay. pero i told them i cant select from the payment options, and told them i can pay maximum of 2k per month (the most) beginning august. but they replied its ok to pay 2K for 3 months beginning july 20, and the rest of balance will be payable in 9months.
but i really dont have the means to comply with that.
And, just last monday i received their letter dated June 25 stating Formal Demand for Payment, that if i dont pay they will sue me of RA 8484 Defrauding of Creditors.
Is RA 8484 for Personal loans din? I read on your previous posts that its onlt applicable for CC diba? can they sue me that? and if i am unemployed, can they pressure me to pay? is there a law that can be sued against me? will my husband be liable for the loan? can they take away my assets? kase on their first letter to me they know daw that my assets are enough for them to use to cover the payments.
pls shed some light. thanks in advance. your answers will be a great help.

I'm from Cebu and also delinquent payer from Citibank CC. I have an outstanding balance of 50K plus, and was able to agree with the bank/ collection agengy that I will pay 500/mo. I'm now paying this for about a year, and my billing when we had this agreement had reached 112K plus. My question is, is it worth continue paying this much?

ReplyDeleteNeldon_CC po ito, regarding po sa question ko last post ko about WARRANT OF DISTRAINT... Kasi meron na naman akong natanggap na txt kay Allan Pineda na naman. Na I pafile na daw nila ang WARRANT OF DISTRAINT within a week since hindi na man daw ako nagcooperate kay Atty Beltran AIG – Legal Dept. I am being summoned daw to appear in the court. Then sabi pa pls call daw to hold issuance.
Tanong ko lang po:
1. Ano yong WARRANT OF DISTRAINT?
2. Pag naissue napo yong summone sa MTC daw yon. Pupunta ba ako? Taga Cebu po ako… hindi po ba pwede sa Cebu na nila i file?

I think sometime in 1998, I lost my job at may outstanding bill ako with BPI someting like 60T? so since then di na ako nakapagbayad. Year 2000, may na receive ako na summon from MTC for that civil case for sum of money at umabot na sa 140T ang outstanding because of penalties. I signed a compromise agreement with the collection agency to pay for 8T for 3 year per month at inapprove ng court ang settlement but di ko talaga nakayanan ang magbayad each month so 3 months lang yata ako nakapagbayad. Then may bill na dumating sa akin demanding to pay the entire amount which balooned to more than 500T! Aba! di na ako nagbayad since then. My Question is am I criminally liable? Makauha pa ba ako ng NBI Clearance? I hope You can share some ideas to me

ReplyDeleteGusto ko rin po sanang humingi ng advise sa inyo regarding my loan w/ Chinatrust. Marami-rami na po akong nabasa sa blogsite nyo regarding different scenarios for cc and loans, and this is my case. I have issued 24 pdcs to chinatrust for the monthly amortization of my loan, smooth payment po for 1 year but then ung 2nd year nababayaran ko pa rin po naman pero delayed na. Every 12th of the month po ang date ng checks pero nababayaran ko po sila ng katapusan na. Before napapa-adjust ko pa sa kanila thru fax ung pag delay ng deposit ng checks but then after around 5 times, hindi na daw nila tinatanggap yung ganung sistema kasi napagbigyan na daw nila ako. As a result, may ilang months din na nagbayad ako ng penalty pag nadedelay. They would always call me to check if I was able to pay for the month until nawala ung mobile ko so hindi na nila ako macontact. Masyado akong na sstress pag tumatawag sila kaya hindi ko na binigay ang bagong number ko sa kanila. Yung address din na nilagay ko sa application form ko sa kanila ay dun sa dati kong boarding house and for sure marami nang demand letters ng napadala dun. Three payments na lang matatapos na ang loan ko sa kanila, I never called them pero every end of month binabayaran ko ung amount sa bank. Ang question ko lang po banker, okay lang po ba na tapusin ko na lang ung last 3 payments ko w/o contacting them kasi for sure pag tinawagan ko sila they would say na i will need to pay penalties and other surcharges. And one more thing, pwede ba akong makulong since baka nagpadala sila ng notice to attend court dun sa boarding house and since wala na ako dun, magiging grounds po ba ito ng pagkakaulong since failure to show up in the courts?

Hello Banker good day po!I'm a good payer of an HSBC card for more than 4 years until this year when I got terminated from work last May 2008 that I haven't been able to pay them.They have already forwarded my case to a law firm.I requested for an amnesty.My debt is already 35,000 because of interests.They said if I won't pay 20% of the debt they would file a legal case.No amnesty will be given.I'm so afraid that this might affect my job hunting effort.can i still get an NBI or police clearance because of this?I really need to find a job because I have 5 kids but until now I'm not lucky enough to find work.Will they really send demand letters?will I be imprisoned?Pls.help me.Thanks and more power.

ReplyDeleteTanong ko lang sana, hindi po credit card ang problem ko, asialink finance corporation po, nagloan ako sa kanila at nagrenew ng magsabay-sabay yung malas ko sa buhay, ninakawan po ako ng 5 employee nagsabwatan, ng malaman ko at kinausap sila tungkol dito, nag alsa balutan po sila lahat at ipinasadiyos ko na lang, may dalawang pwesto po ako nuon, yung isang may-ari ng ng pwesto ng tindahan na inuupahan ko naningil pa ng dagdag na bayad sa renta na wala naman sa kontrata, gusto nya ako ang magbayad ng VAT nya eh sa kontrata ang nakasaad dun ay yung witholding tax lng nya ang babayaran ko at hindi pwede ideduct sa renta na sinisingil nya, yung is naman pwesto na inuupahan ko pinadlock yung lahat na gamit ko sa tindahan mga worth 200k po yun over sa utang ko sa kanya na 5k + lang na delay sa rent, tinatakot po ako sa abogado nya at mayaman po, grabe po ang sama ng loob ko nuon, pakiramdam ko bumagsak yung mundo sa akin. Yung asialink naman po, nagtataka ako, pinakasuhan nila ako ng BP 22 eh nagbabayad naman ako, at isang cheke lang kasi last payment ko na sana yun. May collector po silang naniningil sa akin, at kinasuhan na ako agad ni wala pa nga yung due date ng utang ko, kasi inextend yun kasi sinisettle ko nga. Bale yung pinafile nilang BP 22 sa akin hindi na exact amount yun kasi nagbabayad nga ako. Pindalhan po ako ng mga sulat na dinedemanda na nga ako, tapos may tumatawag at nagtetext na may warrant of arrest na ako. Sa sobrang sama ng loob ko tinigil ko na magbayad kasi ipakukulong naman pa rin pala ako kahit nagbabayad na. 12k+ lang po yung check na na close account, at itinawag ko pa sa kanila yun na wag ihulog kasi close na nga, inihulog pa rin at kahit nagbabayad ako pinakasuhan pa rin ako.
Naging depressed po ako dahil dito, taga cebu po ako, kinakasuhan ako sa manila and court, sabi ko paano ako makakapunta dun eh walang-wala na nga po ako, yung kakaunti kong pera eh binabayad ko pa sa kanila kesa kumain.
Sinerve po sa akin yung warrant 2 days ago lang, nagbail po ako. Grabe po ang sama ng loob ko sa mga taong eto, yung collector po nila dati kung manigil pa sa akin ina-anunsiyo pa sa mga kapit-bahay kung makakatok sa amin at minsan po alas 5 ng umaga naniningil na. Simula po ng grabe nilang panghihiya sa akin bihira na po akong lumabas ng bahay, feeling ko ang liit-liit ko sa paningin ng tao. Magmula po ng maserve sa akin yung warrant mas naging grabe po yung takot ko na lumabas. Nagkukulong na lang po ako sa kwarto ko.
Nakausap ko po dati yung atty nila sa manila, pinkaiusapan ko po pero grabe po kung magsalita parang wala na akong pag-asa sa mundo kung pagsalitaan nya.
2 months ago, napagpasiyahan ko na kumunsulta sa psychiatrist kasi kahit napakaliit na problema di ko na kinakaya, nadiagnosed po ako ng dysthymia (chronic depression) at umiinom po ako ng anti-depressant daily mga 2 buwan na dahil po sa mga taong eto na parang walang diyos kung humiya ng tao.

Mai chance pa kyong mabayaran ng damages. Illegal nman talagang manakot ang mga yun. Tsaka, kung magfile cla ng kaso, bayad palang sa attorney, lagpas nah sa utang nyo...Sino nmang loko-lokong gagawa nito. Dba banker, totoo nman ito? Yan kac ang advise ng friend kung lawyer. Basta, wag kayung magpaintimidate sa kanila, o kung matakot kau, wag kaung magpahalata kac the more kaung takutin ng mga yan...Stay calm and relax. Be brave. Learn to fight.

nbi handled criminal cases. utang is a civil case.
