No Approved Therapeutic Claim

I hope it's okay to call you by your first name :)

Anyway, I just want to share something to you. I am a bit shy about
posting this at our yahoogroup. I would not mind if you post it
though (without my name or email please)

A letter arrived from a collection agency (xxxxxxxx Credit and
Collection Services). This letter just proves that there is indeed
NO AMNESTY PROGRAM.

Greetings!
One of our objectives is to help you ease the burden of carrying your
accountabilities. Thus, Credit Card Company is offering you a special
discount on your Credit Card with account number XXXXXXXXXXXXX,
which is now long overdue and demandable.

Your balance as of April 16,2008 is PhP54,127 but through this special
discount, you can now avail of the final settlement amount of
PhP36,217 as full payment of your outstanding obligation until
April 25, 2008.

If you wish to avail........ Blah blah blah

This is what is FUNNY. I received my statement of account dated
April 20,2008 which indicated that my outstanding balance is at
PHP36,344.I do not know if the collection agency has been advised
that I am still receiving a monthly bill despite the fact that my
account has been suspended.

You are right! There is no AMNESTY PROGRAM! :)

  2. To give the client time to make money, can the repayment for the account above start at P500 then increasing every month or every 3or6 months and still paying the same balance with interest in full?

  3. a) Stopping Of Interest

    Your agreement states that your account will continue to earn interest "until it is fully paid". thus, either :
    1. ask formally for a fixed amount for a uniform monthly repayment for principal and interest
    ( if approved, one condition could be the cancellation of your card)
    2. fully pay the account in cash or from a loan with lesser interest rate( < 3.5% per month)

    b. P500.00 monthly repayment

    I used to make a package similar to this:
    "P500.00 monthly repayment to include interest, subject to review after 6 months for possible accelleration"

    unfortunately,they probably won't accede.why? IDK.

    i've been trying to get a payment restructure from HSBC but unfortunately they do not offer at the moment. I can't afford the minimum amount anymore and would like to cut it off. What would be best to do for this kind of situation? Should I wait for the legal department?

  8. ensure that your request for restructuring is put in writing and properly received by them.

    if they do not want to restructure it, that is their problem.

    your letter would be a good defense if ever.

  9. banker what is the usual interest rate a bank should charge on a person asking for a restructuring program?kase ang ipinapatong ng UNIONBANK sa akin is 3.5%/month for 36 months to pay..is this ok kase parang halos triple ung naging babayaran ko sa knila e sabihin n natin n 20k ung nagin utang ko with interest halos 60k n ang babayaran ko sa knila...please enlighten me on this...

  10. the usual interest of card companies is 3.5% per month or 42% per annum. compare this with 2% per annum interest on savings accounts!

    they are still not contended with that. they will add principal plus interest then multiply it pa with 42% per annum - meaning the interest is earning interest!

  15. a)Your( principal + interest + charges)total outstanding balance for the month will earn interest again next month and the new total will AGAIN earn interest!

    your account will look like this :
    principal
    add:
    interest
    penalty
    over the limit availment(min. of
    P300.00 )
    multiply by interest ( August)
    = total
    multiply again by interest ( Sept)
    = total
    multiply again by interest ( Oct.)
    ......etc. etc.

    I have been reading your advices and thanks po talaga.. I have an amnesty with SCB and i failed to pay 2K for the past 5 months na they have sent me a demand letter to pay in full which is around 50K. what should I do po kaya? I am a breadwinner and sending my siblings to school.. Please help

    Would you believe if I tell you that you just disregard what you signed and just go on with your life? if you have no money to pay, what can you do? sell your soul?

    sa dami po ng mga nirereply-an nyong tao na tulad ko may aberya sa credit cards, sana po mabasa nyo rin po concern ko.

    I've had an unsettled arrangement with AIG. Actually, halos isang taon na po ang nakaraan since they offered me a sort of amnesty/repayment structure. At first, they asked me to pay an initial amount para ma-less yung balance tapos from there idi-divide nalang nila. I paid as requested. Then they sent me po a promissory note, which i refused to sign bcus feeling ko po bias yung conditions. Sumulat po ako sa kanila to appeal and to request a complete proof of the computation and terms and conditions but unfortunately i never received a reply. After half a year, nalaman ko nalang po na finorward na nila sa isang collection agency. Tapos ngaun ung sabi ng collection agency nung finorward sa kanila ung account 25K, pero dahil sa 25% attorney's fee, 32K na babayaran ko sa kanila ngayon. =( Naku, sa totoo lang po, wala talaga akong disposable income ngayon. Dami ko pa priorities like studies ng kapatid ko. Pls help me po. Should I start negotiating about the repayment they are saying or is it ok to tell them, I need to finish my other obligations first?

  21. hello panu po kaya yung case ko...di ako sa credit card me utang kundi sa china trust...and i have signed an application form...makukulong kaya ako now that they are demanding me to pay the full amount, which is 80K? one year ago nung last payment ko and me promisory note naman ako pinasign sa kanila na once nag ka pera e babayaran ko that time less 40K palang ang remaining balance ko ...pumayag naman sila...now somebody is calling me and kung anu anu sinasabi sakin :( i wanted to pay but the minimum na payment na binigay sakin is 6K per month which is impossible for me to pay....is it possible to pay nalang the less 40K balance na hulugan kesa settling the 80K they're demanding me to pay? please advice. j6276

    i know common po ung credit card problem.Kc im one of those million people who have problem in credit cards..Actually i have two credit cards each card has a corresponding balance,mydo malaki-laki xa kc my mga balance transfer ako for both cards.as what other people said i cant afford na to pay my debts to them..im afraid kc d alam ng husband ko about my debts..then palaging 2matawag ung agent sa bahay..i want to settle my accounts,in a lesser amount...gs2 ko banker ung sa kaya ko lng bayaran in a monthly basis,pwd ba ung mangyari.ask ko lng po,may nakulong naba sa hindi pagbayad ng credit cards? plz help me,regarding on this matter..tnx ahead banker

  24. a simple utang is a civil case which does not entail "kulong" except kung may attendant fraud like faking a card or document etc.

    first step is ask for a Statement of Account, then e/m me

    husband should be aware of your debt.kasi conjugal assets and liabilities yan. but that is a matter

I had this debt with unionbank, from a 10k credit limit naging 60k na, so i ignored it for years na lang reading from forum to forum and knowing what goes inside the credit and collection office since my friend worked there. Hindi naman kaila sa ating lahat na when they force you to pay they're meeting a certain target and they have commissions or something like that, anyway, so when i finally decided to settle my obligations with unionbank mga nasa 25 something na sya, and then i issued 24 post dated checks, pero lo and behold, mga nasa 35k ang dapat kong i settle plus interests daw so sige, pumayag na ako just to end it all, and when i received the copy of the letter only 25k is divided into 24 monthly amortization, so where's the rest of the amount go diba? tubo ng collection firm, tapos yung document na yun lang ang signed ng unionbank! i asked them to document the other missing amount sabi ng collection yun daw yung "plus penalties and interests that may accrue thereon" sabi ko kahit sinong abogado makikita kagad yang fallacy na yan sabi ko, since am willing to settle naman let's just be transparent, tanggap ko na naman na may kickback sila for the job they're doing kase pwede ba namang wala, but let's just document it on paper, kahit na masakit sa bulsa ko. makarma sana ang mga tao who thrive on other's money that easy. greed greed greed talaga

    i have 2 cc's,bdo and amex.i have this firm plan of paying them and had asked amex for reconstructive payment which they did but 2k a month is quiet hard for me.they have called and texted me a number of times but i do not know what to say to them thats why i never answered.i just emailed amex.bdo on the otherhand called me up again this afternoon and still, for the same feeling i did not answer.

  29. Rule No 1 - If you cannot pay, dont

    Dont force yourself to pay what you cannot afford.you will just be back in square 1, but this time with bigger debt or higher burden.

    just put your proposal in writing, if they wont agree, fine.got any choice? yes. let the court decide on the issue. dare them to file a complaint. most probably they wont.

    paying 2 cc's right now is very hard knowing the fact that i am earning just slightly above the minimum and soon to be a father this week.
    i will try to contact them and put into writing the proposal that i can afford to pay for now.i really dont know by how much.i think for now, RULE 1 is my best option.
    i know this is not yet over, ill keep you posted sir.

    They can be put to jail for that:
    Art. 287. Light coercions. — Any person who, by means of violence, shall seize anything belonging to his debtor for the purpose of applying the same to the payment of the debt, shall suffer the penalty of arresto mayor in its minimum period and a fine equivalent to the value of the thing, but in no case less than 75 pesos.

    Plus:
    BSP Cir454 d) threat to take any action that cannot legally be taken

    let them put that in writing and they'll be in big trouble.

    legal rate:

    with the repeal of the Anti-Usury law, parties are free to agree on what the applicable rates. BUT the court usually frowns on what is obviously "excessive,unconscionable and contra bonos mores"

  35. OMG! So it is a sham?! I received a call from Citibank today and a rep told me to pay 400 to be able to avail of this amnesty program. So I paid it right away. I have an outstanding balance of P25000 and he told me that I have to pay P400 now or else I won't be able to avail it anymore. With this program, I only have to pay P400 for a year, and after a year of paying that on time which is before the 15th of each month, from P25000 it'll turn to P13000 only. And I told him that I have the intention of paying P1500 every month, and I have been doing that for a couple of months already. He said that then it will be less than P13000 and I'll be able to pay my debt off quickly. I just hope that this is true. I called the rep to ask how I can be guaranteed that I am enrolled in this program, he said that they will send me a letter. Oh, I just hope that this is true.

  37. Sham talaga yang Amnesty Program na yan. Yun sa BPI nga namin, 2 months pa lang kami di nakakabayad, active pa yung card and wala pa kami sa legal, pinadalhan na kagad kami ng sulat stating naiintindihan daw nila na baka na may problema daw kami kaya di kami nakakabayad kaya may offer daw sila na AMNESTY na pwede nila tanggalin na yung interest and willing sila ireconstruct yung balance namin sa amount na kaya ko I just need to call them within 10 days of receipt.

    I was hoping we can still avoid being delinquent so I tried calling the numbers they gave me and to my annoyance, ni isa sa 3 contact numbers na binigay nila ring lang ng ring and walang sumasagot kahit anong oras ko try tawagan.

    The point here is that kung yung mismong bangko na nga ang "nag-offer" ng Amnesty, lumabas na lokohan pa rin and pakitang tao lang, what more pa kung galing sa mga collector?

Na notice ko kasi na if first time ka tinawagan ng mga collector, magpapakilala sila na galing sila MISMO sa Bangko kaya maayos pang kausap and kung ano-anong AMNESTY pa iooffer sayo kaya agree ka lang ng agree kahit deep inside you know na maganda nga yung offer but wala ka talagang pambayad. So the next time they call you kasi you failed to pay, madudulas na taga SO & SO collection firm sya and this time bastos na..kaya nga siguro kung alam mong putol na ang card mo & nasa legal ka na, kung talagang wala kang pambayad, huwag nyo na ring ientertain yung caller kasi collector lang yun...

  39. sir,question naman po. i havent paid 2 credit cards namely citibank and standard chartered for almost 3years now, sobrang financial prob through the past 3years of my life, ngaun im decided to pay for the 2cards for a span of a year or 2, possible po ba na wag na sila mag charge ng interest? thats the only way i could get our of my debt. hindi na sila nagpapadala ng so called amnesty program or credit bill sa bahay...so im not sure kung nao ng nangyayari with my delinquent account, ngaun po, disadvantage pala i cant open my own savings account. since may utang daw ako...is that also true? thanks sir ha...hope you could reply. take care!   44. hi banker....ask lang po ako about sa problem ko sa credit card...may 2 citibank cards po ako...nawaln po ako trabaho last year..so hindi ko mabayaran yung 2 cards ko...may nag offer po sakin ng amnesty program. at binigyan nila ako ng fix payment na 3500 for 3 cards every month. nkabayad po ako from nov2007 to nov2008..pero by december ay talagang broke na po ako...ano po ang pwede ko gawin? may tumtawag na po from law firm...willing naman po ako magbayad pero walang wala na po talaga ako maibayad now...pwede po ba ako humingi ng palugit? balak ko po til june po ako magstart uli.sana po ay matulungan nyo ako..

    in 2002, i also experienced harassments from collection agents, they mentioned many times about the amnesty program.

    I really wanted to settle my account, so i paid their so called minimum payment to avail the amnesty.

    pero, after i pay the so called minimum payment, meron na ibang tatawag sakin, sasabihing iba na ang kausap ko. kung gusto ko amnesty pay another amount.

    Siguro i paid three times before i realized na parang niloloko lang ako ng agents. I was really down back then, naguguluhan yung utak ko. i badly want to settle my account.

    Hanggang ngayon hindi ko pa nababayaran yung debt ko, but the interest had already stopped.

    Ngayon, meron na naman tumawag sakin yung 64k daw 19k ko na lang babayaran tapos zero balance na ako. gusto ko syang bayaran pero natatakot ako na baka mangyari lang ulit yung nangyari before.

    i want to settle my account once and for all.

  53. i have n outstanding balance of 26k kasama na po interest then was approved under amnesty which i would pay 1000 for 24 months, pero malaki pa rin, then nawalan pa me ng work, but i tried paying. di na me naka-pay ilang months then citibank called me saying that i have to keep my account moving by paying 500 immediately or else ma nullify yung amnesty. i then rushed to sm city chinabank then paid the said amount. to my dismay, may tumawag na collection office after a week saying na nilipat na daw ng citibank yung account ko sa kanila. nainis ako kasi wala klaro and dont know if m still paying for my acccount. anyways, i was at ease and made arrangements to pay 1000 a month for 16 months, but then di sila payag kasi daw dapat 2000, di ko yun kaya kasi wala me pera this time and im unemployed. pero i wanna pay talaga kasi tinatakot nila ako na idemanda. i even gave them all my contact info para they'll keep in touch, pero di na tumawag uli. anu gagawin ko?

    I am currently enrolled in standard chartered bank restructuring program. What they did is that they cancel all the interest that occur from my 6 months of non-payment to my credit card. However, they are still sending me a credit card statement with the full amount of the bill (full amount with interest) less my monthly payment. Now, I asked them how come they did not reflect in the billing statement about the restructing program we agreed upon. They told me that they are gonna give me a certificate of complete payment after finishing the 6 months payment of the program. I am not satisfy because the billing still states the whole amount and nothing has changed. What should I do? Oh, I also would like to add that they sent a letter stating that the restructing program has been enrolled signed by their country's collection head - Mr. Varun Mahajan.

    kinda weird. im also enrolled sa restructuring program ng hsbc. i can see my online statement of account, and in there, i see only, my payment, due date, and balance and the other usual stuff. not like what you are receiving. Better clarify what that is all about and why is it like that.

But they simply could not adjust the credit card bill statement. They say it will be adjusted as soon as i have completely paid the program. What do you think should I do? Shall I continue paying?     it's up to you michael whetether you want to continue or not. you know what, kaya hinde ako naga-agree sa mga programs ng bangko, para kasing laging may mali. una, hinde ko kaya ang monthly amort na gusto nila, or, hinde fully documented like the offer of metrobank,1k per month pero verbal agrement yun kasi iba yung nakasaad sa letter nila kaya hinde ko itinuloy.
    about my hsbc, i will just may principal then stop paying na ako kasi ang laki talaga ng interest nila, nasa 3.5% per month (hinde ko pa kasi alam ang tungkol sa site na to) eh kung ipinadaan ko sa korte yun, it go down to 1% per month lang.
    sa case, kung doubtful ka, stop paying and let them see you in court na lang na kung saan, sigurado ka sa legality ng agreement, lower interest rate at cut pa ni judge mga interest and penalties, no need for lawyers under small claims court at yan ay kung talagang magdedemanda sila which very slim ang chances but you will go thru the harassments of their collection agencies and actually madali na yun, marami ng diskarte sa mga harasments nila.

  64. i've had the same problems w/ the rest. just would like to share my experience with all this CC companies. first w/ SCB, I almost had a 50k balance w/ them. half is for BT and half is purchase bal. My account was handled by 2 diff collection agency. Unfortunately nakulitan ang parents ko dun sa 1 so they decided to pay for it.(lucky me!). however dun sa purch balance ko I have to deal w/ it on my own. super bait nung collection rep na tumatawag sa akin. first, she was asking me to pay at least 5k every month. so naging honest na lang ako na wala tlaga ko money and hindi ko kya ang 5k. so we ended up w/ an agreement of 2k a month. everytime na i won't be able to make a pymt, I immed advise the rep and she's been so understanding abt it.i brought down my bal to around 16k. one day, she texted me and advised me na if I can pay at least 6k they'll fully close it and I have no more obligation w/ SCB. I got a discount of 10k, and it's really a great deal. another situation is w/ HSBC. They've been harrassing me for 3 years. from my bal of around 50k, naging 100k+. all because of LF/OL and FC na asa 2k plus. Super bad talga sila when it comes to collection because they don't listen to their customers. I've been trying to settle my account from the time they cancelled my card and demanded for the full pymt. I told them I can't pay in full. So they cancelled my card and continue to send me billing stmt. I've been receiving a lot of calls from diff agencies na hindi marunong makipagusap. They just want what they want. Wala sila napala sa akin, coz sabi ko talga I'm willing to pay but not for the amt that they are requesting. I've been very vocal abt my financial situation. After 2 years, somebody called me regarding my HSBC card. I explained to them that I'm willing to negotiate. Super bait coz from a bal of 116k, they just asked me to pay 15k and everything's settled. In short, I got a great great deal, a big saving of 100k. have my certificate now stating I have no further obligation w/ HSBC. I guess you just have to be honest w/ them. pag bastos sila..babaan nyo ng phone. im sure one day, somebody's going to call you w/ a very good heart who's willing to listen and negotiate w/ u.

  65. Naiintindihan ko po yung mga problem dito. Nadaanan ko yan dati nung 21-23 years oild ako. Ang hirap. Minsan di na na makakatulog. Ang ginawa ko lang ay pinunit ko yung mga card ko na may utang at nagiwan ako ng isa na walang balance at pinatago ko sa nanay ko in case of emergency. For 2 years, binayaran ko yung 30k na utang kasi maliit lang sweldo ko. Pero after 2 years, nakahinga na ako.

    On my experience, to avoid this problem, try to live by your means. If you are only getting 15k monthly salary then you have to live below that. Wag na kayo magcredit card. Mag cash na lang kayo. Wag na kayo bumili ng hulugang cellphone.

    even in emergencies, kung pwede pa lang wag umasa sa credit card , kung di mo man lang gagamitin ang card mo wag mo na ipatago sa nanay mo, better cancel it, kasi nagbabayad ka pa nyan ng annual membership fee which is not wise financial management. dapat mag umpisa ka mag build ng emergency fund mo na at least 6 months of your monthly income.

First, I had one of my cc been settled a month ago already this is the story... The collector and I agreed that I would settle my account just half the price like for example 30k ang babayaran ko lang ay 15k then i settled na. They give me a certificate of completion, however meron pa rin ako natatangap na billing statement stated that my balance pa ako 15k + 2k charge, anu po sa tingin niyo bakit ganon po? talaga ba ganyan?

    if you have a document, perhaps that certificate of completion(bakit certificate of completion, dapat certificate of full payment), call the bank concern, tell them that you have certficate of full payment, send them a copy will do best and you will know what's the real score.

    my husband also has the same issues with his cc's. although he is trying his best to be able to pay his obligations, d na talaga kaya ng means niya and naaawa na ako sa kanya because he's been finding ways na makabayad but the banks are not cooperating.. there was even one instance that the "bank" daw called him and offered him the amnesty program..that is with citibank.. but there was a condition na kailangan nya muna mgbyad ng partial amount na 7k for him to avail of the program. they agreed that he will pay the day after kaya lang he was not able to pay kasi both of us are working and wla ng ibang mauutusan. so monday binayaran nya pa rin and called the bank and they told him hinda siya eligible because di siya nakabyad on time..and that was so rude of them kasi atleast nga ngbayad pa rin ung tao.. banker kung pwed sana mgka communicate kayo ng husband ko pra mkahingi siya sayo ng advice on what to do pra ma solve ang prob nya..     im very happy i've found this blog. I know we all have same problems and I just want to share mine.

    I have an HSBC cc, i think last october 2009 pa ang last payment ko with them. And now, they are still sending me my bill and it reaches na to P50k+...At first, I'm so worried kasi alam ko hindi na ako makakabayad neto, I still have my work but I have some obligations pa na mas impt. pa kc mgbayad ng utang...Nung una talaga, na didisturb talaga ako kasi tawag2x ng tawag sa office at cellphone and then it ended na i think last month. Later did i know na forward na pala sa isang law firm. Nagpadala ng sulat amounting to P70k including attorney's fee daw. So lalo na akong na worried na hindi na talaga makapagbayad. Kahapon lng may tumawag sakin, at first nag deny ako but unfornately nabisto din nya ako...marami siyang sinabing hindi maganda sakin and made a settlement para daw wala ng problema...She said she will give me an amnesty program. I can pay my utang at lower cost amounting to 39,500 and payable for two months.1st-March 22 and the other half on April 22,2010. I decided nlng to get a loan here sa office or borrow from my friend para mabyaran ko nalang para at least wala na akong problema. BUt after reading your comments, I have to think twice pa pala or else mas mababaon pa ako sa utang. Help me naman how to handle this problem. I badly need advice. THnks!

Learn from my experienced, ang nga credit collectors, lahat na puedeng pangbobola gagawin yan. huag kayong maniniwala dyan. sa credit card un collaterized loan kaya kung hindi ka makabayad walang makukuha sa iyo ang cc company. then ibibigay nila yan sa collection agencies. almost zero account na yan. ang habol na lang dyan maaring hati sila sa puede mong ibayad. mapipilitan silang bayaran mo kung magkano lang ang kaya mong bayaran, sa madaling sabi. tapatin mo na ito lang ang babayaran mo to close the account. Hingi kayo ng letter sa kanila, in case na isasara itong lang ang babayaran mo.

But,last June 25, 2010 may tumawag sakin sabi naging 128t na yung outstanding balance ko. Tapos he demand me to pay 15taw but i refuse to pay the said amount and sabi ko P1,000 lg ang kaya ko. Dahil wala akong work ngayon at naghihirap talaga sa pera.   85. banker, i received a letter from a law office. hsbc is one of their clients. im unemployed and will be giving birth. they said if i fail to settle my credit card obligation after 5 days whether in full or under the discounted amount, they shall be constrained to file necessary complaint for collection of sum of money, under the rule of small claim cases before the Metropolitan Trial Court of Makati. will i be really subpoena to attend the court for non payment of cc? please help me. i need your advice. thank you

    Just received a call again from the collection agency coercing me to pay 20k until this month only and the account will be settled.but then i never had such amount for that even if i will be saving some for a year.so what i did was i told him that my atty advise me to settle only on the court.and he ask me the name of the atty and i gave him the family name(said atty was my boss' atty but no advise actually from him)..and he said something but i tell him that there's no further discussion to be done. what i want is only to settle on court then he said ok then i put down the phone..my question now banker is could they possibly sue me?if any letter will be sent from them, how will i know its true or just a bluff?

    actually im working abroad right now, and this CITIbank and HSBC kept sending SMS and calling at home sa pinas, mga magulang ko e mdyo harass na and bit worried about me, kept on explaining to them na nanakot lang yuna t pabayaan mo sila, but still, parents will always be a parent...concerned sa anak nila,

    anyway...

  94. banker, meron po ako 3 credit cards mainly from metrobank, psbank at unionbank and an outstanding balance with interest of total 600,000++. with your site marami ako natutunan. sa ngayon past dues na ko. panay tawag ng 3 bank collections. sabi ng friend ko wag ko na raw bayaran kasi lalo ako mababaon sa utang dahil sa interest pa lang malaki na. ano po ba dapat ko gawin? dapat po ba humingi pa ako ng restructuring program nila or hindi na? hindi ko na kasi kayang bayaran pa yung utang ko kasi meron ako pina-prioritize ngayon year. so please help me out banker kung ano po ba dapat ko gawin. thanks in advance.

Dear banker, this site is very informative and at least alam ko na hindi ako nag-iisa. wala narin talaga akong money to pay for ccs. and wala na talaga akong pambayad. iniisip ko na babayaran ko nalng sila kapag lumago na ung business ko. or should i just totally ignore them? nakakaharass pro pinatay ko na ung cell phone ko kapag may tumatawag na anonymous number.
    un nga lang, tumatawag sila sa house ng parents ko. nakakatakot lang na baka pumunta sila dun sa bahay at mang-harass ng parents ko. would you think after mga 3 years eh titigil din sila? salamat ng marami.

Meron na akong na-work out na payment plan that time but unfortunately, di din ako nakabayad because of financial troubles. but now, im applying for a home loan. malaki ba yung chance na madis-approve yung loan ko because of this? lalabas ba yung utang ko with citibank? if ever, ano kaya pwede ko gawin? pwede ba ako tumawag sa citibank na babayaran ko yung utang ko pero 20T-30T lang? mag-iisue kaya sila ng clearance? thank you in advance for your help.

  98. Dear Mr. Banker:

    May credit line for Unionbank Card is 35K. I was suffering from ailment and was not able to pay monthly but I am still working. I was offered a Restructuring by the bank 42K payable in 36 mos. @ 1,540.00/mo. and started paying last Oct. 2009 but my last payment was April 2010. Two days ago I received a call from a law firm telling me that my balance is already 228,000.00 and need to pay the whole amount or else they will file a case against me two days after the call. I asked the caller on how did they arrived on that amount, she answered me that it was given to them by the bank but told me to call them again for the restructuring. They gave me a no. of Unionbank (daw) for verification of the figures. My call was answered by a man who immediately tell me that my account was already forwarded to the Collection Agency and that computation was based on 49K w/ 9.5% interest per mo. and a 30% attorney's fee. I've tried to ask him to explain it to me further but he told me to just call the Collection agency.

    I asked the opinion of our legal secretary and told me to just ignore it. I am not running away from this obligation but right now my priority is my health.

    I did not call them again neither they. You think they will file a case against me if I do not communicate with them anymore? Will it be ok if I just call the bank directly if a have already a money to settle it let say after a year?

    he is calling my house almost everyday even during midnight threatening me that i might spend my xmas in the prison.

    i told him i will settle my account this coming year see i just give birth and need to support the growing needs of my family i will negotiate with them as soon as i can but he is harrassing me should i be afraid?

  105. Hi, i just want to ask, i've had issues with my cc payments to citibank, hsbc and unionbank but i've just settled them thru amnesty program. But this one - Standard Chartered, is really something, i had an amnesty program as well and was paying 500/mo, but everytime i get a bill the outstnding bal is still the same and i even get late payment charges w/c is sometimes more that what i'm paying monthly, i was supposed to pay every 30th and i paid on the 30th thru atm ( so probably late bec theres a 3day posting) then someone called me up regarding late payment and during some reconciling she said that another account no was assigned to me and that i should pay using that account no. That was when I really doubted them and I stopped paying, that was about 2years ago. then about 6mos ago i received a letter from a law firm saying i could just pay 9k instead of the full 19k amount to avoid litigation and further financial damage. I still did not respond to it. My question is if i go over a credit investigation, will this appear on my personal credit report and might affect my other credit transactions? Also, i am applying to a financial institution JP Morgan Chase as tech support analyst, i was told they will do a credit investigation and it might affect my employment. do you think they would see that record on the financial check? Please enlighten me, thanks and regards.

  107. yah i know thats why i tried to pay all my cc debts, its just that standard chartered collection agencies are really abusive. besides, i know that the balance before all these started was already paid and its just the interests and other charges that are being collected already.
    Anyway, i was informed that since JP Morgan is not a member of the phil credit card association of the phils then they have no access to the cc credit data base, is this true?
    It seems unfair that this would affect my employment.

    I hope you can help me too. Sa dami ng credit cards problems at alam ko na ang dami mo na rin na-advise sa mga katulad ko. I am a good payor of citibank until I delivered a sickly baby and ondoy. Sobra laki gastos sa delivery and hanggang ngayon almost non-stop sa hospital. Lumaki na ung bill ko and di ako nakabayad for 2 months palang pero everyday I have a call na from the card company. I am asking for an amnesty program or restructuring pero binigay nila sakin ay 2.2% interest. so instead na lumiit ung debt ko lalong lumobo kasi for 4 years ung gusto nila at 2,700.00 per month. 83k lang sana un, naging 140k na. papayag po ba ako or may ibang option pa? thanks po

    I was looking for some help through the internet and I found out this site.I have a problem applying for a credit card.

    The last time I had a credit card was year 2008. I had an HSBC credit card then. Due to financial difficulties I wasn’t able to pay my monthly dues and because of that I avail their offer or let’s say an amnesty program. I was able to pay the agreed amount.
    For the record I also have the same experienced with CITIBANK, it happened before I got the HSBC. With two experiences on both credit card companies, I’m now having a thought of probably my name was put in black listed.

    Right now I could humbly say that I’m now more financially stable, and planning to applying for a new credit card. Unfortunately my application was always disapproved, I ask the reason but the agent just told me to wait an email. Up to now I haven’t received any emails from them.

    Am I not allowed to have credit card anymore? Please enlighten me.

    Im really having a problem... I am a government employee and a teacher... I have this HSBC credit card that I can no longer pay even the montly minimun... I trying to call up the company to give me advise on how can I pay this... Really having problems financially...

    I learned that the cc company wont sue you in court.. but would there be a posibility that they will if I am a government employee and teacher...

    Please help...

    HSBC will merely refer you to their collector for harassment.
    If the collector contacts you, just tell them that according to your lawyer you will just see them in court.

But with hsbc after 3 years of silence. Last may i received a call in office since they have access with all the locals (ihateit) i have a package daw that cant deliver since d malocate ung exact add ko. then knabahan na ako. the person on the other line said he is from the collection agency of hsbc my principal blance then was 30k now its 149k. he ask me to pay at least 20k til end of june at hsbc main the fort, he even gave me contact person who will assist me in paying then il be cleared with clearance. is this true? i want sana ung principal na lang pero monthly please help me, gsto ko po masettle kasi hassle xa sa sa buhay q palagi ko naiisip mga utang q sa cards. thanku.

  131. hello po, i also have the same problem with my bpi card....in the collector agency they are offering me amnesty of 3%....so i opted not to get their amnesty program...but then i have a cc wich is hsbc where in i have a good credit standing and they offered me balance transfer of only .75% lang per month(14,20 02 26 moths)...is it a good deal? ill take it na kaya so i can pay my bpi?

    Hi Banker. My credit card bill already exceeded from my cc limit 37K now It's on 38K. I could only pay the minimum due amount since I don't have much money. And di pa rin nababawasan yung balance ko every month for that. Please advise me what to do. Can I make an agreement to HSBC that they will just give me a fix amount to pay monthly so I could finish paying my outstanding balance? I am also planning not to use the card anymore once I finish paying everything. Thank you!

I keep sending messages din sa HSBC coz I'm planning to pay off my debts at an amenable payment terms pero laging sagot ay wla daw clang amnesty program or something. I don't want to be a delinquent account sa kanila. Gusto ko lang sana mag negotiate para d na umabot pa sa kung anong gulo ba. Kanino kaya ako susulat to negotiate? Matagal and hindi ko rin gusto yung mga answers ng customer support nila eh.

    Like you ayoko na sanang umabot sa time na may pupunta sa bahay na CA tapos mang haharass :( Puro matatanda pa naman nan don sa bahay baka mag ka truama ang mga yun. I kept calling their Collection Dept kaso busy.

    I have 2 cc from BDO and Metrobank,
    Medyo d ako nakapagbayad dahil nawalan ako ng trabaho and d pa kaya namin bayaran ngayon.
    Im planning to pay my cc at i fully paid but in restructure way para hindi malaki yung mababayaran ko I mean kaya ko lang bayaran.
    No here;s my question:
    1. Pwde bang mag request sa 2 banks na ito na ang bayaran ko lang ay yung na gamit ko lang talaga wala na yung mga interest at i reconstruct yung total amount na gamit ko lang?

    2. Kanino ako pwde lalapit sa 2 banks nato? sino dapat ang i negotiate ko?

    Sana po ay ma advice nyo po ako , kasi gusto ko sana ma zero out yung utang ko, wala naman ako plan na d bayaran yun pero gusto ko installment lang and ang babayaran ko ay yung nagamit ko lang talaga.

  152. just want to share, i was able to settle my 2 Citibank accounts which have been delinquent for more than 2 years by availing their special payment program. we agreed and closed the deal for a lower rates and so did the payment over the counter in their advised bank (Chinabank) after getting the receipts I went to their office to claim the certificates for both accounts on the same day. so i guessed it was a mission accomplished for me. then i also have another account with East west, same scenario, but before everything else, I received an agreement form via email stating all the contents of our conversation over the phone. After making the payment (over the counter) I emailed back the proof of payment along with the signed agreement form. The agent explained to me that the actual certification/clearance will be mailed to me after 3 weeks so now I am waiting for that day to come to receive and claim my certificate. There's one more account to settle (AIG Dolce) which I think will be a tough one 'coz the agent sounds so persistent with his asking price which I think is not really a fair one. He's asking for too much and I even doubt it if I really owed that amount of money from the bank. Now I asked for SOA copy and waiting for their response. I need to close this account for a loan application for a family house plan.

    I have an outstanding balance of 6o thou with HSBC. Failed to pay the minimum of 2 thou due just a few weeks ago because I'm currently out of job. I have no intentions of running away from my debt but I would like to ask them how I can ask for an extension (say, 6 mos) so I can settle at least part of the balance without them still charging me the interest. How do I go about it? I am thinking of writing them a letter but do not know how to start. Help please? thanks so much!

    ano po ma-aadvise nyo? I don't have a job yet (resigned a few months ago and I have 3 cards. Have only 20 thou to spare which I was able to loan kaso hindi ko mapapagkasya ung amount sa 3 kong cards. Ung pinakamalaki is with HSBC at 60 thou. Ung 2 other cards around 20 thou lang. What do I do? Effective ba talaga mag pa "restructure"? Or makipag negotiate with them so the cay at least remove the finance charges? Need your advise badly.

Hi banker, so im just one of these millions who has credit card debts. i have 2 citibank cards. i have been paying consistently, and sometimes more than the full amount due, unfortunately there was this one time na nagulat na lang ako --- excess na nga yung payment ko, ako pa ang nagkautang. i asked them na isa-isahin namin kung pano naging ganun kasi i know na wala akong utang. i checked my computation many times, and when asked pano nagkaganun ang computation nila --- they just hung up on me. After nun, i lost the zeal in paying full - but sa minimum amount na lang --- knowing that they owe me. One time, i failed to pay just 1 month, and they closed my account immediately and asked mt to pay in full 60k (wala man lang minimum amount due basta settle in full) - this august 7. Now i dont know what to anticipate, biglang ganun na lang.
    My questions:
    1. what's their next move?
    2. should i file a dispute?
    3. im planning to get an sss salary loan to pay for that, should i still proceed?
    4. will the 60k still incur interest even if closed na ang account?

    Here is my problem. In 2004, I took a loan with PS Bank amounting to Php24,000. Since then, I never pay any single penny due to some financial issues and I've been moving from one company to the other. In 2008, I moved here in Dubai.

    Of course, I was receiving a lot of calls, SMS and letters from the banks then later on turned-over to the so-called law firms from 2004 till 2006. But it was stopped. Then last year, they came back again through our Barangay Captain. Then on 12th August 2012 and 15th August, they sent a letters to my mother's house. My family doesn't know about this loan and I always deny to them. I don't want to give them the stress. I am very much willing to pay my loan but not to the extent of paying the Php131,000 mentioned in here. I sent them an email telling them that I am willing to pay but don't have the capacity to pay in full. I can arrange to pay only up to Php30,000, this is the maximum.

    And they replied today:

    Hi, ____,

    About your PSBank Loan,
    Your outstanding balance php131,113.90 as July17,2012.
    we advise you to make partial payment atleast 15k until August 28,2012
    to enter you in the amnesty program. by september 2012. otherwise we
    insist you to pay the whole obligation next month.

    Please call at 0928-2716793 look for Mr.Jonathan Englis,
    legal department of PSBank

    I answered their above email and told them that I can arrange Php15,000 til August 30, 20120. But show me first the Statement of Account? And what is the amnesty program?

Ang credit limit ko kasi is 68K and it did reach to the credit limit because of charges from the late payment etc since nagkakaproblema na ako. I keep paying with an exact amount until i lost my job and have a financial problem until ang na bayad ko nalang is yong below minimum nalang if I got money. Ayun dun na nag uumpisa ang mga late charges etc, until it reach to the credit limit. Dun na din nag uumpisa tumatawag ang mga taga HSBC and keep updating me the amount including the charges which is 76K all already. So hindi ako tumitigil nagbabayad kahit below minimum lang from may sideline na income. Pero last July lang po, I stop na paying cause hindi na talaga kaya and until now wala pa rin akong work and my only income is around 300-800 from my sidelines na Tarpaulin designs. And then last August lang may tumawag sa akin na from Lawfirm daw at nang hingi ng amount 90K but I told them that I can't afford that amount and they said they will let me pay 80K by 5K monthly payment terms etc. I told them na hindi pa rin kaya but they didn't listen to me and said that I should find a way. I told them na susubukan ko lang and ayoko mag promise. So the Call end up and they give number of months that they will call back once i failed.

    Now my question is because I lost my HSBC bill copies, if they call back regarding about my failed to pay the amount of their request. If they ask for example of how much is exaclty my balance before it was charge by late payment charges etc. Because I lost the bill copies, can I tell them an exact amount even if I'm not sure how much was that. For example, the HSBC billed me 76K including all the charges. And my doubt balance with out charges is already 10K if I was not charge by some late payments etc. Can I tell the Lawfirm that my balance is already 10K with out charges if they ask that how much is my balance before it was charged by some late payments? I actually want to tell them already of how much I can only afford because I want to end up these already.

And my doubt balance with out charges is already 10K if I was not charge by some late payments etc. Can I tell the Lawfirm that my balance is already 10K with out charges if they ask that how much is my balance before it was charged by some late payments? I actually want to tell them already of how much I can only afford because I want to end up these already.
    Can I just tell them an amount of how much is my balance is excluding the late charges even if I'm not sure how much was ?

    Please advice me.

Paano kung gusto na namin bayaran ung debts namin eh ang prob nasa collector na ung account, ano ang best gawin para mapapayag namin sila na ung kayang amount lang ang laya naming bayaran? Paano namin gagawin? I mean, suuslat ba kami sa collections agency or pupunta muna kami sa bangko then pay? Hindi namin alam paano maguumpisa sa pagbabayad. Thank you.

    Another Law office called in and told me na I really have to pay my outstanding balance. Nice naman sya so I talked to her. She made me a promise to pay 3,500 due on tuesday. Of course nag dobleng isip ako to pay kasi nga as per sa nababasa ko kahit fully paid na sila may tumatawag pa din. magsesend daw sya ng e-mail sa bank para daw mag request ng amnesty. then I read this blog kaya ayun. tama nga hinala ko. good thing wala kaming landline sa haus, cra cp ko. the question is, kung direkta sa bank ako makikipagusap may alam po ba kayo na pwede kong kontakin sa HSBC?

    I tried it.. Pumunta ako sa head office ng HSBC, hindi ako binababa, pinakausap lang sa kin ng receptionist through phone, i asked baka pwedeng amnesty kasi di ko kayang bayaran ng one shot payment, nakiusap ako, sinabi kong lubog na lubog ako, ang sagot sa kin kailangan ko daw talaga bayaran ung amount na sinasabi, kung hindi, lalaki daw ng lalaki utang ko dahil sa interests. Nagpapatransfer ako ng different collection agency dahil nanghaharass ung prime alliance, di daw nila pwede ipa transfer ang maitutulong lang daw eh sabihan ung taga prime alliance.

    i wanted to pay din, pero kung ganun ang bank, pano naman ako makakabayad..

  165. be responsible enough for your ccs, your using some cc for your own satisfaction and then afterwards your simply just ignore it because you can't pay it? is that how we live these days? I also have some cc but good for me and thanks to them i have some substitute for buying some things in emergency if ever i don't have some money in my pocket.. after reading this blog for some very long time, i realized that this is a very helpful reading for everyone like me, but unfortunately for some people they are disregarding some things or they lack of some responsibility after reading this blog, no offense for banker and ms. hopeful but your advise for some bloggers like me is that it's lack of something like being responsible for paying our debts because we also use them and we satisfied ourselves for using cc, my point is I just want to be responsible enough or to think what is right and what is good.. what if all the people in our country is delinquent for how many years and after reading this blog they just want to ignore it because nothing is really happening even if they don't pay there cc?

      The whole gamut of credit process and procedures starts with identifiying target markets and providing proper credit initiations and remedial management.

      I see defects and weaknesses of these so called "credit professionals" even at credit initiation phase pa lang. Much more for remedial management.

      example:

      when someone requests:
      " I can no longer afford to pay, do you have any 'amnesty program' to lighten my payment?"

      their reply:
      " None. MAG-DEFAULT KA MUNA!"

      is that not a STUPID answer?

      When referred to collectors, they would get swindled, LIES, blackmails at pinapahiya pa. is that a mark of an honorable
      person?

      everybody I met here wants to pay, but for some reason,
      lost the same appetite to pay because of these BASTOS na
      collector.

      what if your wife is preggy and the collector tells her
      "mabuti na yan mamatay para may pambayad ka pa sa utang mo!"

      I hope you will not judge others.
      instead, help, not blame.
      Only God can judge us.

      alot of cc defaulters here are always willing to pay but most have been swindled and their hard earned resources are taken away just like that.

      well, all i can say is that you are lucky that you're not in our shoes and i hope it stays that way. But if in case life gives you a complete turn-around, you'll understand everything in this blog. i hope we can hear something from you by then.
